SUBJECT: Exception to Platting Suburban Bank
The owners of the Shoppes of Boynton, located at the northeast
corner of Congress Avenue and N.W. 22nd Avenue, are requesting an
exception to platting as allowed by Appendix C, Article VI,
section I of the Code of Ordinances.
The Planning Department concurs with Engineering Department
findings contained in the attached memo and recommends approval
of the exception.
We have placed this item on the Planning and Zoning Board agenda
for the special meeting scheduled for August I, 1991.

determined that platting is not necessary for the above referenced project,
based upon existing in place infrastructure and other related subdivision
required improvements which are newly constructed.
Should your office concur with our determination in accordance with the
exception section of the City's Code of Ordinances, that being Appendix "C",
Subdivision and Platting Regulations, please place this matter on the
Planning & Zoning Board's agenda for the August meeting.

Dear Mr. Sturdyvin:
The Engineering Department, for the City of Boynton Beach, Florida; is in receipt
of the above VDM Group letter. The subject letter was forwarded to the Planning
Director and the City's Consulting Engineer for review and comment.
It is the position of the Engineering Department, and that of the Planning Director
(see attached Planning Memorandum dated July 9, 1991), that an exception to platting
is required. The exception to platting shall be reviewed by the City Planner, City
Engineer and the Planning and Zoning Board, upon receipt of a formal written request
from your office.
At your earliest convenience, please submit a written request to this office,
reference exception to platting, so that conformance with the City's Code of
Ordinances may be followed in providing you with an opportunity to be considered
by City Departments and the Planning and Zoning Board for the City of Boynton Beach,
Florida. In order to expedite this exception, we will begin formulating a response
to the Planning and Zoning Board while we wait for your formal letter, which shall
be added to their agenda package.

VDM letter on platting
As we discussed a few weeks ago platting is not required for the
proposed sale of the Suburban Bank parcel at the Shoppes of
Boynton.
What is required is an exception to platting that requires review
by the City Planner, the city Engineer and the Planning and
. Zoning Board. The procedure for requesting such an exception is
a letter written to either yourself or the City Engineer. This
letter is submitted to the Planning and Zoning Board with
appropriate department comments.
If you have any further questions regarding this matter, please

Exception of Platting/Exemption
Dear Mr. Glidden:
Pursuant to your inquiry as to whether or not this office can uni1atterally
issue and provide you with a platting exemption in one day, the answer is that we
cannot do so. In accordance with the provisions set forth within the above re-
ferenced codes, the Planning Director, the City Engineer and the Planning & Zoning
Board must agree as to the issuance of an exemption.
The criteria for justifying platting exemptions including the procedures for
filing a preapplication for exemptions is attached herein for your review and future
reference.

ARTICLE VI. APPLICATION OF ORDINANCE
Section 1. Requirement and exception or platting,
No person, firm, corporation or any other association
shall create a subdivision of a tract of land anywhere in the
incorporated area of the City of Boynton Beach except in
conformity with this ordinance. No subdivision shall be
platted or recorded nor shall any building permit be issued
unless such subdivision meets all the provisions of this
ordinance and those of any applicable Laws of the State of
Florida, and has been approved in accordance with the
requirements as herein set forth, except that the recording
of the plat may not be required if:
A. The land to be subdivided is to be divided into no'
more than three (3) contiguous lots and because:
1. Unusual conditions are created by ownership or
development of adjacent lands, or
2. The land concerned is isolated or remote in its
relationship to other platted or improved lands, or
3. The improvements and dedications existing on the
land are substantially in accordance with the
requirements of this ordinance and if the waiving
of the requirements for platting, as determined by
the planning and zoning board and the city
engineer, would not conflict with the purpose and
intent of this ordinance.
B. The resubdivision of land heretofore platted is of such
unusual size and shape or is surrounded by such
development or unusual conditions as may be
determined by the planning and zoning board, the city
planner and the city engineer to justify the waiving of
the requirements for preparing a replat.
Section 2. Exception pre-application.
Pursuant to paragraphs A and B of Article VI, section 1
above, the developer shall submit a pre-application in the
manner prescribed by this ordinance. The city engineer, the
city planner and the planning and zoning board shall

