Find attached for your review the plans and exhibits for the
above referenced project. Site Plan Review approval for this
project will be granted by the city Commission. To ensure that
the project stays on line with the review time frame, I request
that the plans and exhibits be reviewed and formal comments
transmitted to the Site Development Division of the Planning and
Zoning Department no later than 5:00 P.M. on March 25, 1992.
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
section B to review and formulate comments. (See attached)
2. The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards,
additional data should be requested by the reviewer through
the Planning and Zoning Department.

3. Each comment shall reference the code section and include
the language of the submittal requirements and review
standards that require the data to be submitted for review.
4. Technical Review Committee member(s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific
code section may be included in their review comments with
the name of the appropriate TRC Member that is responsible
for the review specified.
6. If a TRC member findd the plans acceptable, he/she shall
forward the plans and a memo, within the time frame stated
above, to the Planning and Zoning Director stating that the
plans are approved and they do not have any comments on the
plans submitted for review.
All comments shall be typed and addressed to the Planning and
Zoning Director and transmitted to the Site Development Division
for distribution to the applicant. Please include the name and
phone number of the reviewer on this memo.
The Site Development Division will send to the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and submit to the Site
Development Division within 90 days twelve (12) sets of amended
plans for review. When the Site Development Division receives the
amended plans, they will distribute the plans with a cover memo
to all TRC Members for review and approval.

number of anticipated trips (27), we propose the traffic impact
study be waived.

Dear Mr. Haag:
Waste Management of Palm Beach is proposing to develop a waste
reduction f~cility for the purpose of mulching vegetative
materials.
In regards to this process our operating plans include the
following assumptions:
o The waste reduction facility will employ-five full-time
employees.
o The waste reduction facility will take delivery of some
30 in-bound loads of vegetative (only) materials; or,
some 600 cubic yards, each working day.
o The mulching process will reduce the volume of in-bound
materials by about 3:1 generating some 200 cubic yards
of mulch each day. Mulch will be loaded into 100 cubic
yard transfer trailers for out-bound transport.
Summarily, our operation will add a net of 27 daily trips.

Mr. Dorris:
The City of Boynton Beach has completed its first review of the
site plan for the above referenced project. Attached are comments
made by the reviewing departments during their initial review of
your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.)
When there are comments made by the reviewers that you feel are
not applicable to the approval of the project or will be
addressed separately and you have not amended the plans to comply
with the comment(s), you must prepare written explanation for
each comment stating why the comment is not applicable and return
the explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets of the plans to the Planning and Zoning Department.
When the amended plans and documents have been submitted to the
Planning and Zoning Department, they will be distributed to the
reviewing departments for a second review and the reviewers will

The following comments are in response to the submittal of the
site plan for the above referenced project. The project is
scheduled for review of comments and discussion of conditional
use at the March 31, 1992, Technical Review Committee meeting.
1. The perimeter boundary of the proposed site shown on the
location map found on Sheet A-2 of 10 does not match the
existing site plan, the proposed site plan shown on the same
sheet, or the survey that was included with the submittal.
Amend the plans to show consistency in representing the
perimeter boundary of the new site.
2. The piece of land shown on the survey as not subdivided is
substandard in size and shall be incorporated into the size
of the new mulching facility lot. (Appendix C, Subdivision,
Platting, Article X, Section 7)
3. Amend the required off-street parking space count specified
on Sheet A-2 of 10 to read "4 spaces." [No fewer than four
(4) parking spaces shall be provided for any non-residential
use - Appendix A-Zoning, Section 11.H.5] Identify on the
plan the total number of employees that will be working at
the new facility. (Section 8.3.4, Chapter 4, Site Plan
Review)
4. Amend the provided off-street parking space count specified
on sheet A-2 of 10 to identify the total number of spaces
that are provided at the site, less the number of spaces
that are dedicated and required for the adjoining site.

5. Add the following parking space information to sheet A-2 of
10:

8. This development order is subject to the Palm Beach County
Traffic Performance Standards Ordinance No. 90-40 since it
is a new non-residential project impacting county roads.
Submit information in letter form, regarding the number of
trucks and employees associated with this use and the amount
of mulch produced and shipped daily. If there are not any
trucks directly associated with the use list the number of
trucks that deliver organic material to the site and ship
same from the site on a daily basis. This information is
needed to determine the number of gross trips per day that
are generated by this use.
9. The attached Community Appearance Board (CAB) application
form must be completed and submitted, by the applicant, with
a fifty dollar ($50.00) application fee. Color samples of
the exterior finish materials are required to be submitted
with the application form. [Section 19-43, Article III,
Chapter 19]
10. Change the area identified on the landscape plan as existing
soil to an improved surface of appropriate landscape
material or an other acceptable surface. (Section 8.1,
Chapter 4, site Plan Review)
11. Indicate on the site plan drawing whether there is a
dumpster enclosure proposed to be placed around the dumpster
pad. If there is an enclosure proposed, show on the
landscape plan accent shrubs around three sides of the
enclosure. If there is not an enclosure, show on the
landscape plan hedge material two (2) feet on center around
three sides of the concrete dumpster pad. (Section 8.1,
Chapter 4, Site Plan Review)
12. To determine compliance with the Landscape Code, the
following information must be added to the landscape plan:
Identify the site specific landscape specifications
regarding the placement, location and spacing of required
landscape material. The specifications shall be noted as
identified in the text of the Landscape Code. Complete the
specifications by identifying the actual distance in feet
and/or area in square feet for each type of required site
specific landscaping for the proposed site. (Section 8.1,

