The City of Boynton Beach has completed its first review of the
site plan for the above referenced project. Attached are comments
made by the reviewing departments during their initial review of
your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.)
When there are comments made by the reviewers that you feel are
not applicable to the approval of the project or will be
addressed separately and you have not amended the plans to comply
with the comment(s), you must prepare written explanation for
each comment stating why the comment is not applicable and return
the explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets of the plans to the Planning and Zoning Department.
When the amended plans and documents have been submitted to the
Planning and Zoning Department, they will be distributed to the
reviewing departments for a second review and the reviewers will
recommend if the site plan will be placed on a board approval
schedule (see attached). If there are major comments not
addressed by new plans or the reviewers recommend that the plan
not be forwarded to the Planning and Development Board, this
office will notify you on your alternatives regarding the site
plan as soon as possible.

Submit an amended Site Plan Review application form that reflects the
changes that were made as a result of amending the plans and documents
to comply with the Code of Ordinances and the Technical Review
Committee comments. A copy of the original form with a distinguishable
symbol identifying the change(s) may be submitted or a completed new
form with the changes identified. It is the agent of the owners
responsibility to notify the owner(s) of changes. If there are no
changes required to be documented on the application form, a letter
from the applicant stating same must be turned in with the amended
submittal.
Submit twelve (12) assembled and complete sets of plans and documents
that show compliance with the Code of Ordinances and comments made by
the Technical Review Committee. Two (2) of the sets shall have the
appropriate legible raised seal and signature of the designer
responsible for the drawing(s). Plans and documents shall be assembled
in twelve (12) individual complete packages with the title of the
project on all pages and/or sheets and each page or sheet numerically
numbered such as the following example: 1 of 3, 2 of 3, 3 of 3.

SUBMITTAL REOUIREMENTS
The following shall be incorporated as part of the submittal of
amended plans and/or documents for review
1. Submit a scaled locator map that identifies the location and
perimeter boundary of the site and the surrounding roads and
current zoning districts including the district of the
subject property. The map shall show and identify by name
the roads surrounding the site and the roadway path that
links the site to the closest arterial road with the names
of the roads and arterial road(s) identified. The map shall
show the zoning district line and the title of the zoning
districts that abut the perimeter of the zoning district
where the subject property is located. The map shall have
the North compass direction and scale identified. Maximum
size of locator map is 8 1/2" by 14".
2. Submit color photographs of the buildings on the site that
are to remain in their existing condition and photos of
existing buildings that are located on the sites that abut
the perimeter of the subject property. The minimum size is
8" by 10". Each photograph shall be labeled to identify the
location of the existing structures with respect to the
location of the proposed project.
3. Submit a 8-1/2" x II" transparency of the landscape site
plan drawing to be used on an overhead projector at board
meetings.
4. Submit colored elevation view drawings - a colored duplicate
copy of all drawings of the elevation views of each side of
all buildings and signage associated with the project. The
colored elevation views shall match the elevations shown in
the documents that where submitted for site plan review. The
applicable exterior surfaces as identified above shall be
colored with the color name and associated color reference
number identified. The type of exterior surface material
shall be identified next to the associated color. The
colored elevation drawings shall have compass direction or
title of the side of the building identified. The title
block of the original drawing shall be shown. The maximum
size is 24" by 36". Do no submit on board of any kind.
5. Submit color samples as an example of the proposed colors.
Each sample shall have attached a label that identifies the
color by name and numerical/letter code from an established
color chart.
6. Where a specific exterior surface is not applicable to the
project, signify by placing a "N/A" on the appropriate line.
7. Submit a copy of the legal description of the subject
property on an 8 1/2" by II" sheet of paper.

