Attached are comments made by the reviewing departments during their initial review of your project. In order to complete the review process, the site plan and documents must be amended to comply with these comments within 90 days of the date of this letter. (If amended plans are not submitted in 90 days r a new application fee will be required.) It should be noted that the comments are divided into two (2) categories; the first category is a list of comments that identify deficiencies that are required to be corrected and shown in compliance on the plans submitted for second (2nd) review in order for the project to continue through the site plan review process. The second set of comment(s) are recommendations that the Planning and Zoning Department staff believe will enhance the proposed development. The applicant shall understand that all documents/plans submitted for s1te plan and/or permit review are subject to additional comments. I recommend that the applicant/ agent contact me regarding questions related to the comments. If the applicant is not intending to correct code deficiencies they should contact me regarding the proceduresr application forms, fees and submittal deadline dates for seeking relief from the code requirement. I. SITE PLAN REVIEW COMMENTS: 1. Place a note on the plan that refers to the parking lot variance that was approved for the back-up space on the east s1de of the building. Include the following approval dates: Planning and Development Board on November 9r 1993 and the City Commission on November 16r 1993. 2. Label the exist1ng driveway on the west side of the building as the loading zone. show and identify the following dimensions for the loading zone: width 12 feet by 35 feet long with a clear height of 14 feet. [Appendix A-Zoning Section 11 J.] 3. Show on the site plan drawing the location and width of the roof overhang. Show on the site plan drawing, the location of the building in compliance with the required zoning district setback dimensions. Setbacks shall be measured from the edge of the overhang to the property line. Add to the site plan the setback dimension from the south property line to the building. [Appendix A-Zoning Section 4 J.3.] 4. With a distinguishable symbolr identify on the elevation view drawings the dividing line between the existing construction and the proposed new construction. Also, specify whether the roof overhang on the existing building is existing or proposed for construction. The minimum front setback for the subject zoning district (C-2) is thirty (30) feet. Since the building is not conforming to the present setback dimensions, the applicant may not add to the south side of the building. Spec1fy on the plan, the zoning d1strict of the properties that are located to thenorthr east and west of the subject property. [Appendix A-Zoning Section 6 B.3.] 6. Add to the drawingsr a detailed section view drawing of the dumpster walls and buffer wall. The walls shall be shown with a stucco finish on both sides. I recommend that the color of the dumpster walls match the color of the walls of the building. Note: Change the name of the wall along the north property line from privacy wall to buffer wall. Show on the plans, a ten (10) foot clear opening width for the dumpster enclosure. The clear opening width shall not be violated by the gate and post material. [Appendix A-Zoning Section 4 1.] 7. To keep the project on track for City reviewr submit, as soon as possible, for reviewr a traffic impact statement. The traffic statement shall identify the daily trips for the subject expanded use. The study will be sent to Palm Beach County for their review for conformance with the County Traffic Performance Standard. [City Ordinance Chapter 19 Article VI Section 19-81] 8. Add the following note to the landscape notes: Landscape material will be installed in a sound workmanlike manner and according to accepted good planting procedures. [Landscape Code Section 7.5-35 (a)] 9. Considering that the west driveway will rema~nr show and identify the required hedge material along the west property line of the site where the vehicle use area is visible from the actual west property line. The hedge material shall follow the perimeter of the building that is encroaching the west property line. [Landscape Code Section 7.5-35 (e)] 10. Show and identify on the plan, the required hedge material along the south property line where the vehicle use area is visible from N.E. lOth Avenue. More specificallYr south of the hand~capped sidewalk and south of the parking spaces located northwest of the proposed addition. Identify the width of the landscape strip south of the handicapped walkway. [Minimum width is f~ve (5) feet.) [Landscape Code Section 7.5-35 (d)) 11. Show and identify on the plan, where the coco plum hedge material is located and where the buttonwood hedge is located. Also specify the variety of buttonwood (silver or green). [Landscape Code Section 7.5-36) 12. Show and ~dentify on the plan the line-of-sight triangles on both sides of each ingress/egress to the site. Include a note specifying that within the triangular area an unobstructed space between thirty (30) inches and six (6) feet above the vehicle use area shall be maintained clear. Remove all hedge plant material that is located within three (3) feet of each side of all ingress egresses and dimension said three (3) feet. [Landscape Code Section 7.5-35 (h)) 13. show and identify on the floor plan, the location of the fifty (50) seats. Also add to the floor plan, the parking ratios that are identified on the site plan. Add to the site plan drawing, the square footage of the existing building and the proposed addition. On the floor plan drawingr identify the total square footage of the building. [Appendix A-Zoning Section 11 H.16.d.