She further confirmed that all ads and notices have been property filed. MAYOR TAYLOR ANNOUNCED THE PUBLIC HEARING. THERE WAS NO ONE PRESENT WHO WISHED TO SPEAK ON THIS APPLICATION. Motion Commissioner Jaskiewicz moved to approve the parking lot variance. Commissioner Tillman seconded the motion which carried unanimously. Davis, agent for the owners, confirmed that the applicants were in agreement with the conditions of approval. Tambri Heyden, Planning and Zoning Director, had no additional staff comments. Mayor Taylor confirmed that the Planning and Development Board unanimously recommended approval of this application. Motion Vice Mayor Titcomb moved approval of Item IX-A, Old Dutch Mill Seafood Market, major site plan modification. Commissioner Jaskiewicz seconded the motion. Commissioner Bradley commended the Bills for the work they are doing, and expressed excitement about the refurbishing of this business. The motion carried 5-0. VIII. PUBLIC AUDIENCE: SahtoS" Garcia, Vice President of Rolling Green Homeowners' Association, 1631 NW 3rd Lane, questioned when the last survey was performed relative to the installation of a traffic signal on 17th. With the assistance of the Police Department, a project including plants and telephone poles was planned for the median. That project has stalled, and the homeowners are requesting an explanation. In addition, Mr. Garcia pointed out that many of the people in the neighborhood have spent money to comply with Code and avoid Code Enforcement liens, They were promilld assistance from the City. They applied for grant money, but they have not received any cAo. money. With regard to the issue of telephone poles, Mayor Taylor contacted FPL and provided information to the Police Department. FPL agreed to put the poles aside for pickup by the residents. However, Mayor Taylor learned that the residents had a change of heart and decided not to put the telephone poles around the median. The poles are available if the residents are interested in them. When Charles Frederick, Director of Recreation and Park, confirmed for Mr. Garcia that the median on 1 rn is City owned, Mr. Garcia requested that the City improve it. He said the residents are frustrated because th~y were cited for not complying with Code; however, the City is not doing its job regarding that median. 7 MINUTES PLANNING AND DEVELOpEAl:NT BOARD MEETING BOYNTON BEACH, FLORIDA APRIL 8, 1997 Major Site Plan Modification 1. Davis Scott and Mary Jo Bills 1022 North Federal Highway Request for approval of a major site plan modification to remodel the existing building exterior, add a 100 square foot addition and reconstruct the parking lot on .25 acres. Mr. Aguila asked how the building is nonconforming. Mr. Lewicki advised that the setbacks are nonconforming. Mr. Aguila asked how long it has been vacant. Mr. Lewicki advised that it has been vacant for about two and a half years. Mr. Aguila asked if there is a use problem with what the applicant is proposing to do. Mr. Lewicki said there is no use problem because the use proposed is within the zoning classification. However, the change of use triggers the major site plan modification. Mr. Aguila referred to the comment in Planning and Zoning Department Memorandum #97 -126 that there is minimal landscaping on the site, but its quantity and location cannot be verified as the submitted survey of the property is deficient. He asked if staff reviewed the current landscaping conditions to make an evaluation, or if they are relying on the survey. Mr. Lewicki said he was hoping that the second submittal would resolve the problem. Mr. Aguila felt sign packages should be submitted and reviewed at the time this board evaluates the rest of the site because signage has a major impact on projects. Mr. Lewicki explained that the Code requires submittal of the sign package; however, it also states that we cannot stop an application once it is in the process. Architect George Davis agreed to all the conditions of approval on Exhibit "e". Mr. Aguila asked what the second floor is going to be used for. Mr. Davis stated that the second floor is inhabitable and will be sealed off until the applicant has money to do something with it. Mr. Lewicki stated that the location of the screening and rooftop equipment has to be identified and expects that this issue will be resolved at the time of permit. Mr. Myott stated that the plan is not clear with regard to the windows on the second story and the trim. He suggested that the whole building be cleaned up. Page 2 Site Plan Review Staff Report Memorandum #97-126 Old Dutch Mill Seafood Market Existing Site Characteristics: Proposed Development: Concurrency: a. Traffic b. Drainage- Driveways: The site contains a nonconforming building which is currently vacant. Most of the site is impervious area (building and pavement). The site has two access points; one from Federal Highway (nonconforming) and one from Northeast 10lh Avenue. There is minimal landscaping on the site, but its quantity and location cannot be verified as the submitted survey of the property is deficient. The applicant proposes to convert an unoccupied bar (Old Dutch Mill) to a retail seafood market The improvements include remodeling of the existing building and adding a 100 square foot expansion to the existing structure. The parking, landscaping and on-site drainage will also be upgraded to comply with city code and design standards. The applicant intends to retain both driveways in the same locations as they currently exist, therefore, a parking lot variance application was submitted and is being concurrently reviewed, to allow the nonconforming driveway onto Federal Highway to remain at its current location. The width of the driveway will be reduced and it will be changed from a two-way to a one-way ingress. The total square footage of the proposed use, including the proposed addition will be 2,940 square feet. This number includes the second story of the building that is not considered for this use at this time. The on-site parking will contain 16 parking spaces, which will adequately serve future occupancy of the second story. The proposed use is vested from traffic levels of service as the site is located within a subdivision that was platted prior to the effective date of the city's concurrency management ordinance and is developed with an existing building that compared with the proposed use, does not generate