Accompanying this letter you will find one copy of the site plan
which was approved by the City Council on Tuesday, September 17,
1985 and two copies of the landscaping and building elevation plans
bearing the stamp of approval of the Community App~arance Board.
The approval of the City entitles you to construct only the im-
provements shown on the site plan. The site plan will be viewed
procedurally as an as-built or record drawing. Additionally, the
Council approved the shared parking agreement.
With respect to the two sets of plans bearing the Community Ap-
pearance Board stamp of approval, both sets must be submitted to
the Building Department along with other construction plans.
If you have any questions concerning this matter, please do not

Enclosed please find a parking analysis for the above
referenced project. The parking study is based on modifications
to the approved development plan which included deletion of the
approved 60,000 square feet of Office use and addition of 23,595
square feet of Retail use. The proposed plan includes a total of
420 parking spaces for the entire Forum Shoppes.
From the parking analysis it was determined that there is
significant opportunity for shared parking among the uses within
the entire center. With this shared parking, the proposed 420
parking spaces for the Forum Shoppes will provide adequate parking,
as per City code, for all the proposed uses in the Forum Shoppes
during the peak parking demand periods.
If you have any questions or comments regarding this analysis
please contact this office at your convenience. I look forward to

Pursuant to the City's Concurrency Management Ordinance (Ord. No.
90-18), the Forum Shoppes site plan modification (deleting 60,000
square feet of office space and adding 23,595 square feet of
retail) is a category (A)(10) project:
"Any additions to existing non-residential structures or
uses, including recreation and community facilities which are
accessory uses to residential uses, which would generate not
more than five-hundred (500) net vehicle trips per day on
a one-time or cumulative basis, with any five (5) year
period. I!
According to a statement from David Plummer and Associates (July
26, 1990), the modification would generate 381 additional net
trips. Thus, the project is exempt from meeting all of the level
of service requirements for as long as the site plan modification
remains valid.

Dear Craig:
Please be advised that the plans submitted for site plan review
of the above-referenced request cannot be processed further due
to lack of information needed to determine compliance with the
Parking Lot Regulations and submittal of an unacceptable
methodology for joint parking allocation (see items #1 and #2
below, respectively, for details). Six sets of revised plans
addressing these comments, as well as the attached comments from
other departments, will need to be resubmitted to the Planning
Department no later than 5:00 P.M. on any given deadline listed
on the project review scqedule available in the Planning
Department.
1. Consistent with the Parking Lot Regulations, the existing
parking lot must meet current standards (Chapter 5, Article
X, Section5-138(a), (b), (d) and (g)). Therefore, the
following information shall be provided for eXisting and
proposed elements of the site to verify compliance with this
article:
a) a typical parking stall layout detail, including
curbs, wheelstops and striping
b) cross-section of paving materials
c) a lighting plan to include fixture types, lamp
types and sizes, and average illumination levels.
d) a traffic control plan
e) drainage calculations and drainage information
verifying that new paved areas will meet pretreatment
requirements.

2. The shared parking study submitted does not provide for a
10% buffer as required by code. In addition, the
methodology used was superseded by a revised shared parking
study submitted for the Bavarian Haus addition in 1988. A
copy of this study was provided to the representative from
David Plummer's office in attendance at the August 6, 1990
TRB meeting, to use for revising the study for the subject
retail addition.
Appendix A - Zoning, Section 11.H.13.
3. Provide details on the proposed freestanding sign to include
setback dimensions, height, size, advertising, colors and
materials. Chapter 21, Section 21-9, Appendix A - Zoning,
Section 11.A.I0 of the Code of Ordinances and site plan
application, page 5, item #16.
4. Indicate the proposed colors of all exterior surfaces on the
building elevations. Site plan application, page 5, item
#14.
5. Compliance with the Landscape Code is required. Therefore,
provide a landscape plan indicating types, location and sizes
of existing and proposed plant material. Site plan
application, page 5, item #18 and Chapter 7.5, Article II -
Landscape Code, Section 7.5-36 and 38.
6. A fire lane is required in front (west side) of the new
retail addition. Due to the methodology used in the shared
parking study, I cannot determine how providing this fire
lane will impact the overall parking situation when the 16
spaces shown in front of this bUilding are removed. Chapter
5, Article X - parking Lots, Section 5-142(m) of the Code of
Ordinances.

