Dear Mr. Haley:
As requested, we have completed two (2) borehole permeability
tests at the above-referenced site. The tests were of the con-
stant head type, as per South Florida Water Management District
(SFWMD) criteria, and positioned near the northeast and south-
west portions of the property, as referenced on the attached
sheets.
The permeability test results are shown on Sheets 1 and 2, along
with the subsoil stratigraphy and water table levels as indi-
cated by the auger borings. Two (2) auger borings, to depths of
15 feet, were completed at the referenced locations. The bor-
ings disclosed the site to be asphalt paved with relatively
clean to slightly silty sands extending from beneath the pave-
ment structure to the terminal limits of the boreholes. The
water table was measured in the borings at depths of 5.2 and 5.5
feet. Based on the existing site topography (R.L. Vaught &
Associates, Inc., 1-18-91), we estimate the groundwater eleva-
tion at +8.3, as referenced to the National Geodetic Vertical
Datum (NGVD).

The water table level will fluctuate in response to rainfall
conditions. Historic u.s. Geological Survey (USGS) groundwater
level data, available from the SFWMD, indicates the "wet season"
water table level in the vicinity of the site is about +9.5
NGVD. Considering the historical data and the current levels,
we recommend assuming a wet season water level of elevation +9.5
feet NGVD for designs.
The tests for this study indicated hydraulic conductivities of
3.6 x 10-5 and 4.1 x 10-5 cfs per foot 2 (of seepage area)
per foot (of head). These values are slow to moderate and with-
in the range expected for the encountered subsoils. We recom-
mend using the average value, or about 3.8 x 10-5 cfs/ft2-ft
for use in design of the trenches.
The hydraulic conductivity values discussed above are typically
used assuming a constant head and gradient condition. The per-
formance of the trenches should be evaluated in view of poten-
tially diminishing head as a result of groundwater mounding of
the exfiltration waters. The analysis method would include use
of a three-dimensional groundwater flow model (MODRET), with
input consisting of pertinent soil and groundwater parameters
obtained from the borehole permeability test data.

Dear Mr. Cutro:
The Palm Beach County Traffic Division has reviewed the traffic impact study
for the project entitled Exxon Site (Bovnton Beach) pursuant to the 1990 Traffic
Performance Standards Code (Ord. No. 90-40). The project is located on the
southeast corner of Congress Avenue and Woolbrite Road. It consists of 1,431
square foot convenience store/service station with a car wash. An existing
-'-~26,000 square foot retail facility will be demolished to accommodate the project.
~The County Traffic Division has determined the project meets the 1990 Traffic
Performance Standards Code of Palm Beach County.
It should be noted that there is one calculation error in the trip generation
information. The internalization rate of convenience store customers who also
buy gasoline should be 27%, not 37%. This changes the total project traffic to
989 trips. The balance of remaining trips is 729 trips.

Enclosed please find a study documenting the trip generation
characteristics of a proposed Exxon Service Station to be located
at the southeast corner of Woolbright Road and Congress Avenue.
R. J. Development, Inc. proposes to demolish an existing 26,000
square foot general commercial retail facility and construct a
new 1,431 square foot gasoline service station/convenience store
and car wash. It is anticipated that an application for a site
plan modification will be submitted to the City of Boynton Beach
for the above-mentioned project prior to our next submission
deadline (April 19, 1991).
Please review the enclosed study for compliance with all
applicable provisions of the 1990 Countywide Traffic Performance
Code of Palm Beach County (County Ordinance No. 90-40). We would
appreciate it if you could provide comments to our office prior
to April 30, 1991.

