concerning this site that must be rectified (excluding issues that are
covered entirely with a city approved surety) .
If any outstanding conditions are related to permits issued by the
Building Division, please provide this division a memorandum containing a
description of the unresolved conditions. If the unresolved conditions
are not permit related, please notify the owner or the owner's agent to
ensure that the matters are rectified.
Please respond to me, within ten (10) days in order that we may proceed
in a timely manner to issue the Certificate of Occupancy. No response is
necessary if your department is satisfied with the current state of the

You have asked me to examine an apparent conflict between section
11 L 5 of Appendix A of the Zoning Regulations and Section 5-
142 (h) (3) as they relate to setback requirements for driveway
entrances from intersecting right-of-ways. stated differently,
you have posed the following question:
Should the requirements of the Boynton Beach Parking
Lot Regulation be applied to the construction of
driveway entrances for service stations?
The question is answered in the negative.
There are several principals of statutory construction that must
be applied:
1. The principals of statutory construction apply to
zoning ordinances which are issued by cities. Rinker Materials
Corp. v. city of Miami, 286 So.2d 552 (Fla. 1973).
2. The general, and most persuasive rule of statutory
construction is that whenever possible, the Courts will, and
must, attempt to construe related statutory provisions, if
conflicting, in such a way as to harmonize them and give them
both full effect. Palm Harbor Soecial Fire Control District v.
Kellv, 516 So.2d 249 (Fla. 1987); villery v. Florida Parole and
Probation Commission, 396 So.2d 1107 (Fla. 1980); District School
Board of Lake County v. Talmadqe, 381 So.2d 698 (Fla. 1980).
3. Where a statute is passed with knowledge of prior
existing laws, construction is favored which gives each statute a
field of operation rather than a construction that would leave
one statute meaningless or released by implication. State
Del;)artment of Public Welfare v. Galilean Children's Home, 102
So.2d 388 (Fla.~DCA 1958).

ambiguities which may arise from conflicting zoning ordinances
should be resolved in favor of the property owner. Thomas v.
Citv of Crescent city, 503 So.2d 1299 (Fla. 5th DCA 1987).
5. Courts must also give specific, terms and provisions
precedence over those terms and provisions which are more general
in nature if the two provisions conflict. Lake Barrinaton
citizens Commission v. Villaqe of Lake Barrington, 312 NE.2d 337
(1974).
In applying the above rules of statutory construction to the
question posed I conclude that the two provisions of the Code are
not in conflict and can be read together. The parking lot
regulations should be generally applied to all parking lot
construction unless a more specific ordinance of the City exists,
such as the one which applies to service stations. The Boynton
Beach parking lot regulation does not apply to the construction
of driveway entrances for service stations. Section 11 L 5 of
Appendix A controls the distance requirements for parking lot
entrances for service stations.

Dear Mr. Morton:
'rhis is to advise you that on April 20, 1993, the City Commission
of Boynton Beach approved the Site Plan at the above referenced
location.
The approval of the Site Plan was subject to the following
conditions:
1. Moving the dumpster enclosure to the Northwest corner of
the site;
2. Adding landscaping to the drainage area at the northwest
corner of Woolbright Road and Southwest 8th street;
3. Subject to all outstanding comments from reviewing
departments and attached to the city commission back-up.
The Site Plan approval entitles you to develop the property as
shown on the approved plans. If you wish to modify the plan prior
to submission of your building plan, please contact the Planning
and Zoning Department. Modifications during the building permit
process will be handled as part of that process. The approval of
the Site Plan remains in effect for one year, until April 20, 1994.
If an extension is needed, please forward your request to the
planning and Zoning Department 30 days prior to the expiration
date.
We have attached a list of submittal documents from the Building
Department to assist you in assembling your building permit
package. We have also attached copies of the comments that must be
met in the building permit submittal.

