Description of Project:
The applicant is requesting site plan approval for a new one
thousand eight hundred sixty-five (1,865) square foot, forty four
(44) seat restaurant. The restaurant will be located on a .284
acre lot that has been subdivided from the Gateway Center property.
The new lot will have a different owner than the Gateway Center.
A cross parking and cross access agreement will be required because
the new site will not have direct access to a public right-of-way.
One (1) parking space is required for each one hundred (100) square
feet of gross floor area, therefore, nineteen (19) spaces are
required and twenty one have been provided. The landscaping
located around the perimeter of the north and east sides of the
site is part of the existing landscaping that was required for the
shopping center. The existing and new landscaping will be upgraded
to comply with City codes. proposed new landscaping is shown
around the base of the new freestanding sign and on two (2) sides
of the new dumpster enclosure. The site is located in the
Mediterranean/Spanish Design district.
Appendix II of the Community Design Plan specifies certain
architectural features that shall be incorporated into the design
of the building. The design of the building shown on the plans
does not show the appropriate architectural features. At present
time, the applicant has not requested an appeal to the Community
Design Plan. The location of the building complies with the

Review of Departmental Comments:
Please find attached the comments from all of the reviewing
departments. The Technical Review Committee recommends that the
project proceed forward through the approval process subject to the
following comments: Public works Memorandum #93-079, Memorandum
from Richard Staudinger, City Engineer, dated April 5, 1993;
Building Department Memorandum #93-074; utilities Department
Memoranda #93-137 and #93-039; and Planning and Zoning Department
Memorandum dated April 6, 1993 Reference 2nd Review File No. 716.
It should be noted that correcting the location of the dumpster
enclosure, depicting the correct setbacks and showing compliance
with the Community Design Plan will result in the appearance of the
site and building to change.
Recommendation:
The Planning and Zoning Department realizes that correcting the
outstanding comments will result in the configuration of the site
to change and the appearance of the building to be adjusted to
comply with the Community Design Plan. The applicant may apply for
a variance for a reduction in setbacks and also may request an
appeal of the Community Design requirements. At this time, the
applicant has not requested either and wants the project to proceed
through the process. Note: A comment regarding the Community
Design Plan requirements was included in the first review of the
project. The setback requirement and dumpster location was not
applicable until the 2nd Review when the site became independent
from the shopping center. Due to the unresolved issues stated in
the Staff comments, regarding the layout of the site and the design
of the building, the Planning and Zoning Department recommends that
the Planning and Development Board remand the project back to Staff
and direct staff to work with the applicant to resolve the staff
comments.

2ND REVIEW
The Building Department has no objection to this project being
forwarded to the Planning and Development Board since the
following comments can be addressed at time of permit:
I. Please show proof that the site has been legally subdivided
from the shopping center with all applicable cross access
and cross parking agreements. Absent proper subdivision,
Section 21-26 of the Sign Code requirements is applicable to
this site.
2. If the site is determined to be a legal outparcel, the
freestanding sign must comply with Section 21-25 of the
Boynton Beach Code of Ordinances and the sign must be a
maximum area of 64 square feet with a maximum height of 20
feet.
3. The total area of wall signs for the entire building can not
be more than 1 1/2 times the building's frontage.

Attached, for the applicant's use, are plans showing the
locations of existing water and sewer utilities available to this
site. Preferred location is the on site water and sewer
laterials as depicted on the as built drawing.
Fees and deposits for connection to these facilities will be
collected at the time of the building permit.
Backflow prevention on the water service will be required in
accordance with Ordinance 90-51, and a grease interceptor is
required on the sewage service in accordance with Ordinance Sec.
26-80(6).
Locations of utility connections, water meter, clean outs,
backflow preventors, grease interceptors and other related
appurtenances, will be reviewed at the time of the building
permit.

corrected on the amended plans or were generated as a result of the
reVlew of amended plans. All comments shall be corrected.
Correctlng the deficiencies may result in substantial changes In
the layout of the site and the design of the building. The
appllcant must understand that the following comments are comments
generated for Site Plan Review and that additlonal comments may be
forthcoming as a result of the review of the working drawings and
documents submitted to the Building Department for permits. All
permit documents are revlewed for compliance with the applicable
requirements specitied In the Boynton Beach Code of Ordinances.
Note: This proJect has changed from a leased out parcel to a
separately owned site.
1. To show compllance with General Note 6 found on sheet 2 of 13,
show no less than twenty (20) teet from the leading edge of
the proposed buildlng overhang to the east and south property
lines.
2. Identity on the site plan drawing the wldth of the mansard
root overhang.
3. Amend the parking tabulation to correctly identify the total
number of parking spaces provided at the site.
4. Submit tor reVlew a landscape plan that clearly illustrates
the existing and new trees, hedges, grass and other applicable
vegetation in compliance with City Codes. Include the
location, spacing, size and species of all landscape material.
Identify each species by common and botanical name. Include
a note on method of automatlc water supply, irrigation.
Specity that the plant materials shall conform to the
standards for Florida #1 or better and ensure that fifty (50)