The following comments are in response to the submittal of the
site plan for the above referenced project. The comments for the
project were discussed at the May 14, 1992, Technical Review
Committee meeting. The site plan was reviewed for consistency
with the review standards specified in Section 8 of Chapter 4,
Site Plan Review, Part III, Land Development Regulations of the
Code of Ordinances. The applicant shall amend the drawings and
documents to show compliance with the following comments:
1. Correct the inconsistencies on the site plan, landscape plan
and conceptual drainage plan/site plan drawings with regards
to the parking lot layout, number of parking spaces,
pavement markings and signage. Note: All parking lot
dimensions and construction shall comply with the
requirements specified within the applicable codes.
2. Show on the plans the appropriate required parking space
calculations as specified in Section 11 H of the Zoning
Code. (Required parking ratio for the proposed business is
1 to 300, one (1) parking space for each three hundred (300)
square feet of gross floor area. Show on the plans no less
than the number of parking spaces required by the 1 to 300
ratio. All regular and handicapped parking spaces shall be
shown consistent with the applicable codes regarding type,
striping and layout.
3. Submit elevation view drawings showing each side of the
proposed building. Revise the elevation view drawings to
depict the Spanish/Mediterranean architectural theme which
is the architectural theme specified for the site in the
Community Design Plan.
4. Specify on the elevation view drawing the color proposed for
all exterior finish surfaces of the building. All colors
shall comply with the colors listed in the Community Design
Plan for the Spanish/Mediterranean theme.
5. Show on the site plan the location of the six (6) foot high
buffer wall that is required to buffer the subject
commercial property from the abutting residential zoning
district to the North of the subject property. Include a
section view drawing of the wall that shows the wall being
placed no closer than two (2) feet from any property line
with a stucco finish that is colored to match the color of
the walls of the building.

6. Show on the landscape plan the ten (10) foot isosceles
line-of-sight triangle at the ingress/egress driveway and
the thirty-five (35) foot isosceles line-of-sight triangle
at the intersection of Boynton Beach Boulevard and N.W. 7th
Court. State on the plan that within the line-of-sight
triangles a vertical space between thirty-six (36) inches
and seventy-two (72) inches will remain clear and
unobstructed.
7. Show on the landscape plan a continuous visual screen along
the entire East side of the vehicle use area where the
vehicle use area is visible from the East property line.
The minimum size of landscape material is eighteen (18)
inches high with a maximum spacing of twenty-four (24)
inches on center.
8. Add to the plant list two (2) foot on center spacing for the
plant material along the North property that is specified on
the plan Cl .
9. The interior landscape requirements listed on the landscape
plan are not applicable for this project. Remove same from
the plan.
10. Identify with a distinguishable symbol on the plant list the
native specie material. Note: Fifty (50) percent of the
number of plants that are required to meet the site specific
location of landscape material shall be a native specie.

We have reviewed the above referenced plans and offer the following
comments:
1) Landscaping plan requires curbed parking stalls, not reflected in
either site plan. Developer must clarify which applies.
2) Location of parking lot lighting must be shown on plans, photo-
metrics to be provided at time of permit application.
3) The Department of Transportation is proposing lane widening in
this area. Developer shall contact the F.D.O.T. to determine
ultimate R/W and adjust setback accordingly.
4) Drainage calculations must be provided prior to second review
approval. S.F.W.M.D. exemption letter is required. City drainage
concurrency requires design to accommodate 2!" pretreatment off
parking lot and a design storm of three year, 24 hour for quantity
considerations.
5) Source of irrigation water shall be noted on plans.
6) The two site plans differ in parking lot configuration. The
developer shall rectify.
7) Note on plans shall state compliance with all applicable City of
Boynton Beach ordinances and construction standards.
8) Sidewalk shall continue along N.W. 7th Court to the property line.
Sidewalk shall be continuous across the entrance.
9) Propery survey must be provided prior to second review approval.
10) Handicapped stall on second site plan does not provide adequate
room for backing without entering the roadway.

Please be advised that my original comments for the Waste
Management "Mulching Facility" stands as written. It is my
understanding that should the Waste Management site utilize and
or purchase the existing manufacturing building's
(situated to the north of the Waste Management Site) required
parking spaces, the existing building to the north may then have
an insufficient amount of required parking spaces placing it in a
state of non-compliance with City Codes. Therefore, in
conjunction with the construction of the Waste Management site,
the site to the north would have to be modified to comply with
current parking lot requirements of Chapter 5, Article X, as
specified in my previous memo to you.
Since this is a zoning matter which will affect the validity
and/or application of my previous comment(s), I conclude that
your office will calculate the correct number of required stalls
for the existing building to the north by taking into account
both the occupied and vacant portions of the northern structure
including any other zoning review criteria necessary to determine
compliance with the required parking elements of our City's Code
of Ordinances for both of the subject sites.
Additionally, I do not have comments relative to the Bookstore
and the Sales Center submission. The City Engineer will be
forwarding to you under separate memorandum, his review comments
for the above referenced sites.

