parking amounts to 1134 and the new ~ount with the PolIo layout

c) On the concern with the flood lights on the roof parapet, we
want to clarify that they will be removed and they will be
installed on the edge of the overhang illuminating upward to the
barrel tile overhangs and porch so there will be no glare to the
public parking areas. No wall mounted flood lights will be
installed. All lighting will conform with the City standards and
photocell activaction.
d) We have reviewed all the parking calculations and we found
that the existing plans of the Shopping Center show 27
handicapped spaces, 20 on the south side and 7 on the north side
that we matched in our plan. The overall count by following the
Master Plan attached to your report reflects that the existing
parking amounts to 1.134 and the new count with the PolIo layout
comes up to 1155. (Total gain at PolIo site equals 21), which
adds up to a space buffer of 48.77, much higher than the
percentage shown on the traffic study or previously approved
site plan.
I hope this new information clarifies and satisfies the parking
comments.

The city of Boynton Beach has completed its first review of the
site plan for the above referenced project. Attached are comments
made by the reviewing departments during their initial review of
your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.) when
there are comments made by the reviewers that you feel are not
applicable to the approval of the project or will be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets of the plans to the Planning and zoning Department.
When the amended plans and documents have been submitted to the
Planning and Zonin~ Department, they will be distributed to the
reviewing departments for a second review and the reviewers will
recommend if the site plan will be placed on a board approval
schedule (see attached). If there are major comments not addressed

This study is designed to address and document the parking
requirements for shared uses at The Shoppes of Boynton, a
proposed mixed use commercial development at the northeast corner
of Congress Avenue and N~ 22nd Avenue in the City of Boynton
Beach, Florida. Since Quantum Boulevard, which is a 4-lane
divided highway, severs a portion of the retail from the cinema,
it was felt that significant shared parking was a viable option
for the development north and south of Quantum Boulevard.
Although the parking on the opposite side of the roadway is
reasonably convenient for patrons using any of the facilities, it
is important to provide positive traffic control regulations to
facilitate pedestrian traffic across Quantum Boulevard. Thus, a
parking area analysis was the method used in making a determina-
tion as to the viability of shared parking usage. Because of the
varied parking usage within the development, namely cinema,
and restaurant, on the north portion, and retail on the south
portion, it is believed that a shared parking usage study
would be appropriate.
Because of the varied requirements and usage of parking spaces
during different hours of the day, it is felt that this study,
using the interactions associated with shared parking phenomenon
as published by the Urban Land Institute (ULI), is appropriate.
The Urban Land Institute 1983 publication is the methodology used
in this report.
Additionally, the formula required by the Ordinance No. 86-8 of
the City of Boynton Beach was calculated to ensure that the
proper buffer was maintained within this proposed project.

The Shoppes of Boynton is a mixed-use development proposed for
the northeast corner of Congress Avenue and N~ 22nd Avenue in the
City of Boynton Beach, Florida. The land use prop~sals for the
project south and north of Quantum Boulevard are outlined below:

The Urban Land Institute methodology allows for a calculation and
assumption of shared parking capacities which would result in an
overall site plan which would provide for more efficient parking
on the site. Therefore, it is this methodology that is used in
the compilation of this report in order to allow a more efficient
usage of parking area within the site based on the proposed
land use.

ULI METHODOLOGY

The basis for the Urban Land Institute's research was to define
the characteristics of parking demands for single land uses.
Then, by analyzing parking accumulations at mixed use centers,
the shared parking concept was quantified.
The ULI recommends the following procedure be followed in
determining shared parking:
1. Initial Project Review: Knowledge of the site and the
intended land uses is very important in beginning the shared
parking analysis. Results from the initial review for The Shoppes
of Boynton has been presented in earlier sections in terms of
square footage and land uses proposed.
2. Adjustment for Peak Parking Factor: The parking factors
are those specified in the City of Boynton Beach Code as
detailed earlier in this report and indicate a need for 742
spaces, for the section of development south of Quantum
Boulevard and for 540 spaces, for the section of development
north of Quantum Boulevard.
3. Analysis of Hourly Accumulations: Parking accumulation
curves are selected by reviewing the ULI data and incorporating
site specific conditions.
4. Estimate of Shared Parking: The hourly parking
for each land use is merged to estimate overall shared
demand. This is simply the hour by hour addition of
demand for each use to estimate aggregate demand.