Kimley-lIorn and Associates, Inc. is plellsed to provide this Jetter documenting our
analysis or the trip generation characteristics or the proposed Exxon Service Station (to be
located at the southeast corner of Woolbright Road and Congress ^ venue) for submittal to the
City of Boynton Beach. This anaJysis has been completed consi,tent with the J 990 Countywide
Traffic P6rfQrmance Standards and is based on the comparison of new external trips for an
existing 26,000 square foot general commercial retail facility and the proposed construction
of an Exxon Service Station with a small convenience store Dnd car wash.
Based on the standards of Palm Beach County. the 26,000 square feet of existing retail
is vested for 3,096 total daily trips. With a passer-by capture rate of 44.52 percent, the total
new external trips associated with the site are currently 1,718.
The proposed construction or an Exxon Service Station with a J ,431 square foot
convenience store and a car wash yields a total trip eeneration of 1.822 daiJy trips with a
total of 919 new external trips per day. The documentation for the reduction in new trips is
provided on the attached table and is consistent with the methodology accepted by Palm 'Beach
County.
In addition to the passer-by traffic associated with the service station and the
convenience store, there is also an element of traffic that wHl use both of these facilities and
the car wash. This interaction is reflected in the reduction of the convenience store and car
wash traerie under the title - -Less Gas Customers.......
Based on this anal)'sis, the total new trips 8enerated by the proposed Exxon Service
Station is less than that presently vested for the site and results in a balance of 799 new daily
trips which can be u$ed in developing the remainder of the site. while staying below the vested
threshold.

The City of Boynton Beach has completed its first review of the
site plan for the above referenced project. Attached are comments
made by the reviewing departments during their initial review of
your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 dayst a new application fee will be required.)
When there are comments made by the reviewers that you feel are
not applicable to the approval of the project or will be
addressed separately and you have not amended the plans to comply
with the comment(s), you must prepare written explanation for
each comment stating why the comment is not applicable and return
the explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets of the plans to the Planning and Zoning Department.
When the amended plans and documents have been submitted to the
Planning and Zoning Department, they will be distributed to the
review1ng departments for a second review and the reviewers will
recommend if the site plan will be placed on a board approval
schedule (see attached). If there are major comments not
addressed by new plans or the reviewers recommend that the plan
not be forwarded to the Planning and Zoning Board, this office
will notify you on your alternatives regarding the site plan as
soon as possible.

Dear Mr. Nordal:
This is to advise you that on April 21, 1992, the City Commission
of Boynton Beach approved the conditional Use and site Plan for
the convenience store/service station at the above referenced
location.
The approval of the Conditional Use and Site Plan was subject to
the following conditions:
1. The applicant shall provide two (2) drawings amended to
address the Public Works comment regarding dumpster pad
size and the Engineering Department comment, No.5,
regarding pavement markings.
2. Prior to building permit, the applicant shall submit
executed deeds for dedication of land necessary to
construct Woolbright Road and congress Avenue to the
Engineering Department.
3. All other comments shall be addressed at time of
building permit.
4. That the dumpster be fitted with doors and the ~rain be
moved to the center of the dumpster pad and that the
drain be connected to the oil separator located in the
car wash. This last condition can be met at the time of
building permit.
The Site Plan approval entitles you to develop the property as
shown on the approved plans. If you wish to modify the plan prior
to submission of your building plan, please contact the Planning
and Zoning Department. Modifications during the building permit

Since this is off site, a third party agreement regarding
demolition shall be a condition of approval.
5. Adequate storage for vehicles entering car wash shall be pro-

3.E.4.C. Note: This can be a accomplished using pavement
markings.
7. Developer will need to obtain a SFWMD permit exemption, Volume

