Building: 3,637 square teet
DESCRIPTION OF PROJECT: VSB Ltd., the owners of the Shoppes of
Boynton, are leasing an existing vacant outparcel site to the
owners ot PolIo Tropical. The owners ot PolIo Tropical are
requesting conditional use and site plan approval to develop the
leased site into a three thousand six hundred thirty-seven (3637)
square teet, one hundred (100) seat, drive-through restaurant. The
site includes a fenced exterlor playground area located on the east
side of the building and a drive-thru lane that begins at the
southwest corner ot the buildlng and extends around to the
northeast corner of the building with the tood pick-up window
located on the east side ot the building. The one hundred (100)
seat restaurant requires forty (40) parking spaces. The forty (40)
spaces are provided at the site as a result of the Shoppes of
Boynton deve~opment recelvlng approval to use shared parking as an
03.1 ternate method to providing the required number of parking
spaces. Wilen uSlng shared parking as specified ln Appendix A-
ZOlling, Sectlon 11.H.13, a ten (10) percent buffer of parking
spaces shall De provided above the number at spaces required as a
result ot lmplementing the computations specitied ln the code. The
entlre development lncludlng the proposed restaurant has
approxlmately a torty-seven (47) to torty-eight (48) percent
parking space butter. The parking stUdy specifies that 839 spaces,
which includes the 10% buffer, will meet the parking demand for the
project. Tnere are 1125 parking spaces provided at the project. The
Technlcal Review Committee had no objectlons to the revised parking
study. The archltectural style and color of the proposed building
blends wlth the theme ot the existing shopping center, however, the
architectural style and color do not comply with the applicable
deslgn district as detined in the Communlty Design Plan. The
Shoppes of Boynton slte is located in the Coastal Village Design
Dlstrict. The design of the proposed building complies with the
HediterraneanjSpanlSh Design district specifications. Glen
Rozansky, Agent for Pollo Tropical, is requesting an appeal to the
Comrnunlty Design Plan architectural design theme requirements. Mr.
Rozansky requests the Board to consider approval of the appeal to

allow the design ot the PolIo Tropical building, as shown on the
site plan drawings, be acceptable for the subj ect site. See
attached Exhibit "A", Community Design Plan Appeal. The new
buildlng has toundatlon landscaping. The foundatlon landscaping is
not required by the Landscape Code. The required interior parking
area landscaplng wlll be incorporated into the landscape permit
plans. Very little of the existing landscape material around the
perimeter ot the shopping center will be changed. The existing
material that must be moved as a result of the construction of the
new tacillty will be relocated within the Shoppes of Boynton site.
SURROUNDING LAND USES AND ZONING (SEE ATTACHED LOCATION MAP):
Jillutting the property to the north across the L-21 canal is a two
story mUlti-family residential project which is zoned Planned Unit
Development (PUDl. The property east of the shopping center is a
vacant site zoned Planned Industrial Development (PID). Abutting
the property to the south and across Gateway Boulevard is an
industrlal project which is zoned Planned Industrial Development
(PID) . The property west of the subj ect property and across
Congress Avenue is a three story multl-tamily residential project
that is zoned Planned Unit Development (PUD).
PROPOSED USE: The three thousand six hundred thirty-seven (3637)
square toot drlve-through restaurant which has an outside
playground area lS required by Section 6.B.1.11. and 1A of the
Appendix A-Zoning Code to receive Conditional Use Approval. The
requirement for conditional use evaluation is placed on the
restaurant use because the restaurant offers drive-through food
pick-up. The operating hours tor the restaurant use are:
11:00 AM to 10:00 PM Monday thru Thursday
11:00 AM to 11:00 PM Friday, Saturday and Sunday