Applying the ULI methodology to The Shoppes of Boynton yielded
the hourly parking accumulation curves for each of the two land
uses for weekday and Saturday conditions.

Retail in The Shoppes of Boynton is expected to be made up
mostly of small stores with some medium size stores that might
act as anchors, but are not anchor stores in the traditional
sense of a grocery store or large retail store. A wide range of
businesses could be tenants in these Retail stores. These retail
businesses do not exhibit the same parking characteristics as the
ULI data. These businesses also tend to close sooner in the day
than a traditional anchor.
The cinema parking activities are different than the retail use.
Guided by the ULI data, conservative estimates of parking
accumulation were used. It was assumed that weekday matinees
would be offered and patronized. Furthermore, it was assumed
that each weekday evening would be a sellout at each of the
screens. This is a virtual impossibility, but these assumptions
have been used to present the worst case and to provide
enough parking during these times.
The restaurant facility normally peaks during the evening peak
and a secondary peak during the noon hour. This facility usually
will peak similar to the cinema and it is very likely that a
customer at the movies will also visit the restaurant.
Seasonal variations are addressed in the ULI report, and the City
of Boynton Beach Ordinance. In each case, the variations would
tend to decrease the parking demands during the off-season.
Because the ULI data has been collected nationwide, seasonal
variations do not describe experiences in South Florida. It is
assumed in this report that the peak season for general retail
and cinema occur at the same time, and that no shared parking
benefit can be derived from the relation of different peak
seasons. Once again, this assumption serves to present the worst
case, and supply the most parking.
Percentages for the parking accumulation curves have been applied
to peak hour demand for parking in each land use to arrive at
calculation of shared parking values. Table 1 shows the total
parking demand for weekdays, and Table 2 for Saturdays.

Weekday shared parking demands peak at 5:00 PM in the evening,
due to moderate usage of the retail and cinema facilities. The
peak demand from the ULI methodology is 727 spaces.
Saturdays have a peak hour demand of 762 spaces, at 2:00 PM.
Since a greater aggregate peak hour demand occurs on the
weekend, it will be used for design purposes.
Boynton Beach requires a buffer of ten (10%) percent above the
ULI calculations to provide for natural turnover of parking and
unexpected fluctuating peaks. If this was provided at The Shoppes
of Boynton, 839 spaces would be supplied.
The current approved site plan allows
therefore, the shared parking concept
project. With 1,107 spaces the buffer
for 1,107 spaces and

exceed tho requirements in many respccts. Our facility is first class for its type. The
style and architccture. exterior treatments. landscaping, and interior finishes arc
very high quality, which is the image that we want to pOrLray. .
Our design is compatible wiLh the Shoppcs of Boynton development and whir Lbe 11igb
standards of Boynlon Beach itself. Our food, made fresh daily on premises .!lnd our
operational systcms also achieve the excellence tbat will :be an enhancement to the
community. We have been very well received ill all of the neighborhoods where wo
have opened: our appeal has been especially strong with families. Wr:. need lhe
condilional use approval for our drive-thru lane because in our quick service
format, It Is an essential component. We cannot proceed without it.
With respect to some of the olher specific standards used for evaluating conditional
uses, I oreer the following comments. The ingress nnd egress points to the properly
will not be modified for our use. The refuse area will comply with the applicable
ordinances. The ulilities are available to the property with sufficient capacity Cor
our use. The proposed landscape is lush. The proposed sign age is minimal and
tastefully done. We comply with the required setbacks.' The height ot the building is
less than the building directly behind us. Our investment in 1he City will have a
positive iDlpact on the tax base and our employment opportunities will have a good
economic effect. There is adequate parking to accommodate OUf use. as addressed in a

