CALL TO ORDER
Chairman Powell called the meeting to order at 6:30 p.m. The Recording
Secretary called the roll. Mr. Oyer sat as a voting member of the Board.
AGENDA APPROVAL
Chairman Powell requested Old Business be changed to Unfinished Business.
Chairman Powell added Item a, under Unfinished Business, "Status of Thank you
Letter to Mrs. Sam Scheiner".
Motion
Mr. Oyer moved to approve the agenda as amended. Mr. Richter seconded the
motion which carried 5-0.

UNFINISHED BUSINESS
A. Update on Downtown Development Coordinator Position
City Manager Miller introduced Ann Ford who is the new Downtown Development
Coordinator. Today was her first day of work and she networked inside and out-
side of City Hall. She will be contacting each of the members of the Board to
talk about the downtown redevelopment efforts. City Manager Miller stated that
Ms. Ford brings with her a great deal of enthusiasm and determination.
B. Status of Thank You Letter to Mrs. Sam Scheiner
Chairman Powell advised that many months ago, the Board requested a letter be
sent to Mrs. Sam Scheiner expressing appreciation for Mr. Scheiner's years of
service on the Board. That letter was to have been prepared and presented to
the Board for individual signatures; however, that has not been done.

Mike Haag made the presentation. He used the overhead projector to display the
location map.
This site is located at 101 North Federal Highway and is in the Central Business
District. The land use plan designation is mixed use. The proposed use is a
retail food store. The existing building will not change in size.
The applicant is proposing a Coastal Village look by incorporating the elements
of the Community Design Plan. There are two accesses into the parking lot; one
on Ocean Avenue and the other is from the 20' City alley. New landscaping will
be added around the site and both rights-of-way. The retail food use requires
additional parking over and above that of the old service station. Further, the
occupancy changed to merchantile and, therefore, the site must be brought up to
the current Code. In addition, the Community Design theme (Coastal Village)
must also be applied.
Mr. Haag advised that Mr. Eichorst was concerned with the location of the pro-
posed dumpster location. Staff worked on this situation and arrived at a deci-
sion to move the dumpster from the northeast corner to the southwest corner of
the parcel.
Mr. Oyer advised that for many years, a dumpster was located at the rear of the
building next to the alley. The City had no problem with that. By moving it to
this proposed location, it will be in the public view. He feels the City should
be able to do a better job of maneuvering the trucks. If the truck enters from
Federal Highway, they would need the dumpster in the northeast corner; however,
if they entered from 4th Street, they should be able to service the dumpster in
the rear and it would be out of public view. Mr. Haag pointed out that the
dumpster in the alley was on Mr. Oyer's property. Mr. Oyer said he paid for
one-third of it for use by his tenants, but it was on a concrete apron.
Chainman Powell feels the new proposed location of the dumpster will create even
more problems for servicing than the location in the northeast area. Mr. Haag
explained that Mr. Eichorst had many concerns with the other locations. He
wants the dumpster on this site so that it can be serviced completely within the
site. Accidents have occurred in areas where dumpsters are located too close to
the rights-of-ways. Mr. Haag advised that the Board has the right to make a

Ms. Heyden advised that Mr. Islam was present earlier. but left the meeting.
She advised that this is a request to convert the existing station to a con-
venience store. The change in use requires that this site be brought up to
current Codes. This will involve parking improvements. landscaping. driveway
modifications. l1ght1n~ and a dumpster.
The dumpster enclosure was the major topic of discussion. The Community
Redevelopment Advisory Board unanimously recommended approval with recommen-
dations. One of the recommendations was regard1ng the location of the dumpster.
They recommended the dumpster remain where 1t currently encroaches the alley a~
the northwest corner of the building as opposed to the Public Works Director's
recommendation that it be located adjacent to the south side of the building.
Bob Eichorst, Public Works Director, said that if the dumpster is located in the
northeast corner where it was originally placed. the trucks would be 10' from
the curb. The trucks would have to back into Federal Highway approximately one

