Nordal, President of RJ Properties and Developments, Inc. and agent for Lonestar Hardware, Inc., is requesting Condit1onal Use approval to allow retail gasoline sales on a 1.000 acre site at the Southeast corner of Woolbright Road and Congress Avenue. The subject parcells zoned C-3, Community Commercial District. There is currently a vacant, 26,000 square foot retail facility (formerly occupied by Westlake Hardware) and a parking lot situated at the site, which w1ll be demolished to accommodate this project. The property has a 200 foot frontage on Congress Avenue that has a clipped corner which is for the future right-of-way dedication and a 221.75 frontage on Woolbright Road which also has the same clipped corner for the future right-of-way dedication. Retail gasoline, convenience store and car wash sales are permitted subject to Conditional Use approval in the C-3 zoning district if the property has frontage on a four-lane collector or arterial road. Currently, Woolbright Road is classified as a four-lane county minor arterial road and Congress Avenue is a four-lane county minor arterial road. SURROUNDING LAND USES AND ZONING (See attached location map): Abutting the subject property to the North is the right-of-way for Woolbright Road. Across Woolbright Road to the North is the business office building of the Palm Beach Federal Savings Bank, zoned C-l. Abutting the subject parcel to the east is 160 feet of the remainder of "Parcel A" and to the East of that portion of "Parcel A" is the Sun First National Bank of Palm Beach County, zoned C-3. To the South of the subject parcel is the remainder of exhibit "A" attachment referred to as "Parcel B". To the South of the subject property "Parcel B" is the residential community of Cedarwood Villas, zoned C-3. Across Congress Avenue to the West 1S Glendale Federal Bank, zoned C-3. At the Northwest corner of the intersection of Woolbright Road and Congress Avenue, at the diagonal corner opposite the subject parcel is Mobil Oil service station. This is a permissible intersection for service stations. PROPOSED USE (See attached site plan): The applicant is proposing to demolish the existing vacant structure and parking lot and to construct a service station with retail gasoline sales, including a convenience store and car wash. Included would be the new parking lot with the required site lighting, buffers and landscaping meeting the code requirements of the Code of Ordinances. A canopy is proposed over the convenience store and the fuel pump islands. STANDARDS FOR EVALUATING CONDITIONAL USES: The Planning and Zoning Board and City Commission shall consider only such conditional uses as are authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses absolutely or cond1tioned upon the conditions including, but not limited to, the dedication of property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area and the c1tizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose of this section. In -TO: Planning & Zoning Board RE: Exxon service Station Page Two of Four evaluating an application for conditional use, the Board and Commission shall consider the effect of the proposed use on the general health, safety and welfare of the community and make written findings certifying that satisfactory provision has been made concerning the following standards, where applicable: 1. Ingress and egress to the subject property and proposed structures thereon, with particular reference to automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. Proposed access would be provided by a driveway onto Congress Avenue and a driveway onto Woolbright Road. The driveway onto Congress Avenue is thirty-five (35) feet wide. The driveway on Woolbright Road is also thirty-five (35) feet wide. The driveway on Congress Avenue lies within 135 feet of intersecting rights-of-way lines. The driveway on Woolbright Road lles within 140 feet of intersecting rights-of-way lines. Note that for the future development of the property adjacent to the site, the Palm Beach County Traffic Division has determined the balance of trips remaining on the site after the service station is constructed is 729, instead of the 799 reported in the traffic statement submitted by the applicant's traffic engineer. 2. Off-street parking and loading areas where required, with particular attention to the items in subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and nearby properties, and the city as a whole. Eleven (11) parking spaces are shown on the Site plan which is the minimum required by the Zoning Regulations. The lighting provided should be directed away from abutting properties. It is not anticipated that the proposed use would create any additional adverse impacts on surrounding use. 3. Refuse and service areas, with particular reference to the items in subsection 1 and 2 above. A dumpster is proposed to be located in the southeast corner of the site. The odors from the dumpster would be detectable for up to 200 feet from the dumpster enclosure. The properties which abut this parcel are located beyond this range and would not be adversely affected. Concerning the serviceability of the dumpster the Public Works Director has indicated that this would be a suitable location for the dumpster. The location is also non-objectionable from an esthetic standpoint. 