PolIo Tropical Conditional Use
Glenn Rozansky, for PolIo Tropical, has applied for a conditional
use for a restaurant and drive-thru at the Shoppes of Boynton.
This site is an outparcel located at the northeast corner of
Quantum Boulevard and Congress Avenue. The restaurant will have
100 seats.
In the original site plan, this parcel was proposed as a bank,
but because the banking sector has had a serious economic
downturn, the owners of the center are requesting this change.
The need for the conditional use comes about because the proposed
use has a drive-thru pick up window. It should be noted that the
original bank also had drive-thru tellers.
The comments generated by Staff review are minor and can be
addressed by the applicant at time of building permit.
At its meeting of April 13, 1993, the Planning and Development
Board reviewed this conditional use and forwarded it to the City
Commission with a recommendation for approval.
Subsequent to that meeting, Staff has met with the applicant and
reviewed the Staff comments. The applicant has agreed to comply
with all the comments, including the question raised at the Board
meeting regarding a pedestrian crosswalk between the north and
south parking lots of the site.
This item is scheduled for final review by the City Commission at
its meeting of April 20, 1993.

referenced project. Site Plan Review approval for this project
will be granted by the City Commission/Community Redevelopment
Agency. To ensure that the project stays on line with the review
time frame, I request that the plans and exhibits be reviewed and
formal written comments transmitted to the Director of the Planning
and Zoning Department no later than 5:00 P.M. on March 22, 1993.
Do not return plans and exhibits. Retain same for the review of the
amended plans (2nd review).
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land

2. The documents submitted for the project were determined to be

the project based on the review standards, additional data
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the code section and include the

4. Technical Review Committee member (s) shall identify in their

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, within the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Michael Haag will be the Planning and Zoning Department
staff member coordinating the review of the project.
The Planning and Zoning Department will send to the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply wi th the comments and the procedures for resubmission. When

Part III, Land Development Regulations of the code of Ordinances.
The applicant shall amend the drawings and documents to show
compliance with the following comments:
1. Remove from the sheet titled Master Site Plan (MSI) ,all
improvements that have not received site plan approval from
the City with the exception of the PolIo Tropical site.
(Example~ Major 1, Major 2, etc.)
2. Correct the inconsistencies in the square footage shown on
Sheet MSI and Sheet 8 of 8. The existing area shall match the
area listed on the attached Exhibit "A". Considering that
tenant walls often change location, I would prefer that the
area for retail spaces A through J, excluding I, be listed and
shown as a combined total for the building. Identify the area
of the theatre, Retail K, Retail Land M and PolIo Tropical as
the total area for each building. The attached Exhibit "A" is
the City record of square footage for the project which
contains the same total area used in the shared parking study.
3. Add to Sheet MSI a tabular summary of the total square footage
for the entire shopping center including the proposed new
site. See attachment "A".
4. Add to the plans a tabular summary of the parking calculations
for the entire shopping center site including the PolIo
Tropical site. Show all computations and ratios needed to
identify the total number of regular and handicapped parking
spaces required for the entire project. Include the language
in the shared parking study that verifies the study is still
valid and complies with City Code section 11.H.13. See comment
#5 and the attached code section 11.H.13.
5. A field visit to the site indicates that the last paragraph on
page 11 of the parking study is incorrect. Modify the report
to the numbers identified below and incorporate same into the
parking calculations. The total number of parking spaces
provided at the project is 1107. Modification to the existing
project for the new PolIo Tropical site allows for 18
additional parking spaces to be added to the project.
Therefore, the new total number of parking spaces provided at
the project is 1125, which results in a space buffer of 47.5%.
6. Correct the inconsistencies on sheets MSI, 2 of 8, 2 of 3, 2
of 4, and 6 of 8 with regards to the internal access aisle
located directly south of the theatre and west of the main
entrance to the theatre site.

