The following comments/recommendations are re-submitted for your review:
1. If site plan is approved, all plans for paving, drainage, site lighting, landscaping, irrigation, etc.
shall conform to the parking lot ordinance at time of permitting.
RECOMMENDATIONS
1. Delete the south ingress driveway. The purpose of this entrance is to provide access to the
east side of the building if there is a backup of cars on the west service lane.This driveway may
lead to a conflict between incoming cars and cars exiting the west service lane desiring to go back
north on N.W. 7th Ct. Even with signage, it will still be confusing as to who has the right of way.
In addition, motorists will be tempted to exit the subject driveway rather than wait for one of the
east service lanes to clear. Remove the two foot concrete seperator on the west side. Replace the
loading zone striping with striping and signage to indicate that this is a thru lane to access the two
east service lanes. This will satisfy circulation and ensure against any backup of cars onto
N.W.7th Court (vehicles entering the north driveway will stack until the west service lane clears).
Assuming that deliveries are made during slack periods of operation, the easternmost service lane
can be utilized as a loading area.
2. I do not recommend fOlwarding this plan to the P&D Board unless there is at least a verbal
agreement from the applicant to pursue these recommendations.

Thc following comments/recommendations are submitted for your review:

Not only does this driveway not meet code, it will lend itself, in my opinion, to a conflict between
incoming cars and cars going cast around the south side of the building. Even with signage, it will
still be confusing as to who has the right of way. In addition, drivers will be tempted to exit the
subject driveway rather than wait for one of the service lanes to clear.
I would offer the following alternative subject to T.R.C support: Remove the two foot divider on
the west side and provide striping and signage to indicate that this is a thru lane to access the two
east service lanes and not for service, or parking. This will satisfy accessibility and disallow any
backup of cars out towards N.W.7th Court and more importantly, eliminate the ingress driveway.
2. The northernmost driveway will still require a variance per note 2 ofthe fIrst review.
3. If site plan is approved, all plans for permitting for paving, drainage, site lighting, landscaping,
irrigation, etc. shall conform to the parking lot ordinance.
RECOMMENDATIONS
1. If the recommendations in item one of the comments can be incorporated in the site plan,
subject to the approval ofthe TRC, we recommend that the plan be forwarded to the P&D board.

The following is a list of 1st review comments regarding the Site
Plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two ( 2)
categories; the first category is a list of comments that identify
deficiencies that are required to be corrected and shown in
compliance on the plans and/or documents submitted for second (2nd)
review in order for the project to continue through the site plan
review process. The second set of comment(s) are recommendations
that the Planning and Zoning Department staff believe will enhance
the proposed development. The applicant shall understand that all
documents plans submitted for site plan and/or permit review are
subject to additional comments. I recommend that the applicant/
agent contact me regarding questions related to the comments. If
the applicant is DQt intending to correct code deficiencies they
should contact me regarding the procedures, application forms, fees
and submittal deadline dates for seeking relief from the code
requirement.
I. SITE PLAN REVIEW COMMENTS:
1. The corner side setback on 7th Court must be 20 feet.
The setback is dimensioned from the property line to the
leading edge of the building overhang. Correct the plans
accordingly. [Appendix A-Zoning, Section 6.B.3]
2. Four (4) parking spaces are required. Correct the plans
accordingly or request approval of variance to reduce the
number of required parking spaces. Appendix A, Section
11 H.16.
3. The width of the access aisle for the parking spaces
narrows to nineteen (19) feet, where the code requires
twenty-seven (27) feet per the Parking Lot Standards.
Correct the plans accordingly.
4. A twelve (12) foot wide by thirty-five (35) foot long
loading zone is required and not shown on the plans.
Approval of a variance to the board of Adjustment will be
required to omit the loading zone from the proj ect .
Appendix A, Section 11 J.
5. The west side of the vehicle use area requires a 2.5 foot
wide landscape strip and visual barrier, preferably a
landscape hedge. Correct the plans accordingly. [Chapter
7.5, Section 7.5-35, Section 7.5-35 (e)]
6. Native plant material is required for fifty percent (50%)
of the total number of required landscape plants. Please
note 7 below, ixora specie hedge material is not
considered native. Correct the plans accordingly.

