I represent the owners of the ten acre tract of land, just
nor'lll 01' S.W. 30 Avenue at S.W. 14th Place, in the City of
Boynton Beach. The tract is 400 feet east of Congress Avenue
in the Lawson Industrial Park Development. The present
zoning is M-l, Industrial District.
The west six acres has been developed as a self storag-e
facility with a full Lime attendant. After due consideration

prohibiting parking of boats, l!':Jcks, vans and commercia!
vehicles in residential ar'eas. The ordinances in Boynton
Beach and the nearby Cities; Boca Raton, Delray Beach, and
the County; vary in content from completely prohibitin~
outside parking, in residential districts, except cars, to
requiring enclosures for parking of boats and vans. As a
result the residents must park their boats, trailers, vans
and tr':J.cks elsewhere. Also the man~' winter time residents
frequentl~' need addi lional space for their cars and boats.
which they bring with them dUI'ing the seasonal months. The
transient nature of the Brpa further creates a need for
convenient, nearby, open yard storage.
We determined that there are few open storage parking lots in
the City of Boynton Beach. The nearest one is in the County,
west of Congress Avenue. The~e is clearly a community need
for this type of facility.
The site is ideally suited for this use. It would be
accessed from the present entry to the self storage, off S.W.
14th Place, via S.W. 30th Ave and Congress Avenue. It is
completel~' sCI'eened to the west, and view, from Congress
Avenue by the existing self storage buildings. To the south
there are two office/warehouse complexes built next to the
tract. On the north side .is the LWDD Lateral Canal L-28.

The storage of junk vehicles would be prohibited. The
vehicle owners would nol be allowed to work on the vehicles

monitor and control the parking activities.

Please be advised that the plans submitted for site plan review
of the above-referenced request cannot be processed further as
the changes proposed do not meet the Parking Lot Regulations.
Also, due to the total cost of construction which is a minimum of
$100,000, this project must be forwarded to the Planning and
Zoning Board, Community Appearance Board and city commission. A
separate submission is required for the Community Appearance
Board; Mike Haag of the Building Department can be contacted for
details. sixteen sets of revised plans addressing the comments
below, as well as the attached comments from other departments,

Upon review of the above mentioned project, the folloWing list of
comments have been provided as a courtesy with the applicant's
knowledge that there will be a full review made when the project
is placed on a future Technical Review Board agenda.
1. The number of parking spaces required for the proposed use
will be established by the Planning and Zoning Board and
recommended for approval to the city Commission (Appendix A-
Zoning, Section 11.H.12). For verification of the surplus
parking existing on the site that is proposed to be applied
to the new outside storage area, add to the submittal the
approved site plan showing the existing parking spaces.

all storage units.
2. Incorporate into the drawings a typical partial elevation
view drawing of the chain link fence. Include on the
drawing the type and location of the adequate screening
required for open storage areas as specified in AppendiX A-
Zoning, Section 8.b.5. (13).

vehicles in a wrecked condition stored within the open

4. The required spacing for hedge material is two (2) feet on

7. State on the plans that the landscape material will be

material will be Florida #1 or better.

DESCRIPTION: Request submitted by Gerald B. Church,
representative for Mega Mini, Co. Ltd., for approval to construct
an outdoor vehicle storage rental lot. The project is located at
2951 S.W. 14th Place.
RECOMMENDATION: The Board unanimously recommend~d approval,
(7-0), of the project as presented subject to staff comments,
including but not limited to the following improvements that were
identified by the applicant to be incorporated into the site:
i. All trees will be twelve (12) feet in height with a six
(6) foot spread at planting
ii. The trees located within the fence area and along the
east property line will be mahogany (24 trees in total)
iii. A continuous Silver Buttonwood hedge will be planted
along the east property line
iv. Flame vine and Alamanda vine material will be
alternately planted five (5) feet on center along the
north side of the block wall that separates the site
from the residential zoned district to the north
v. Black Olive trees will be planted along the north
property line to continue the tree line that was
created when the existing project was built, with the
new trees being placed at the same spacing as the

drawing of the six (6) foot high block wall. Identify and
show the following wall information:
i. type, location and size of all vertical and
horizontal structural components,
ii. the distance the end of the wall and foundation are
from the east property line, and
iii. location and type of ground surface on both sides
of the wall and the overall height of the wall from
the ground surface.

