This matter came before the City Commission of the City of
Boynton Beach, Florida on Tuesday, January 18, 1994, requesting a
site plan approval of a 14,872 square foot warehouse building to be
located on 1520 Neptune Drive. The City Commission of the City of
Boynton Beach, upon the recommendation of city administrative staff
finds the following:
1. The proposed structure is a one (1) story rectangular
shaped building. The shape, design and color of the building are
harmonious with structures located on adjacent lots.
2. The site is not located in a Community Design District.
3. The site plan should be approved subject to staff
comments, attached hereto and made a part hereof.
ACCORDINGLY, IT IS ORDERED that the applicant's request
for site plan approval is granted subject to staff comments,
attached hereto and made a part hereof.

Please place the above-referenced item on the City Commission
agenda for January 18, 1994 under Development Plans, Consent
Agenda.
DESCRIPTION: This is a request for site plan approval of a 14,872
square feet warehouse building to be located on 1520 Neptune Drive.
One, two-way driveway is proposed to provide access to the building
and the 30 parking spaces. Landscaping proposed above and beyond
what is required by code includes trees along the rear property
line and groundcover in the planters near the building entrances.
A portion of the building will be occupied by the owner; the
remainder will be leased.
RECOMMENDATION: The Planning and Development Board unanimously
recommended approval of this site plan request, subj ect to the
attached staff comments (Planning and Zoning Department memorandum
dated January 7, 1994 from Michael Haag, Public Works Department
Memorandum No. 93-293, Building Department Memorandum No. 93-257,
Fire Department Memorandum No. 93-295 woe (Revised 1-10-94) and
utilities Department Memorandum No. 93-532).

DESCRIPTION OF PROJECT:
The proposed structure is a one (1) story rectangular shaped
bUilding. There are overhead doors, storefronts, and swinging
doors depicted on the west and south elevations of the
building. Small storefront windows are located on the face of
the building that fronts Neptune Drive. The shape, deslgn,
and color of the building are harmonious with structures
located on adjacent lots. The following is a brief summary ot
basic elements of the project:

frontJ.ng on Neptune DrJ.ve and the other three sides abuttlng
developed sites located in the M-l zoning district.

Palm Beach County TraffJ.c DivJ.sion reviewed the traffic lmpact
statement, submitted by the applicant, and has determJ.ned that
the projects meet the Traffic Performartce Standards of Palm
Beach County.
Drivewav/Parkinq Lot:
The plans indicate one (1) two-way driveway on Neptune Drlve,
The drlveway leads to the vehlcle use area that lS shown
borderlng the north and west sides of the slte. A dumpster
enclosure and a loadlng zone are located at the south end of
the proJect.
ParK-ino Spaces:
Based on the lndustrlal use and floor area lndlcated on tne
plans, 30 parklng spaces are requlred and 30 spaces are
provlded.

Accessibilitv Features:
The approprlate number of handicapped parklng spaces are
provided at the slte. A sidewalk leadlng to the building from
the public rlght-of-way offers accessibility to the northwest
corner of the buildlng.
Landscapina:
Supplemental trees are shown along the perimeter of the
project. The groundcover landscaping shown in the planters
near the entrances to the bUilding are not required by the
code.
Buildina and Site Reaulatlons:
The location and size of the building dnd size of the lot are
in compliance with the requirements specified in the zonlng
code for buildings located in the M-l zoning district.
Community Desian Plan:
The site is not located in a Community Design District.
REVIEW OF DEPARTMENTAL COMMENTS:
Please find attached the comments from all the reviewlng
departments: Please take note of Fire Department memorandum
number 93-295. Mr. Cavanaugh is recommending that. the plans
not be forwarded for Board review until the plans show a fire
hydrant. Staff supports Mr. Cavanaugh regardlng the f lre
hydrant, however, the addition of a fire hydrant or flre
hydrants to the site, wll1 not substantially change the deslgn
of the building or the configuration of the site. Therefore,
the project has been forwarded for Board review subject to the
applicant complying with all staff comments.
RECOMMENDATION:
The Planning and Zoning Department recommends that the
Planning and Development Board find the site plan reVlew
acceptable and forward same to the City Commission with 3-
recommendation to approve, subject to the appllcant submlttlng
working drawings to the BUilding Department that depict the
project in compliance with the applicable City of Boynton
Beach Code of ordinances and the attach~d staff comments.

The following is a list of comments regarding the 2nd review of
the above-r~ferenced project. It should be noted that the
comments are divided into two (2) categories:
The first category is a list of comments' that identify unresolved
comments either from the first review or new comments as a result
of the 2nd review. To show compliance with these comments will
not substantially alter the configuration of the site and the
design of the building.
The second category is a list of recommendations I believe wlll
enhance the aesthetics and function of the proJect.
All comments and recommendations can be rectified on the plans at
time of permitting considering that the request for Site Plan
Review is approved. The applicant must understand that
additional comments may be generated upon review of the documents
and working drawings submitted to the Building Department for
permits for the proposed project.
I. Site Plan Review Comments:
1. To ensure that the minimum allowed back-up space (minimum 27
feet) is maintained for the parking spaces 'along the west
property line, indicate on the plan the width of the planters
that are located on the west side of the building.
2.
specify on the site plan that the bUilding is one (1) story.
RECOHHENDATION(S):
1. Recommend that the color of the dumpster enclosure m3cch the
color of the bUilding. The recommendation includes establish~ng
six (6) feet as the overall height of the dumpster enclosure.
2. Recommend changing the plant species where trees are
proposed to be planted under the overhead power lines along the
south property line, to a speCles that is identified in the FP&L
brochure titled "Plant the Rlght Tree in the Right Place."
NOTE: If recommendations are approved, lncorporate them lnto the
working drawlngs required for permlts for the proJect.

