Finizio Deputy City Engineer DATE: April 13, 1994 RE: Technical Review Committee Comments Concurrency Review Board Conditional Use Time Extension Exxon (Gasoline Sales & Convenience Store) Property Owner's Request for Time Extension The applicant has not adhered to last year's conditions of approval for their prior request for a time extension which was granted by the City Commission. The condition of approval at that time was for them to block the existing driveway approaches (Congress Ave./ Woolbright Road) to preclude vehicular traffic from using this flat unobstructed pavement area as a shortcut between Congress Avenue and Woolbright Road. ENGINEERING DEPARTMENT RECOMMENDATION The Engineering Department for the City of Boynton Beach, Florida recommends the granting of a one year time extension based upon the property owner's full compliance with the following comments to be implemented by the owners within 30 days from final Commission action (if approved) or the approval becomes null and void: 1. Provide an adequate number of steel bollards, filled with concrete and set a minimum depth of 3 ft. into existing ground at both existing ingress/egress driveway approaches. 2. The property owner shall obtain a building permit and fence in the perimeter area of the entire parcel. The Engineering Department, based on the prior history of this site, relative to vendor sales, parking and storage of semi-trailer trucks, sale of used cars and the use of this pavement area by motorists traveling northbound on Congress Avenue (pavement area is an unlawful shortcut to Woolbright Road once motorists encounter a red light at said intersection), has determined that the aforementioned conditions will result in fewer code violations and an increase in both pedestrian and vehicular safety in the immediate area of this site.