4. Utilities, with reference to locations, availability, and compatibility. The site 1S served with water and sewer lines which are adequate to serve the proposed use. 5. Screening, buffering and landscaping with reference to type, dimensions, and character. The proposed landscaping and buffering meets or exceeds the requirements of the Landscaping and Zoning regulations. TO: Planning & Zoning Board RE: Exxon Service Station Page Three of Four 6. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adjacent and nearby properties. The proposed signs and site lightlng generally meets the requirements of the Sign and Parking Lot regulation respectively. There are however, some comments from staff which address minor aspects of proposed signs and site lighting. 7. Required setbacks and other open spaces. The proposed building setbacks meet or exceed the requirements of the Appendix A-Zoning, Section II.L. - Commercial establishments engaged in the retail sale of gasoline or gasoline products. 8. General compatibility with adjacent properties, and other property in the zoning district. Currently the site is occupied by an existing structure and parking facilities. The building was formerly occupied by a hardware store known as "Westlake Hardware" and is now vacant. This structure and parking lot will be demolished. It is not anticipated that a retail gasoline, convenience store and car wash at this location would adversely impact surrounding land uses, on the contrary, the improvements to the site, lncluding landscaping may have a positive influence on surrounding properties. In addition, the proposed uses will not adversely effect future uses on the remainder of the site. 9. Height of buildings and structures, with reference to compatibility and harmony to adjacent and nearby properties, and the city as a whole. The proposed building is a one-story structure which is compatible with surrounding land uses. The height to the top of the canopy is seventeen and one-half feet. 10. Economic effects on adjacent and nearby properties, and the city as a whole. It is not anticipated that a retail gasoline convenience store and car wash service station located on this site would adversely impact property values in the surrounding area. 11. Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19, Article II of the City of Boynton Beach Code of Ordinances. This project conforms to the standards and requirements which apply to site plans as set forth in Chapter 4, Part III - Code of Ordinances - Land Development Regulations Sections 1. thru 13. . Compliance with, and abatement of nuisances and hazards in accordance with the performance standards section 4 of the zoning regulations; also, conformance to the City of Boynton Beach Noise control Ordinance. The current Environmental Review approval is due to expire on April 30, 1992. A written request should be submitted to the Planning and Zoning Department requesting that the existing Environmental Review approval be re-evaluated and extended for one (1) year or submit a new application and fee for an Environmental Review application forms and submission deadline dates are available at the Planning and Zoning Depart~ent. (Section 11.3, Appendix A-Zoning) REVIEW OF COMMENTS: Attached are comments from the various reviewing departments. Four (4) department have indicated no problems with the proposed development. The Publlc Works comment can be adjusted on the plans after site plan approval. The comment, No.5, of the Engineering Department can be addressed at time of building permit or can be adjusted on the site plan after approval. The comment made by the Administrative Coordinator of Engineering is no longer applicable. The requirement for photometric plans as part of site plan review was removed under the new site plan review ordinance. RECOMMENDATION: Staff recommends approval of the proposed Conditional Use subject to the following: 1. The applicant shall provide two (2) drawings amended to address the Public works comment regarding dumpster pad size and the Engineering Department comment, No.5, regarding pavement markings. 2. Prior to building permit, the applicant shall submit executed deeds for dedication of land necessary to construct Woolbright Road and Congress Avenue to the Engineering Department. 3. All other comments shall be addressed at time of building permit. Photometric plan shall be submitted at the time of Building Permit application, Section 5-l42(a). 2. Site plan designates removal of existing building by others. Since this is off site, a third party agreement regarding demolition shall be a condition of approval. 5. Adequate storage for vehicles entering car wash shall be pro- vided, length to approximate 75'. Ordinance 92-6, Section 3.E.4.C. Note: This can be a accomplished using pavement markings. 7. Developer will need to obtain a SFWMD permit exemption, Volume 4, SFWMD, Chapter 40E, Section 4.052. 9. As a pre-requisite to Engineering Department sign-off, the applicant for the above referenced project shall submit executed 'deeds for the dedication of land necessary to construct both Woolbright Road and Congress Avenue.
