DESCRIPTION: Basehart & Cottrell, Inc., agent for Racetrac
Petroleum, Inc., property owner of a portion of the Shoppes of
Woolbright PCD subdivision, proposed for development as a Racetrac
service station/convenience store is requesting approval of second
site plan extension to grant a 5 month retroactive and a one (1)
year time extension for site plan approval and concurrency
exemption. The'Racetrac site is located at the northwest corner of
Woolbright Road and S.W. 8th Street. The request, if approved,
would extend the expiration to April 20, 1996.
RECOMMENDATION: The Planning and Development Board, with a 4-3
vote, recommended approval subject to all staff comments (Planning

on May 6, 1995. Staff has been instructed to enforce this
agreement, although not signed by Tradewinds, on Mr. Morton IS

NATURE OF REQUEST
Basehart & cottrell, Inc., agent for Racetrac Petroleum Inc.,
property owner of a portion of the shoppes of Woolbright PCD
subdivision, proposed for development as a Racetrac service
station/convenience store is requesting approval of a second site
plan extension. The Racetrac site is located at the northwest
corner of Woolbright Road and S.W. 8th street (see Exhibit "A" -
location map). The request is for a five (5) month retroactive and
one (1) year time extension for site plan approval and concurrency
exemption (see Exhibit nB" - letter of request prepared by Basehart
& Cottrell, Inc.). If approved, the request would extend the
expiration of the site plan submitted by Racetrac to April 20,
1996.
BACKGROUND
On May 8, 1990, the Shoppes of Woolbright PCD plat was recorded.
A modification to the master plan was approved on April 20, 1993 to
allow a service station to be built within the PCD.
On April 20, 1993, the city commission approved the Racetrac site
plan ( see Exhibit "C" - approved Racetrac site plan). On April 30,
1993 the applicant submi~ted for a building permit, without paying
associated fees, to construct the service station (see Exhibit "0"
_ building permit application and October 5, 1995 memorandum from
Milt Duff of the Building Division).
On May 17, 1994, the city commission granted a one (1) year time
extension for site plan approval and concurrency exemption. This
extension expired April 20, 1995. A justification for the
extension was that power poles existed on the site and obstructed
the construction of the service station. FP&L was responsible for
the removal of the poles, which were located along the old S.W. 8th
street right-of-way. At that time the applicant indicated that by
mid-June 1994, FP&L would complete the removal of the poles and the
installation of new lines, which had been impeding their progress
in applying for a new building permit. On May 16, 1995, the
Building Department voided the permit application due to no
activity having occurred for six months or more.
On April 13, 1995, the Planning and Zoning Department received an
incomplete application~ an environmental review permit. On May
11, 1995, the Environmental Review Committee approved the
application, sUbject to conditions. These conditions have not yet
been satisfied. However, by code, the applicant has one year to
satisfy them.
Chapter 4, Section 5 of the city's land development regulations
which governs a request for an extension of a site plan states
that "At its discretion, the city Commission may extend the

approval of a site plan for a one year period, provided a request
for extension is filed prior to the expiration of the one (1) year
period. In granting such extensions, the city Commission may impose
additional conditions to conform the site plan to current
development standards." Historically, site plan extensions have
been granted under certain circumstances.
ANALYSIS
The request for time extension was filed five months after the site
plan expiration date, as the site plan approval was valid through
April 20, 1995 and the extension was filed September 14, 1995. A
site visit indicated that the power poles have been removed. As
previously stated, the applicant submitted for a bUilding permit to
construct the service station on April 30, 1993 and on May 16, 1995
the BUilding Division voided the permit application. As indicated
in the site plan ordinance, securing a building permit vests the
site plan. The applicant states in their letter of request that
the construction of the service station is expected to be completed ..,
by May of 1996.
Wi th respect to concurrency, the Shoppes of Woolbright PCD is
exempt and vested indefinitely without requiring extension. This
is a result of Comprehensive Plan Policy 9D.5.2., which states that
development orders which are the sUbject of, or required by court
orders, shall be construed to be vested for as long as the court
order remains in effect. The Shoppes of Woolbright PCD was a
result of the Tradewinds lawsuit.
RECOMMENDATION
The Concurrency Review Board and Technical Review Committee met on
September 26, 1995 to discuss this request. They have unanimously
recommended that the five (5) month retroactive and one (1) year
site plan extension be granted, subject to compliance with the
previously approved site plan and permit review comments. This
recommendation is based on a technical standpoint only and does not
take into consideration whether there have been changing market or
economic conditions; nor does it re-evaluate the appropriateness of
the use at this location or in relation to the rest of the PCD.
Since by court order, the PCD cannot be held to new changes in
city's codes, other than those codes which are life/safety related,
the 1993 approved site plan does not have to be reviewed against
any code changes that may have occurred between 1993 and the
present.