Community Appearance Board review of the Exxon Service
Station with Convenience Store and Car Wash
The above referenced service station is proposed to be constructed
on a one (1) acre lot located at the southeast corner of
Woolbright Road and Congress Avenue. The proposed site is
presently owned by Westlake Hardware, Inc.
The applicant has submitted a color aerial photograph of the
vicinlty where the proposed serVlce statlon will be located. The
photograph shows the design and color of the buildings near the
proposed site. The construction materials, layout and design of
the proposed service stat~on is similar to the existing service
stations located at Seacrest Boulevard and Woolbright Road, and
the two (2) statlons located on the east side of Congress Avenue
on the north and south side of Boynton Beach Boulevard.
The Community Design Plan Chapter 7.5, Article V establishes
district boundaries wherein the design of the buildings and
streetscape landscaping on a site located within a district shall
be In compliance with the archltectural theme specified for the
district. The site is located in the Community Design District
identifled as modern. The modern archltectural theme generally
~ncludes buildings and structures with surfaces having straight
lines with rectangular, square, round or angular shapes. The
Commun~ty Design Plan specifies a range of color for each
architectural theme, however, the modern theme does not list a
palette of colors that must be represented on the exterior
surfaces of bUildings proposed for the district.
The Community Design Plan specifies that the material proposed
for the roof and walls of buildings shall match at least one (1)
of each of the roof and wall material listed in the Community
Deslgn plan wlthin the appropriate architectural theme. The roof
and wall material shewn and identified on the plans for the
service station is listed in the Community Design Plan wlthin the
modern architectural theme. The Community Design Plan further
specifies that the proposed buildlng shall incorporate into the
design of the building at least fifty (50%) of the architectural
features and/or treatments listed ~n the Community Design plan
for- tne appropriate theme. The building design includes the
follow~ng archltectural features from the modern archltectural
theme: accent panels and melding, fixed glass and exterior
llghts.
SUMMARY:
The small main building with a canopy above and over the pump
islands and a detached accessory car wash building is s~milar to
the layout and design of the current modern service station
convenience store and accessory car wash sites being constructed
throughout South Florida. The design proposed for the buildlngs
~s compatible with the straight line surfaces and rectangular
shapes of the modern archltectural theme. As stated earller the
Communlty Design plan does not have a palette of dominant colors
to chose from to be applied to buildlngs located in the modern
archltectural theme, therefore, the colors are discretionary.
The applicant proposed colors for the buildings and slgnage that
represent the logo colors for the gasollne distributor.

The landscaping proposed for the slte meets and exceeds the total
numbers and speCles of plant materials that are specified in the
Landscape Code and the landscaping that is required ln the
service station section of the Zoning Code. The street trees and
ground cover materials are consistent wlth the streetscape
landscaplng material identified in the Communlty Design Plan.
RECOMMENDATION:
The Planning and Zonlng Department recommends that the Board find
the exterlor elevatlons, colors and landscaping for the Exxon
SerVlce Station aesthetically acceptable and forward to the City
Commission a recommendation to approve the project.

The following Building Department comments must be addressed prior to
the issuance of a permit:
1. The parking layout and striping should be a minimum size, with
double lines per Section 5-142(1) of the Boynton Beach Code of
Ordinances.
2. The handicap note on the plans should state 12' X 18' minimum,
not 12' X 9' as stated.
3. Details and sizes of signs shall comply with Chapter 21 for the
following:
a. The freestanding sign shall not exceed 64 square feet
(Section 21-25(b).
b. The wall sign shall not exceed the maximum allowed under
Section 21-25(c).
c. Directional signs shall comply with Section 21-25(f).
d. Identify where the 10.38 square foot ancillary will be

1. Photometric plan shall be submitted at the time of Building Permit application,
Section 5-l42(a).
2. Site plan designates removal of existing building 6y others. Since this is
off site, a third party agreement regarding demolition shall be a condition
of approval.
3. Car wash exit shall reflect the mlnlmum outside turning radius of R-24' for
passenger cars. Policy onDesign oIUrban Highways and Arterial Streets - AASHTO.
4. The plans shall provide a detail of curbs (see attached) and curb cut flumes.
Flume design shall address both erosion and blockage caused by siltation and
vegetative growth.
5. Adequate storage for vehicles entering car wash shall be provided, length to
approximate 75'. Ordinance 92-6, Section 3.E.4.C.
6. Future access noted on the south side of site should be removed from this
site plan. Cross access may allow cut through traffic. Future access will be
reviewed with the adjacent property site plan. Ordinance 91-73, Section 8.3.1.
7. Developer will need to obtain a SFWMD permit exemption, Volume 4, SFWMD,
Chapter 40E, Section 4.052