Upon review of the above mentioned project, the following list of
comments have been provided as a courtesy with the applicant's
full knowledge that there will be a full review made when the
project is placed on a future Technical Review Board agenda:
1. Provide a copy of the approved shared parking agreement
for the new retail building.
2. Provide south Florida Water Management District
modification permit for the work proposed at the site.
3. Provide a typical parking space drawing showing the
parking space size and pavement marking configuration for
both handicapped and regular parking stalls.
4. Site must comply with the State of Florida Accessibility
Requirements Manual. Specify the slope of the walkway
leading to each tenant space from the top of the
handicapped ramp located at the handicapped parking space.
5. Provide a detailed drawing of the handicapped ramp
located at the parking area. Specify the slope and
length of the ramp.
6. Provide survey showing the location of all easements
in relation to new expanded retail space and parking
area.
7. Submit landscape plan in compliance with the landscape
code for the new parking area and retail space.
8. Establish a sign program to comply with the Boynton Beach
Sign Code.
9. The building elevation drawings submitted with the plans
for final sign-off, shall match in every respect the
drawings approved by the City Commission during the
approval process of the project. Each exterior finish
material shall have it's color identified by name,
manufacturers name and color number on the final
sign-off plans.

As architect and Agent for the owner of the Forum Shoppes,
PR Limited, Inc., I have reviewed the comments by the
Technical Review Board and accept same with the following
objections and reasons:
Enqineerinq Department Memorandum 90-256
PR Limited, Inc. objects to the comment by the
Technical Review Board that would require modi-
fications to the existing parking lot storm
drainage. It is their position that the existing
condition currently serves the shopping center in
a satisfactory capacity and any modifications
would be not only costly but would not have any
significant improvement to the current existing
condition. Therefore, they do not accept nor
agree to comply with comment #4, nor any improve-
ments to existing site work.
It is also my clients intention that modifications
to the access drive between the Bavarian Haus and
First Union Bank be constructed as phase 1 with all
remaining work to the shopping center and modifi-
cations to the site be performed in phase 2. It is
their intent to immediately begin phase 1; however,
all work outside of phase 1 will be done
when an anchor tenant is secured. Due to the
economic condition for retail space in South Florida
and the conservative nature of my clients, they do
not intend to proceed with phase 2 without said
tenant.

In the event said tenant negotiates for certain
lease requirements such as particular canopy
colors or signage requirements, reconfiguration
of loading spaces or minor site modifications
standard for the real estate industry, my client
intends to sign the site plan rider with the
understanding that such minor modifications may
be applied for through the proper departments of
the City of Boynton Beach.
Further, my clients have reviewed all the staff
comments by the technical review board as they
apply to the new construction only and will comply
with same as part of phase 2 requirements. In the
event that practical engineering solutions can not
be agreed upon at staff levelr my clients would
seek relief from said comments at the commission
level.

Dear Mr. Golden:
The Forum Shoppes is an approved commercial development
located in Boynton Beach in the northeast Quadrant of Congress
Avenue and Ocean Drive. As per discussions with City staff,
existing on site today is a 24,OQOsQuare foot cinema and 19,423
square feet of retail use. The development is also approved for
an additional 60,000 square feet of office use. The purpose of
this letter is to determine the net traffic impact of modifying the
approval by deleting 60,000 square feet of office use and adding
23,595 square feet of retail use.
In order to determine the traffic impacts of this
modification, a comparison of the approved and proposed total trip
generation was conducted. The trip generation rate and capture
rate characteristics for the retail use were calculated using the
total 43,018 square feet of retail use which includes the existing
and proposed retail uses. The source for these rates is ITE's
"Trip Generation", Fourth Edition. The following table illustrates
the daily trip generation comparison of the approved Office and
proposed Retail uses for the Forum Shoppes.