and one-half feet to exit the site. With regard to the location in the alley,
if a truck pulls in with a car following, a stacking problem could be created on
Federal Highway. The problem with the northwest corner is that there is only 71
from the building to the alleyway. The enclosure requires 101.
Vice Mayor Aguila stated he would support the site proposed on the site plan
with the dumpster located on the south side of the building on the west side of
the site. Vice Mayor Aguila asked if the applicant would be agreeable to the
dumpster layout. Ms. Heyden said the applicant would be agreeable to that site.
In response to Vice Mayor Aguila's question, Ms. Heyden advised that the appli-
cant does not want a freestanding sign. Mr. Eichorst confinmed that it was
recommended that the applicant not erect a sign and he was agreeable.
Vice Mayor Aguila requested clarification of Mike Haag's Comment #2 in his
memorandum to Ms. Heyden dated November 4, 1993. Mr. Eichorst said there is a
2~1 overhang off the building on the south, east and north sides. On the north
side, there is only 7' left because of that 2~1. There is no overhang on the
west side of the building. Vice Mayor Aguila would like the roof wrap all the
way around the building. Mr. Eichorst said an overhang would encroach the prop-
erty line.
Vice Mayor Aguila will not support placing the utilities underground because it
is unrealistic. He feels it is an unnecessary expense. Mayor Hanmening agreed.
Ms. Heyden advised that the applicant has not met all the requirements of the
Community Design Plan. He was supposed to have turned in a drawing this evening
prepared by George Davis to show lattice work. Vice Mayor Aguila feels the
building is busy enough. Vice Mayor Aguila expressed concern about making
suggestions since the applicant was not present; however, it was suggested that
the conditions be made and the applicant could come back before the Commission
if he had a problem.
Vice Mayor Aguila suggested asking the applicant to agree to limiting the use of
his total glass area to no more than 15 percent to 20 percent for advertisements
(beer sales, lotto). Further, there are to be no outside banners.
With regard to the back-up distance of 271, Vice Mayor Aguila feels this should
be reduced to 24', using the remaining 31 for green area on Federal Highway. He
asked that this change be incorporated in this plan.
Motion

Vice Mayor Aguila moved to approve, subject to the comments made here this
evening with the elevation as presented, the colors as presented, no underground
power, 24' back up, dumpster as shown on the overhead, and any other staff c~~-
ments. Commissioner Katz seconded the motion.
Mayor Pro Tern Matson pointed out that the applicant is to be aware that the City
Commission does not want to see this front junked up. ~
The motion carried 5-0.

Mr. Richter noted that the enclosure was 12' x 121. The right-of-way between
the building and the alley is only 10'. He assumed that is why the enclosure
was moved. Mr. Haag stated Mr. Eichorst prefers lZ1 x 121 for a dumpster
enclosure.
Mr. Oyer suggested recommending that the dumpster be on the northwest corner
where it was previously and waive some of the requirements on the footage or
landscaping if necessary. This will provide a better image to the community.
Mr. McEwen agreed with Mr. Oyerls recommendation.
Mr. Haag explained that in the Central Business District, it is unique to make a
site meet the Code because of the Community Design Plan and the Central Business
District guidelines. The architect, George Davis, has done a very good job in
mixing the landscaping to meet the Plan and the guidelines. Mr. Davis worked
with the landscaping people who are working on the Ocean Avenue project, and his
material will blend in with that landscaping material.
This site will require a parking lot variance because of the distance the drive-
way is located from Federal Highway. That request for variance will go before
the Planning and Development Board for consideration on Tuesday evening. The
Planning and Zoning Department and the TRC had no problem with that variance.
In response to a question from Mr. Oyer, Mr. Haag explained that there is an
ingress/egress on Ocean Avenue and an ingress/egress on the 201 wide City alley.
Mr. Oyer questioned why the applicant was required to landscape the apron on
U.S. #1. Mr. Haag explained that the survey showed this as no driveway entrance
on Federal Highway. Mr. Oyer suggested using the apron on Federal Highway for
ingress and having egress on Ocean Avenue with a right-hand turn only.
Mr. Haag said if a driveway were put on Federal Highway, the F.D.O.T. would have
to provide conceptual approval. If that approval was received, the applicant
would then have to seek a parking lot variance from the City. The applicant did
not request a variance for that location.
Mr. Haag advised that the colors of the building fall in line with the Coastal
Village Design theme. The extra features which were added to the roof, as well
as the siding and storefronts are consistent with the Community Design Plan.
The applicant is missing one exterior wall element, but plans to propose
something.
Mr. Haag explained that this site is located in the Coastal Village Design
District. The applicant must make his selections from the choices provided.
Mr. Oyer noted that the Coastal Village Design theme was waived from the
preschool for St. Mark's Church. He also thought there was discussion about
getting away from the rigidity of the Coastal Village theme. Mr. Oyer feels
this theme should be carried along the Intracoastal Waterway, but feels it is a
detriment to the town to require people to comply with this theme if they do not
want it. Mr. Haag explained that the Codes would then have to be changed.
Chainman Powell explained that the theme was waived on the preschool so that the
new construction would blend with the existing buildings.

