Concurrency: Traffic - Comments have not yet been received by Palm Beach County regarding their review of the traffic study. The study indicates that the project complies with the Palm Beach County Traffic Performance standards Ordinance. The applicant shall comply with any off-site improvements determined to be necess ary as part of the County's review of the study. / Page 2 site plan Review staff Report Memorandum #95-331 Papa Johns Driveways: Parking Facility: Landscaping: Building and Site Regulations: Community Design Plan: Signage: Drainage - Insufficient drainage information has been submitted for the engineer- ing Division to certify compliance with the city's drainage levels of service at the time of site plan approval, as required. The Engineering Division is recommending that this be postponed to time of permit review. A two-way driveway on N.W. 7th Court is proposed to serve the facility. The parking facility has provided the six (6) required parking spaces, including one handi- capped space. The applicant has requested variances from the Board of Adjustment to eliminate one (1) of the required spaces and to eliminate the requirement of a loading zone. Th~ applicant has requested a landscape appeal to allow the two foot overhang of the parking spaces to encroach into the five (5) foot wide landscape strip that is required to border the vehicle use area when the area is adjacent to a right-of-way. The landscape appeal is being considered concurrently with the site plan review. All other required landscaped issues will be in compliance with code when staff comments are met. The site plan has not been designed to accommodate the requirements of the Public Works Department for safe access to the dumpster. The site meets all other aspects of the building and site regulations, subject to the outcome of the variances in progress. The building style has a hint of Spanish/Mediterranean style with its flat roof with a clay tile cap and decorative beam ends. Many of the buildings in the area are Spanish/Mediterranean, therefore staff has made recommendations regarding minimizing the use of green on the awnings and darkening the color of the walls to more of an earth tone shade to better compliment surrounding buildings. The proposed signage will meet city code when the staff comments are incorporated. REVIEW OF DEPARTMENTAL COMMENTS: Below is a list of those departments that have comments regarding this request. RECOMMENDATION: Due to the significant nature of the staff comments (particularly unsafe dumpster access and insufficient back-up for one of the required parking spaces, necessitating a variance to reduce one of the required parking spaces) staff recommends denial of this site plan request. The above comments indicate the problems that are reflected in trying to utilize such a small site for this type of use. It should be noted that the comments are divided into two (2) categories. The first category is a list of comments that identify unresolved comments either from the first review or new comments as a result of the second review. To show compliance with these comments will not substantially alter the configuration of the site and design of the building, unless requested variances are not approved by the appropriate body. The second category is a list of recommendations I believe will enhance the aesthetics and function of the project. All comments and recommendations can be rectified on the plans submi tted at time of permitting, if the site plan request is approved. SITE PLAN REVIEW COMMENTS: 1. The first parking space south of the ingress violates the back-up distance requirement in the parking lot ordinance. A variance, case number 209, to omit one (1) required parking space will be presented to the Board of Adjustment on July 17, 1995. The applicant shall modify the plans to show compliance with the final determination of the requested variance. 2. A twelve foot wide by thirty-five foot long loading zone is required and not shown on the plans. A variance, case number 209, to omit the loading zone is currently being processed for review and will be presented to the Board of Adjustment on July 17, 1995. Specify on the plans that the screening for the equipment mounted on the roof will be the same material and color as the walls of the building and that the screening will extend no less than equal to the highest piece of equipment or fixture mounted to the roof. 15. It is recommended that the size of the b4ilding be reduced to allow the required improvements to be installed and the site to function properly. 17. It is recommended that the value of the dover sky color proposed for the walls of the building be darkened to an earth tone shade to be more compatible with the adjacent building to the east. 18. The green awning is a predominant feature of the building and the predominant color. Green is not used on any surrounding buildings. It is realized that green is Papa John's corporate colors, therefore it is recommended to minimize, rather than eliminate, the use of green. This might be accomplished by making the awning red with green stripes, rather than the reverse which is proposed. 