referenced project. Site Plan Review approval for this project
will be granted by tl:e City Commission/Community Red,?velopment
Agency. To ensure that the project stays on line with the review
time frame, I request that the plans and exhibits be reviewed and
formal written comments transmitted to the Director of the Planning
and Zoning Department no later than 5:00 P.M. on Auqust 2. 1994. Do

Development Regulations, Chapter 4, Site Plan Review, Section
8 of the Code of Ordinances to review and formulate comments.
The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the Site Plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
show code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member( s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not J:.ave any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Michael E. Haag will be the Planning and Zoning
Department staff member coordinating the 1st review of the project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.

Dear Members of the Board,
In reference to the above location for the proposed new Miami Subs Grill restaurant, the
following is a response to the six (6) questions stated in the Board of Adjustment application in order to
establish a justification for the requested variance.
A - A special condition exists with the building in question in regards to a loading zone. Unlike the
adjacent Walgreens Drug Store, this restaurant will receive only one or two deliveries per week. This is
due to the fact that all food is purchased from a single supplier and delivered at the same time. All
deliveries will be made in the early morning, typically between 6:00 to 8:00 AM, Since the restaurant is
not open for breakfast this will be several hours before its normal operating hours. Deliveries will never
interfere with any other vehicular traffic during the early morning period since the drive-thru lane will be
utilized to park the delivery truck while unloading,
B - The out-parcel has a existing cross-parking agreement with Boynton Lakes Plaza. All parking spaces
are held accountable by the agreements already signed between the Plaza, tenants and city, and spaces
cannot be deleted or converted into loading zones. The new building is required to have a minimum of 32
parking spaces based upon square footage. The site, however, already has 59 existing spaces.
C - The "Cocos" Mexican restaurant, also located in the Boynton Lakes Plaza, lacks any designed loading
zone, This variance would also not give this Miami Subs Grill restaurant any special privileges beyond
any other Miami Subs Grill restaurants in the chain since they also do not have designed loading zones.
D - The failure to not grant the variance as requested would create an undue hardship due to previous
agreements with plaza owner, city zoning board approvals and land purchase agreements.
E - This is a minimum variance that will make possible the reasonable use of this out-parcel due to the
existing cross-parking agreement and existing site conditions.
F - It is the intent of Miami Subs Grill to benefit the surrounding community by providing a well-
established, easily accessible, high quality restaurant, while creating employment for local citizens as well
as tax revenue for the City of Boynton Beach.

We have again reviewed subject application and reaffirm the
position we expressed to Mr. Haag prior to the Planning and
Development Board meeting with respect to the southeast access to
Miami Subs near Plaza Lane. It is simply that the access is too
close to Plaza and should be eliminated. Two other problems cited
by other departments could also be resolved by closing this access,
as follows:
I. The dumpster could be relocated away from Congress Avenue to
the areR vacated by closure.
2. Proper backup space for parking stalls near the access could
be provided.
Although I attended the final 45 minutes of the Miami Subs
presentation, at the Planning and Development Board meeting, I was
not asked to comment, and did not volunteer. I am a little
concerned by a suggestion made by the applicant late in the
presentation to simply move the southeast access farther north, in
that I do not feel a satisfactory access can be accommodated along
Miami Subs' eastern property line at any point.
with respect to the project in general, it is likely that a
different designer would have provided a layout more to our liking,
but the bottom line is that the proposal appears to be in
compliance with those portions of the Boynton Beach Code of
Ordinances administered by this office.

Comments: Spanish Barrel tile (changed from the Spanish'S' tile), the 12" square tile
accents, and "aqua" colored storefront are not standard features of a typical Miami Subs Grill
restaurant These were incorporated to help blend in with the rest of the shopping center as
well as the Community Design Code. The overall height of the building has also been reduced
to a maximum of 18 feet above [mished floor due to agreements with the adjacent Walgreens.
This is why there are several design changes to the building since the previous review.
3. A variance will be applied for concerning the loading zone. Unlike the adjacent Walgreens,
there are only one or two deliveries per week since all food is purchased from a single supplier.
Deliveries are made in the early morning, several hours before the opening of the restaurant,
and will not interfere with traffic flow in any way since truck will park in drive-thru lane.
4. Details of signs and their locations have been added to the plans.
5. All driveways and parking spaces are existing and have been dimensioned on the plans.
Response to recommendations:
1. Color scheme of the restaurant is standard for a typical Miami Subs Grill and their
headquarters will not allow any major changes. Exterior colors are however as per city
Community Design Plan. Most of the accent tile bands were omitted as per your
recommendations. The architectural lighting is Miami Subs' company trademark and should be
allowed to remain. The single tile band remaining is a also a official Miami Subs restaurant
recognition feature. The awnings shown are different from the typical Miami Subs' bubble
awnings. This is to better reflect a more Mediterranean/Spanish look that the center requires.
2. If the plans are reviewed you can see there are two drive-thru windows. One where you pay
and get your drink, and one to get the food. This is the standard Miami Subs Grill drive-thru
system. Because of this there needs to be at least one car length after the menu boardlbefore
the first drive-thru window, to allow for time to get the food ready at the second window.
This is why realistically, due to site restraints, the menu board cannot be relocated,

