This letter is to authorize Mr. Eduardo Carcache from CKE Group, Inc.
to act as our agent for Taco Bell in regards to the parking lot
variance for the above referenced Taco Bell restaurant.
Taco Bell Corp. is the contract purchaser for this property. Purchase
of the property is contingent on getting necessary approvals to build
this propose restaurant.

GENERAL INFORMATION FOR APPLICATIONS FOR
VARIANCES TO PARKING LOT REGULATIONS
1. All applications for variances to the Parking Lot
Regulations must be received and accepted by the Planning
Department at least six (6) weeks prior to the regular
meeting of the Planning and Zoning Board.
2. All variances which are requested in connection with the
construction of reconstruction of a particular parking lot
are covered by an application and filing fee (consult City
of BOYnton Beach Land Development Fee Schedule). A separate
application must be completed for each specific design
requirement (Sec. 5-142) or permit application requirement
(Sec. 5-144) to which a variance is requested (see note at
bottom of page two).
3. An application for a variance may be processed at the same
time that an application for site plan approval or approval
of subdivision construction plans is submitted. However,
submittal deadlines vary for different applications.
Contact the Planning Department for further details.
4. All parking lot variance applications are reviewed by the
Technical Review Board (TRB) which consists of the
department heads or designated representatives of those City
departments concerned with land development. The TRB may
recommend to the Planning and Zoning Board that the variance
request be approved, approved with modifications, or denied.
The applicant is not required to attend the TRB meeting.
The applicant will be notified as to the modifications
recommended by the TRB. The applicant should be prepared to
respond to all TRB recommendations at the hearing before the
Planning and Zoning Board. A copy of the staff report and
recommendation is available from the Planning Department
prior to the Planning and Zoning Board meeting.
5. All applications for variances are advertised for a public
hearing in a newspaper of general circulation. If possible,
the public hearing will be scheduled for the same Planning
and Zoning Board meeting that the site plan or subdivision
constructions plans are reviewed. At the public hearing
before the Planning and Zoning Board, any person may comment
favorably or unfavorably on the variance request. The
applicant or his agent must attend the meeting.
6. The Planning and Zoning Board gives final approval or denial
to parking lot variances, except those which are approved or
denied by less than a unanimous vote of the entire Board, in
which case the application shall be forwarded to the City
Commission for final disposition. The Planning and Zoning
Board or City Commission may approve, approve with
modifications, or deny such variances.
7. Prior to Obtaining a building permit, all modifications
required by the Planning and Zoning Board must be shown on
the site plan or subdivision construction plans.
8. All applicants with approved site plans or subdivision
construction plans, or approved parking lot variances, which
at a later date request an additional variance, or variance
modification, will be required to submit a complete variance
application and filing fee, and will be subject to all Code
requirements in effect at the time the additional variance
is requested.

approval and presented to the Planning & Development Board, the
variance request must be recommended for' approval by the Technical
Review Committee.

Accompanying this memorandum you will find a copy of the
application and related documentation for the above-referenced
request for a variance to Chapter 23 "Parking Lots", Article II,
Section H. 5. of the city's Land Development Regulations. A check
in the amount of $400.00 to cover the review and processing of this
application has been forwarded to the Finance Department. The