Mr. Oyer feels that if the Planning Department is advising applicants that they
must follow this theme before the Board has an opportunity to review the appli-
cation, then the theme is locked in everywhere. He said this architectural
style was instituted ten years ago in anticipation of a marina which never
materialized. Mr. Haag advised that he is following the Code. Although Mr.
Cutro was working on changing the Community Design Plan, it is still in effect
and must be followed. Mr. Oyer feels something must be done in the future to
eliminate the requirement for the Coastal Village theme.
Mr. Richter feels the Coastal Village theme is not a bad idea and he used Bud1s
Chicken as an example of the excellent work they did on Boynton Beach Boulevard.
Kentucky Fried Chicken followed and did a beautiful job. Mr. Oyer's concern
centers around the City forcing business people to follow this theme. Mr. Haag
advised that a variance procedure is in place which the applicant can follow and
Mr. Davis is aware of that procedure. The applicant and his architect did not
choose that route.
The Planning and Zoning Department recommends approval of this request subject
to staff comments.
Mr. Richter feels the City should handle the stop sign as well as the paving of
the last 30' of the alley.
Shaf1Qul Isllm said he feels the original location of the dumpster was a much
better location than the one required by Public Works and he would prefer to
keep the dumpster where it was. Regarding the driveway on Ocean Avenue, the
City advised that was not allowed. They suggested he consult with F.D.O.T.
regarding a driveway on Federal Highway. He was told by F.D.O.T. that he could
have a driveway on Ocean Avenue and possibly one on Federal Highway.
Chainman Powell asked if Mr. I~lam was happy with the ingress and egress as pro-
posed. Mr. Islam said he was_happy with the proposal. If he seeks to change
the proposal, a great deal of time could be lost. He would prefer to get the
business started as soon as possible.
Chainman Powell explained that many of the requirements are mandated by Code.
Until those Codes are changed, there is nothing the applicant can do. Mr. Islam
said he did not realize there were so many requirements. Chainman Powell
advised him that he has an option to appear before other City Boards to seek
variances if he so chooses.
With regard to the entrance from U.S. #1, Mr. Oyer questioned whether the Board
had the ability to grant approval with a request that the Planning Department
see if it can be changed. If that is possible, the Board would waive its right
to review this application again. Chainman Powell advised that would be
possible.
Mr. Oyer feels the Planning Department should "carry the ball" in seeing whether
or not Mr. Islam can get the driveway entrance on Federal Highway since it ;s a
concern to the entire community.