of the foregoing conditions does exist and, upon, affirmative
determination, shall delete the requirement f~ platting.
Section 3. Exemption pre-application.
The developer shall submit a pre-application in the
manner described by this ordinance and an affidavit of
exemption. The city engineer, the city planner and the
planning and zoning board shall review the pre-application
and affidavit of exemption and shall determine if they are
in order, and upon such determination shall approve the
affidavit of exemption. In the event the city engineer and
the planning and zoning board approve the affidavit of
exemption, the developer shall be required to make available
to the purchaser proof of the affidavit of exemption.
Section 4. Requirements in lieu of platting.
If, pursuant to this article" platting is not necessary, in
lieu of platting a certified survey- shall be submitted to the
city engineer's offICe and the city-engineer shall reserve the
right to require deeded rights of way ~ easements,
rese-rv~tioi1s or improvements re uired in connection with
platting under 'this ordinance mcluding he posting of a
performance and maintenance bond, as may be necessary to
carry out the intent and purpose of this ordinance.
ARTICLE VII. ADMINISTRATION OF ORDINANCE
Section 1. Responsibility for coordination and en-
forcement of provisions.
For the purpose of coordinating, enforcing and administer-
ing this ordinance, the city engineer shall be ,deemed the
administrative officer of this ordinance, except that for the
pre-application plans the city planner shall be responsible
for the review and administration prior to presentation to
the planning and zoning board.

Per our phone conversation the other day and the correspondence
between Oliver Glidden & Partners, Inc. and the City ox Boynton,
you are aware that the attorney xor Suburban Bank has required a
letter xrom the City regarding platting requirements %or the above
outparcel.
In our phone conversation you explained that the sale ox this
outparcel would require platting but an exception could most likely
be obtained due to the existing improvements and characteristics 02
the parcel.
Axter reviewing the related code sections regarding platting and
discussions with Derek Vander Ploeg, a platting exception does not
appear necessary. The Shoppes ox Boynton is currently considered
one parcel as evidenced by the %act that the entire parcel is under
one property control number with Palm Beach County. The sale 02
the bank outlot is the .first subdivision ox this parcel and
there.fore, shouldn't trigger any platting requirements.

Dear Tambri:
We will be walking a set of revised plans through the various
departments for Site Plan Review Sign-off's within the next two
weeks and wish to resolve one particular loose end relating to
the building area/parking. In this regard, we want to properly
respond to you regarding the necessary parking calculations to
support two minor changes which were made 1.) during the review
process and 2.) within the last week.
The first of these two changes involves a slight site plan
modification that was recommended by the Planning & zoning
Board, realigning a driveway aisle to the East of the building.
This plan had been previously submitted informally on an 8 1/2"
x II" sketch to the City and is now incorporated into the Master
Site Plan which is attached hereto.
The second change involves a slight modification of the entry to
the building which was the result of a continuation of the front
wall, eliminating a triangular recessed entry. This change
added approximately 70 square feet to the proposed building and
therefore needs to be addressed, as we understand it, with a
revised traffic/parking calculation.
It is our understanding from our recent conversation with you
that we need to submit a modified traffic/parking study along
with the Revised Site Plan and exact building area calculations
for your review with the intent to process this revision
administratively through the Planning Department. It is
important for us to determine if this change needs to take place
prior to the sign-off for Site Plan Review or whether it could
possibly happen subsequently.

The Engineering Department is in receipt of Memorandum No. 9l-141CC, July 31, 1991,
upon which you placed a notation dated July 31, 1991 asking why the applicant
requested negation of Planning & Zoning Board agenda item as referenced above.
Please be advised that on July 31, 1991, at approximately 11 A.M. in the morning,
Mr. Cutro walked into my office and asked me if the applicant was withdrawing the
agenda item and furthermore not constructing the Suburban Bank project because of,
and in his words "is it something the City did to cause this?". Subsequently, later
that afternoon, I visited the City Attorney's office with Craig Livingston on an
unrelated matter and as we walked into Mr. Cherof's office, Chris Cutro was clearly
heard complaining to Mr. Cherof regarding this office's request for the applicant's
compliance with Appendix "C", "Subdivision and Platting Regulations", Article XVI,
"Variances and Exceptions", Section 1, "Administration of Variances", Subsection
lD, which states the following, "an application fee as adopted by Resolution of the
City Council shall be payable to the City of Boynton Beach". Mr. Staudinger, P.E.,
Gee & Jenson Consulting Engineers, was present and I find it highly unusual that
matters originating from this office result in a meeting where I am excluded. As
this is not the first time that I have been excluded from matters that pertain to
me, I again request your assistance in developing interdepartmental cooperation in
this regard.
It should be noted that Craig Livingston's most recent request for platting exception
was routed thru City Departments to our governing Boards without benefit of obtaining
the required fee from Busch's Restaurant. I recommend that Mr. Cutro coordinate the
transmittal of an appropriate invoice to Busch's Restaurant, thru our Director of
Finance, so as not to confer any special privileges to the applicant. The associated
fees, when received, will offset expenses borne by the taxpaying public.
I do not know of any instances where Mr. Cutro has scheduled meetings without our
Building Official present, in order to complain about or debate the validity of fees
established by the Building Department, and I would expect the same courtesy to be
afforded to my office.
Additionally, (contrary to popular belief),the applicant has withdrawn from constructing
Suburban Bank, including the matter as referenced above, for reasons totally unrelated
to this or any other City Department's performance. Suburban Bank has a signed

contract with the land owners which expired and upon the expiration of the signed
contract, the bank revisited the financial issues relating to construction of the
proposed bank and made a business determination not to construct during these

