The Planning Department concurs with Engineering Department findings contained in the attached memo and recommends approval of the exception. The subject letter was forwarded to the Planning Director and the City's Consulting Engineer for review and comment. In accordance with the provisions set forth within the above re- ferenced codes, the Planning Director, the City Engineer and the Planning & Zoning Board must agree as to the issuance of an exemption. VI, I 1 BOYNTON BEACH CODE ARTICLE VI. APPLICATION OF ORDINANCE Section 1. Requirement and exception or platting, No person, firm, corporation or any other association shall create a subdivision of a tract of land anywhere in the incorporated area of the City of Boynton Beach except in conformity with this ordinance. No subdivision shall be platted or recorded nor shall any building permit be issued unless such subdivision meets all the provisions of this ordinance and those of any applicable Laws of the State of Florida, and has been approved in accordance with the requirements as herein set forth, except that the recording of the plat may not be required if: A. The land to be subdivided is to be divided into no' more than three (3) contiguous lots and because: 1. Unusual conditions are created by ownership or development of adjacent lands, or 2. The land concerned is isolated or remote in its relationship to other platted or improved lands, or 3. The improvements and dedications existing on the land are substantially in accordance with the requirements of this ordinance and if the waiving of the requirements for platting, as determined by the planning and zoning board and the city engineer, would not conflict with the purpose and intent of this ordinance. B. The resubdivision of land heretofore platted is of such unusual size and shape or is surrounded by such development or unusual conditions as may be determined by the planning and zoning board, the city planner and the city engineer to justify the waiving of the requirements for preparing a replat. Section 2. Exception pre-application. Pursuant to paragraphs A and B of Article VI, section 1 above, the developer shall submit a pre-application in the manner prescribed by this ordinance. Section 3. Exemption pre-application. The developer shall submit a pre-application in the manner described by this ordinance and an affidavit of exemption. The city engineer, the city planner and the planning and zoning board shall review the pre-application and affidavit of exemption and shall determine if they are in order, and upon such determination shall approve the affidavit of exemption. In the event the city engineer and the planning and zoning board approve the affidavit of exemption, the developer shall be required to make available to the purchaser proof of the affidavit of exemption. Please be advised that on July 31, 1991, at approximately 11 A.M. in the morning, Mr. Cutro walked into my office and asked me if the applicant was withdrawing the agenda item and furthermore not constructing the Suburban Bank project because of, and in his words "is it something the City did to cause this?". Subsequently, later that afternoon, I visited the City Attorney's office with Craig Livingston on an unrelated matter and as we walked into Mr. Cherof's office, Chris Cutro was clearly heard complaining to Mr. Cherof regarding this office's request for the applicant's compliance with Appendix "C", "Subdivision and Platting Regulations", Article XVI, "Variances and Exceptions", Section 1, "Administration of Variances", Subsection lD, which states the following, "an application fee as adopted by Resolution of the City Council shall be payable to the City of Boynton Beach". Mr. Staudinger, P.E., Gee & Jenson Consulting Engineers, was present and I find it highly unusual that matters originating from this office result in a meeting where I am excluded. As this is not the first time that I have been excluded from matters that pertain to me, I again request your assistance in developing interdepartmental cooperation in this regard. It should be noted that Craig Livingston's most recent request for platting exception was routed thru City Departments to our governing Boards without benefit of obtaining the required fee from Busch's Restaurant. I recommend that Mr. Cutro coordinate the transmittal of an appropriate invoice to Busch's Restaurant, thru our Director of Finance, so as not to confer any special privileges to the applicant. The associated fees, when received, will offset expenses borne by the taxpaying public. I do not know of any instances where Mr. Cutro has scheduled meetings without our Building Official present, in order to complain about or debate the validity of fees established by the Building Department, and I would expect the same courtesy to be afforded to my office. Additionally, (contrary to popular belief),the applicant has withdrawn from constructing Suburban Bank, including the matter as referenced above, for reasons totally unrelated to this or any other City Department's performance. Provide a graphic scale on all drawings. Site plan application, page 5, item #2. 2. Complete page 2, question 19, on the site plan application. 3. Traffic circulation around the revised drive-through will not flow efficiently if all five lanes are not operational during peak hours to maximize vehicle stacking. If the bank's operating procedures do not provide for this, redesign of the drive-through is strongly urged. 4. The total number of parking spaces provided appears to be 1106 rather than 1107 as indicated on the site plan, application and shared parking study. The discrepancy occurs along the south side of the bank where a parking space was lost. Revise the documents stated. 5. The shared parking study submitted does not reflect the past two site plan modifications that involved revisions to the number of parking spaces required for the retail south of Quantum Boulevard (742 parking spaces) and increases in the total square footage of retail space south of Quantum Boulevard (148,292 sq. ft.). In addition, since the bank is to be subdivided from the shopping center parcel, the bank parking ratio should be applied; one parking space for every 250 square feet of gross floor area, rather than the retail rate of 1:200 that was used. The changes anticipated have been marked on the attached pages (2, 3, 9, table 1 and table 2) of the shared parking study submitted and shall be reflected on the revised plans, site plan application (page 4) and shared parking study submitted for final sign-off. Despite these changes, the shared parking study provides quantitative evidence that with the increase in square footage associated with the bank, a sufficient number of parking spaces is available at the peak hour of parking demand and that a buffer exceeding the minimum 10% is provided. Appendix A - Zoning, Section 11.H.13 and 16.d(18) . 6. Since the bank parcel is being subdivided, a cross access agreement with the shopping center is needed to provide for the cross parking areas, access aisles and driveways shown on the site plan. A copy of this agreement shall be submitted prior to final sign-off, so that this department may coordinate review of the agreement with the City's legal department. As a point of information, the bank parcel is only required to have 19 parking spaces, which are shown within the proposed boundaries of the bank parcel, allowing the bank to be independent of the shared parking study for the shopping center. Therefore, two options are available.