DESCRIPTION OF PROJECT: Mr. Islam, the applicant and property
owner is requesting site plan review approval for the proposed
modifications to the 101 N. Federal Highway site. The. 24 acre
site is occupied with an existing one story 1,784 square foot
concrete block building. The previous use of the building was a
gasoline service station. At present time a gasoline service
station is a nonconforming use for the subject slte. The new use
is a retail food and beverage store. The existing structure will
remain in place with no increase in size.
Access to the site is by a two-way driveway on Ocean Avenue and a
two-way driveway on the twenty (20) foot wide City alley that abuts
the north side of the site. The following noteable changes are
proposed for the exterior of the building: block in existing
windows, overhead doors and door openings; install new doors and
new storefronts along the east side of the building, add wood board
& batten siding to the walls, apply decorative lamps on the walls
and install a standing seam sloped roof around the perimeter of
three sides of the building.
Note: most of the improvements to the project are a result of the
project showing compliance with the code requirements based on the
change in use from the previous service station to the new retail
store. The change of use resulted in additional parking spaces
being required.
The following colors proposed for the building and wall signage are
consistent with the colors identified in the Community Design Plan
and the Central Business District Guidelines: WaLls - wood, beige
and stucco, light yellow; Roof - roman blue; Wall Sign - dark
brown. The vehicle use area will be improved to comply with the
requirements of the parking lot code for construction material and
configuration of layout. The applicant has formally submitted an
application for a variance from the code requirement regarding the
distance the driveway on Ocean Avenue is located from US Highway #
1. The total number of parking spaces provided on-site exceeds the
number required for the new use. The plans indicate that the
installation of the site lighting fixtures will comply with
specifications listed in the central Business District Landscape
Code. A concrete block dumpster enclosure is proposed for the site
wi th . the color of the stucco finish matching the color of the
building. The landscaping proposed for the site will comply with
the code. Flowering trees and multiple species of plants and hedge
material are shown along the Ocean Avenue entrance to the site.
The Ocean Avenue driveway entrance has been coordinated with the
new Ocean Avenue streetscape improvement plans.

REVIEW OF STAFF COMMENTS: Find attached comments from all
reviewing departments. As indicated in their comments they
recommend the project proceed through the approval process subject
to the permit documents reflecting compliance with staff comments
and technical compliance with the City codes.
The concern regarding Memorandum No. 93-215 from the Director of
Public Works was rectified between the applicant and the director.
The solution was accomplished by moving the enclosure, The new
location is directly south of the building. The new location will
include a landscape island being constructed south of the
enclosure. The handicapped parking space that is shown on the
plans at the new enclosure location will be relocated to the front
of the building. The balance of the site will remain unchanged.
The total number of parking spaces will remain the same. This
change is minor and the permit documents will reflect the correct
location. Staff will w1tness the new location during the permit
review process. The new location was an alternate location
discussed by the Technical Review Committee during the review
process of the project.
A conflict has arisen regarding the responsibil ty of the road
improvements for the twenty (20) foot wide City alley that borders
the north side of the site and the time that the work shall be
completed. The Deputy City Engineer's comment No. 4 from
memorandum No. 93-310 states that the property owner shall be
responsible for making improvements to the alley prior to the new
business opening.
The consensus of the Technical Review Committee is that the work
should be performed by the City. Memorandum Number 93-212 from Bob
Gibson of the Public Works Department states that the improvements
for the alley are scheduled for the new year and the job was given
a high priority. The part of the alley near the proposed driveway
is somewhat improved do to the Utilities Department working on the
utili ties in that area and repairing same. It is also possible
that the property owner may want to improve the alley prior to
opening the new store. It also should be noted that if the
property owner damages the existing alley as a result of making the
improvements to his site he will have to repair the damaged areas.
This conflict should be resolved during the board review of the
project.
RECOMMENDATION: The Planning and Zoning Department recommends
approval of the site plan review request subject to all staff
comments, with the exception of the requirement of the property
owner being responsible for improving the alley. The
recommendation for approval is also conditioned upon approval of
the parking lot variance for the location of the driveway on Ocean
Avenue.

