SUMMARY: Ron Dorris of Ron Dorris Architects, AlA, PA., the
agent for James and Genevieve Rollyson, the property owners, 1S
requesting Cond1tional Use approval to allow for the construction
of a vegetation recycling facility for Waste Management of Palm
Beach. The site 1S located on the Northeast side of the
cul-de-sac at the end of Industrial Way. The subject parcel is
Zoned M-1, L1ght Industrial. The proposed site is to be created
by subdividing a 2.4 acre lot from the eXlsting 6.5 acre piece of
property. The subject property is vacant except for 40 parking
spaces that belong to the 50,000 square foot building that will
remaln on the 3.1 acre lot North of the subject property. The
applicant has submitted a conceptual drawing indicating where the
40 parking spaces may be placed on the 3.1 acre site so that the
existing building may be maintained at complete occupancy as a
manufacturing building. Driveway access to the 3.1 acre site
will be provided by the dedication of an ingress/egress and
utility easement. The subject property will consist of seven (7)
parking spaces and associated landscaping. The remainder of the
site is the fenced mulching facility. The mulching facility will
conta1n a 791 square foot building with a drive through scale to
weigh the inbound trucks and one portable mulching machine with
associated traffic areas for the movement of the equipment used
to deliver, store, load and transport the product. An area of
approximately 1,800 square feet will be dedicated as an on-site
storage area for the organic material. The mulching area will be
enclosed with a six (6) foot high vinyl slatted chain link fence,
a cont1nuous hedge and tree landscaping material. This site is
not located in a Community Design plan district, therefore, the
architectural design and colors are not subject to the
requirements of the Community Design Plan. However, the proposed
design and colors match the adjacent Waste Management facillty.
Proposed colors and their location are 1llustrated on the colored
elevation drawing submitted with the Conditional Use request.
SURROUNDING LAND USES AND ZONING (See attached locator map): All
of the lots and developed sites that abut the subject property
are Zoned M-1 Industrial District and have an Industrial land use
designation. Abutting the subject property to the North is the
3.1 acre lot with the existing 50,000 square foot light
manufacturing building. Abutting the property to the east is a
1.6 acre vacant lot. Abutting the property to the South, across
Industrial Way, are sites that have been developed with buildings

The trucks transport the finished product off-site to the
Solid Waste Authority. No sales of mulch will occur on the
premises. The Palm Beach County Traffic D1vision rev1ewed
the traffic impact statement provided by Waste Management of
Palm Beach and determined that the project meets the
standards of the 1990 Countywide Traffic Performance
Standards Code. See the attached letter to Mr. Kazunas,
City Engineer from Dan Weisberg, County Traffic Division.
For additional information regarding the proposed use, see
the attached description of work prepared by Waste
Management of Palm Beach identified as EXHIBIT "A".
STANDARDS FOR EVALUATING CONDITIONAL USES: The Planning and
Zoning Board (Planning and Development Board) and City
Commisslon shall consider only such condit10nal uses as are
authorized under the terms of these zoning regulations and,
in connection therewith, may grant conditional uses
absolutely or conditioned upon the faithful adherence to and
fulfillment of such restrictions and conditions including,
but not limited to, the dedication of property for streets,
alleys, recreation space and sldewalks, as shall be
determined necessary for the protection of the surrounding
area and the citizens' general welfare, or deny conditional
uses when not in harmony with the intent and purpose of
this sect10n. In evaluating an application for conditional
use, the Board and Commission shall consider the effect of
the proposed use on the general health, safety and welfare
of the community and make written findings certlfY1ng that
satisfactory provision has been made concerning the
following standards, where appl1cable:
1. Ingress and egress to the subject property and
proposed structures thereon, with particular reference
to automobile and pedestrian safety and convenience,
traffic flow and control, and access in case of fire
or catastrophe.
Proposed access to the site would be provided by a
twenty-eight (28) foot wide two-way driveway. The driveway
wlll also serve the building that exists on the lot north of
the new site. The slte offers ease of access for emergency
service vehicles because the site is laid out to allow
traffic circulation for large trucks.
2. Off-street parking and loading areas where required, with
particular attention to the items in subsection I above,
and the economic, glare, noise, and odor effects the
conditional use will have on adjacent and nearby properties,
and the city as a whole.
The seven (7) ott-street parking spaces provided on the site
exceed the code required minimum number by three (3) spaces.