STANDARDS FOR EVALUATING CONDITIONAL USES: The Planning and Zoning
Board and City Commission shall consider only such conditlonal uses
as are authorized under the terms of these zoning regulations and,
in connection therewith, may grant conditional uses absolutely or
conditioned upon the conditions including, but not limited to, the
dedication ot property tor streets, alleys, recreation space and
sidewalks, as shall be determined necessary for the protection of
the surrounding area and the citizens' general welfare, or deny
conditional uses when not in harmony with the intent and purpose
ot this section. In evaluating an application for conditional use,
the Board and Commission shall consider the effect of the proposed
use on the general health, safety and welfare of the community and
make written tlndings certitying that satisfactory provision has
been made concerning the tollowlng standards, where applicable:
Note: Following the standard is a brief analysis ot the overall
slte as it relates to the standard.
1. Ingress and egress to the subject property and
proposed structures thereon, with particular reference
to automobile and pedestrian safety and convenience,
traffic flow and control, and access in case of fire
or catastrophe.
Ingress to the site tor north bound traffic is by way of a
driveway located at the northwest corner of the project. This
driveway is also an egress for north bound traffic only. A
median on Congress Avenue will require south bound traffic to

center and exit the site by way of a major driveway located on
Quantum Boulevard that leads traffic to the front of the movie
theatre. On site access aisles allow traffic to enter and exit
the parking spaces located around the perimeter of the
proposed restaurant and the one-way drive-through traffic
lane. Two (2) on site sidewalks allow pedestrian access to the
proposed building. One sidewalk intersects congress Avenue
right-ot-way and the other intersects Quantum Boulevard right-
ot-way.
2. Off-street parking and loading areas where required, with
particular attention to the items in subsection labove,
and the economic, glare, noise, and odor effects the
conditional use will have on adjacent and nearby properties,
and the city as a whole.
The oft-street parking area already exists as part of the
existing Shoppes of Boynton (Shopping center). The existing
parking will be modified slightly to accommodate the new use.
A new loading space is being constructed for the delivery of
goods to the restaurant. The loading space is positioned east
of the new building between the movie theatre and the new
building. The delivery ot goodS to the proposed restaurant
will take place daily 8:00 a.m to 11:00 a.m. and 2:00 p.m. to
5:00 p.m.
3. Refuse and service areas, with particular reference to the
items in subsection land 2 above.
Refuse storage will be provided for the proposed use by way of
a block walled dumpster enclosure. The enclosure will be
constructed tive (5) feet west of the existing dumpster
enclosure. The new dumpster enclosure will be located west of
the theatre building and directly south ot the existing six
(6) toot high buffer wall. The dumpster enclosure will have
gates and be constructed six (6) feet high.
4. utilities, wlth reference to locations, availability, and
compatibility.
The existlng utilities will be adequate to serve the new use.
5. Screening, buffering and landscaping with reference to
type, dimensions, and character.
The existing shopping center site has a six (6) foot high
bufter wall that was installed along the perimeter of the
north side of the S110ppJ.ng center. The wall was installed
consistent with the zoning code as the buffer wall required to
separate the shopping center (commercial, C-3) from the multi-
family residential development ( Planned Unit Development)

Trees were installed along the wall on both sides to enhance
the aesthic vJ.ew and provJ.de additional buffering along the
north property line. The trees are not code required
landscaping. See the attached Exhibit "C" which is a plan view
ot the butter wall and landscaping. The residential
structures north of the project are located approximately one
hundred ten (110) teet north of the buffer wall.

