Regarding the request for access to the property to the east I have eliminated approximately 28 feet to allow the city access to the proposed Downtown Mangrove Park. To mitigate this loss of detention area I have increased the south swale by eliminating a further twelve (12) parking spaces making a total of twenty-six (26) spaces sacrificed in providing storm water quality. In response to the request that swales be constructed along our property frontage on N.E. 6th avenue, I will depict this requirement on the drawings. The memo states that no water quality treatment is required for the classroom addition, however Mr. Staudinger requests that French Drain Trench be provided in the drop-off area. It is agreed that a Trench will be provided pursuant to his request and the location can be decided at the time the engineering plans are prepared. Schorah & Associates, Inc. to determine the traffic impact of new classrooms proposed at the St Marks Church. The church is proposing an academic program for 55 children as outlined in the attached letter from Reverend John Block. Daily trip rates are not available for the Private School category in the 5th Edition of the Institute of Transportation Engineers', Trip Generation. Based on a previous study submitted to Palm Beach County for approval and conversations with Mr. Dan Weisberg of the Palm Beach County Traffic Division, a daily rate of 3.00 trips per student was used. I have enclosed Table 1 which shows the trip generation rates used and how the daily rate was derived, and Table 2 which shows the trips which would be generated by the 55 new students. The students would generate 165 new daily trips, 32 AM and 38 PM peak trips. Since the trips are less than 200, per the Traffic Performance Standard, the applicant is not required to submit a Traffic Impact Study. If you have any questions, please contact me. Scott Miller City Ma~ ~~~er Cutro Planning and Zoning Director TO: DATE: February 12, 1993 RE: Saint Mark Catholic Church Site Plan, Conditional Use, Parking Lot Variance and Community Design Plan Appeal Saint Mark Catholic Church has submitted a site plan, conditional use, parking lot variance and community design plan appeal for the expansion of the school for a pre-kindergarten and kindergarten building to be located on their site. Due to complications in the code, the site plan, conditional use and community design plan appeal were reviewed by the Community Redevelopment Advisory Board, while the parking lot variance was reviewed by the Planning and Development Board. To simplify this request for the City Commission, I will review each of the elements of each request separately in a logical progression. Conditional Use The Central Business District zoning district requires the pre- kindergarten school to go through conditional use review. The proposed new use will be an extension of the existing school on the site and will not have negative impacts on the surrounding land uses. The Community Redevelopment Advisory Board reviewed this request and forwarded it to the City Commission with a recommendation for approval. Community Design Plan Appeal The proposed new building is designed to match the existing school building in color and roof configuration. Overall the site contains four buildings which are of a consistent color and roof style. Making the new structure conform to the Coastal Village Design Guidelines would be inappropriate. The Community Redevelopment Advisory Board reviewed this request at its meeting of February 8, 1993 and forwarded the appeal to the City Commission with a recommendation for approval. Parking Lot Variance In the Central Business District landscape code, there are a series of separate requirements included in the parking requirements such as parking lot design, drainage, landscaping and lighting. The applicant requested a blanket variance to these requirements, however, subsequent negotiations with staff have reduced the actual variances to minor requirements. Presently, drainage of the site is unacceptable, because almost all of the stormwater on site runs east into the Mangrove area. The applicant has agreed to create swales and a retention area on the east site line. This will bring the site up to 50% of the requirement required by Code. The City Engineer feels this is a major improvement over the existing conditions. Planning & Zoning Dept. Memo *93-032 Page 2 The Planning and Development Board at its meeting of February 9, 1993 reviewed this request and forwarded the drainage portion of the variance to the City Commission with a recommendation for approval. Lighting and landscaping are considered one requirement under the Central Business District landscape code. At the present time, the lighting on site is substandard. The applicant has agreed to upgrade the lighting to an average of one footcandle at grade level in the vehicular use areas and .75 footcandles at grade level in the pedestrian area. These are the requirements of the CBD landscape code. The CBD landscape code requires a certain design of fixtures and lighting type. These should be waived so that all the fixtures on the site can match both in fixture design and lighting. The landscaping on the site is missing hedge material in places, as well as 24 trees on the site and the north swale, no landscaped entrance exists, the species on the site are not acceptable under the CBD landscaping code and do not meet the 90% native requirement. The site on which the new structure is to be located contains trees that can be moved elsewhere on the site. The applicant has agreed to do this and then supplement the number moved up to the 24 trees. The applicant has agreed to add an entrance feature on the south side of the site. Any new material being planted on the site will meet the 90% native requirement and the CBD plant lists. Any hedges will be filled in and lengthened as needed. The only variances being granted to landscaping are as follows: 1. Hedge material is planted and will be planted spaced at 24 inches instead of 18 inches on center; 2. The existing ficus and black olive trees which will remain are not an acceptable species in the CBD; 3. Grass will be allowed to remain below the hedges instead of ground cover; 4. No landscaping is being provided around the dumpster; 5. No pedestrian furnishings are being provided; 