The owner of the vacant property wishes to develop the .22 acre
site into an office building project. The request is to
construct a building that is designed and built to represent the
modular home product that the company the applicant represents
supplies to prospective buyers. The total area of the proposed
building is one thousand five hundred three (1,503) square feet
of which three hundred fourteen (314) feet will be office area
and the remaining one thousand one hundred eighty-nine (1,189)
feet will be the area of the model house. The office area has
been incorporated into the model building to accommodate the
office facilities for the project. The subject property is a
corner lot with frontage on Boynton Beach Boulevard. The
entrance to the parking area is off N.W. 7th Court. The use and

the Community Design Plan Code is fully applied, the housing
model will not look like the finished product the applicant is
attempting to sell. As an example, the district requires barrel
or cement tile roofing material and stone, brick or medium to
heavy modulated stucco exterior wall material but the product
being offered will have fiberglass roof shingles and vinyl
exterior wall siding when completed. Staff feels that the color
of the structure should comply with the design district
requirements but because the use is temporary, full compliance
with the Community Design Plan is not needed. The colors
proposed for the structure comply with the colors specified in
the Code within the Spanish/Mediterranean design theme. In
addition, a concrete block buffer wall is required between the
subject commercial zoned property and the residentially zoned
property located directly north of the subject property.
However, we would again suggest that because this is a temporary
use in a residential configuration that the buffer wall be
waived.
staff acknowledges this is a unique use that is not often seen on
a commercial property. If at some time in the future the model
is altered or converted for full use as an office or commercial
structure, the site would have to undergo full site plan review
and comply with the applicable code requirements.

Review of Departmental Comments:
The comments from the reviewing departments are attached. The
Technical Review Committee recommended that the project be
forwarded to the Planning and Development Board with the
understanding that their unresolved comments and code
deficiencies will be rectified and corrected at the time working
drawings for the project are reviewed for permit issuance.
Recommendation:
The Planning and Zoning Department recommends that the Board find
the plans acceptable and forward same to the City Commission with
a recommendation to approve, subject to the administrative
decision by the director to waive the requirements of the buffer
wall, and the board accepting the degree to which the building

1. Revise the parking computations shown on the plans to
specify the required parking space ratios. The required
parking space ratios for the sales office use are one (1)
parking space for each three hundred (300) square feet of
gross floor area.
2. Show on the site plan the location of the solid masonry six
(6) foot high buffer wall that is required to buffer the
subject commercial property from the abutting residential
zoning district located directly to the North of the subject
property. Include a section view drawing of the wall that

any property line. Also, specify the wall has a stucco
finish on both sides that is colored to match the color of
the walls of the building and/or the color of the existing

3. Show on the landscape plan a continuous visual screen along
the entire North side of the vehicle use area where the
vehicle use area is visible from the North property line.
The minimum size of landscape material is eighteen (18)
inches high with a maximum spacing of twenty-four (24)
inches on center. Note: Fifty (50) percent of the number
of plants that are required to meet the site specific
location of landscape material shall be a native specie.

Site Plan review - Model Home Sales Center - Amended plans
The amended plans illustrate two iterns which must be corrected before we
can reccmnend forwarding of this project. These i terns were not indicated
on the initial plans. They are:
1) The landscape plan indicates irrigation is to be provided with City
water. In that this is a ccmnercial establishment, we wi 11 not set a
separate irrigation meter for it, and all water usaqe will be billed for
water and sewer charqes. The applicant must acknowledge that he is
aware of this policy, in writing, before we can approve the plans. This
policy is intended to promote conservation in accordance with
Comprehensive plan policy 3C.3.4.
2) The plans indicate fire protection will be provided fram a hydrant not
adjacent to a public right-of-way, in which case access may be a
problem. A water main could be extended (at developer expense) along
Boynton Beach Blvd. to provide better access fram the right-of-way
adjacent to the property. In addition, it is not clear fram the current
plans whether the existing hydrant is within 200' of all points on the
bui I ding, as requi red by code.
The following two conditions are repeated fram our original memo for your
convenience, and may be met after Ccmnission approval.
1) The capacity reservation fee must be paid within 30 days of City
Ccmnission approval. Based upon a 3/4" meter size the reservation fee
for this facility is $ 138.60. (Sect. 26-34(E))
2) All water and sewer utilities to be owned and operated by the city shall
be constructed in accordance with city standards. (Sect. 26-33(b)).
The site appears to have a sewer service line to it, but not a water
service, although a 3" water main is available in the right-of-way.
A water service line and meter must be installed at the developer's
expense.