In accordance with the City of Boynton Beach, Florida Code of Ordinances,
specifically Chapter 19, Section 19-17, "Plan Required" and Chapter 5, Article X,
"Boynton Beach Parking Lot Regulations", the applicant for the above referenced
project shall submit the following plan revisions, information and technical data.
1. Provide a site lighting plan which conforms to the requirements set forth
within Chapter 5, Section 5-l42(a), "Required Lighting". Lighting systems
shall be photocell activated and lighting standards shall withstand a
lateral wind load of 110 MPH (certification required). Section 5-142(g),
"Lighting Standards".
2. The construction detail for the proposed parking area shall conform to the
requirements as specified within Section 5-l42(g), "Storage Areas", which
requires a prime coat or material equal to or better, reference surface
applications.
3. Provide raised continuous concrete curbing where parking stalls adjoin
landscaped areas in accordance with Section 5-l42(e), "Required Curbing".
4. Delete note on Page 202 which indicates all construction shall comply with
the City of Delray Beach current standards and revise this note accordingly.
5. All swales shall be fully sodded and water quality calculations need to also
consider 2~ inches times the percent impervious.
6. There is a positive outfall, however, 3 year - 24 hour flood routing is
required to check for flooding in parking lots.
7. Impacts to existing drainage systems, in which the proposed system ties into,
needs to be documented. Provide calculations.
8. The applicant shall provide a copy of the Lake Worth Drainage Districe approval/
25 year storm will be stored prior to discharge into Lake Worth Drainage District.
Show weir elevations, etc.
8. Wet Season Water Table needs to be verified for this project.

Dear Vince:
Returned herewith are the two "sign-off" plans for the referenced
project. I have reviewed the plans for concurrence with the
drainage requirements of our Memo 91-165CC (copy enclosed). Mr.
Church, the applicant's engineer, is to provide my office with
evidence of the South Florida Water Management District and Lake
Worth Drainage District sign-off and provide calculations to
document the 3 year/24 hour flood stage. We will not actually
sign-off on the plans until this information is provided.
However, I have no problem with the applicant continuing the
sign-off process with other departments while we are waiting for
this documentation. Mr. Church has indicated verbally that Lake
Worth Drainage District has approved the plan and that South
Florida Water Management District is presently reviewing the
application.

At the city commission meeting of September 19, 1991, the
space Flus project was listed as Item Number V. A. 2, on the
consent Agenda.. The project was unanimously approved by the
Planning and Zoning Board, and as appl1cant, I had agreed to the
oonditions.
At the meeting public comments were requested. Mr. Kanonik,
who resides in Golf View Harbor, opposed our project. He stated
that the proposed si~ foot boundary separation wall should be 12
feet for security purposes and butfer screening. In view of his
concerns, I subsequently requested that our item be tabled until
the next city commission meeting, in order to assess the costs and
other aspects.
As you know, during the meeting the matter was discussed with
Mr. Kanonik and four other residents who attended the meet1nq. An
attempt was made to' reach a mutual solution, when, at the
invitation of the commission, we went out to the lobby to caucus
with them. However, the neighbors insisted that the wall be 12
feet in height.

adequate buffer, and whether it is financially feasible to
construct a 12 foot wall as part of the project.
The cost of the presently desiqned six foot blook wall, with
stucco on both sides, is estimated at $30.00 per foot, a total of
$12,000.00 for the 400 feet of wall. The cost of a 12 foot wall