additional trips. Insufficient drainage information has been submitted by the applicant, thus precluding the Engineering Division from certifying compliance with the City's drainage levels of service. Although required to be conducted at the site plan level, the Engineering Division is recommending that this review be postponed to time of permit review. As mentioned above, there are two driveways proposed for the seafood market; one from Federal Highway (nonconforming) and the other one from Northeast 10th Avenue. Since the driveway from Federal Highway is nonconforming, the applicant filed a parking variance application to allow the nonconforming driveway to remain at its current location. Page 3 Site Plan Review Staff Report Memorandum #97-126 Old Dutch Mill Seafood Market Parking Facility: Landscaping: Building and Site Regulations: Community Design Plan: Signage: RECOMMENDA liON: The number pf parking spaces proposed is 16, which exceeds the required 15 parking spaces. The parking lot is proposed to be upgraded to meet all city codes and design standards. The site landscaping will fully meet the code requirements when staff comments are incorporated. The building, as mentioned above, is a nonconforming structure. However, grandfather rights for the building and site regulations are still in effect. The proposed addition will not increase the non- conformity of the structure. The existing structure, resembling a dutch mill, consists of several architectural forms that were added onto the original building. However, the most distinctive architectural feature of the building is the tapered, octagonal tower finished with gray asphalt shingles. The other parts of the building having a sloped roof are also finished with the same material. The walls are finished with a combination of stucco and wood siding. The architectural character of the new addition will resemble the character of the original structure. The submittal contains no information regarding signage and does not allow staff to evaluate whether proposed signs will fully meet the requirements of the sign code. Therefore, staff recommends that signs be approved administratively at time of permit review. The Planning and Zoning Department recommends approval of this site plan request, subject to the comments included in Exhibit C - Conditions of Approval. Traffic b. Drainage- Driveways: The site contains a nonconforming building which is currently vacant. Most of the site is impervious area (building and pavement). The site has two access points; one from Federal Highway (nonconforming) and one from Northeast 10th Avenue. There is minimal landscaping on the site, but its quantity and location cannot be verified as the submitted survey of the property is deficient. The applicant proposes to convert an unoccupied bar (Old Dutch Mill) to a retail seafood market The improvements include remodeling of the existing building and adding a 100 square foot expansion to the existing structure. The parking, landscaping and on-site drainage will also be upgraded to comply with city code and design standards. The applicant intends to retain both driveways in the same locations as they currently exist, therefore, a parking lot variance application was submitted and is being concurrently reviewed, to allow the nonconforming driveway onto Federal Highway to remain at its current location. The width of the driveway will be reduced and it will be changed from a two-way to a one-way ingress. The total square footage of the proposed use, including the proposed addition will be 2,940 square feet. This number includes the second story of the building that is not considered for this use at this time. The on-site parking will contain 16 parking spaces, which will adequately serve future occupancy of the second story. The proposed use is vested from traffic levels of service as the site is located within a subdivision that was platted prior to the effective date of the city's concurrency management ordinance and is developed with an existing building that compared with the proposed use, does not generate additional trips. Insufficient drainage information has been submitted by the applicant, thus precluding the Engineering Division from certifying compliance with the City's drainage levels of service. Although required to be conducted at the site plan level, the Engineering Division is recommending that this review be postponed to time of permit review. As mentioned above, there are two driveways proposed for the seafood market; one from Federal Highway (nonconforming) and the other one from Northeast 10th Avenue. Since the driveway from Federal Highway is nonconforming, the applicant filed a parking variance application to allow the nonconforming driveway to remain at its current location. ~ Page 3 Site Plan Review Staff Report Memorandum #97-126 Old Dutch Mill Seafood Market Parking Facility: Landscaping: Building and Site Regulations: Community Design Plan: Signage: RECOMMENDATION: The number of parking spaces proposed is 16, which exceeds the required 15 parking spaces. The parking lot is proposed to be upgraded to meet all city codes and design standards. The site landscaping will fully meet the code requirements when staff comments are incorporated. The building, as mentioned above, is a nonconforming structure. However, grandfather rights for the building and site regulations are still in effect. The proposed addition will not increase the non- conformity of the structure. The existing structure, resembling a dutch mill, consists of several architectural forms that were added onto the original building. However, the most distinctive architectural feature of the building is the tapered, octagonal tower finished with gray asphalt shingles. The other parts of the building having a sloped roof are also finished with the same material. The walls are finished with a combination of stucco and wood siding. The architectural character of the new addition will resemble the character of the original structure. The submittal contains no information regarding signage and does not allow staff to evaluate whether proposed signs will fully meet the requirements of the sign code. Therefore, staff recommends that signs be approved administratively at time of permit review. The Planning and Zoning Department recommends approval of this site plan request, subject to the comments included in Exhibit C - Conditions of Approval.