6. Signs, and proposed exterior lighting, with reference to
glare, traffic safety, economic effect, and compatibility
and harmony with adjacent and nearby properties.
The following signs are proposed tor the new use: Three wall
signs, a d1rectional slgn and a menu board. The menu board
with speaker is located on the east side of the building and
east of the playground area. The directional sign is
positioned at the entrance to the drive-through lane. All of
the signs are in compliance wlth the specifications identified
in the Sign Code. The city recognizes the proposed signage as
a logo of the chain restaurant. The exterior lighting attached
around the perimeter of the build1ng is of an ornamental type
with the exception of the flood lights. See comment number 11
ot the Plannlng and Zoning Department memo. The site lighting
in the parking area is existing with the exception of three
(3) lig11t poles that are being slightly moved into new
landscape areas.
7. Required setbacks and other open spaces.
The proposed building setbacks comply with the setbacks
specified in the C-3 zoning district.
8. General compatibility with adjacent properties, and
other property in the zoning district.
The proposed drive-through food take-out restaurant is
compatible with the drive-through restaurant at a shopping
center located southwest of the Shoppes of Boynton and there
are drive-through restaurants located in other c-3 zoning
d1stricts 1n the City.
9. Height of buildlngs and structures, with reference to
compatibility and harmony to adjacent and nearby properties,
and the city as a whole.
The thirty teet tour inches (30 I 4") height of the proposed
building supports a one story structure. The basic height of
the structure is twenty feet eight inches (20 18") with a
twelve feet lJY twelve feet tower that is located at the
southwest corner of the proposed building. The overall height
ot the tower is thirty teet tour inches (30' 4"). The height
ot the building is compatible with the surrounding buildings
and the city as a whole.
10. Economic effects on adjacent and nearby properties, and
the city as a whole.
The proposed restaurant may be used by adj acent property
owners and other citizens of the city.
11. Conformance to the standards and requirements which apply
to site plans, as set forth in Chapter 19, Article II of the
City of Boynton Beach Code of Ordinances.
This proJect conforms to the standards and requirements which
apply to site plans as set forth 1n Chapter 4, Part III, Code
of Ord1nances - Land Development Regulat10ns 1 through 13.

12. Compliance with, and abatement of nuisances and hazards
in accordance with the performance standards section 4 of
the zoning regulations; also, conformance to the City of
Boynton Beach Noise Control Ordinance.
The site shall be maintained In compliance with performance
standards and the noise control ordlnance.

The Planning and Zoning Department recommends that the

working drawings to the Building Department for permlt review

This memorandum shall also serve as formal notification to the
applicant that some of the site details do not comply with minimum
City standards, including the submission of a site lighting plan
which does not comply with minimum City standards regarding lateral
wind load certifications and photocell activation. The aforementioned
deficiencies will be addressed during the permit review process, at
which time full compliance must be obtained prior to issuance of

The Building Department supports the granting of a Conditional
Use Permit for the above subject project. After reviewing the
submitted site plan, we offer the following comments which need
to be addressed or clarified:
1. If they are not a registered trademark, the logo signs must
match the project sign program.
2. The lighting numbers comply with our code with the existing
poles. However, the Police Department needs to approve the
illumination on the wall, which makes compliance with the
code possible.
3. Downspouts are only shown on the east elevation with a note
to see roof plan for size and location; however, no roof
plan was submitted to review for code compliance.
4. Show proof of the ratio of handicapped parking, per code.
5. Please explain the disposition of the Palm Beach County
mobile unit facility.

The amended plans tor the above referenced project have been
submitted and reviewed. The tollowing comments are either comments
trom the origlnal set of comments that were not satisfactorily
corrected on the amended plans or were generated as a result of the
review of amended plans. All comments shall be corrected. However,
since correcting the deficiencies will not result in a substantial
change in the layout ~f the site, it is acceptable to show
campI iance wi t11 the outstanding comments on the plans that are
required to be submitted to the Building Department tor permit
review. The applicant must understand that the following comments
are comments generated for Site Plan Review and that additional
comments may be forth coming as a result of the review of the
working drawings and documents submitted to the Building Department
for permits. All permit documents are reviewed for compliance with
the applicable requirements specified in the Boynton Beach Code of
Ordinances.
1. Add to Sheet MSI a tabular summary of the parking calculations
tor the entire shopping center site lncluding the PolIo
Tropical site. Show all code specitied computations and ratios
needed to ldentify the total number ot regular and handicapped
parking spaces required for the entire project. Include the
language in the shared parking study that verities the study
15 valid and complies with City Code Section 11.H.13.
~. A field visit to the site indicates that the last paragraph on
Page 11 ot the parking study is incorrect. Modify the report
to the numbers identified below and incorporate same into the
parklng calculations or provide documents that verify the
numbers ln the report are accurate. The total number of
parking spaces prOVided at the project is 1107. Modification
to the existing project for the new Pollo Tropical site allows
for 18 addltional parking spaces to be added to the project.
Therefore, the new total number of parking spaces provided at
the project is 1125, which results in a space buffer of 47.5%.
3. The new site has created a net increase of 24 internal parking
spaces. Add to the landscape plan the calculations and figures
ti1at lndicate how the required interior landscaping
specifications are belng prOVided tor at the site. On the
landscape plan show and identify with a distinguishable symbol
the location of the required interior landscape area, the
required trees and the other landscape material that will be
lnstalled over the required inter lor landscape area. Show with
a distingulshable symbol where fifty (50) percent of the total
number of required trees are a native species and show in
numbers where a total of not less than fifty (50) percent of
the total number ot the other required interior landscape
material will be a native species.