7. The new site has created a net increase of 24 internal parking
spaces. Add to the landscape plan the calculations and figures
that indicate how the required interior landscaping
specifications are being provided for at the site. Find
attached Section 7.5-35 (g) of the landscape code that
identifies the landscaping requirements for parking area
interior landscaping. On the landscape plan show with a
distinguishable symbol the location of the required interior
landscape area, the required trees and the other landscape
material that will be installed over the required interior
landscape area. show with a distinguishable symbol where fifty
(50) percent of the total number of required trees are a
native specie and show in numbers where a total of not less
than fifty (50) percent of the total number of other landscape
material will be a native specie. See the attached copy of
the policy from the Comprehensive Plan documents that states
the 50% native specie requirement.
8. A field visit to the site indicated that the proposed
landscape plan does not correctly identify and show the
existing landscape material. show with a distinguishable
symbol and list by name all of the existing landscape material
and specify where on site the existing material will be
relocated. Note: Relocation of existing landscape material
falls under the responsibility of the Environmental/Forester,
Kevin Hallahan. It appears that the perimeter visual barrier
that is required to screen the vehicle use area at the corner
of Quantum Boulevard and Congress Avenue is being removed.
This continuous (two foot on center) landscape barrier is
required and shall remain in place or the applicant may seek
approval of an appeal to omit same. [See attached Section
7.5-35 (d) and landscape appeal procedures]
9. At the ingress/egress to the site from Congress Avenue show on
the landscape plan the appropriate line-of-sight triangles and
identify the space that shall remain unobstructed to allow
cross visibility. See the attached line-of-sight regulations
of the Landscape Code, Section 7.5-35 (h).
10. Submit a statement justifying the reason why the City should
approve the conditional use for the drive-thru restaurant.
Find attached the standards for evaluating conditional uses.
11. This site plan review is running concurrent with a conditional
use request. The deadline to submit amended plans is March 22,
1993 prior to 5:00 P.M.

drawings of the elevation views of each side of all buildings and

match the elevations shown in the documents that where submitted for

identified. The title block of the original drawing shall be shown. The

Sec. 11,
13. Parking spaces required in this ordinance for one use or
structure may be allocated in part or in whole for the
required parking spaces of another use or structure if quan-
titative evidence is provided showing that parking demand
for the different uses or structures would occur on different
days of the week or at different hours. Quantitative evi.
dence shall include estimates for peak hour/peak season
parking demand based on statistical data furnished by the
Urban Land Institute or an equivalent traffic engineering
or land planning and design organization. Quantitative
evidence may also include, where appropriate, field stud.

(g) Parking area interior landscaping. Off-street parking
areas shall have at least twenty (20) square feet of interior
landscaping for each parking space excluding those spaces
abutting a perimeter for which landscaping is required by
other sections hereof and excluding all parking spaces
which are directly served by an aisle abutting and running
parallel to such a perimeter. Each separate landscaped area
shall contain a minimum of twenty-five (25) square feet and
shall have a minimum dimension of at least five (5) feet and
shall include at least one tree having a clear trunk of at
least five (5) feet, with the remaining area adequately
landscaped with shrubs, ground cover or other authorized
landscaping material not to exceed three (3) feet in height.
The total number of trees shall not be less than one for each
five hundred (500) square feet or fraction thereof of required

