DESCRIPTION: This is a request for a one year time extension of
the site plan approval, granted April 20, 1993 by the City
Commission, for the Racetrac service station and convenience
store within the shoppes of Woolbright PCD. Racetrac is to be
located at the northwest corner of Woolbright Road and S.W. 8th
Street.
RECOMMENDATION: The Planning and Development Board unanimously
recommended approval of this extension as requested, subject to
all original, approval conditions.

DESCRIPTION: Basehart & Cottrell, !nc., agent for Racetrac
Petroleum, Inc., property owner of a portion of the Shoppes of
Woolbright PCD subdivision, proposed for development as a Racetrac
service station/convenience store is requesting approval of second
site plan extension to grant a 5 month retroactive and a one (1)
year time extension for site plan approval and concurrency
exemption. The Racetrac site is located at the northwest corner of
Woolbright Road and S.W. 8th street. The request, if approved,
would extend the expiration to April 20, 1996.
RECOMMENDATION: The Planning and Development Board, with a 4-3
vote, recommended approval subject to all staff comments (Planning
and Zoning Department Memorandum No. 95-572). At their meeting,
the Board raised the issue of whether changes to the PCD since the
1990 settlement agreement have to meet current code, despite the
fact that the 1990 agreement allows compliance with codes in effect
in 1986. A new agreement, which replaces all previous agreements
related to the property, was approved by staff and the Commission
on May 16, 1995. staff has been instructed to enforce this
agreement, al though not signed by Tradewinds, on Mr. Morton's
statement that Tradewinds is agreeable to signing.

'rhis is to advise you J:hat on April 20, 1993, the City Commission
of Boynton Beach approved the site Plan at the above referenced
location.
The approval of the Site Plan was subject to the following
conditions:
1. Moving the dumpster enclosure to the Northwest corner of
the site;
2. Adding landscaping to the drainage area at the northwest
corner of Woolbright Road and southwest 8th street;
3. Subject to all outstanding comments from reviewing
departments and attached to the City commission back-up.
The Site Plan approval entitles you to develop the property as
shown on the approved plans. If you wish to modify the plan prior
to submission of your building plan, please contact the Planning
and Zoning Department. Modifications during the building permit
process will be handled as part of that process. The approval of
the Site plan remains in effect for one year, until April 20, 1994.
If an extension is needed, please forward your request to the
Planning and zoning Department 30 days prior to the expiration
date.
We have attached a list of submittal documents from the BUilding
Department to assist you in assembling your building permit
package. We have also attached copies of the comments that must be
met in the building permit submittal.

similar. Mr. Hallahan advised that they have common characteristics. The major
difference is that the trees selected for Woolbright are the Carpent~ria and the
ones on Congress are Washingtonia Pa~. He would >.pro~bly steer toward the
Carpentaria Palms because the Walh1ngtonia Palms are too large for the ~tility
islands. Commi~oner Aguila noted that Yellow Tabebuia are proposed o~,
Woolbright and pointed out that they are very messy.
Maintenance Responsibility of Off-Site Improvements:
City Manager Parker state~ that the City Attorne~ advised that the best way to\
~ndle this is by a separate maintenance agreement~ not a dedication on the

t b. All structures requiring the pickup of large
quantities of garbage or trash shall provide an
easily accessible area for the pickup and
-delivery of a dumpster or other trash receptacle;
all such areas shall be so designed that garbage
and trash pickup can be accomplished without
excessive maneuvering such as turning around and
backing up.
K. PERMANENT RESERVATION OF SPACES. Area reserved for
off-street parking or loading, in accordance with the
requirements of this section, shall not be reduced in
area or changed to any other use unless equivalent
off-street parking or loading is provided in accordance
with this section.
L. COMMERCIAL ESTABLISHMENTS ENGAGED IN THE RETAIL SALE OF
GASOLINE OR GASOLINE PRODUCTS.
1 . Purpose. The purpose of these regulations is to
establish development standards for commercial
establishments which engage in the sale of gasoline,
or other motor fuels. These regulations are intended
to cover businesses of any type, including
convenience stores and automotive service stations.
The development standards established by this section
would overlay the development criteria stated in the
zoning district in which these uses are allowed.
Businesses, which engage in the sale of gasoline or
other motor fuels, shall require conditional use
approval .
2. Definitions. For the purpose of this ordinance, the
following definitions shall apply:
Automotive service station. The use of a building or
other structure, on a lot or parcel of land which
includes any retail sale of gasoline or other motor
fuels.
Convenience store. Any place of business that is
engaged in the retail sale of groceries, including
the sale of prepared foods, and gasoline and
3services. The term "convenience store" does not
include a store which is solely or primarily a
restaurant.
Gasoline dispensing establishments. Any commercial
enterprise, including automotive service stations and
convenience stores, which engage in-the sale of
gasoline or other motor fuels to the public.