We have reviewed the above site plan and can review pending
resolution of the following comments:
1) There exists a discrepancy between the location map and
site plan (sheet A-2) regarding the location of the east
property line. If the existing site is to maintain road
frontage at the cul-de-sac, the plan must reflect same

please support the calculations with actual test data fram a flow test on

Dear Mr. Dorris:
This is to advise you that on June 16, 1992, the City Commission
of Boynton Beach approved the Conditional Use for a vegetative
mulching facility at the above referenced location.
The approval of the Conditional Use was subject to the following
conditions:
1. All outstanding comments from the reviewing departments be
addressed at time working drawings are submitted for permit
review.
2. Sound reduction apparatus material and/or mufflers be added
to the mulching machinery and/or equipment to reduce the
sound level to the permissible commercial land use category
sound level of 65 (dB) decibels.
The Conditional Use approval entitles you to develop the property
as shown on the approved plans. If you wish to modify the plan
prior to submission of your building plan, please contact the
Planning and Zoning Department. Modifications during the building
permit process will be handled as part of that process. The
approval of the Conditional Use remains in effect for one year,
until June 16, 1993. If an extension is needed, please forward

submitted and reviewed. The following comments from the original
set of comments have not been satisfactorily corrected on the
amended plans. The deficient comments shall be corrected.
However, it is acceptable to show compliance with the outstanding
comments on the plans that are required to be submitted to the
BUllding Department for permit review.
1. Add to the landscape plan the contlnuous visual landscape
barrier that is required along the north, south and west
property lines of the new site. The landscape barrier is
required to screen the on-site vehicle use area from the
abutting right-of-way and from the abutting property.
Identify on the plan: the specie, spacing and height at
planting of the required landscape material. (Maximum
spaclng is two (2) feet on center. Mlnimum height at
planting is eighteen l18) inches. Fifty (50) percent of the
total number of plants are required to be a native specie)

2. Prior to the issuance of a bUilding permit to commence

Accompanying this memorandum you will find the approved site plan
package for the project(s) listed below. The site plan package
will include the following items:

approved by the City Commission at their regular meeting
held on June 16, 1992.

3. Waste Manaaement Mulchina Facilitv: Vegetative mulching,

Dear Mayor Weiner:
I represent the owners of the building and property located at 500
Industrial Way, Boynton Beach. This building is occupied by The
Palm Beach Post.
We fee very strongly that the proposed mulch site is totally
inappropriate at this location.
The odors caused by decaying vegetation and compost - regardless of
how quickly it may be chipped or mulched are noxious and a nuisance
to which I will not subject our tenants. We feel strongly enough to
fight this if necessary.
Please discuss this situation with the members of your council
before the Public Hearing which is scheduled for June 16th.
I finally request some sought of written response, in a timely
enough manner, to allow us to prepare for the Public Hearing.
Thank you very much for your attention to this important matter and
feel free to call for any discussion.

Waste Management of Palm Beach
Vegetative Recycling Facility
The applicant, Waste Management, Inc., is requesting a
conditional use to establish a vegetative recycling facility at
the east end of Industrial Way.
This plan has been reviewed by the Technical Review
Committee and found to be in compliance with all applicable City
codes.
It should be noted that staff included a condition regarding
the upgrading of the property to the north of this site.
However, because the subject site has been sold to Waste
Management, the condition has been removed. Instead, the
applicant must provide staff with an affidavit indicating the
land has been sold, a warranty deed, and a corrected application
sheet.
The Planning and Development Board, at its meeting of
June 9, 1992, reviewed this request for conditional use and
forwarded it to the City Commission with a recommendation for
approval.
This item has been scheduled for a public hearing before the
City Commission on June 16, 1992.

15. Create the required perimeter landscape strip along the
North property line where said property line cuts across the
existing parking lot. Show the landscape strip at a minimum
width of two and one-half (2 1/2) feet containing hedge
landscape material spaced at two (2) feet on center and
eighteen (18) inches in height at planting. The remainder of
the landscape area shall be landscaped with grass, ground
cover or other landscape treatment. [Fifty (50) percent of
the hedge material shall be specified as a native specie].

16. Prior to the issuance of a building permit to commence
construction, the applicant shall submit to the Planning and
Zoning Department a copy of a survey that shows a recorded
ingress/egress easement through the new site that allows
access to the old site. I recommend that at this time, you
show a proposed twelve (12) foot wide drainage easement
centered over the existing drainage system shown on the
survey. This easement should be incorporated into the final
survey of the site to allow the owner of the old site access
to work on the existing drainage system.
17. Prior to the issuance of a building perm1t to commence
construction, the applicant shall submit to the Planning and
Zoning Department a City approved cross access and cross
parking agreement signed by both property owners.
18. The proposed use is designated as a conditional use and will
be evaluated consistent to the requirements identified in
Section 11.2 of Appendix A-Zoning of the Code of Ordinances.

2) The proper dimension of the parking stall, layout sheet A-3, is
18' to edge of pavement, 16' to wheel stop.
3) South Florida Water Management District exemption must be
obtained prior to permitting.
4) Stop sign post shall be concrete encased per F.D.O.T. standards.
The above comments can be addressed at the time of building permit.

The applicant further states that future spaces are to be developed
by the tenants of the Rollyson Building.
Postponement of the construction of required parking stalls is in
violation of City ordinances and the 100 required parking spaces
shall be constructed concurrent with the development of this site.

2. Noted plan deviations from City codes and omission of data necessary

size, the reservation fee for this facility is $790.02