way. On the side of a building or open lot use providing an
off-street parking area or other vehicular use area, where
such area will not be entirely screened visually by an
intervening building or structure from any abutting
right-of-way, excluding dedicated alleys to the rear of
building, there shall be provided landscaping between such
area and such right-of-way as follows:
(1) A strip of land at least five (5) feet in width located
between the abutting right-of-way and the off-street
parking area or other vehicular use area which is
exposed to an abutting right-of-way shall be land-
scaped. such landscaping is to include a minimum of
one tree for each forty (40) lineal feet or fraction
thereof. Such trees shall be' located between the
abutting right-of-way and off-street parking area or
other vehicular use area and shall be planted in a
planting area of at least twenty-five (25) square feet
with a dimension of at least five (5) feet. In addition, a
hedge, wall, or other durable landscape barrier of at
least three (3) feet in height shall be placed along only
the interior perimeter of such landscaped strip. If such
durable barrier is of nonliving material, lor each ten
(10) feet thereof, one shrub or vine shall be planted
abutting such barrier along the street side of such
barrier. The remainder of the required landscaped
areas shall be landscaped with grass ground cover or
other landscape treatment.

(h) Point of access. When an access way intersects a public
right-of-way or when the subject property abuts the
intersection of two (2) or more public rights-of-way, all
landscaping within the triangular areas described below
shall provide unobstructed cross-visibility at a level between
thirty (30) inches and six (6) feet, provided, however, trees or
palms having limbs and foliage trimmed in such a manner
that no limbs or foliage extend into the cross-visibility area
shall be allowed, provided they are located so as not to
create a traffic hazard. Landscaping, except required grass
or ground cover, shall not be located closer than three (3)
feet from the edge of any accessway pavement. The
triangular areas above referred to are:
(1) The areas of property on both sides of an accessway
formed by the intersection of each side of the
accessway and the public right-of-way line with two
(2) sides of each triangle being ten (10) feet in length,
(or more when determined to be necessary by the city
engineer) from the point of intersection and the third
side being a line connecting the end of the other two
(2) sides.
(2) The area of property located at a corner formed by the
intersection of two (2) or more public rights-of-way
with two (2) sides of the triangular area being
thirty-five (35) feet in length along the abutting public
right-of-way lines, measured from their point of
intersection, and the third side being a line connecting
the ends of the other two (2) lines.
APPENDIX A-ZONING
Sec. 11.2
D. STANDARDS FOR EVALUATING CONDmONAL USES.
The planning and zoning board and city commission shall con-
sider only such conditional uses 88 are authorized under the
terms of these zoning regulations and, in connection therewith,
may grant conditional uses absolutely or conditioned upon the
faithful adherence to and fulfillment of such restrictions and
conditions including, but not limited to, the dedication of prop-
erty for streets, alleys, recreation space and sidewalks, as shall
be determined necessary for the protection of the surrounding
area and the citizens' general welfare, or deny conditional uses
when not in harmony with the intent and purpose of this section.
In evaluating an application for conditional use, the board and
commission shall consider the effect of the proposed use on the
general health, safety and welfare of the community and make
written findings certifying that satisfactory provision has been
made concerning the following standards, where applicable:
1. Ingress and egress to the su bject property and
proposed structures thereon, with particular reference
to automobile and pedestrian safety and conven-
ience, traffic flow and control, and access in case of
fire or catastrophe.
2. Off-street parking and loading areas where required,
with particular attention to the items in subsection
D.l. above, and the economtc. glare, noise, and odor
effects the conditional use will have on adjacent and
nearby properties, and the city as a whole.
3. Refuse and service areas, with particular reference to
the items in subsection D.l. and D.2. above.
4. Utilities, with reference to locations, availability, anti
compatibility.
5. Screening, buffering and landscaping with reference to
type, dimensions, and character.
6. Signs, and proposed exterior lighting, with reference to
glare, traffic safety, economic effect, and compatibility
and harmony with adjacent and nearby properties.
7. Required setbacks dnd other open spaces.
8. General compatibility with adjacent propertiee. and
other property in the zoning district.
9. Height of buildings and structures, with reference to
compatibility and harmony to adjacent and nearby
properties, and the city as a whole.
10. Economic effects on adJacent and nearby properties, and
the city as a whole.
11. Conformance to the standards and requirements which
apply to site plans, as set forth in Chapter 19, Article' n of
the City of Boynton Beach Code of Ordinances.
12. Compliance with, and abatement of nuisances and hazards
in accordance with the performa&Jce standards section 4 of
the zoning regulations; also, confor .nance to the City of

