utility easement abandonment
NATURE OF REQUEST
CCL Consultants Inc, agent for, Howard R. Scharlin, Trustee for the
Woolbright Place PUD and Shoppes of Woolbright PCD and Race Track
Petroleum Inc., is requesting abandonment of a portion of a twelve
(12) foot wide utility easement that contains a city sewer force
main which services an area south of Woolbright Road. This
abandonment is the continuation of the easement on both the north
side and south side of the Vinings Easement Abandonment granted by
the City Commission on December 20, 1994. The attached, Exhibit
"A" shows the location of the easement.
BACKGROUND
The easement, was dedicated across the undeveloped land of the
former Lake Boynton Estates Plat No. 1 (replatted as Woolbright
Place Plat No.1) to provide city sewer to the developments south
of an existing pump station, which is no longer operable. This old
pump station is located near the northeast corner of the future
vinings Phase II project.
The easement extends through Shoppes of Boynton PCD from Woolbright
Road north through a portion of the Racetrack approved site on the
west side of SW 8th Street and east across 8th Street and then
north to Mortonsway along S.W. 8th street. It then proceeds north
through the previously abandoned section on the Vinings project.
It continues north through the single-family planned portion of the
Woolbright Place PUD and then east where it terminates at the old
pump station and at a new pump station, 120 feet north of the old
pump station. The old pump station was shut down and replaced with
the new station. The new station has been operating since it was
built several years ago when much of the infrastructure for the
Woolbright place PUD and Shoppes of Woolbright PCD was installed.
ANALYSIS
The force main within the easement is being rerouted as part of the
installation of new infrastructure to serve the Woolbright Place
and Shoppes of Woolbright projects while maintaining existing
service.
The subject easement is no longer needed now that the force main is
rerouted.
The city departments involved in review of a request for
abandonment and the parties that were given public notice of the
requested abandonment are identified below. Public notice is given
to the property owners that abut the easement to be abandoned.

Accompanying this memorandum you will find two (2) copies of the
application and related documents for the above-referenced
abandonment application. The $500.00 application fee for staff
processing and review has been forwarded to the Finance Department.
A legal advertisement for same has been prepared for the April,
1995 public hearings and will be forwarded to your office after
review by the city Attorney and city Manager. In order for our
department to meet the deadline for preparing Planning and
Development Board agenda materials for this request, comments from
staff and the various utilities companies must be received by our
office by March 31, 1995.
Please inform staff of this time frame when distributing copies of
this request for comment. If easier, comments can be forwarded to
you with a xerox copy transmitted to our office. Thank you.