7. All signage (site and building) must be shown and conform
to the attached code specifications [Chapter 9, Section
10 I]. All visible features and materials of the
proposed signage shall be identified by type of material,
color name, color number or designation and manufacturer.
This information is required at site plan review. Find
attached, Section 10. I. of the Community design Plan.
8. Identify all exterior colors by color name, color number
or designation and manufacturer. Remove the red neon
from around the perimeter of the fascia of the building.
The colors specified on the drawings shall match the
colors specified on the color elevation drawings. It is
strongly recommended that you review the current
Community Design Plan, Chapter 9 of the City Code of
Ordinances, prior to submitting your amended plans.
9. show on all plan view drawings the location of the buffer
wall required along the north property line of the
subject property. Also show a section view drawing of
the wall. The plan view drawings and section view
drawing shall depict the buffer wall in compliance with
section 4.L. of Appendix A-Zoning.
10. Show on the drawings the location of the mechanical
equipment and the utility services for the building.
Specify and show on the plans the location and type
barrier required to screen the appurtenances. [Chapter 9,
Section 10.C.4. and Section 11.E.]
11. Remove the drive-up window that faces the public street
on the east side of the building. [Chapter 9, Section 11.
H. ]
12. Remove the dumpster enclosure from the north fifty (50)
of the site and relocate to the south portion of the
site.
13. Show and dimension on the landscape plans the required
line-of-sight triangles and the clear cross visibility
space required within the triangles. The line-of-sight
triangles shall be shown on both sides of each ingress/
egress and at the intersection of rights-of-way that
border the property. [Chapter 7.5, Section 7.5-35 (h)
and Appendix A-Zoning, section 4.E.]
14. Show on the landscape plan the location, width and type
of easements proposed or "of record" on the property.
Also indicate the location of overhead utility service
lines. Certain plant species and sizes may be
prohibited from being planted in an easement or under
overhead lines.
II. RECOMMENDATIONS:
15. Recommend using melaleuca mulch instead of pine needle
mulch.
16. It is recommended that the site be redesigned to
accommodate the required code specifications.
NOTE:
If recommendations are approved, incorporate them
into the working drawings required for permits for
the project.

We have no objection to the conditional use, however, we offer
the following comments to be addressed for the site review:
1. There are no details of the signs but they must be in
complete compliance with the sign code (the maximum
height is 20 ft. not 30 ft. as written on the plans) .
Free-standing signs cannot exceed 64 sq. ft. and wall
signs cannot exceed 81 sq. ft. Drive-through or
directional signs are limited to 4 sq. ft. and 5 ft. in

1. The southernmost driveway should be eliminated due to its juxtaposition with B.B.Blvd.
Art.X. Sec. 5-142(h)(3).
2. Regarding the northernmost driveway, the applicant must go through the variance procedure to
obtain relief from the 180' driveway setback requirement from B.B.Blvd. Art. X, Sec.5-142(h)(3)
& Sec.5-145.
3. Construct a 4' concrete sidewalk along N.W.7th Ct. in accordance with Chapter 22,
Sec. 22-25 (streets & sidewalk). Art. X, Sec. I 44(h).
4. If site plan is forwarded for approval, the applicant shall submit plans at time of permitting for
all required improvements conforming to the parking lot ordinance (paving, drainage, site lighting,
landscaping, etc.). Art. X,Sec. 5-142.
5. A minimum 5' high buffer shall be constructed between the commercial site and the abutting
residential property. App.C, Art. 9,Sec. 3.
RECOMMENDATIONS:
I. If curbing is being used as the wheel stops for the three parking stalls at the north end, then the
length of the stall may be 16' rather than 18'.
2. By volunteering to close the southernmost driveway, the easternmost aisle could become the
thru aisle for the two lanes on the west side of the store.
3. Since we are being asked to simultaneously review a comparable site directly across the street
which will also require a variance for its driveway, the two sites should be subject to a satisfactory
traffic accident report in the area ofB.B.Blvd. and N.W. 7th St. The Wendys restaurant and the
gas station directly east of it share a common bond with the two subject sites - having driveways
close to the Blvd. and opposite each other. A traffic report has been ordered from the police
department, and ifthe number ofincidcnts and the severity of same is relatively low, then the
proposed developments should be forwarded to the P&D Board.

