Haag site and Zoning Development Administrator DATE: November 4, 1994 RE: Gulfstream Professional Building variance to Article X - Parking Lots Section 5-142 (h) (3) "Driveways" File No. PKLV 94-002 Section 5-145 (~) (4) of the Code of ordinances requires that when a variance to Section 5, Article X, Parking Lots is requested, the Technical Review Board (Technical Review Committee) must forward to the Planning and zoning Board (Planning and Development Board) a recommendation that is to be part of the public hearing proceedings. To that end, this memo is forwarded, consistent with the requirements of Section 5-145 (c) (4). Robert Lake, agent for Leopold and Phillip Ettinger, owners of the subject property, is requesting a variance to section 5-142 (h) (3) of the Parking Lot Regulations. The variance is requested in connection with a new tenant, a church, propos ing to occupy a portion of the existing office building located at 500 S.E. 36th Avenue (Gulfstream Blvd. ) . The new tenant changes the use of the tenant space from office to a church. The use change results in the need of additional parking spaces to accommodate the church. A change in use which requires additional parking spaces causes the existing parking facility to conform to current parking lot standards. The property is located at the southeast corner of Gulfstream Boulevard and old Dixie Highway. section 5-142 (h) (3), in part, is described as follows: No parking lot driveway may be constructed closer than thirty (30) feet from the intersection of the right-of-way lines along local streets and one hundred eighty (180) feet along streets of a higher classification as shown on the city or county thoroughfare plans. The driveway under consideration is located on the old Dixie Highway right-of-way. Old Dixie Highway is classified as a "collector" which is a higher classification than a local street. The purpose of the one hundred eighty (180) feet distance requirement is to allow vehicles to ingress or egress a site without becoming part of the stacking of vehicles waiting at the intersection or turning at the intersection, and to allow vehicles egressing a site to access a traffic lane while approaching an intersection. The 180 feet distance requirement creates safe traffic flow into and out of a site when a driveway is located near an intersection. I Page 2. Planning and Zoning Department Memorandum No. 94-318 PLV Gulfstream Professional BUilding As previously stated the site is an improved site with an existing 25,282 square foot bUilding with associated parking facility and landscaping. The use change of adding the church tenant to the bUilding requires the eXisting parking faci! i ty to conform to current standards. The existing building was approved by the City Commission on June 2, 1981 and at that time the parking lot code requirement for a driveway was as follows: i Section 5-141. Entrances and Exits Each parking lot shall have at least one common entrance and one common exit and the location shall be approved by the City Councilor its designated agent. (Code 1958, Sec. 18-6) The current code requirement, Section 5-142 (h) (3), as previously defined, was established March 16, 1982, by Ordinance No. 82-8. For an illustration of the existing site, see the attached copy of a reduced site plan of the property. For an explanation of the code requirement, the nature of the request and the variance justification, please refer to the attached copy of the variance application submitted by the applicant. On Tuesday, September 27, 1994, the Technical Review Committee (TRC), met to review the plans and documents submitted to formulate a recommendation with regard to the variance request.