resiaential district to tne north by an 80 foot wide canal, and any
attempt to enter will'not be made by parsons coming through the
Golt view HarDor SUt)cHvls1on, and across the waterway. By the same
tOken, there is no reason for intruders to attempt to gain access
to houses in the subdivision by entering through our proposed
facllity and then scalin9 a wall.
As we developed our project in the planning stages, we
realized that appropriate buffer would be essential to soreen the
north side. By code, a boundary separation wall is required to be
six feet in height, set bac~ two feet from the property line, per
Appendix A - Zoning, Section 4, L., Butfer Walls. Further, our
understanding was that six feet would be the maximum allowable
height.
In addition to this basic requirement we set the wall baok 20
feet from t.he prope.rty line to provide more open space for the
residential ne1qhborhood, and at the same time it lined up with the
existing wall of our self storage building. We proposed to stucco
the wall, and included the planting ot vines five teet on center.
Further, we proposed plantlnq nine alaCK Olive trees, eight teet
in height, outside the wall, over and abOve the City'S lanrtsoapin9
requirelltents. We felt that this would provide an acceptable
buffer.
In response t.o some conoerns expressed at the Planning and
Zoning Board meetin~, we notified 22 property owners in Golf view
Harbor e.bout our project. We arran(]ed a meeting place at the
Holiday Inn in Boynton Beaoh. and four of the property owners
showed up. Their primary concern was acreeninq. In an effort to
improve what we planned to do, we proposed the plantinQ of 27 BlaCk

as a condition on the site plan. FUrther, we met with the
neighbOrs to try an~ sa~1sry tneir concerns.

will present an attractive, well landscaped appearance tor the

Please be advised that the Planning and Zoning Board met on
Tuesday, September 10, 1991, and took the following action:
l. Deleted the SeaMist Centre and Marina conditional use
request from the agenda. Further processing of this request
cannot occur until the applicant resubmits plans to the
Technical Review Board. Although advertised as such, a
pUblic hearing before the Planning and Zoning Board is not
required by code. (PM91-221)
2. After conducting a public hearing, unanimously approved the
request for a parking lot variance to Section 5-142(h)(7)
"Driveway" of Article X, Parking Lots, for Abita Springs
Water Co. Inc., located at 3030 S.W. 13th Place, subject to
proviso. The motion was made by Mr. Collins and seconded by
Mr. Cwynar.
3. The Board accepted the property owner's agent's request to
withdraw, from the agenda, the site plan approval for Best
Homes at Boynton Lakes, Plat 5, for the construction of 41
townhouse units. After the issue regarding the requirement
to construct various improvements on common areas is
resolved, this request will be placed on a future Planning
and Zoning Board agenda.
4. Unanimously recommended approval of the request submitted by
Leon o. Surles for site plan approval to construct a 4,000
square foot carpet wholesale distribution facility on .77
acres, subject to proviso. Motion was made by Mrs. Huckle
and seconded by Mr. Collins. (PM91-222)
5. Unanimously recommended approval of the request submitted by
Mega Mini for Space Plus for approval of an amended site
plan to construct an outdoor rental storage lot, subject to
proviso. Motion. was made by Mrs. Huckle and seconded by Mr.
Collins. In addition, the Board requested the Planning
Department to notify the residential property owners
abutting the subject parcel to the north, prior to the

6. The Board removed from the table and unanimously made a
finding of consistency with the Comprehensive Plan for the
proposed amendment to Appendix A-Zoning, Section 11.1 of the
Code of Ordinances to allow for expansions of nonconforming
structures used for conforming uses, in the Central Business
District, subject to proviso. Motion was made by Mrs.
Huckle and seconded by Mrs. Greenhouse. (PM91-224)
7. Make a finding of consistency with the Comprehensive Plan
for the proposed amendment to Appendix B-P1anned Unit

create time extensions for master plan approvals and specify
that a master plan modification shall not extend the