4. A field VIsit to the site indicated that the proposed
landscape plan does not correctly identity and show the
existing landscape material that must be relocated to
construct the proposed improvements. Show with a
distinguishable symbol and list by name allot the existing
landscape material that must be moved and specify to where on
site the existing material will be relocated. Note: Relocating
existing lanascape material on the site shall not cause the
eXIsting SIte to become non-conforming with regards to
landscaping required by the landscape code.

Village design theme specifications or receive approval of a
Community Design Appeal regarding design theme requirements.
10. The proposed use is designated as a conditional use and shall
be evaluated consistent to the requIrements identified in
Section 11.2 ot Appendix A-Zoning of the Code of Ordinances.
11. For traffIC satety, I recommend that a twenty (20) foot long
stacking space be identified and shown on the site plan
located between the tront ot the vehicle that is positioned at
the pick-up window and ~he stop sign located at the end of the
drive-through lane. Note: The view to the west shall allow
unobstructed VIew of on coming vehicles.
12. To eliminate glare to the adjacent residential developments,
I recommend removing all of the wall mounted flood lights
proposed tor the parapet wall around the perimeter of the
building.
13. To enhance the aesthetic view of the north elevation of the
building, I recommend planting a minimum of three (3) native
palms in the landscape strip located directly north of the
building. Note: The placement of the palms shall not obstruct

APPENDIX II. BOYNTON BEACH COMMUNITY DESIGN
PLAN STANDARDS
. All applicable projects shall comply with the design standards
as follows:
(a) New projects. New projects shall comply with the site plan
review process contained in Chapter 19. Plans submitted
for review shall show and identify a minimum of one (1)
type of finish roofing material and one (1) type of exterior
wall finish material from the appropriate architectural style
list. Alternately, the applicant may submit to the commu.
nity appearance board, materials that are harmonious with
the required architectural style for roof and exterior wall
covering material. Submitted plans shall also incorporate
at least fifty (50) per cent of the architectural features and/or
treatments identified on the appropriate architectural style
list into the design of the building, or show architectural
features and/or treatments that are harmonious with the
required architectural style.
(b) Modifications to existing projects. All other projects which
must comply with the community design plan shall show
and identify on the plans submitted for review a minimum
of one (1) type of finish roofmg material and one (1) type of
exterior wall finish material from the appropriate archi-
tectural style list or present to the community appearance
board, materials that are harmonious with the required
architectural style for roof and exterior wall covering ma-
terial. Submitted plans shall also incorporate at least
twenty-five (25) per cent of the architectural features and/or
treatments identified on the appropriate architectural style
list into the design of the building, or show architectural
features and/or treatments that are harmonious with the
required architectural style.
(c) Architectural amenities. All projects subject to compliance
with the community design plan may choose an architec-
tural amenity from the appropriate architectural style list
or present amenities that are harmonious with the re-
quired architectural style and incorporate the amenity into
the site and receive credit as a required architectural fea.

very high quality. which is the image lhat we want to portray. ..

have opened: our appeal has been especially strong with families. We need lhe

format, It is an essenlial component. We cannot proceed without it.
With respect to some of the other specific standards used for evaluating conditional