process, is in fact a requirement of the City's parking lot regula-
tions and shall be submitted during the permit review process. I
recommend that the applicant submit plans for this review as soon as
possible so that when the applicant intends to construc~ they will
not be delayed by having to design and/or reconfigure the entire site
in order to provide adequate site lighting.

Staff has reviewed the plan and offer the following comments:
1. The stub of the north line running to the east,
terminating in a plug at the building foundation is
undesirable. We recommend a 6" 900 bend be used in
lieu of a 6"x 6" tee and the building being served from
the east (Sec. 26-16[a]).
2. Clean outs shall be spaced at a maximum of 75' on the
sanitary sewer service (Standard Plumbing Code).
3. The fire hydrant to the east is labeled F.E. Verify if
this is a fire hydrant. Hydrants must be within 200'
of any part of the building (Appendix C, Art. X, Sec.
16 ) .
4. The applicant shall revise all the utility easements to
reflect a new easement 12' wide centered over new water
mains and easements abandoned where mains are
abandoned. Site plan shall depict these easements
(Sec. 26-13[a]).
5. Plan shall depict the dumpster pad raised above
surrounding grades to eliminate acceptance of storm
water into the sanitary sewer (Sec. 26.80).
6. Applicant shall shift the water main away from the menu
board and playground. Structures are not allowed
within easements (Appendix C, Art. VIII, Sec. 9).
7. Applicant shall add City Criteria for clean out detail
in pavement and riser connection detail (Sec.
26-33[b]). See details attached.
8. Water service is to be furnished and installed by the
applicant including pipe, valves, meter box and
connection (Sec. 26-31).
9. Plan shall contain the note, "City of Boynton Beach is
responsible for operation and maintellance of main line
sanitary sewers only". This is consistent with the
remainder of the development.
~o. Irrigation water shall be provided by well (City
Comprehensive Plan Policy 30.3.4).
11. Horizontal conflict detail shall show 18" clearance per
Health Department Separation Statement.
12. The meter box, 17" x 30", shall be CDR System or equal
per current criteria (Sec. 26.33[b]).
13. Health Department permit is required (Sec. 26-12).

POLYVINYL CHLORIDE PIPE (PVC)
PART 1 - GENERAL
1.1 DESCRIPTION OF WORK:
A. The extent of Polyvinyl Chloride Pipe (PVC) is shown on
the drawings.
B. Related work specified elsewhere:

PART 2 - PRODUCTS
2.1 POLYVINYL CHLORIDE PIPE
A. Pipe shall be unplasticized polyvinyl chloride (PVC)
plastic pipe with integral bell containing a locked-in
ring and spigot joints for gravity sewer construction,
4 inch through 12 inch.
B. Pipe shall meet the requirements of AWWA C900
(Polyvinyl Chloride (PVC) Pressure Pipe", class 150 and
shall meet the requirements of DR18. PVC compound for
pipe and fittings shall meet the requirements of ASTM
01784.
C. Fittings shall be class 150 and conform to the
requirements of DR18, designed to withstand a minimum
of 744 PSI quick burst pressure at 73 F, tested in
accordance with ASTM 01599. Bells shall be gasketed
joint conforming to ASTM 03139 with gaskets conforming
to ASTM F477. Ductile iron or cast iron push-on joint
or M.J. (long body only, conforming to ANSI A21.10,
AWWA Cl10) will be allowed as alternative when PVC
sizes are not available. Fittings shall be as
manufactured by The Harrington Company, Scepter Mfg.
Co., LTD, or approved equal.