The following comments are in response to the submittal of the
site plan for the above referenced project. The project is
scheduled for review of comments and discussion of conditional
use at the March 31, 1992, Technical Review committee meeting.
1. The attached Community Appearance Board (CAB) application
form must be completed and submitted, by the applicant, with
a fifty dollar ($50.00) application fee. Color samples of
the exterior finish materials are required to be submitted
with the Community Appearance Board application form.
[Section 19-43, Article III, Chapter 19 and Section 7.5-75
(a) Appendix II, Article V, Chapter 7.5]
2. Specify on the elevation view drawings of the main building
and car wash building the color of the exterior finish
material identified as "color panels furnished by Exxon."
Also, identify the color of the rear wall and garage doors
of the car wash building and the colors identified as
rainbow colors. [Section 7.4, Chapter 4, Site Plan Review]
3. The current Environmental Review approval is due to expire
on April 30, 1992. I recommend that you submit a written
request to the Director of the Planning and Zoning
Department requesting that the existing environmental review
approval be re-validated and extended for one (1) year or
submit a new application and fee for environmental review.
Application forms and submission deadline dates are
available at the Planning and Zoning Department. [Section
11.3, Appendix A-Zoning]
4. Specify on the plan that the car wash is fully automatic and
the water used in the washing process is recycled. [Section
II.L.3.E.4.c 1 and 2, Ordinance No. 92-06]
5. Revise note 2 on the landscape plan to specify that the
three (3) inch caliper is measured four and one-half (4 1/2)
feet above ground level. [Section 7.5-33 (b)(5), Chapter

6. Identify on the landscape plan the specific location of the
ten (10) and twelve (12) feet high Alexander Palms. The
location of the palms shall not exceed forty (40) feet on
center along the street frontage. [Section 11.L.3.F.l,

7. To form the continuous hedge that is required along the west
property street frontage, continue the Wild Coffee hedge
material to within three (3) feet of the edge of the south

8. Show unobstructed cross visibility area and space through
the required site perimeter landscape strips at both sides
of all ingress and egress driveways. The cross visibility
area and space is shown by placing and dimensioning on the
site plan a ten foot (10') isosceles triangle. The point
where both ten foot (10') legs join shall be placed on the
property line at the edge of the ingress/egress with one leg
extending along the property line and the other leg along
the edge of the ingress/egress with the remainder of the
triangle being a line across the landscaped area connecting
the end of each ten foot (10') leg. State on the plans that
the vertical space between thirty inches (30") [above the
adjacent pavement surface] and six feet (6') within the
triangle area shall be clear of landscape material.

9. Add the following note on the landscape plan: "All landscape
areas shall be provided with an automatic irrigation water

10. Specify on the landscape plan the specie of sod. [Section

11. Correct the inconsistencies in the location of the site
lighting fixtures located along the south property line that
are shown on the landscape and irrigation plan versus the
site and drainage plan.
12. Prior to the issuance of a building permit for the project,
submit to the Planning and Zoning Department a copy of the
recorded right-of-way dedications required by Palm Beach
County for Congress Avenue and Woolbright Road.
13. Note that for future development of the property adjacent to
the site, the Palm Beach County Traffic Division has
determined the balance of trips remaining on the site after
the service station is constructed is 729, (instead of the
799 reported in the traffic statement submitted by the
applicant's traffic engineer).
14. Specify on the site plan that the Congress Avenue property
line is the front of the subject property.
15. The proposed use is designated as a conditional use and will
be evaluated consistent to the requirements identified in
Section 11.2 of Appendix A-Zoning of the Code of Ordinances.

