Dear Mr. cutro;
lit the City Commission meeting of September 19, 1991, the
space Flus project was listed as Item Number V. A. 2, on the
consent Agenda. The project was unanimously approved by the
Planning and Zcning Board, and as appl1cant, I had .agreed to the
conditions.
At the meeting pUblic comments were requested. Mr. Kanonik,
who resides in Golf View Harbor, cpposed our project. He stated
that the proposed six foot boundary separation wall 6ho~ld be 12
feet for security purposes and butter screening. In view of his
concerns, I subsequently requested that our item be tabled until
the next city Commission meetin~, in order to assess the costs and
other aspects.
As you know, during the meeting the matter WaS discussed with
Mr. Kanonik and four other residents who attended the meeting. An
attempt was made to reach a mutual solution, when, at the
invitation of the Commission, we went out to the lobby to caucus
with them. However, the neighbors insisted that the wall be 12
feet in height.
our primary concerns are twofold; namely, have we provided an
adequate buffer, and whether it is financially feasible to
construct a 12 foot wall as part of the project.
The cost Of the presently desiqned six foot block wall, with
stucco on both sides, is estimated at $30.00 per foot, a total of
$12,000.00 for the 400 feet of wall. The cost of a 12 foot wall
is estimated at $l~O.OO per foot, a total of $60,000.00 for the 400
feet of wall. The higher cost is due to the fact that the 12 foot

The question becomes whether the expenaiture or an aaaitional
$~O/OOO is worth the improvement tor security and aesthetics.

consider 12 root enclosures on all three Sides, nor would it be
allowed t>y COde. Note also that our project is separated from the
resiaential district to the north by an BO foot wide canal, and any
attempt to enter will not be made by persons coming through the
Golr view flart>or SUbaivislon, and across the waterway. By the same
tOken, there is no reason for intruders to attempt to gain access
to houses in the SUbdivision by entering through our proposed
facJ.li ty and then scaling a wall.
As we developed our project in the planning stages { we
realized that appropriate buffer would be essential to screen the
north side. By code, Ii boundary separation wall is required to be
six feet in height, set back two feet from the property line, per
Appendix A - Zoning, Section 4, L., Buffer Walls. rurther, our
understanding was that SiK feet would be the maximum allowable
height.
In addition to this basic requirement we set the wall back 20
feet from the property line to provide more open space for the
residential neighborhood, and at the same time it lined up with the
existing wall of our self storage building. We proposed to stucco
the wall, and included the planting of vines five feet on center.
Further, we proposed planting nine Black Olive trees, eight feet
in height, outside the wall,over and above the City'S landscapin~
requirelnents. We felt that this would provide an acceptable
buffer.
In response to some concerns expl'essed at the Planninll and
Zoning Board meetinll, we notified 22 property owners in Golf view
Harbol' about our project. We arranged a meeting place at the
Holiday Inn in Boynton Beach, and. four Of the property owners
showed up. Their primary concern was screening. In an effort to
improve what we planned to do, we proposed the plantinq of 27 BlaCk
olive trees, 12 teet in height. our understandinq, as previously

noted, was that the wall oould not eKeeed ~iK teet, and thererore
could not be raised. As wa3 brought out at the City Commission
meeting, the wall oould be higher since it hod been ~et~cK to the
building eetback line. There wae a consensus of all who attended
our meeting, that our plan Was 0 mutual compromise, in an er!ort
to provide On appropriate buffer. For those not ramiliar witn tne
area, the noighbors have heavily l~ndscaped backyards.
To summarize our pOSition, we have proposed a legal use ror
the property, consistent with the city's land use policies. The
storage of vehicles is a passive activity comparea to some or tne
potential industrial uses that could be developea; tne list or uses
in the zoning code is several pages long, and incluaes
manuf<'lcturing and commercial uses. lIlso 1 we were required to
prohibit the storage or wreCked or junk veniCles. This is noted
as " condition on the site Plan. fUrther, we met with the
neighbors to try and s~~ls.y their concerns.

