On February 22, 1993, your submittal for Site Plan Review of the
above referenced project was reviewed for completeness. It has been
determined that the submittal is substantially complete and accepted
for further processing. Dorothy Moore will be responsible for the
review and coordination of your site plan thru the remainder of the
Site Plan Review process.
The next step in the review process is for the Technical Review
Committee to review the submittal for compliance with the review
standards identified in Part III, Land Development Regulations,
Chapter 4, Site Plan Review, Section 8 and all applicable sections
of the Boynton Beach Code of Ordinances. The results of the review
will be forwarded to you within twenty (20) days of the date
identified in the first paragraph of this letter.

The following comments are in response to the submittal of the site
plan for the above referenced project. The comments for the project
will be discussed at the March 11, 1993, Technical Review Committee
meeting. The site plan was reviewed for consistency with the review
standards specified in section 8 of Chapter 4, Site Plan Review,
Part III, Land Development Regulations of the code of Ordinances.
The applicant shall amend the drawings and documents to show
compliance with the following comments:
1. Submit a recent certified property survey of the site, clearly
illustrating existing conditions and ownership. There are
inconsistencies between the submitted site plan application
and the Red Lobster site development plans concerning
ownership of the property.
2. We have found inconsistencies in the total summation of the
horizontal control dimensions and the setback dimension at the
south boundary line as shown for the Red Lobster building on
the site development plan and the previously approved IlBoynton
Beach Promenade, Alterations and additions toll site plan.
These inconsistencies will be documented as amendments to the
approved Boynton Beach Promenade site plan and will be filed
as such.
3. The dimensions as provided on the Red Lobster site development
plan for the south boundary horizontal control dimensions do
not add up to 59'0" as shown on the plans but rather 58'0".
Correct the dimensions accordingly.
4. There are inconsistencies between the previously approved
"Boynton Beach Promenade" (Alterations and additions to) site
plan and the submitted Red Lobster site development plan. To
clarify these inconsistencies between the two sets of plans,
please submit and make a part of the Red Lobster site plan the
project data that is consistent with the approved site plan
for the flBoynton Beach Promenade, Alterations and Additions
to." Include this information onto your site development plan
page C-2, fiRed Lobster."
5. The architectural design and colors are different than the
existing structures on the site. The Planning and Development
Board will make a determination if the design, colors and
materials are acceptable. Also, the inclusion of neon as a
signage is not included in any of the signage of the approved
sign program. The planning and Development Board will make a
determination if the signage is acceptable. (see attached
Section 8, Review standards, 8.5 to 8.5.4, Building and other
structures)

Red Lobster Restaurant at The Promenade
I have reviewed the above referenced plan submission and herein
provide the following conditions of approval:
1) Page CI of the Engineer's plan(s), that being Caulfield and
Wheeler, Inc., under Notes, paragraph #1 indicates that General
Mills Restaurants, Inc. are the owners of the outparcel depicted
with bold lines on the submitted plans, including a statement
that the submitted survey is, in fact, "Plat".
According to the City of Boynton Beach, Florida Code of Ordinances,
specifically Appendix "A", "zoning", Section 11,1, "Location of
Off Street Parking Spaces", subsection 12, General Mills Restaurant
must purchase the required number of parking stalls in order to
satisfy this section of the City's ordinances which states as
follows:
'~equired parking spaces for all other uses (except
dwellings) shall be owned by the owner of the
building lot to be served, and shall be located on
the same lot, or not more than 300' distance, as
measured along the nearest pedestrian walkway."
In accordance with the aforementioned City code, the owner shall
purchase the required number of parking stalls necessary to serve
the proposed Red Lobster site, unless relief is granted by the
City via legislative and/or administrative action necessary to
meet the intent of this ordinance.
By copy of this memorandum to the City Attorney, I am requesting
a legal opinion as to whether or not the aforementioned code may
be satisfied, reference it's intent, by the original land owner
providing a shared parking agreement to General Mills Restaurants,Inc.
2) This outparcel, being a separate subdivision of the main parcel,
would be in a state of non-compliance with the codes as currently
exists no street frontage and/or guaranteed access from public
rights-of-way to this location, therefore, the applicant shall
provide an ingress/egress access agreement commencing from a point
at the Congress Avenue right-of-way at the Boynton Beach Mall
access road and terminating at a point to the parking facility
which shall serve this structure.
3) A determination as to whether or not the applicant shall be
responsible to plat this outparcel and/or submit a request for
an exception or exemption from the subdivision regulations, will
be considered and discussed during the Technical Review Committee
meeting wherein all factors will be considered prior to generation of
that decision. The Engineering Department reserves the right to
submit comments regarding this issue after the first consideration
of this plan by the Technical Review Committee.

Find attached for your review the plans and exhibits for the above
referenced project. Site Plan Review approval for this project
will be granted by the City Commission. To ensure that the project
stays on line with the review time frame, I request that the plans
and exhibits be reviewed and formal comments transmitted to the
Director of the Planning and Zoning Department no later than 5:00
P.M. on March 8, 1993.
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review, Section
8 to review and formulate comments. (See planning
& Zoning Department memo #92-020)
2. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the Site Plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards, additional data
should be requested by the reviewer through the Planning and
Zoning Department.

3. Each comment shall reference the code section and include the
language of the submittal requirements and review standards
that require the data to be submitted for review.
4. Technical Review Committee member (s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific code
section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review
specified.
6. If a TRC member finds the plans acceptable, he/she shall forward
the plans and a memo, within the time frame stated above, to the
Planning and Zoning Director stating that the plans are approved
and they do not have any comments on the plans submitted for
review.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Dorothy Moore will be the Planning and Zoning
Department staff member coordinating the review of the project.
The Planning and Zoning Department will send to the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.