Plene be advised that on Tuesday, October 16, 1990, the City
commission approved the referenoed site p~an modification subject
to fltaff comments, copies of which are attsched. Approval is
also conditioned upon complying with the drainage solutions
agreed upon between yOU' and the ~nglneerinq Department regarding
item 14 of Bngineerlnq Department Memorandum No. 90-256.
These plans were approved subject to your compliance with the
attached stipulations and must now be modified to incorporate
same. ~o initiate your sign-off procedure, please submit two (2)
sets of modified plans to the Office of the Site Development
Division of the Building Department, which will record the
required identification markings on each set of the modified
plans.

each Technical Review Board member who made comments. The Zoning
& Site Development Administrator will provide the Building

PARKING STUDY
INTRODUCTION
The deve 1 opers of the Forum Shoppes, located in the northeast
Quadrant of the Congress Avenue and Ocean Drive intersection in the
City of Boynton Beach, are proposing a modification to the
deve 1 opment' s approved plan.
Existing on site today is 19,423
square feet of retail use and a 24,000 square foot Ci nema, An
additional 60,000 square feet of Office use is also approved but
unbuilt. The proposed modification consists of deleting the 60,000
square feet of Office use and adding 22,517 square feet of Retail
use. The parking spaces on site would also be modified from the
530 existing spaces today to a proposed 420 spaces. The purpose
of this report is to examine the adequacy of the proposed parking
to be provided on site and cross-parking availability with nearby
parcels to accommodate the proposed uses.
DATA COLLECTION
An inventory of the total number of parking spaces for the Forum
Shoppes and surrounding commercial parcels was conducted and the
results are shown on Exhibit 1. As in the original parking study
for the Forum Shoppes (June 1985) the center was divided into seven
(7) zones in addition to the Forum Shop pes to assign parking areas
to the uses they serve. Parking accumulation counts were taken at
5:00 PM and 6:00 PM on Friday, July 20th and 1:00 PM and 2:00 PM

on Saturday, July 21st, which corresponds to the peak parking
demand times as shown in the previous study. For each zone, the
number of parked cars were counted each hour and were compared to
the total number of spaces per zone as shown on Exhibit 2. Because
these parking counts were conducted in July, an off-peak period,
daily traffic count data was analyzed in order to adjust these
parking counts to represent peak conditions. An adjustment factor
of 11% was determined as shown on Exhibit 3.
PARKING ANALYSIS
The Cinema represents a large portion of the Forum Shoppes parking
needs and because the peak park i ng demands occur on weekday
evenings and on weekends, sharing of parking between the Cinema
and the other uses within the center is possible. Because the
Cinema is considered the critical use of the site, the analysis
was conducted to determine if the total available spaces for use
by the Cinema would be adequate.
In order to determine the amounts of cross-parking that can occur
between the zones in the entire center wi th the Ci nema, the
potential for cross-parking of each zone was analyzed. Zone 1 has
limited access to the rest of the center and the peak period for
the Bowling Alley coincides with the Cinema, therefore it was
excluded. Zone 7 was also excluded because there is not a cross-

parking agreement between this site with the Forum Shoppes.
Therefore, only Zones 2, 3, 4, 5 and 6 were used for this cross-
parking analysis and all are within a critical walking distance to
the cinema within the Forum Shoppes. The cross-parking agreements
between the properties included in the center can be found in the
Appendix. In addition to the cross-parking availability between
the zones in the center, an analysis of shared parking between the
uses within the Forum Shoppes was also conducted. The results of
this analysis are shown on Exhibit 4.
The results indicate that the peak period for the entire site
occurs duri ng the weekday eveni ng as represented by the counts
taken at 1:00 PM on Saturday. Zone 2 has a surplus of 11 spaces,
while in Zone 3, 14 spaces were unused. Zone 4 has a surplus of
166 spaces (81.4% of total number of spaces) which is substantially
higher than the surplus which occurred when the original study was
conducted. The change in land use in Zone 4 from a supermarket to
Office Depot created this reduction in parking usage. Zones 5 and
6 have 68 unused spaces (90.7% of the total number of spaces).
Based on this analysis, the total number of spaces available for
cross parking within Zones 2, 3, 4, 5 and 6 is 259 spaces (73.4%
of the total proposed spaces). From field observations, the 79
spaces ut i 1 i zed by the Forum Shoppes i nc 1 uded Cinema usage in
addition to the retail usage. Therefore, to determine the
ava i 1 abi 1 i ty of spaces for the retail port ions of the Forum