(1.)] 14. The handicapped walkway shown on the east elevation view drawing is not shown on the site plan. Add to the elevation view drawingr the south elevation of the building. On the elevation Vlew drawings, identify the color, manufacturer's name and color number for the following exterior portions of the building: fiberglass roof shingles, cornice fascia, river rock wall veneerr stuccoed block walls, window frames, door face, door framesr and hand railing. For the property owners liabilitYr place an easement of the subject property where there is a building encroachment from the property owner to the west. 2. Add to the plan, a medium or small classified tree or palm and ground cover landscape material to the interior parking space island at the rear of the building. 3. Show on the elevation view drawings and site planr where needed, the location of all site, wall and roof mounted mechanical equipment. Add to the site planr floor plan and elevation view drawings, screening for samer including screening for the can wash area. I, further, recommend that the screening material blend with the design and color of the building. 4. Add to the drawing, the location, sizer letter style and color of the proposed site and building signage.Also include the color and size of the associated sign framework and supports. Showing the signage at this time may eliminate possible delay for Board approval for the subject signage in the future. Existing site development on the currently developed site consists of a 1016 S.F. CBS restaurant and accessory parking. Proposed development consists of refurbishing the ,existing restaurant and expanding by 1084 S.F. for a proposed total development of 2100 S.F. TRAFFIC GENERATION The Palm Beach County Unified Land Development Code Article 7, Section 7.9 (I) C - Traffic Performance Standards, APPLICABILITY, Subsection 2 (B) requires that for any application for a site specific development order on property on which there is an existing use shall be subject to the Palm Beach County Traffic Performance Standards to the extent the traffic generation projected for the site specific development order exceeds the traffic generation of the existing use. The generation rates and capture rates of the existing use shall be updated to current pro forma traffic generation and pass-by rates and shall be used to calculate previous approval traffic. Because the structures and land have been in use within the last five years, they shall be considered an existing use. A brief review of the directly accessed links, however, Seacrest Blvd. and Federal Highway, reveals that adequate capacity is available to support the proposed restaurant expansion and the project appears to meet the requirements of the Traffic Performance Standards. The low A.M. and P.M. peak hour turning movement volumes at the project entrance with N.E. 10th Avenue do not warrant the construction of exclusive turn lanes based on the Palm Beach County engineering guidelines used in determining the need for turn lanes of 30 left turns or 75 right turns.in the peak hour. Site Plan Review approval for this proj ect will be granted by the City Commission/Community Redevelopment Agency. To ensure that the project stays on line with the review time frame, I request that the plans and exhibits be reviewed and formal written comments transmitted to the Director of the Planning and Zoning Department no later than 5:00 P.M. on Februarv 22. 1994. Adher1ng to the following review guidelines will promote a comprehensive review and enable the applicant to efficiently obtain Technical Review Committee approval: 1. Use the review standards specified in Part III, Land Development Regulationsr Chapter 4r Site plan Review, section 8 of the Code of Ordinances to review and formulate comments. 2. The documents submitted for the project were determined to be substantially complete based on the submittal requirements identified in Section 7 of the Site Plan Review Ordinance. Howeverr if the data provided to meet the submittal requirements is insufficient to properly evaluate and process the project based on the review standards or the documents show code deficiencies, additional data and/or corrections should be requested by the reviewer through the Planning and Zoning Department. Technical Review Committee member (s) shall identify in their comments when the plans depict or when the location and installation of their departmental required improvements may conflict with other departmental improvements. 5. When a TRC Member finds a code deficiency that is outside of his/her review responsibility, the comment and the specific code section may be included in their review comments with the name of the appropriate TRC Member that is responsible for the review specified. 6. If a TRC member finds the plans acceptabler he/she shall forward a memo, within the time frame stated above, to the Planning and Zoning Director stating that the plans are approved and they do not have any comments on the plans submitted for review and recommend the project be forwarded through the approval process. All comments shall be typed, addressed and transmitted to the Director of the Planning and zoning Department for distribution to the applicant. please include the name and phone number of the reviewer on this memo. Michael E. Haag will be the planning and Zoning Department staff member coordinat1ng the 1st review of the project. The Planning and Zon1ng Department will send the applicant a cover letter which includes the comment(s) and directions to amend the plans to comply with the comments and the procedures for resubmission. When the planning and Zoning Department receives the amended plansr they will distribute the plans with a cover memomorandum to all TRC members for review and approval.