Please place the above-referenced request on the september 20,
1994, City Commission agenda under Public Hearings.
DESCRIPTION: This is a request, submitted by David Daszkal, for
conditional use approval for a 2,934 square foot, drive-through
restaurant (Miami subs Grill), to be located on outparcel "A" of
Boynton Lakes Plaza; the northeast corner of Plaza Lane and
congress Avenue. Although utilities, parking, drainage and
landscaping for the outparcel were installed during construction
of the main shopping center building, several changes to these
improvements are necessitated to accommodate the drive-through
facility. The design and color of the building meet the
community Design Plan requirements of the spanish/Mediterranean
district in which the outparcel is located, however the outparcel
building does not resemble the main shopping center - a
requirement of the original 1990 site plan approval of the
shopping center. Miami subs Grill is proposing a white, pink and
aqua color scheme, whereas the shopping center is a two-tone
beige, aqua and dark blue color scheme.
RECOMMENDATION: The Planning and Development Board, with a vote
of 5 - 2, recommends approval of this request, subject to
Melaleuca mulch, rather than Cypress mulch being used, and
subject to the attached staff comments (Utilities Department
Memorandum No. 94-277 and 94-252, Building Department Memorandum
No. 94-197 and Planning and Zoning Department memorandum dated
September 2, 1994), excluding the following comments from the
Planning and Zoning Department's september 2, 1994 memorandum,
regarding the architectural design and color of the building and
the southeast outparcel entrance near Plaza Lane:
1. Recommendation II.1.a;
2. Recommendation I1.l.c, d, e, f and g;
3. Recommendation 11.2, however the planning and Development
Board is recommending that the neon be removed from the
freestanding sign (as well as from the building); and
4. Recommendation 11.3. The Planning and Development Board is
recommending closure of the southeast outparcel entrance
near Plaza Lane, however they are recommending that the
dumpster location, impacted by the closure, be relocated to
the southeast corner of the outparcel, rather than the
southwest corner.
As a point of information, the Police Department has notified the
Planning and zoning Department that they support the closing of
the southeast outparcel entrance near Plaza Lane, as a means to
help relieve the traffic at the Plaza Lane entrance to the
shopping center and at the Plaza Lane/Congress Avenue
intersection.

Development Board on September 13, 1994 (see attached agenda) and
then to the City Commission the following week (September 20,
1994).
The applicant must understand that the permit plans shall be
amended to comply with the attached staff comments and that
additional comme~ts may be generated by staff following their
review for technical compliance of permit documents that are
required to be submitted for development of the project.
For the applicant's convenience, attached is a list of documents
required for permit submittal.
An approval of the site plan by the City Commission shall be
valid for one (1) year, unless a building permit from the
Building Department is secured. If the applicant fails to secure
a building permit in that time, all previous approvals shall
become null and void.

ton Beach, Florida.
lB. Uses requiring an environmental review permit: Within
any C.2 neighborhood commercial zoning district, no build-
ing, structure, land or water, or any part thereof, shall be
erected, altered, or used, in whole or in part, for any of the'
followir_g specified uses, unless an environmental review
permitls secured in accordance with the standards and
procedu'"es set forth in section 11.3:
a. Automotive service stations, subject to the provision
of 1.cc. above.
b. Print shops.
c. Drycleaning on premises, limited to handling goods

d. Any use listed under 6.B.l or 6.B.IA, which uses,
handles, stores, or displays hazardous materials, or
which generates hazardous waste as, defined by 40
Code of Federal Regulations, Part 261.
2. Prohibited uses. Within any C.2 neighborhood commercial
zoning district, no building, structure, land or water, or
any part thereof, shall be erectea: altered, or used, in whole

all cases, the floor area occupied by used merchandise
shall not exceed twenty-five (25) percent of the gr'lSS floor
area.
Stores which deal primarily in used merchandise, shall be
limited to retail merchandise of the type that is permitted
in the list of permitted uses above. Pawnshops and auction
houses shall be prohibited, however, in the C-2 district.
U sed merchandise stores shall be located not less than
twenty-four hundred (2,400) feet apart, as measured by
direct distance between property lines, and shall have a
gross floor area of not more than five thousand (5,000>
square feet. Where these stores are currently located at
less than this minimum distance, such stores shall not be
expanded. All new applications for occupational licenses
to operate such uses or applications for building permits
to expand such uses shall be accompanied by an affidavit
which certifies that the provisions of this paragraph would
be complied with. Exterior storage and display in connection
with such uses shall be prohibited.
7. O(f-streefparking. As set forth in section H.R hereinafter.
C. C-3 COMMUNITY COMMERCIAL. DISTRICT. These dis-
trict regulations are to encourage the development of appropriate
intensive retail commercial facilities providing a wide range of
goods and services, located centrally and accom.modating three
(3) or four (4) neighborhoods and located adjacent to at least one
major thoroughfare.
1. Uses permitted. Within any C-3 community commercial
district, no building, structure, land or water shall be used
except for one (1) or more of the following uses:
a. Any use permitted in C-! or C-2 districts, without
specific limitation on floor area.
b. Any conditional use in the C-2 district, except as pro.
vided for otherwise under the C-3 district regulations,
without specific limitation on floor area. *
c. Antique stores and 'auctions houses, selling only ob-
jects of value such as quality antiques, art objects,
jewelry and the like, but not used merchandise generaD.y.

Please place the above-referenced request on the April 18, 1995
City Commission agenda under Development Plans, Non-consent agenda.
DESCRIPTION: This is a request for relief from Section 10.F.G of
the Community Design Plan regarding exterior lighting for Miami
Subs at 1920 South Federal Highway, submitted by owner, Joe Marouf.
Exposed neon lighting is proposed along the entire length of each
side of the existing parapet wall.
RECOMMENDATION: The Planning and Development Board, with a 4-3
vote, recommended denial of this request. This recommendation was
based on the Board's concern that approval would establish a lack
of consistency between project to project; either neon (or any kind
of exterior lighting attached to the outline of a building) should
be allowed or not allowed.