Shoppes, the average availability for the entire center of 73.4%
cou 1 d be ut i 1 i zed as per the methodo logy of the revi sed 1988
parking analysis for the Bavarian Haus. However, due to the change
in land use in Zone 4 from grocery store to Office Depot, this
availability has increased dramatically. To represent a more
conservative availability for the Forum Shoppes retail use, the
va 1 ues of 54.2% avail abil i ty for the weekday, and 56.3%
availability for the weekends were utilized as calculated in the
Bavarian Haus Parking Study dated June, 1988.
In order to determine if the proposed parking for the Forum Shoppes
modification is adequate, the City of Boynton Beach Code
Requirements were reviewed. Code requirements for the approved and
proposed uses are shown on Exhibit 5. For the 420 proposed Forum
Shoppes parking spaces, 210 spaces are provided for the Retail use
as per code requirements, thus the remaining 210 spaces would be
for the Cinema use. An increase from the 155 Cinema parking spaces
in the original report to 210 Cinema parking spaces reflects the
impact of deleting 60,000 square feet of Office use and adding
22,517 square feet of Retail use.
By applying the shared use parking availability percentages to the
existing and proposed parking, an analysis of peak parking demand
requirements was conducted for the Forum Shoppes. The results of
this analysis for the peak parking demand period of 1 :00 PM on

Saturday is shown on Exhibit 6. The parking demand of 626 spaces
includes a demand of 440 spaces for the Cinema as per ULI
guidelines for 1 PM Saturday of 80% utilization. The total number
of spaces supplied within the entire center is 773 spaces, thus
providing a surplus of 147 spaces over the demand. The 10% buffer
requirement is met with these surplus spaces representing a 23.5%
buffer.
From this analysis, it can also be shown that the availability of
cross-parking within the center allows for the code requirements
for a Cinema to be met. For this time period, Zones 2, 3, 4, 5 and
6 will have 259 spaces available for Cinema use, while the Forum
Shoppes retail uses (existing and proposed) will have a surplus of
118 spaces available for Cinema usage. The remaining 210 spaces
are 100% available for use by the Cinema. The total available
spaces for Cinema use for weekday evenings was determined to be 587
spaces as compared with the 550 required for the Cinema. The peak
parking demand, number of surplus spaces and the availability of
spaces for Cinema usage for all the demand periods analyzed are
shown on Exhibit 7.
CONCLUSION
As analyzed in the original parking studies in June 1985 and June
,1988, it was determined that the Cinema is the critical land use
in this analysis. The Cinema requires 550 parking spaces as per

the City code. With the availability of shared parking between the
uses in the entire center, it was determined, from this analysis,
that during the peak parking demand periods the number of spaces
ava i 1 ab 1 e for the Cinema use and all other uses in the Forum
Shoppes will meet the City code requirements. In addition, for the
peak park i ng demand per i ods of th is s; te, a su rp 1 us of spaces
creates a buffer of greater than 10%, this meeting the City Code
Requirements.

WHEREAS, the Dev~!pper is the owner of that certain parcel
commonly known as Leisure Plaza Shopping Center" legally describrd
in Exhibit ^ attached hereto, which property is hereinafter called

the "Shopping Center Site",
':'HEREAS, Ranch 1I0use is the owner of that certain parcel
legally described in Exhibit B attached hereto which is 60 feet
to the South of the property described in Exhibit A, which pro-
perty is hereinafter call the "Ranch House Site", and
ImEREAS, the Developer is also the owner of the 60 foot
parcel lying between the Shopping Center Site and the Ranch House
Site. The only portion of this GO foot strip which is included
in the terms of this agreement is the two access easements as
described on exhibit D attached hereto;
\'iHEREAS, Develope. and Ranch House desire to grant to each
other certain nonexclusive irrevocable easements and rights-of-
way in and to the parking areas and other common areas and for
public utilities as described below:
NOW, THEREFORE, in consideration of the forgoing premises,
of the mutual covenants contained herein and the sum of Ten
($10.00) Dollars and other good ~nd valuable considerations, the
receipt of which is hereby achknowledgec, the parties her~to do

1. The Develop~r and Ranch House hereby grant to each other
and to their respective successors and assigns, for the benefit
of all ,owners and occupants of the Shopping Center Site and the

by zoning code) or other divider or barrier shall be construct-
ed between the sites.
This agreement shall be binding upon and shall inure- to
the benefit of the parties hereto, their successors and assigns
and grants and agreements contained herein are covenants run-
ning.with the land. The grants and agreements contained herei~
are not intended and shall not be construed as a dedication-of