Please be advised that on Tuesday, March 19, 1991, the City
Commission approved the referenced site plan modification,
subject to staff comments, copies of which are attached, as well
as rereview of the color scheme with the Community Appearance
Board.
These plans were approved subj ect to your compliance with the
attached stipulations and must now be modified to incorporate
same. To initiate your sign-off procedure, please submit two (2)
sets of modified plans to the Office of the Site Development
Division of the Building Department, which will record the
required identification markings on each set of the modified
plans.
After both sets of modified plans have the appropriate markings,
you should proceed with your sign-off on both sets of plans from
each Technical Review Board member. The sign-off procedure
requires that the Engineering Department sign-off first, followed
by all other departments with the exception that the Planning
Department sign off next-to-last and the Building Department
sign-off last. The Zoning & Site Development Administrator will
provide the Building Department sign-off. One (1) set of final
signed-off plans will remain with the Building Department and the
other set of plans will be returned to you to be retained at the
job site.

To help facilitate the sign-off process, appointments should be
made to meet with each Technical Review Board member to allow
them sufficient time to review and sign-off the modified plans.
After securing all the required Technical Review Board member
signatures and completing processing by the Site Development
Division, you may apply for building permits by submitting the
appropriate documents and fee to the Plan Review and Permitting
Division of the Building Department. The Building Department
will advise you as to any additional permits which may be
required, such as Palm Beach Health Department (water and sewer),
Clearing/grubbing, excavation/fill, drainage, paving, site
lighting, landscaping and irrigation.
The approval of the City entitles you to construct only the
improvements shown on the site plan. The site plan will be
viewed procedurally as an as-built or record drawing.
Pursuant to Chapter 19, Article VI, Section 19-83 of the City of
Boynton Beach Code of Ordinances, approval of this si te plan
modification will expire on March 19, 1992 unless an application
for a building permit is submitted to the City Building
Department prior to that date. An extension to the site plan
approval for a maximum period of one year, may be filed not later
than 60 days after the expiration of the site plan, May 19, 1992
(Chapter 19, Article VI, Section 19-92 of the Code of
Ordinances). Extensions must be filed with the Planning
Department by submitting a letter of extension'for review by the
Concurrency Review Board and the Planning and Zoning Board.

Site plan Modification
Please be advised of the following Planning Department comments
with respect to the above-referenced request for a site plan
modification:
1. Provide a graphic scale on all drawings. Site plan
application, page 5, item #2.
2. Complete page 2, question 19, on the site plan application.
3. Traffic circulation around the revised drive-through will
not flow efficiently if all five lanes are not operational
during peak hours to maximize vehicle stacking. If the
bank's operating procedures do not provide for this,
redesign of the drive-through is strongly urged.
4. The total number of parking spaces provided appears to be
1106 rather than 1107 as indicated on the site plan,
application and shared parking study. The discrepancy
occurs along the south side of the bank where a parking
space was lost. Revise the documents stated.
5. The shared parking study submitted does not reflect the past
two site plan modifications that involved revisions to the
number of parking spaces required for the retail south of
Quantum Boulevard (742 parking spaces) and increases in the
total square footage of retail space south of Quantum
Boulevard (148,292 sq. ft.). In addition, since the bank is
to be subdivided from the shopping center parcel, the bank
parking ratio should be applied; one parking space for every
250 square feet of gross floor area, rather than the retail
rate of 1:200 that was used. The changes anticipated have
been marked on the attached pages (2, 3, 9, table 1 and
table 2) of the shared parking study submitted and shall be
reflected on the revised plans, site plan application (page
4) and shared parking study submitted for final sign-off.
Despite these changes, the shared parking study provides
quantitative evidence that with the increase in square
footage associated with the bank, a sufficient number of
parking spaces is available at the peak hour of parking
demand and that a buffer exceeding the minimum 10% is
provided. Appendix A - Zoning, Section 11.H.13 and
16.d(18) .
6. Since the bank parcel is being subdivided, a cross access
agreement with the shopping center is needed to provide for
the cross parking areas, access aisles and driveways shown
on the site plan. A copy of this agreement shall be
submitted prior to final sign-off, so that this department
may coordinate review of the agreement with the City's legal
department. As a point of information, the bank parcel is
only required to have 19 parking spaces, which are shown
within the proposed boundaries of the bank parcel, allowing
the bank to be independent of the shared parking study for
the shopping center. Therefore, two options are available.
The bank can be deleted from the shared parking study with
