The undersigned hereby petitions the Planning and Zoning Board to
grant to the petitioner a variance to Article X "Parking Lots",
of Chapter 5, "Building, Housing and Construction Regulations",
of the Code of Ordinances of the City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated below:
Section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
Chapter 7.5 Environmental Regulation Article II Landscape Code Section 5.E which states:
Perimeter landscaping relating to abutting properties. On the site of a building or
structure or open lot use providing an off-street parking area, such area shall be
provided with a landscape barrier, preferable a hedge, to form a continuous screen
between the off-street parking and abutting property. Such landscape barrier shall be
located between the common lot line and parking area.
Nature of Variance Requested: To eliminate the required hedge on the eastern side
of the proposed and existing parking areas which will exist to the east of the existin~
structure due to the uses that exist to the east (LWDD r/w, FP&L esmt. and 1-95) and
an exiting hedgerow of vegetation. Additional landscape along Congress Ave. and addition,

interior greenspace will be provided.
Statement of Special Conditions, Hardships, or other reasons
Justifying the Requested Variance (attached additional sheets if
necessary) :
Special conditons exist in that the subject site abuts properties that will not develope
except for transportation or utility purposes. The proposed parking area is a minimum of
500' to 700' from 1-95 and will not be visible. A literal enforcement of this requiremen
would be an undue hardship on the applicant in that providing the hedge will not further
the Code's intent to buffer adjacent properties. Granting this variance will furthe~
the public interest in that additional buffering can then be provided along Congress
Avenue to screen parking areas visible to the public.

The nature of this landscape appeal Is to eliminate the required hedge on the eastern
sldo of the proposed and existing pal'klng areas Which are to the east of the existing
struoture, Due to the uses that exist to the east, that being I Lake Worth Drainage
District Rlght-of-Wavl FP & L easement and Interstate 951 and the fact that an existing
hedgerow of veg<<ation already exists along the eastern perimeter of the property. The

The undersigned hereby petitions the Planning and zoning Board to
grant to the petitioner a variance to Article X "Parking Lots",
of Chapter 5, "Building, Housing and Construction Regulations",
of the Code of Ordinances of the City of Boynton Beach, Florida,
as it pertains to the property described in this application, and
for the reasons stated below:
Section, Subsection, and Paragraph number of specific requirement
to which variance is requested, and exact language contained in
the Code:
Chapter 23 Parking Lots Article II
Paragraph F
Drainage
Nature of Variance Requested: The southern parking area on the subject
site will not be utilized by the new tenant, UPS. The nature of this variance
is to allow the existing parking area to remain "as-is" for future tenant use.
This parking area was constructed pursuant to a previously approved site
development plan prior to recent improvements required by today's Code.
Statement of Special Conditions, Hardships, or other reasons
Justifying the Requested Variance (attached additional sheets if
necessary) :
Special conditions are that the applicant is leasing a portion of an existing
building. The existing parking area to the south was constructed per old Code
regulations in effect at that time, and prior to the applicant's interest in the

A lltera interpretation of this provision would create an unnecessary hardship
on the applicant in that this parking lot is remote from their intended operation
and will not be utilized by the applicant as it is required to meet parking needs
of a future tenant. Granting this variance will not confer any special privileges
as the future tenant will be required to upgrade their respective parking area
just as the applicant is required to upgrade theirs.
