As a result of the July 18th City Commission meeting, the consideration of the proposed Papa
John's site plan was voted unanimously to table the project until such time as staff review was
completed of the new layout. As we have discussed through various telephone conversations,
Interplan is preparing revised plans and supplemental documents for staff review at the
August 8th TRC meeting. Given this, I respectfully ask that the proposed Papa John's project is
tabled until the August 15th City Commission meeting.

Please place the above-referenced request on the July 18, 1995 City
Commission agenda under Development Plans.
DESCRIPTION: This is a request from Interplan Inc., agent for Papa
John I s Pizza, for approval to appeal Chapter 7.5, Article II -
Landscape Code, Section 5.D.1. of the Land Development Regulations.
The appeal for reduction in the width of the perimeter landscape
strip to screen on-site parking spaces adjacent to Boynton Beach
Boulevard and N.W. 7th street, is submitted in connection with a
site plan approval request for construction of a Papa John's pick-
up/delivery pizza store at the northeast corner of Boynton Beach
Boulevard and N.W. 7th Court (please refer to the attached Planning
and Zoning Department Memorandum No. 95-336 for further details
regarding this appeal). The site plan request is also to be heard
at the July 18th Commission meeting (see separate transmittal -
Planning and Zoning Department Memorandum No. 95-351).
RECOMMENDATION: The Planning and Development Board, with a 7-0
vote, recommended denial of this request, based on their
anticipation of the site plan needing redesign, which might
eliminate the need for this appeal. Discussion of redesign took
place as a resul t of the applicant presenting to the Board a
revised design that they are exploring to address the dumpster
access problem.
Based on a discussion with the applicant today, the applicant
believes that even with the redesign, the appeal will still be
necessary. As a compromise, it is recommended that the Commission
approve the appeal with the condition that it be granted only for
angled parking, so that if the parking lot can be redesigned with
90 degree parking, the full width of the required landscape strip
shall be provided.

NATURE OF REQUEST
Interplan Inc., agent for Papa Johns Pizza, is requesting approval
to appeal Chapter 7.5, Article II - Landscape Code, Section 5 D. 1.
of the land development regulations (see Exhibit "All - letter of
request). The appeal, reduction in the width of the perimeter
landscape strip along the parking spaces, is in connection with and
concurrent with site plan approval for the construction of a Papa
Johns pick up/delivery pizza store. The location of the proposed
business is the northeast corner of Boynton Beach Boulevard and
N.W. 7th Court (see attached location map).
BACKGROUND
The site plan being processed concurrently with this request
depicts a 1,142 square foot building (see attached Exhibit liB" -
Site Plan). The vehicle use area consists of one-way traffic flow
in a counter-clock wise direction around the building with six (6)
diagonal parking spaces. The diagonal parking spaces border the
west side of the site (N.W. 7th Court) and the south side of the
site (Boynton Beach Boulevard).
ANALYSIS
The requested appeal pertains to the two (2) foot portion of a
parking space that may overhang into a required landscape area when
16 foot deep parking spaces with raised curbing are provided rather
than 18 foot deep parking spaces with wheelstops. Although this
overhang is permitted, the two (2) foot area shall not reduce the
required width of the landscape strip or the required eighteen (18)
foot long parking space. As previously stated, the diagonal
parking spaces are located along the portion of the site that is
adjacent to the abutting rights-oi-way. The required width of a
landscape strip abutting a right-of-way is five (5) feet.
Chapter 7.5, Article II - Landscape Code Section 5 D.1. states the
following:
"A strip of land at least five (5) feet in width located
between the abutting right-of-way and the off-street parking
area or other vehicular use area which is exposed to an
abutting right-of-way shall be landscaped, such landscaping is
to include a minimum of one (1) tree for each forty (40)
lineal feet or fraction thereof. Such trees shall be located
between the abutting right-of-way and off-street parking area
or other vehicular use area and shall be planted in a planting
area of at least twenty-five (25) square feet with a dimension
of at least five (5) feet. In addition, a hedge, wall, or
/
other durable landscape barrier of at lease three (3) feet in
height shall be placed along only the interior perimeter of
such landscaped strip. If such durable barrier is of
nonliving material, for each ten (10) feet thereof, one (1)
shrub or vine shall be planted abutting such barrier along the
street side of such barrier. The remainder of the required
landscaped areas shall be landscaped with grass ground cover
or other landscap~ treatment."
The applicant is requesting that the width of the landscape strip
be reduced a maximum of. two (2) feet in the areas where the
diagonal parking space encroaches the five (5) foot wide landscape
strip. The dimension of the parking space will remain eighteen
(18) feet with sixteen (16) feet improved surface and two (2) feet
overhang into the landscaped strip.
The reduced width of the required landscape strip is affected by
all parki~g spaces except the handicapped space. The reduced width
from five (5) feet to no less than three (3) feet at the location
of the two (2) foot overhang does not reduce the size or quantity
of tree or hedge material required around the vehicle use area.
RECOMMENDATION
The impact of the reduced width of the landscape strip is limited
to those areas where the parking space overhangs into the landscape
strip. With angled parking, only a portion of the vehicle will
encroach the landscape strip, whereas with ninety degree parking
t.he entire front of the vehicle would encroach. Also, more
landscaped areas is actually provided when diagonal parking spaces
are used rather than ninety degree (900) parking.
Based on the above, the Planning and Zoning Department recommends
approval of the request to appeal Chapter 7.5, Article II
Landscape Code, Section 5 D. 1., subject to the site plan and
landscape plan depicting with dimensions, where applicable, the two
(2) foot portion the parking space that encroaches the landscape
strip.

