DESCRIPTION: Basehart & Cottrell, !nc., agent for Racetrac Petroleum, Inc., property owner of a portion of the Shoppes of Woolbright PCD subdivision, proposed for development as a Racetrac service station/convenience store is requesting approval of second site plan extension to grant a 5 month retroactive and a one (1) year time extension for site plan approval and concurrency exemption. The Racetrac site is located at the northwest corner of Woolbright Road and S.W. 8th street. The request, if approved, would extend the expiration to April 20, 1996. RECOMMENDATION: The Planning and Development Board, with a 4-3 vote, recommended approval subject to all staff comments (Planning and Zoning Department Memorandum No. 95-572). At their meeting, the Board raised the issue of whether changes to the PCD since the 1990 settlement agreement have to meet current code, despite the fact that the 1990 agreement allows compliance with codes in effect in 1986. A new agreement, which replaces all previous agreements related to the property, was approved by staff and the Commission on May 16, 1995. staff has been instructed to enforce this agreement, al though not signed by Tradewinds, on Mr. Morton's statement that Tradewinds is agreeable to signing. with respect to this issue, the new agreement states the following: "17. CODE COMPLIANCE: The parties agree that unless herein stipulated, all current and future acti vi ties will be governed by City Codes and Regulations in force and effect upon the date of application for activity." Whether a request for site "application for activity" is deferred to the city attorney. plan extension constitutes an a determination appropriately If it is determined that current codes do or can apply, the following is a list of the items from the current service station regulations that are not met by the 1993 site plan: 1. Gasoline establishments are required to be located at the diagonal corners of intersection consisting of roads four lanes or wider. Exclusive of turn lanes, S.W. 8th street is not a four lane road and there can be no diagonal corners because the intersection of S.W. 8th Street and Woolbright Road is not a full intersection; it forms a "T" because S.W. 8th street does not extend south of the intersection. 2. The driveway onto S. W. 8th street is not set back a minimum of 110 feet from the intersecting right-of-way lines of S.W. 8th street and Woolbright Road. 3. The gasoline pump island closest to S.W. 8th street is set back less than the required 30 feet from S.W. 8th street. 4. The buffers along the street frontages are missing some of the minimum numbers of trees. The trees are less than the minimum size and height. Some of the hedges are missing and not all are underplanted with flowering groundcover. 5. The buffers along the interior property lines are missing some of the required trees. The trees are less than the minimum size and height and are not underplanted with groundcover. The hedges are less than the minimum height.