6. The 90% native plant material requirement will not be met for the entire site. The Planning and Development Board, at its meeting of February 9, 1993, reviewed the landscaping and lighting section of the parking lot variance and forwarded it to the City Commission with a recommendation for approval. site Plan Review Due to the other reviews that took place regarding this site, the site plan review is easier than most. The new structure meets the building requirements for the CBD zoning district and the overall site meets the parking and landscaping requirements if the community design plan appeal and parking lot variances are granted. The Community Redevelopment Advisory Board reviewed the site plan at its meeting of February 8, 1993 and forwarded the plan to the City Commission with a recommendation for approval. Memo #93-032 Page 3 One condition on the site plan is that a section of 5th Avenue, which still exists as a right-of-way, but has been encroached upon by the church parking lot and other developments to the west, be abandoned. We would suggest that staff be instructed to prepare this application as soon as possible under our alley abandonment program and that this condition should not stop building permits from being issued. To save time at the City commission meeting, staff will make one consolidated presentation on all the requests for this site. Finizio-Telephone No. (407) 738-7487 Administrative Coordinator of Engineering DATE: January 14, 1993 RE: Technical Review Committee Comments Major Site Plan Modification and Conditional Use Approval St. Marks Catholic School and Church 624 NE 6th Avenue, Boynton Beach, FI The Engineering Department for the City of Boynton Beach, Florida is in receipt of the above referenced site plan submission and accompaning letter, dated Dec. 28, 1992, from Michael B. Schorah & Associates, Inc. l. In response to the Design Engineer's letter, dated Dec. 28, 1992, a copy of which is attached herein, I contacted PBC Traffic Engineering Division and pursuant to discussions held on l/13/93, this project is not vested, reference PBC's Traffic Performance Standards Ordinance. Therefore, the issue relative to impact fees in this regard shall be addressed between the applicant and PBC Engineering should the applicant attempt to seek relief. It should be noted that the Civic Center Subdivision, according to the Planning Department's Category (A) (5) Subdivisions which are fully exempt, appears to be exempt for single family and duplex dwelling units only. Additionally, this subdivision did not indicate upon any master plan a use for this property relative to vehicle trips generated per day and therefore according to Allan Ennis, this project falls under the jurisdiction of PBC's Traffic Performance Standards Ordinance. I recommend that the Planning Department forward a copy of this plan to PBC and that their comments be made a part of our conditions of approval, whether they be at the conceptual or permit application stage. 2. The applicant shall upgrade the existing parking lot facility in accordance with Chapter 5, Article ~, "Boynton Beach Parking Lot Regulations", Section 5-138, "Scope", which states that compliance with City Code is required when (a)..."a parking lot serves an existing building(s) where said building(s) is proposed to be enlarged or when an additional building(s) is proposed to be constructed". The submission of this site plan did not take into consideration the requirements to upgrade the existing site as well as the subject site to full code compliance with the required improvements provisions listed within City codes, therefore, since this application addresses only the proposed construction, I consider this application incomplete until such time as the applicant addresses the required upgrade. The required improve- ments that shall be depicted upon a comprehensive submission includes, but is not limited to, parking lot lighting systems which comply with City codes, pedestrian lighting, traffic control, curbs and car stops. Drainage will be addressed by the City Engineer under separate memorandum (the NE and SE section of this site frequently floods and is considered flood prone), including all other applicable section of 5-142. 3. Christopher Cutro, Planning & Zoning Director Technical Review Committee Comments January 14, 1993 Page #2 From a safety standpoint, it is extremely important that the entire site be upgraded to comply with City codes as Child Day Care Center activities and Bingo functions during the winter months will be operated during hours of darkness. All lighting systems shall be photocell activated. Note: The applicant has not filed a variance for lighting and therefore staff concludes that lighting will be upgraded as the applicant was made aware of this requirement during the TRC meeting of 1/14/93. Pursuant to City codes, variances are only granted on the basis of the applicant exhibiting a true hardship relative to the section of our codes from which they seek relief. In this case the only justification provided appears to be a monetary one and therefore variances should not be granted so as not to set a harmful precedent which will erode the City's future ability to compel developers to upgrade their sites based solely on monetary interests. The Engineering department has the following comments: 1. Applicant shall supply unity of title for preschool site and existing facilities so the parking and infrastructure can be shared. Northeast 5th right-of-way may not have been abandoned in this area. A survey and title search should verify the status of the right-of-way. 2. The traffic analysis and trip generation supplied by the applicant, including the January 21, 1993, letter from Yvonne Ziel, is not adequate to substantiate a reduced trip generation rate of 3.0 for this facility. The 3.0 generation rate for private schools is based on a number of grades in the same location whereby several students from a single family could utilize the same vehicle. I do not believe this is the case for a pre-kindergarten and kindergarten school of 55 children. Utilizing the standard rate for day care centers generates over 200 trips from this site. The above comments are not of such magnitude as to stop the conditional use from proceeding with a positive recommendation from the Engineering Department.