Your question is answered in the affirmative.
Section 11 L 2 of Appendix A provides that the minimum
frontage for service stations is 175 feet on all abutting
streets. No specific method of measurement is provided.
However, the Boynton Beach Parking Lot Regulations, adopted
after Section 11 of Appendix A, provides guidance for
purposes of interpretation. Section 5-142(h)(3) deals with
driveway set-backs and provides that the measurement is
"from the intersection of the right-of-way lines along local
streets". This appears to be a practicable approach to the
measurement of frontage since lot configurations are
variable. Accordingly, this method of measurement should be
used to calculate frontage. For purposes of clarification I
have attached a diagram. .

'fhis is to advise you that on April 20, 1993, the City Commission
of Boynton Beach approved the site Plan at the above referenced
location.
The approval of the Site Plan was subject to the following
conditions:
1. Moving the dumpster enclosure to the Northwest corner of
the site;
2. Adding landscaping to the drainage area at the northwest
corner of Woolbright Road and Southwest 8th street;
3. Subject to all outstanding comments from reviewing
departments and attached to the city commission back-up.
The Site Plan approval entitles you to develop the property as
shown on the approved plans. If you wish to modify the plan prior
to submission of your building plan, please contact the Planning
and Zoning Department. Modifications during the building permit
process will be handled as part of that process. The approval of
the Site Plan remains in effect for one year, until April 20, 1994.
If an extension is needed, please forward your request to the
planning and Zoning Department 30 days prior to the expiration
date.

1. Referenced in Mr. Staudinger's Memo is the current code and not the 1986
Code which is the standard for the development of this parcel. In the 1986
Code the 180 foot dimension referenced in Mr. Staudinger's Memo is not a
requirement. The plan as submitted meets the 1986 Code.
2. A South Florida Water Management Permit for this area requires that one 1/2
inch pre-treatment be provided for a commercial development. The balance of
the water quality treatment is provided within the lake. The comment regarding
the inlet situated at Southwest 8th Street is not relevant since it's part of the
overall water management system. If the City desires, we agree to a condition
of the approval such that the applicable portions of the Southwest 8th Street
drainage and retention system be approved by the City prior to connection of

L. SERVICE STATIONS WITH OR WITHOUT MAJOR RE-
PAIRS. The following regulations shall apply to all service sta-
tions constructed on or after January 1, 1983. Where an existing
service station is modified in any way, the building official, tech-
nical review board, planning and zoning board, and/or city coun-
cil may impose any or all of the following regulations where
doing so would create significant benefits to the public safety and
welfare, and where the standards contained in the following reg-
ulations could be reasonably accommodated on the existing site.
1. There shall be a minimum distance of one thousand (1,000)
feet between the nearest property line of the lot or plot of
land upon which the proposed service station is to be con-
structed, and the nearest property line of a lot or plot of
land upon which any other gasoline service station, church,
public playground, hospital, public school or other similar
public or semipublic place where large numbers of people
congregate, is located. Such distance shall be by direct
airline measurement.
2. The minimum size plot of land shall be seventeen
thousand five hundred (17,500) feet in area with a
minimum frontage of one hundred seventy-five (175)
feet, on all abutting streets.

3. At least ten (10) percent of the gross plot area shall consist
of landscaping equipped with adequate sprinkle systems of
which at least five (5) percent shall be adjacent to the public
right-of-way. All landscaping shall be maintained in a
healthy growing condition.
4. There shall be a minimum distance of fifteen (15) feet be-
tween the location of a gas pump island and any adjacent
property line.
5. Driveway entrances shall measure no more than forty-five
(45) feet across and be located no closer than forty (40) feet

height and meeting the provisions of the building code shall
be constructed along all property lines abutting residen-
tially zoned property to a distance of twenty-five (25) feet of
any street right-oC.way line. The wall shall be kept in good
repair and appearance at all times. Openings with gates
may be allowed where deemed reasonable by the building
official.
8. The entrance to the building wherein motor vehicles are
washed by mechanical means as a primary function, shall
be located on a lot or plat a minimum distance of seventy-
five (75) feet from the street line to provide an ofT-street
area for waiting vehicles.