northwest corner of your property is incorrectly shown.
Please revise to show correct location and give your

Vice Mayor Aguila had questions for the applicant, and Mr. Carlson came forward.

Vice Mayor Aguila complimented Mr. Carlson on the clarity of the plans. He
asked Mr. Carlson if all exposed areas of the dumpster enclosure will be
stuccoed and painted to match the building. Mr. Carlson responded affirma-
tively and confirmed that the dumpster will be 61 high from average grade. With
regard to the power lines, there is no conflict with the dumpster, but the size
of the trees will be adjusted.
Vice Mayor Aguila asked for clarification on the issue of the fire hydrant. Mr.
Carlson stated that he submitted plans to Utilities and the Fire Department.
Mr. Cavanaugh has approved those plans. The fire hydrant has been located mid-
way down the parking lot on the west side.
Mr. Carlson confirmed that the building will not have a sprinkler system. In
response to Vice Mayor Aguilals question regarding the landscape irrigation pump
pad, Mr. Carlson stated the plans have not yet been finalized. It will be pro-
tected and sheilded from view. Vice Mayor Aguila stated that if it is visible'
from the streets, he wants hedge material to shield it. Mr. Carlson was
agreeable. Mr. Carlson agreed that he will replace all dead hedge material and
fill all gaps.
Vice Mayor Aguila questioned whether Mr. Carlson was aware of the fact that the
Cityls requirement for parking spaces is 91 x 181. Mr. Carlson said he was
aware of this fact. Vice Mayor Aguila stated that on the west property line.
the applicant is proposing twenty-three (23) parking spaces. He suggested
changing the parking spaces to 91 x 181 which would allow the applicant to add
three 61 islands which will permit adding greenery to that side of the site.
The parking ratio will not be changed and it decreases the amount of asphalt on
the site. This will result in a better lOOking project in the City.
Vice Mayor Aguila also suggested that the applicant reduce the parking spaces to
91 x 181 which will result in widening the entry island on the north parking
area. Greenery can be added to this area.
Vice Mayor Aguila pointed out that this is a request for a better looking
project. He is aware that the applicant has complied with all Codes and is not
obligated to comply with his request regarding the parking area. The applicant
said new drawings would be required and questioned how their submission would
affect the process.
Since it was difficult for the applicant to make an immeoiate decision, Mayor
Harmening suggested the applicants think about it to determine whether they felt
there was enough merit to the suggestion to warrant following it. Vice Mayor
Aguila said, however, that he will insist on 91 x 181 parking spaces.

Commissioner Walshak stated that he is aware of the fact that Vice Mayor Aguila
has good intentions to improve the project, but it is difficult for the appli-
cant to make a snap decision. He feels these things should be negottated prior
to a Ctty Commission meeting.

Vice Mayor Aguila moved to approve the Consent Agenda. Commissioner Walshak
seconded the motion which carried unanimously.

Vice Mayor Aguila noted that Mr. Rossi previously requested a six-month time
extension.
Rick Rossi said there is a contract to purchase by a Palm Beach County developer
of single-family homes with a closing date of approximately March 15th. The
land will be converted into houses. It is in a final plat stage and ready to
go to construction with the posting of bond and paying of the proper fees.

Vice Mayor Aguila complimented Mr. Carlson on the clarity of the plans. He
asked Mr. Carlson if all exposed areas of the dumpster enclosure will be
stuccoed and painted to match the building.- Mr. Carlson responded affirma-
tively and confinmed that the dumpster will be 61 high from average grade. With
regard to the power lines, there is no conflict with the dumpster, but the size
of the trees will be adjusted.