County for Congress Avenue and Woolbright Road.
Note that for future development of the property adjacent to
the site, the Palm Beach County Traffic Division has
determined the balance of trips remaining on the site after
the service station is constructed is 729, (instead of the
799 reported in the traffic statement submitted by the
applicant's traffic engineer).

Find attached for your review the plans and exhibits for the
above referenced project. Site Plan Review approval for this
project will be granted by the City Commission. To ensure that
the project stays on line with the review time frame, I request
that the plans and exhibits be reviewed and formal comments
transmitted to the Site Development Division of the Planning and
Zoning Department no later than 5:00 P.M. on March 18, 1992.
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
Section 8 to review and formulate comments. (See attached)
2. The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in Section 7 of the site Plan Review
Ordinance. However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards,
additional data should be requested by the reviewer through
the Planning and Zoning Department.

3. Each comment shall reference the code section and include
the language of the submittal requirements and review
standards that require the data to be submitted for review.
4. Technical Review Committee member(s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific
code section may be included in their review comments with
the name of the appropriate TRC Member that is responsible
for the review specified.
6. If a TRC member finds tne plans acceptable, he/she shall
forward the plans and a memo, within the time frame stated
above, to the Planning and Zoning Director stating that the
plans are approved and they do not have any comments on the
plans submitted for review.
All comments shall be typed and addressed to the Planning and
Zoning Director and transmitted to the Site Development Division
for distribution to the applicant. Please include the name and
phone number of the reviewer on this memo.
The Site Development Division will send to the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and submit to the Site
Development Division within 90 days twelve (12) sets of amended
plans for review. When the Site Development Division receives the
amended plans, they will distribute the plans with a cover memo
to all TRC Members for review and approval.

You have asked me to examine an apparent conflict between section
11 L 5 of Appendix A of the zoning Regulations and section 5-
142 (h) (3) as they relate to setback requirements for driveway
entrances from intersecting right-of-ways. Stated differently,
you have posed the following question:
Should the requirements of the Boynton Beach Parking
Lot Regulation be applied to the construction of
driveway entrances for service stations?
The question is answered in the negative.
There are several principals of statutory construction that must
be applied:
1. The principals of statutory construction apply to
zoning ordinances which are issued by cities. Rinker Materials
Corp. v. City of Miami, 286 So.2d 552 (Fla. 1973).
2. The general, and most persuasive rule of statutory
construction is that whenever possible, the Courts will, and
must, attempt to construe related statutory provisions, if
conflicting, in such a way as to harmonize them and give them
both full effect. Palm Harbor Special Fire Control District v.
KellY, 516 So.2d 249 (Fla. 1987); Villery v. Florida Parole and
Probation Commission, 396 So.2d 1107 (Fla. 1980); District School
Board of Lake County v. Talmadge, 381 So.2d 698 (Fla. 1980).
3. Where a statute is passed wi th knowledge of prior
existing laws, construction is favored which gives each statute a
field of operation rather than a construction that would leave
one statute meaningless or released by implication. state
Department of Public Welfare v. Galilean Children's Home, 102
So.2d 388 (Fla.~DCA 1958).

ambiguities which may arise from conflicting zoning ordinances
should be resol ved in favor of the property owner. Thomas v.
city of Crescent City, 503 So.2d 1299 (Fla. 5th DCA 1987).
5. Courts must also give specific terms and provisions
precedence over those terms and provisions which are more general
in nature if the two provisions conflict. Lake Barrinaton
citizens Commission v. Villaae of Lake Barrinaton, 312 NE.2d 337
(1974) .
In applying the above rules of statutory construction to the
question posed I conclude that the two provisions of the Code are
not in conflict and can be read together. The parking lot
regulations should be generally applied to all parking lot
construction unless a more specific ordinance of the city exists,
such as the one which applies to service stations. The Boynton
Beach parking lot regulation does not apply to the construction
of driveway entrances for service stations. section 11 L 5 of
Appendix A controls the distance requirements for parking lot
entrances for service stations.