19. As a point of information, the plans submitted do not indicate that the awning will be illuminated. Haag Zoning and Site Development Administrator DATE: July 7, 1995 SUBJECT: Papa Johns - File LAAP 95-003 Landscape code Appeal (landscape width reduction along portion of street frontage) NATURE OF REQUEST Interplan Inc., agent for Papa Johns Pizza, is requesting approval to appeal Chapter 7.5, Article II - Landscape Code, section 5 D. 1. of the land development regulations (see Exhibit "A" - letter of request). The appeal, reduction in the width of the perimeter landscape strip along the parking spaces, is in connection with and concurrent with site plan approval for the construction of a Papa Johns pick up/delivery pizza store. The location of the proposed business is the northeast corner of Boynton Beach Boulevard and N.W. 7th Court (see attached location map). BACKGROUND The site plan being processed concurrently with this request depicts a 1,142 square foot building (see attached Exhibit "Bll - Site Plan). The vehicle use area consists of one-way traffic flow in a counter-clock wise direction around the building with six (6) diagonal parking spaces. The diagonal parking spaces border the west side of the site (N.W. 7th Court) and the south side of the site (Boynton Beach Boulevard) . ANALYSIS The requested appeal pertains to the two (2) foot portion of a parking space that may overhang into a required landscape area when 16 foot deep parking spaces with raised curbing are provided rather than 18 foot deep parking spaces with wheelstops. Although this overhang is permitted, the two (2) foot area shall not reduce the required width of the landscape strip or the required eighteen (18) foot long parking space. As previously stated, the diagonal parking spaces are located along the portion of the site that is adjacent to the abutting rights-of-way. The required width of a landscape strip abutting a right-of-way is five (5) feet. Chapter 7.5, Article II - Landscape Code Section 5 D.1. states the following: "A strip of land at least five (5) feet in width located between the abutting right-of-way and the off-street parking area or other vehicular use area which is exposed to an abutting right-of-way shall be landscaped, such landscaping is to include a minimum of one (1) tree for each forty (40) lineal feet or fraction thereof. Such trees shall be located between the abutting right-of-way and off-street parking area or other vehicular use area and shall be planted in a planting area of at least twenty-five (25) square feet with a dimension of at least five (5) feet. In addition, a hedge, wall, or / other durable landscape barrier of at lease three (3) feet in height shall be placed along only the interior perimeter of such landscaped strip. If such durable barrier is of nonliving material, for each ten (10) feet thereof, one (1) shrub or vine shall be planted abutting such barrier along the street side of such barrier. The remainder of the required landscaped areas shall be landscaped with grass ground cover or other landscape treatment." The applicant is requesting that the width of the landscape strip be reduced a maximum of two ( 2) feet in the areas where the diagonal parking space encroaches the five (5) foot wide landscape strip. The dimension of the parking space will remain eighteen (18) feet with sixteen (16) feet improved surface and two (2) feet overhang into the landscaped strip. The reduced width of the required landscape strip is affected by all parking spaces except the handicapped space. The reduced width from five (5) feet to no less than three (3) feet at the location of the two (2) foot overhang does not reduce the size or quantity of tree or hedge material required around the vehicle use area. RECOMMENDATION The impact of the reduced width of the landscape strip is limited to those areas where the parking space overhangs into the landscape strip. Wi th angled parking, only a portion of the vehicle will encroach the landscape strip, whereas with ninety degree parking the entire front of the vehicle would encroach. Also, more landscaped areas is actually provided when diagonal parking spaces are used rather than ninety degree (900) parking. Based on the above, the Planning and Zoning Department recommends approval of the request to appeal Chapter 7.5, Article II Landscape Code, section 5 D. 1., subj ect to the site plan and landscape plan depicting with dimensions, where applicable, the two (2) foot portion the parking space that encroaches the landscape strip. Specifically, we are requesting relief from Chapter 7.5, Article II, Section S.d.l which requires a five (5) foot landscape buffer along Boynton Beach Boulevard, As you can see from the attached 8 'l1" x 11" copy of the affected portion of the site plan, less than one (1) foot of the two (2) angled parking stalls along Boynton Beach Boulevard encroaches into the required buffer area. In the design process, we have had extensive contact with the City in an effort to minimize adverse impact for a number of issues. The encroachment into the landscape buffer is the minimum amount feasible to maintain adequate drive aisles, radii around the building, and back-up space for parking stalls.