The following is a list of comments regarding the 2nd review of the
above-referenced project. It should be noted that the comments are
divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the 2nd review. To show compliance with these comments will not
substantially alter the configuration of the site and the design of
the building except for comment Number 1. The applicant has made
a formal submittal to seek relief from the code requirements for
the comment.
The second set of comments is a list of recommendations I believe
will enhance the aesthetics and function of the project.
All comments can be rectified on the plans at time of permitting
considering that the request for Site Plan Review is approved and
the parking lot variance is approved. The applicant must
understand that add1tional comments may be generated upon review of
the documents and working drawings submitted to the Building
Department for permits for the proposed project.
1. The plans indicate an existing driveway located on Ocean
Avenue approximately forty-three (43) feet west of the intersection
of Highway #1. Section 5-142 (h) (3) Article X of the Parking Lot
Code requires that the driveway be located no closer than one
hundred eighty (180) feet to the intersection. An approval of a
Parking Lot Variance for driveway location is required prior to
approval of the site plan.
2. In order to be in compliance with the zoning district setback
dimensions, remove the new portion of the roof overhang that is
proposed for the north and south corners of the west side of the
building. The new roof overhang shall not extend past the face of
the west side of the existing building. Also, specify on the
elevation view drawing that the roof overhang along the north side
of the building will not exceed two (2) fee~.
3. Amend the typical parking space drawing of the handicapped
striping to be consistent with the City standard drawing B90012.
4. Specify on the site plan drawing, in note form, that the
overhead utility lines shown at the rear of the building will be
relocated to provide underground service to the building.
5. Correct the inconsistencies regarding the location of the
windows that are shown on the east elevation of the building and
the proposed floor plan.
6. On the elevation view drawings of the building specify the
color of the exterior door and window frames. I recommend using a
color harmonious with the color of the building.
7. On the site/landscape plan show and identify a code required
type of exterior furnishing. An example would be a decorative
bench, trash receptable, bollards and other related items. Adding
a decora.tive bench will comply with an architectural feature

8. After reviewing the amended plans, it has been determined that
they do not comply with the requirements of the Community Design
Plan regarding architectural features and/or treatments. Find
attached Appendix II of the Community Design Plan. Appendix II
sets forth the standards used to achieve the appropriate
architectural theme. Please observe the Coastal Village section of
the appendix. An asterisk has been placed next to the areas where
the project is shown in compliance with the code. The required
number of elements has been identified so that the applicant is
aware of where the proj ect is deficient. The applicant shall
understand that the wall accessory that is required to bring the
project into conformance with the design code will require separate
submittal for review by the Planning and Zoning Department, the
Community Redevelopment Advisory Board, and the Community
Redevelopment Agency prior to a permit being issued.
9. On the site/landscape plan identify the width of the required
landscape strip located at the northeast corner of the site. The
minimum width is three (3) feet.
10. Correct the inconsistency regarding the spacing of the hedging
required for the vehicle use area. The plant list specifies
twenty-four (24) inches on center and the notes identify eighteen
(18) inches on center. The minimum spacing required by code is
eighteen (18) inches. Also, add to the plant list the spread
specification for the hedge material. The minimum spread required
by code for hedge material is eighteen (18) inches. The code
reqUired height for the hedge material is twenty-tour (24) inches.
11. To show compliance with the streetscape requirements of the
Community Design Plan, omit the three (3) Black Olive trees shown
on the plan along us Highway #1 and Ocean Avenue and replace with
a species identified in Appendix III of the Community Design Plan.
Note: At least ninety (90) percent of all the trees on the site
shall be native species and all trees shall meet the tree
specifications identified in the Landscape code. See
recommendation No.1.
12. Specify on the site/landscape plan the surface material
proposed for the island shown in front of the south end of the
building.
13. The Coconut tree is not a native species. Correct the plan
accordingly.
RECOMMENDATIONS:
1. That the replacement tree species for comment No. 11 above be
compatible with the landscape material proposed for the new Ocean
Avenue streetscape landscaping as well as being a speCies listed in
Appendix III of the Community DeSign Plan. It is further
recommended that the tree species proposed along US Highway #1 be
selected from an approved list of trees to be planted under power
lines as well as a species listed in the Community Design Plan.
All trees shall meet the tree specifications listed in the
Landscape Code.
2. That the Community Redevelopment Agency consider exercising
the code regarding section 6 E 4. d. (2) of Appendix A - Zoning
[modifying requirements for parking and loading spaces].
Considering that the type of use generally results in a high number
of vehicles entering and exiting the site, the number of parking
spaces is more valuable than a loading space. The site has two
surplus parking spaces based on the thirty-five (35) percent
reduction of parking spaces allowed for uses located in the Central
Business District. Instead of omitting the surplus spaces and
arranging the site to depict a loading space, that more than likely
customers will over park, allow the surplus parking spaces to
remain as shown. It is possibly that the proprietor will
efficiently and economically operate the business by having
delivel:ies made during slow hours of operation.