The Building Department has reviewed the above referenced
resubmitted plans. We have found that the response to #1 of our
first review is in compliance with Appendix A, section II, E.
4(A) setback of a 20' minimum for the canopy; however, not with
the required setback for PCD zoning of the 30' side yard, and the
40' front and rear yard requirements. Please see #2 of
memorandum #93-042. Please note that the setback for the canopy
is from the edge of the canopy, and no structure can be permitted
within an easement.
We still require a response to #3, #5, and #6, with
relocation of the 12' easement, prior to our recommendation for

The Building Department has the following comments which need to be
addressed before a permit can be issued for the above referenced project:
1. All setback dimensions must be shown on the site plan.
2. Setbacks from both S.W. 8th Street and Woolbright Road are required to
be a minimum of 40' and a peripheral greenbelt is required on all
sides in order to comply with Appendix A, Section 6.F.7. (Design
Criteria for PCD District).
3. A sign program, per Chapter 21 of the Code of Ordinances, is required,
showing all signs in compliance with the same, including the number of
signs, height, type and size.
4. Submit a floor plan of the building and show the elevation of the
canopy and its height above fire lanes.
5. Please state on the plans how you will finish the remaining portions

6. Show on the plans a detail of the handicap curb cut or ramp from the

Staff has reviewed the plan and are unable to recommend it moving
forw~rd due to the following:
1. Previous note #1, Utility memorandum 93-073, has not
been rectified. Staff has contacted Mr. Kolb with CCL,
as requested in his March 18, 1993 letter, and
explained that the gravity sewer under the proposed
service road has not been constructed nor is it
presently permitted.
2. Previous note #5, Utility memorandum 93-073, has not
been rectified. Staff has contacted Mr. Kolb with CeL,
as requested in his March 18, 1993 letter, and
explained that the Lift Station 608 and 609 reroute,
dated January 1990, although permitted, has never been
constructed. Until this reroute is complete, the force
main across RaceTrac is active. Since the reroute was
a condition of the overall D.C.D. approval, we will not
entertain the suggestion of rerouting this active force
main around the site.
The remaining comments, No.s 2 through 4, 6 and 7, have been
addressed sufficiently by the consultant's letter of March 18,
1993, and can be monitored at time of building permit issuance
once the site plan is approved.

4. Potable water shall not be used for irrigation.

5. An active force main runs across the site. As a

SUBJECT: Racetrac Convenience Store/Gasoline Sales
CCL Consultants, representing Racetrac Gasoline, has filed for a
site plan review for a convenience store with 12 gas pumps at the
northwest corner of Woolbright Road and southwest 8th Street. This
site is an outparcel of Parcel B in the Shoppes of Woolbright PCD.
The site would contain a 3040 square foot convenience store with 12
gas pumps. The proposed development meets the overlay zoning for
gasoline sales that was applicable in 1986 and some sections of the
ordinance adopted in 1992.
The Planning and Development Board reviewed this site plan and
forwarded it to the City Commission with a recommendation for
approval.
This request has been scheduled for review and consideration by the
City Commission at its meeting of April 20th, 1993.

Dear Scott,
As a result of our on-site meeting with Mr. Morton yesterday, he will level out and seed
and mulch the large sand stockpile on the north side of the pond. Once this action is
completed, he is requesting we review the permit plans for the Racetrac Gas Station at
SW 8th and Woolbright Road. At the City Commission and Planning and Development
Board meetings I was directed not to approve the permit plans for this project, which
utilizes the lake for retention, until the lake problem with blowing sand was fixed. This
letter is my request that this matter be placed on the agenda of the May 18, 1993 City
Commission meeting for discussion. I believe it is appropriate that the Commission
concur with staffs/action in this matter.

Entrance Drive Widths
Dear Mr. Kolb:
I am in receipt of your letter dated March 31, 1993 requesting two (2) 45 foot wide
entrance drives for the referenced project: No supporting data, such as truck routing,
tank fill locations, etc. was supplied. I certainly concur that the entrance drive off
Woolbright Road will be used for gasoline deliveries to the station and is therefore
justified to be 45 feet in width. However, the entrance drive off SW 8th does not appear
to be readily accessible to trucks as SW 8th is a divided roadway that dead-ends just
north of the proposed station site in a manner which would not allow a U-turn by a
gasoline tanker. I suggest you reduce the entrance drive on SW 8th to the 32 foot
maximum in the parking lot code or provide backup material to justify a wider entrance
drive.