In order to resolve this latest impasse we are prepared to
con~truct an eight foot wall, with stuooo on the outside, complete
with planting of vines, five feet on oenter. Further, we will
plant Black Olive trees, 12 teet in height, with a crown spread Of
~lO feet, 20 feet on center the entire length of the wall. This
/' will present an attractive, well landscaped appearance for the
neighbors on the other side.

Leonard Kanonik, 1330 SW 28th Avenue, owns property on the canal.
He pointed out that in order to gain his approval, he would
insist a 12' high wall be constructed to block out the view from
his property and provide necessary security. He provided a com-
puter printout of crime occurrences in the last nineteen months.
He also stated he is currently working with the Engineering
Department with regard to a problem with drain off and oil
entering the canal.
Commissioner Matson questioned the existing buffer. Chris cutro
explained it is l2' and a variance would not be required because
the building is set back 20'. They have proposed a 6' block
wall. Commissioner Matson asked whether there would be a problem
making the wall 12' instead of 6'.

Jerry Church, Engineer, spoke on behalf of the applicant. He
explained they have complied with the Ordinance which requires a
boundary separation. The 6' block wall would be stucco on both
sides and set back 20'. Trees are proposed in that buffer area
as screening. As a result of a meeting with the residents, they
are planting 28 Black Olive trees to be spaced lS' on center,
staggered. Vines will also be provided 5' on center. He felt
they have satisfied the needs of most of the residents.
Mayor Weiner pointed out that Mr. Kanonik is concerned with
security, not aesthetics.
Commissioner Aguila questioned Mr. Staudinger about the drain
off. Mr. Staudinger explained that the Engineering Department
will be checking the drainage running into the canal and the
potential for pollution. The purpose for inspecting is to see if
there is anything broken or if anything has been removed. He
explained the system in question is the system for the existing
mini-warehouse. It is independent of the new system., There is a
staff.comment that the applicant supply the hydraulics on the old
system. Staff would have to be sure the applicant is not harming
the old system before they could approve it.
Don Cera, 1310 SW 28th Avenue, lives directly across from this
project. He had previously met with Mr. Holzer and stated they
were cooperative. However, he feels the agreement on trees was
made as a concession on screening. Mr. Cera is now concerned.
He believed the wall could be no higher than 6'. It was con-
firmed by Mr. Cutro that the wall could be higher than 6'. Based
on that knowledge, the residents requested the increased height
of the wall to 12' and asked that the planting of 27 trees be lS'
on center, 121 in height, 6" in trunk.
Mr. Church was surprised by the comments of the residents. He
thought all of this was settled. He had no knowledge of the

request for a 12' wall. He claimed they sacrificed 20' of pro-
perty to continue the existing wall to make it aesthetically
pleasing.
Mayor Weiner suggested Messrs. Church and Holzer leave the
Ch~mbers to discuss this information. (See continuation later in
the minutes.)
Commissioner Aguila pointed out that if the applicant decides to
build closer to the property line, the height of the wall will
get lower.

Florida, said he is the engineer that worked on the project.
He said letters were sent out to the residential property
owners to the north of the subject parcel. A meeting was
arranged to see if a mutually agreeable solution could be
reached. Only four owners attended this meeting. They were
_ adamant about having a 12 foot high wall along ~he rear of
the property line.
Mr. Church said adequate buffering has been provided in
terms of screening the facility from the other side of the
.property, and it is not financially feasible to erect a 12
foot high wall. In terms of security, he felt a 12 foot
wall on the north side is not going to enchance the security
of the project: that the potential problem is nqt going to -
come from the north side. He set the-boundary separation
wall back 20 feet from the property line, and provided
twelve foot trees to~reduce the impact of the wall it~elf.
He said the landscaping-was over and above what is required.