(d) Colored elevations. All projects subject to compliance with
the community design plan shall submit elevation draw-
ings of all sides of each building proposed to be developed
on the site. Colored elevation drawings will only be re-
quired for the front elevation of a structure when all sides
of a building are consistent in color and materials. Each
colored elevation drawing shall identify the type of each
exterior fInish material and state the color by namt', man-
ufacturer and model or style number. A color sample shall
be submitted 88 an example along with the color or product
identified on the plans. The sample will be used for the
fmal site inspection to ensure that the correct product and
color were used for the project. For projects which require
site plan approval, all color elevation drawings and/or sam-

The Engineering Department has conducted a review of the amended
plans and has performed a site reconnaisance of the Supercity site.
Our comments are as follows:
Deputy City Engineer's Comments
1. The existing concrete approach along Ocean Avenue shall be
removed and a standard sidewalk constructed in it's place.
2. The sidewalk shall transition through the ingress/egress area
and be constructed at elevations which will facilitate the move-
ment of handicap persons through this area. The sidewalk area
through the approach shall be construqted with no less than 2500
psi concrete and be a minimum of six (6) inches in thickness.
3. Provide a "Stop-Sign" (Rl-l) at the intersection of the alley
at Federal Highway.
4. The site reconnaisance revealed that the last thirty (30') feet
of the east end of the alley is in need of repair, therefore, the
plans shall be revised to indicate the removal of weeds and sand,
removal of irregular asphaltic concrete mounds, adjustment of valve
covers including the overlaying of the subject thirty (30) feet of
alley with a minimum of Type II asphaltic concrete (1").
5. The "Handicap-stall" detail does not comply with the latest
edition of the Department on Community Affairs Accessibility Manual.
A copy of the detail may be obtained in the Engineering Department.
6. The site plan is devoid of suitable Parking Lot Lighting. Revise
plans to indicate the location of lighting standards.
7. A "No Left Turn" sign shall be placed where the alley intersects
Federal Highway.
8. Provide Environmental Test Data and other related technical infor-
mation regarding the condition of sub-surface soils which currently
exist in the area where the underground fuel tanks were situated.