Dear Mr. Cutro:
At the City commission meeting of September 19, 1991, the
Space Plus project was listed as Item Number V. A. 2, on the
Consent Agenda. The project was unanimously approved by the
Planning and Zoning Board, and as applicant, I had agreed to the
conditions.
At the meeting public comments were requested. Mr. Kanonik,
who resides in Golf View Harbor, opposed our project. He stated
that the proposed six foot boundary separation wall should be 12
feet for security purposes and buffer screening. In view of his
concerns, I subsequently requested that our item be tabled until
the next City commission meeting, in order to assess the costs and
other aspects.
As you know, during the meeting the matter was discussed with
Mr. Kanonik and four other residents who attended the meeting. An
attempt was made to reach a mutual solution, when, at the
invitation of the Commission, we went out to the lobby to caucus
with them. However, the neighbors insisted that the wall be 12
feet in height.
Our primary concerns are twofold; namely, have we provided an
adequate buffer, and whether it is financially feasible to
construct a 12 foot wall as part of the project.
The cost of the presently designed six foot block wall, with
stucco on both sides, is estimated at $30.00 per foot, a total of
$12,000.00 for the 400 feet of wall. The cost of a 12 foot wall
is estimated at $150.00 per foot, a total of $60,000.00 for the 400
feet of wall. The higher cost is due to the fact that the 12 foot

wall would have to be poured reinforced concrete, substantially
more costly to build than a block wall.
We also explored the possibility of constructing an enclosed
storage bay by continuing the existing wall. It would cost
approximately $100,000 in addition to the other planned and
required improvements, which is beyond the scope of our project.
The question becomes whether the expenditure of an additional
$50,000 is worth the improvement for security and aesthetics.
The 12 foot wall on the north side will not substantially
improve security since there will only be six foot chain link
fences on the other two boundaries. It would be unreasonable to
consider 12 foot enclosures on all three sides, nor would it be
allowed by code. Note also that our project is separated from the
residential district to the north by an 80 foot wide canal, and any
attempt to enter will not be made by persons coming through the
Golf View Harbor Subdivision, and across the waterway. By the same
token, there is no reason for intruders to attempt to gain access
to houses in the subdivision by entering through our proposed
facility and then scaling a wall.
As we developed our project in the planning stages, we
realized that appropriate buffer would be essential to screen the
north side. By code, a boundary separation wall is required to be
six feet in height, set back two feet from the property line, per
Appendix A - Zoning, section 4, L., Buffer Walls. Further, our
understanding was that six feet would be the maximum allowable
height.
In addition to this basic requirement we set the wall back 20
feet from the property line to provide more open space for the
residential neighborhood, and at the same time it lined up with the
existing wall of our self storage building. We proposed to stucco
the wall, and included the planting of vines five feet on center.
Further, we proposed planting nine Black Olive trees, eight feet
in height, outside the wall, over and above the City's landscaping
requirements. We felt that this would provide an acceptable
buffer.
In response to some concerns expressed at the Planning and
Zoning Board meeting, we notified 22 property owners in Golf View
Harbor about our project. We arranged a meeting place at the
Holiday Inn in Boynton Beach, and four of the property owners
showed up. Their primary concern was screening. In an effort to
improve what we planned to do, we proposed the planting of 27 Black
Olive trees, 12 feet in height. Our understanding, as previously

noted, was that the wall could not exceed six feet, and therefore
could not be raised. As was brought out at the City commission
meeting, the wall could be higher since it had been setback to the
building setback line. There was a consensus of all who attended
our meeting, that our plan was a mutual compromise, in an effort
to provide an appropriate buffer. For those not familiar with the
area, the neighbors have heavily landscaped backyards.
To summarize our position, we have proposed a legal use for
the property, consistent with the City's land use policies. The
storage of vehicles is a passive activity compared to some of the
potential industrial uses that could be developed; the list of uses
in the zoning code is several pages long, and includes
manufacturing and commercial uses. Also, we were required to
prohibit the storage of wrecked or junk vehicles. This is noted
as a condition on the site plan. Further, we met with the
neighbors to try and satisfy their concerns.
Our plan was unanimously passed by the Planning and Zoning
Board.
In order to resolve this latest impasse we are prepared to
construct an eight foot wall, with stucco on the outside, complete
with planting of vines, five feet on center. Further, we will
plant Black Olive trees, 12 feet in height, with a crown spread of
10 feet, 20 feet on center the entire length of the wall. This
will present an attractive, well landscaped appearance for the
neighbors on the other side.
Kindly present our proposal for city Commission consideration
at their October 1, 1991, meeting.