Vice Mayor Aguila asked for clarification on the issue of the fire hydrant. Mr.
Carlson stated that he submitted plans to Utilities and the Fire Department.
Mr. Cavanaugh has approved those plans. The fire hydrant has been located mid-
way down the parking lot on the west side.
Mr. Carlson confinmed that the building will not have a sprinkler system. In
response to Vice Mayor Aguila'S question regarding the landscape irrigation pump
pad, Mr. Carlson stated the plans have not yet been finalized. It will be pro-
tected and sheilded from view. Vice Mayor Aguila stated that if it is visible
from the streets. he wants hedge material to shield it. Mr. Carlson was
~ agreeable. Mr. Carlson agreed that he will replace all dead hedge material and
fill all gaps.
Vice Mayor Aguila questioned whether Mr. Carlson was aware of the fact that the
Cityls requirement for parking spaces is 91 x 181. Mr. Carlson said he was
aware of this fact. Vice Mayor Aguila stated that on the west property line,
the applicant is proposing twenty-three (23) parking spaces. He suggested
changing the parking spaces to 91 x 181 which would allow the applicant to add
three 61 islands which will penmit adding greenery to that side of the site.
The parking ratio will not be changed and it decreases the amount of asphalt on
the site. This will result in a better looking project in the City.
Vice Mayor Aguila also suggested that the applicant reduce the parking spaces to
9' x 181 which will result in widening the entry island on the north parking
area. Greenery can be added to this area.
Vice Mayor Aguila pointed out that this is a request for a better looking
project. He is aware that the applicant has complied with all Codes and is not
obligated to comply with his request regarding the parking area. The applicant
said new drawings would be required and questioned how their submission would
affect the process.
Since it was difficult for the applicant to make an immediate decision, Mayor
Harmening suggested the applicants think about it to detenmine whether they felt
there was enough merit to the suggestion to warrant following it. Vice Mayor
Aguila said, however, that he will insist on 91 x 18' parking spaces.

Find attached for your review the plans and exhibits for the above
referenced project. site Plan Review approval for this project
will be granted by the City Commission/Community Redevelopment
Agency. To ensure that the project stays on line with the review
time frame, I request that the plans and exhibits be reviewed and
formal written comments transmitted to the Director of the Planning
and Zoning Department no later than 5:00 P.M. on November 18. 1993.

Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review, Section
8 of the Code vf Ordinances to review and formulate comments.
2. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the site plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
show code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member (s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Dotty Moore will be the Planning and Zoning Department
staff member coordinating the 1st review of the project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. when
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.

5. It appears as though the landscape material required by the
code along the west and east property lines will be omitted
and hedge material existing on the adjacent site in that
area will be credited for the required mater1al. The
Landscape Code will allow existing material to satisfy
material required by the code, however, the following note
shall be added to the plan in all instances where existing
material will be used to satisfy the installation of new
material:
City Landscape inspector will field verify, during landscape
inspection of the site, that the existing hedge meets the
following specifications and, if it does not, the subject
site will be improved with the required new hedge material,
including the fifty (50) percent nat1ve species requirement:
a) minimum height hedge material eighteen (18)
inches;
b) maximum height hedge material six (6)
feet;
c) maximum spacing hedge material - twenty-four
(24) inches on center, to form a continuous visual
barrier;

This letter is a Traffic Impact Statement for the C& M Duilding proposed for a one-acre rarecl cast of Congress
A venue and south of Neptune Drive in the City of Boynton 13each. It Is prepared in accordance with the Palm
Beach County Land Development Code.
The project is proposed as a 15.000 square feet light industrial building. According to the Section 10.8 of the
Land Development Code, Fair Share Road Impact Ordinance, the appropriate trnffic generation rate for light
industrial is 6.97 daily trips per 1,000 square feet. Therefore, the C&M Building is expected to generate 105
average daily trips.
Section 7,9 of the r .and Pevelopnient Code, Traffic Performance Standards" indicates that non-rcsidental projects
in a municipality generating fewer than '200 daily trips "shllll not be required to submit a Trame Impact Study".
This traffic impact study would have to be reviewed by Palm Beach County trame engineering division.
However, since the C&M project does not exceed Ihis limit it can meet the provision of the Countywide Traffic
Performance Stnndards by way of a review by tho City Engineer.
Therefore, based on the calculations and analyses presented herein the C&M building project can be reviewed

documents submitted for the above referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.) When
th~re are comments made by the reviewers that you feel are not
applicable to the approval of the project or will be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with tne amended plans and documents.
After amending the plans and documents, please submit twelve (12)

The following list and information is provided as a checklist to ensure that
the submittal of amended plans and documents is substantially complete for
review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted by the
Planning and Zoning Department.

1. Submit an amended site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans and
documents to comply with the Code of Ordinances and the Technical Review
Committee comments. A copy of the original form with a distinguishable
symbol identifying the change(s) may be submitted or a completed new form
with the changes identified. It is the agent of the owners responsibility
to notify the owner(s) of changes. If there are no changes required to be
documented on the application form, a letter from the applicant stating
same must be turned in with the amended submittal.
2. Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets shall
have the appropriate legible raised seal and signature of the designer
responsible for the drawing(s). Plans and documents shall be assembled in
twelve (12) individual complete packages with the title of the project on
all pages and/or sheets and each page or sheet numerically numbered such
as the following example: 1 of 3, 2 of 3, 3 of 3.
3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property. The
minimum size is 8'1 by 10". Each photograph shall be labeled to identify
the location of the existing structures with respect to the location of
the proposed project.
4. Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and signage
associated with the project. The colored elevation views shall match the
elevations shown in the documents that where submitted for site plan
review. The applicable exterior surfaces as identified above shall be
colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified next
to the associated color. The colored elevation drawings shall have compass
direction or title of the side of the building identified. The title block
of the original drawing shall be shown. The maximum size is 24" by 36". Do
no submit on board of any kind.
5. Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name and
numerical/letter code from an established color chart.
6. Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.