Mr. Oyer feels that if the Planning Department is advising applicants that they
must follow this theme before the Board has an opportunity to review the appli-
cation, then the theme is locked in everywhere. He said this architectural
style was instituted ten years ago in anticipation of a marina which never
materialized. Mr. Haag advised that he is following the Code. Although Mr.
Cutro was working on changing the Community Design Plan, it is still in effect
and must be followed. Mr. Oyer feels something must be done in the future to
eliminate the requirement for the Coastal Village theme.
Mr. Richter feels the Coastal Village theme is not a bad idea and he used Bud's
Chicken as an example of the excellent work they did on Boynton Beach Boulevard.
Kentucky Fried Chicken followed and did a beautiful job. Mr. Oyer.s concern
centers around the City forcing business people to follow this theme. Mr. Haag
advised that a variance procedure is in place which the applicant can follow and
Mr. Davis is aware of that procedure. The applicant and his architect did not
choose that route.
The Planning and Zoning Department recommends approval of this request subject
to staff comments.
Mr. Richter feels the City should handle the stop sign as well as the paving of
the last 3D. of the alley.
Shaf1Qul Isl~ said he feels the original location of the dumpster was a much
better location than the one required by Public Works and he would prefer to
keep the dumpster where it was. Regarding the driveway on Ocean Avenue, the
City advised that was not allowed. They suggested he consult with F.D.D.T.
regarding a driveway on Federal Highway. He was told by F.D.O.T. that he could
have a driveway on Ocean Avenue and possibly one on Federal Highway.
Chainman Powell asked if Mr. I~lam was happy with the ingress and egress as pro-
posed. Mr. Islam said he was_happy with the proposal. If he seeks to change
the proposal, a great deal of time could be lost. He would prefer to get the
business started as soon as possible.
Chainman Powell explained that many of the requirements are mandated by Code.
Until those Codes are changed, there is nothing the applicant can do. Mr. Islam
said he did not realize there were so many requirements. Chainman Powell
advised him that he has an option to appear before other City Boards to seek
variances if he so chooses.
With regard to the entrance from U.S. #1, Mr. Oyer questioned whether the Board
had the ability to grant approval with a request that the Planning Department
see if it can be changed. If that is possible, the Board would waive its right
to review this application again. Chainman Powell advised that would be
possible.
Mr. Oyer feels the Planning Department should IIcarry the ball II in seeing whether
or not Mr. Islam can get the driveway entrance on Federal Highway since it is a
concern to the entire community.

Mr. Richter feels the improvements Mr. Islam will be making to the corner will
be a great improvement to the entire intersection with respect to aesthetics.
If he wishes a variance to the City Codes, and F.D.O.T. is agreeable to allowing
ingress and egress with a right turn from Federal Highway, he should be able to
do it without having to come back before this Board.
Mr. Islam is also opposed to moving the electrical service underground because
it is a very big job. He would prefer to keep the electrical service on the
pole. Chainman Powell noted a staff comment regarding the electrical service.
Mr. Haag advised that the Central Bus~~ess District Landscape Code requires the
service to be underground.
Mr. Richter questioned the cost of this requirement. Although Mr. Haag did not
know the exact amount, he felt this job would be quite costly. The applicant
and his architect have been aware of this requirement. If the applicant seeks
relief from this requirement, he will have to appear before the Board of
Adjustment for a variance.
Mr. Richter confinmed that because of the new site plan, Mr. Islam is required
to upgrade the site and everything must be brought up to Code.
Mr. Oyer further noted that at some point in the future, FPL or the cities may
eliminate electrical poles; however, he feels that until that time arrives, the
looks of the City are not being improved by making one person move the service
underground while another person is utilizing a pole. He suggested recommending
that this requirement be waived and forwarded to the Board of Adjustment.
Motion
Mr. Richter moved that the Board approve the site plan for Supercity Discount
Food and Beverage, agent/owner Mr. Islam, located at the northwest corner of
U.S. Highway #1 and Ocean Avenue, to modify an existing 1,784 square foot
building and 0.24 acre site to establish a retail store, with recommendations
that they waive the requirement for underground power and that the dumpster
location be along the alley right-of-way in front or to the rear of the building
and to also include the possible variance for entrances from Federal Highway and
Ocean Avenue as the present driveways exist. Mr. McEwen seconded the motion.
Mr. Islam said he spoke with Mr. Haag about benches in front of the store. He
is concerned that the benches in front might create a situation where people
will sit to drink a beverage and then throw their trash on the premises. He
does not feel these benches are a good idea outside of a grocery store.
Mr. Haag pointed out that the Landscape Code requires exterior furnishings. He
has the choice of a bench or trash receptacle. He must include one of those
elements. Chainman Powell explained that a trash receptacle outside the store
would be a welcome addition to the business. He reminded Mr. Islam of his
options.
The motion carried unanimously.