NATURE OF REQUEST:
Nolan Sims, agent for Racetrac, property owner of a portion of the
Shoppes of Woolbright PCD plat, proposed for development as a
Racetrac service Station/Convenience Store is requesting approval
of a site plan extension. The Racetrac site is located at the
northwest corner of \oloolbright Road and S. W. 8th Street (see
attached location map). The request is for a one (1) year period
(see attached Exhibit "A" prepared by Nolan Sims, Project Manager
of Racetrac). If approved, the request would extend the expiration
of the site plan submitted by Racetrac to April 20, 1995.
BACKGROUND:
On May 8, 1990, the Shoppes of Woolbright PCD plat was recorded.
A modification to the master plan was approved on April 20, 1993 to
allow a service station to be built within the PCD and on April 20,
1993 the City commission approved the Racetrac site plan. Since
the approval of the site plan the applicant has submitted for a
building permit to construct the service station.
There are power poles that exist on the site and obstruct the
construction of the service station. FP&L removal of the poles,
which consists of several poles along the old s. W. 8th Street
right-of-way, is in progress. The applicant indicated that mid
June 1994 is the anticipated time of completion of the removal of
the poles and the installation of new lines.
The Code of Ordinances which governs a request for an extension of
a site plan is specified in Part III, Chapter 4, Section 5,
Section 5 states that "At its discretion, the City Commission may
extend the approval of a site plan for a one year period, provided
a request for extension is filed prior to the expiration of the one
(1) year period. In granting such extensions, the City Commission
may impose additional conditions to conform the site plan to
current development standards." Historically, site plan extensions
have been granted under certain circumstances.

Basehart & cottrell, Inc., agent for Racetrac Petroleum Inc.,
property owner of a portion of the Shoppes of Woolbright PCD
subdivision, proposed for development as a Racetrac service
station/convenience store is requesting approval of a second site
plan extension. The Racetrac site is located at the northwest
corner of Woolbright Road and S.W. 8th Street (see Exhibit "A" -
location map). The request is for a five (5) month retroactive and
one (1) year time extension for site plan approval and concurrency
exemption (see Exhibit "B" - letter of request prepared by Basehart
& Cottrell, Inc.). If approved, the request would extend the
expiration of the site plan submitted by Racetrac to April 20,
1996.
BACKGROUND
On May 8, 1990, the Shoppes of Woolbright PCD plat was recorded.
A modification to the master plan was approved on April 20, 1993 to
allow a service station to be built within the PCD.
On April 20, 1993, the City Commission approved the Racetrac site
plan (see Exhibit "C" - approved Racetrac site plan). On April 30,
1993 the applicant submitted for a building permit, without paying
associated fees, to construct the service station (see Exhibit "D"
- building permit application and October 5, 1995 memorandum from
Milt Duff of the Building Division).
On May 17, 1994, the City Commission granted a one (1) year time
extension for site plan approval and concurrency exemption. This
extension expired April 20, 1995. A justification for the
extension was that power poles existed on the site and obstructed
the construction of the service station. FP&L was responsible for
the removal of the poles, which were located along the old S.W. 8th
Street right-of-way. At that time the applicant indicated that by
mid-June 1994, FP&L would complete the removal of the poles and the
installation of new lines, which had been impeding their progress
in applying for a new building permit. On May 16, 1995, the
Building Department voided the permit application due to no
activity having occurred for six months or more.
On April 13, 1995, the Planning and Zoning Department received an
incomplete application~ an environmental review permit. On May
11, 1995, the Environmental Review Committee approved the
application, subject to conditions. These conditions have not yet
been satisfied. However, by code, the applicant has one year to
satisfy them.
Chapter 4, Section 5 of the city's land development regulations
which governs a request for an extension of a site plan states
that "At its discretion, the City Commission may extend the

been granted under certain circumstances.
ANALYSIS
The request for time extension was filed five months after the site
plan expiration date, as the site plan approval was valid through
April 20, 1995 and the extension was filed September 14, 1995. A
site visit indicated that the power poles have been removed. As
previously stated, the applicant submitted for a building permi t to
construct the service station on April 30, 1993 and on May 16, 1995
the Building Division voided the permit application. As indicated
in the site plan ordinance, securing a building permit vests the
site plan. The applicant states in their letter of request that
the construction of the service station is expected to be completed
by May of 1996.
Wi th respect to concurrency, the Shoppes of Woolbright PCD is
exempt and vested indefinitely without requiring extension. This
is a result of Comprehensive Plan Policy 9D.5.2., which states that
development orders which are the subject of, or required by court
orders, shall be construed to be vested for as long as the court
order remains in effect. The Shoppes of Woolbright PCD was a
result of the Tradewinds lawsuit.
RECOMMENDATION
The Concurrency Review Board and Technical Review committee met on
September 26, 1995 to discuss this request. They have unanimously
recommended that the five (5) month retroactive and one (1) year
site plan extension be granted, subject to compliance with the
previously approved site plan and permit review comments. This
recommendation is based on a technical standpoint only and does not
take into consideration whether there have been changing market or
economic conditions; nor does it re-evaluate the appropriateness of
the use at this location or in relation to the rest of the PCD.
Since by court order, the PCD cannot be held to new changes in
city's codes, other than those codes which are life/safety related,
the 1993 approved site plan does not have to be reviewed against
any code changes that may have occurred between 1993 and the
present.