Public Works. In its present location our truck would be forced to partially block N.W.

facing south. The truck will need to enter south driveway to service container which will
also require removing 20 feet of the shown concrete divider to allow the truck enough
room to make his turn.

Staff has reviewed the above referenced project and offers the following comments:
1. Plan shall specifY water meter size and location, Sec. 26.16 (c).
2. A Capacity Reservation Fee will be required within thirty (30) days of City
Commission approval, or upon request for my signature on the HRSIDEP permit
applications. The fee amount will be determined based upon meter size or
expected demand.( Sec. 26-34 [E])
3. City water will not be supplied for irrigation.(City Compo Plan, Policy 3C.3.4.)
4. Please provide location of existing or proposed Sanitary Sewer Lateral and show
sanitary cleanout at property line.(Sec. 26.33 (b))
5. Fire hydrants shall be within 200' of all points on every commercial building, and
accessible by Fire Department equipment. The existing fire hydrant on the adjacent
parcel to the west is not considered accessible enough to service this new facility.
(Appendix C, Art. X, Sec. 16.)
6. Provide fire flow test indicating the flow available with a residual pressure of at
least 20 psi (1500 gpm @ 20 psi commercial). Off site water main improvements
may be required, at developer's expense, to meet minimum fire flow standards. We
have no objection to this project proceeding at developer's risk but we strongly
recommend that he confirm adequate flow and pressure at this time.(Appendix C,
Art. X, Sec. 16.)
7. Palm Beach Health Department permit may be required. (Sec. 26.12)
8. A Reduced Pressure Zone backflow preventer will be required near the proposed
water meter location. (Sec. 26.107)
It is our recommendation that the plan proceed through the review process.

ANALYSIS
The subject property is located on the Northwest corner of Boynton
Beach Boulevard and N. W. 7th Court, and in the C-2 (community
commercial) zoning district. The following is a description of the
zoning districts and land uses of the properties that abut the
subject property:
North -
Single family residential neighborhood,
R1AA.
zoned
East -
N.W. 7th Court with undeveloped commercial lot
zoned C2 beyond.
South -
Boynton Beach Boulevard with commercial buildings
zoned C2 beyond.
West -
Commercial building zoned C2.
Section 11. J. of Chapter 2 of the Land Development Regulations
state in part:
1. ---lIoff street loading or unloading space" shall mean a vehicular
loading space constructed of a hard surface and shall consist of a
space with dimensions not less than twelve (12) feet in width,
thirty five feet in length and fourteen (14) feet in height,
exclusive of access aisles----
2.---
a. Every---commercial or industrial building, --, requiring the
receipt or distribution of merchandise, shall have sufficient
permanently maintained off street loading space----

The submitted plans for a Conditional-Use/Variance approval for the referenced site are being
addressed as follows :
Varaince requested:
1. (9')-nine feet "Loading" zone, as opPOsed to the required (12')-Twelve feet.
a. A double west drive with a 2' conc. median to be used, will improve control
traffic thru the property. Removing the conc. median could possibly increase
traffic incidents on-site.
b. The applicants's mode of operation is the double -drive, easing local customers
on-site time frame, in turn significantly reducing car stacking, therefore loading
zone should be reduced to accomodate the conc. median.
c. This approval will allow to conduct business, as the applicant and its customer
base is accustomed to.
d. See comment "c", above.
e. The Loading zone will accommodate the traffic in a safer manner than
providing the truck loading against the on comming traffic.
f. See comment "e", above.

1. East Drive-up window to be covered with Areca palms aligning street buffer.
a. The applicants's mode of operation is the double -drive, easing local customers

b. This approval will allow business to be conducted, as the applicant and its
customer base is accustomed to.
c. The appeal requested, Double-drive thru, accesses on N.W. 7th Court, aisle
width (traffic control - directional) work together, providing ease of access,
reducing car stacking, business time frame and therefore reducing impact this
business will have on the city.