Please accept this letter as a formal request for an appeal to a variance in the landscape code.
Specifically, we are requesting relief from Chapter 7.5, Article II, Section 5.d.l which requires a
five (5) foot landscape buffer along Boynton Beach Boulevard., As you can see from the attached
8 W' x 11" copy of the affected portion of the site plan, I~ss than one (1) foot of the two (2)
angled parking stalls along Boynton Beach Boulevard encroaches into the required buffer area.
In the design process, we have had extensive contact with the City in an effort to minimize
adverse impact for a number of issues. The encroachment into the landscape buffer is the
minimum amount feasible to maintain adequate drive aisles, radii around the building, and back-up
space for parking stalls.

tabled to the September 19th City Commission meeting. The
applicant submitted complete revised plans on July 27th which were
to be discussed at the August 8th meeting of the Technical Review
Committee (TRC). However, before the revised plans were
distributed for this TRC meeting, staff determined that the new
location of the building would require a setback variance from the
Board of Adjustment. The applicant has not applied for the
variance and has asked staff to postpone any further review of the
resubmitted plans until they have a chance to thoroughly evaluate
the affects of this variance requirement on their project.
Therefore, as requested by the applicant, it is recommended that
these requests be tabled until ~he September 19th meeting.

A new staff report (attached Planning and Zoning Department
Memorandum #95-553) has been prepared based on the revised site
plan (attached as Exhibit "B" to the staff report). The revised
site plan no longer requires a landscape appeal because the parking
along Boynton Beach Boulevard has been changed ft-om angled parking
to 90 degree parking and has been shifted north (away from Boynton
Beach Boulevard), with the assumption that the building setback
variance before the Board of Adjustment will be approved.
New staff comments have been generated as well (attached as Exhibit
"C" to the staff report). Public Works Department Memorandum No.
95-183 indicates that Papa John's has not produced any letter or
draft cross access agreement with the adjacent Wendy's Restaurant
for Papa John's to use the Wendy's property to access the dumpster
on Papa John's property. Public Works has also taken a sanitation
vehicle to the Wendy's property and attempted to maneuver the cross
access to Papa John's through the wendy's drive-through lane by-
pass as is proposed. Public Works has determined that this access
is not acceptable and that can pick-up is not a viable solution
either.
Also attached is a letter just received from Papa John's requesting
that this approval, as well as their variance, be further tabled.
The Commission has the authority to honor or not honor the request
to table after weighing the conclusions from the staff against the
nature of the request to table. From purely a technical
standpoint, the issue of the dumpster access is of such rnagllitude

to substantiate a final and negative decision now, independently of
the variance. However, if the Commission chooses to honor the
request, it is recommended that it be tabled to November 21, 1995
which is after the November Board of Adjustment meeting, in the
event that the Board of Adjustment tables the variance at their
October meeting.

Mayor Taylor pointed out that the needs of the municipality need to be considered rather than just
setting a standard. However, Delray Beach and Boca Raton should have asked us about our feelings
on the issue prior to tackling this issue in this manner. City Manager Parker pointed out that they were
trying to be helpful to us, and assumed our position was the same as theirs.