meet the requirements of the intersection analysis requested during site plan approval.
In addition I have questioned the need for a 45 foot wide driveway on SW 8th Street.
That may affect Mr. Fernandez's note number 2 pertaining to substandard radii. I
specifically need an intersection analysis detailing turn and through traffic before and after
the siting of the gas station.

study wa5 to determine the amount of retaiJ/cOnunerdal square footage that will have to be reduced from the
approved pen \0 accommodate the proposed gas station and convenience store.
CONCLUSION
Tbe gas 8tatioJ:l/convenience store will generate 121.5 net daily trips. To aca>mmodate these trips, the
commercial/retail development program (or the peD will have to be reduced by 32,000 squalC feet. Our
conclusion was based on the following analysis.

3. At least ten (10) percent of the gross plot area shall consist
of landscaping equipped with adequate sprinkle systems of
which at least five (5) percent shall be adjacent to the public
right.of-way. All landscaping shall be maintained in a
healthy growing condition.
4. There shall be a minimum distance of fifteen (15) feet be-
tween the location of a gas pump island and any adjacent
property line.
5. Driveway entrances shall measure no more than forty-five
(45) feet across and be located no closer than forty (40) feet
to any street intersection or nearer than twenty-five (25)
feet to any interior property line.
6. There shall be constructed a safety island of grass or con.
crete for pedestrians between two (2) driveways which shall
be ten (10) feet in width and no less than twenty (20) feet in
length measured along its side abutting a sidewalk or
paving of said station, whichever is in the plan of construc-
tion.
7. A masonry or concrete louver wall at least five (5) feet in
height and meeting the provisions of the building code shall
be constructed along all property lines abutting residen-
tially zoned property to a distance of twenty-five (25) feet of
any street right-of-way line. The wall shall be kept in good
repair and appearance at all times. Openings with gates
may be allowed where deemed reasonable by the building
official.
8. The entrance to the building wherein motor vehicles are
washed by mechanical means as a primary function, shall
be located on a lot or plat a minimum distance of seventy-
five (75) feet from the street line to provide an off-street
area for waiting vehicles.

TRC COMMENTS - RACETRAC GAS SERVICE STATION
The Building Department has the following comments which need to be
addressed before a permit can be issued for the above referenced project:
1. All setback dimensions must be shown on the site plan.
2. Setbacks from both S.W. 8th Street and Woolbright Road are required to
be a minimum of 40' and a peripheral greenbelt is required on all
sides in order to comply with Appendix A, Section 6.F.7. (Design
Criteria for PCD District).
3. A sign program, per Chapter 21 of the Code of Ordinances, is required,
showing all signs in compliance with the same, including the number of
signs, height, type and size.
4. Submit a floor plan of the building and show the elevation of the
canopy and its height above fire lanes.
5. Please state on the plans how you will finish the remaining portions
of Tract B.
6. Show on the plans a detail of the handicap curb cut or ramp from the
handicap space to the store and from the public street to the store,
per the State Handicap Code.
Please note that all building code requirements must comply with the code
in effect at the time of permitting, per a legal opinion from our City
Attorney.

I have reviewed the March 29, 1993 Trip Generation Analysis submitted by the
applicant addressing the reduction in commercial square footage resulting from the
modification of PCD uses to include a gas station and convenience store at SW 8th &
Woolbright Road within The Woolbright Place PCD. My review included coordination
with Mr. Dan Weisberg of Palm Beach County concerning the appropriate trip
generation rates, pass by trips & internal trip credits for the gas station/convenience
store. I do concur that the addition of the Gas Station and 3040 SF Convenience
Store and the reduction of commercial square footage to 28,000 SF will not result in a
net increase in trip generation for Parcel B of the PCD.

However, to date I have received no study or analysis of the impact of the Gas
Station/Convenience Store on the intersection of SW 8th & Woolbright Road. This
study is requested in my TRC comments. It is necessary to determine the effect of
the proposed driveway and related turn movements on the subject intersection, and
remains and outstanding comment on the Master Plan Modification and on the Site
Plan.