4. Utilities, with reference to locations, availability, and
compatibility.
The slte is served with City water and sewer lines. The
existing water and sewer capacity is available and the
1nstallation of same will be compatible with the
requirements of the code.
5. Screening, buffering and landscaping with reference to
type, dimensions, and character.
To conceal the exterior storage of the mulching equipment,
vehicles and product, the mulching area is totally screened
with a six (6) foot high vinyl slatted chain link fence. In
addition to the slatted fence, a landscape buffer consisting
of trees and hedge material enclose the mulching area. The
trees shown along Industrial Way are spaced twenty (20) feet
on center, with the trees around the remaining sides
sporadically spaced. All trees are specified to be planted
at twelve (12) feet high with a seven (7) foot spread. A
three (3) foot high hedge is shown forming a continuous
screen around the fenced area except for the thirty-five (35)
foot access into the mulching area. The twenty-four (24)
Live Oak trees (shown along the south side and a portion of
the west side of the fenced area) and the continuous Red
tipped Cocoplum hedge will create a healthy visual buffer.
6. Signs, and proposed exterior lighting, with reference to
glare, traffic safety, economic effect, and compatibility
and harmony with adjacent and nearby properties.
The signage for the project is shown as a freestanding sign
located west of the driveway entrance and parallel with
Industrial Way. Exterior site lighting is provided with
f1xtures mounted on thirty-five (35) foot and forty (40)
foot high poles. The outline footprint of the light levels
from the slte lighting poles and the location of the
freestanding sign generally meets the provisions of the
sign and parking lot regulations respectively. Both site
amenities wlll be reviewed for compliance with the
applicable codes at permit review.
7. Required setbacks and other open spaces.
The proposed building setbacks meet or exceed the
requirements of the Appendix A-Zoning, Section B.A.6. -
Building and Slte Regulations.
8. General compatibility with adjacent properties, and
other property in the zoning district.
Generally, the use is compatible with adjacent properties
and other property in the zoning district. The proposed use

10. Economic effects on adjacent and nearby properties, and
the city as a whole.
The applicant has submitted a response to standard number
10, see attached EXHIBIT liB".
11. Conformance to the standards and requirements which apply
to site plans, as set forth in Chapter 19, Article II of the
City of Boynton Beach Code of Ordinances.
This project conforms to the standards and requirements
which apply to site plans as set forth in Chapter 4, Part
III - Code of Ordinances - Land Development Regulations,
Sections 1 thru 13.
12. Compliance with, and abatement of nuisances and hazards
in accordance with the performance standards section 4 of
the zoning regulations; also, conformance to the City of
Boynton Beach Noise control Ordinance.
The applicant has submitted a response to standard number
12, see attached EXHIBIT "B".
REVIEW OF COMMENTS: Attached are comments from the various
reviewing departments. All of the departments have indicated
that their outstanding comments regarding the mulching facility
site are minor in nature and will not affect the overall layout
of the site. Therefore, their comments may be addressed at the
time that working drawings are submitted for permit review. A
primary concern of the Technical Review Committee is the time
frame that the owners of the remaining portion of the existing
site (James and Genevieve Rollyson) shall be required to provide
a total of one-hundred (100) parking spaces on their site. The
one-hundred (100) parking spaces are required by the code to
maintain total occupancy of the existing bUilding as a
manufacturing use. The present 50,000 square foot building has
active manufacturing occupational licenses issued for businesses
that occupy 45,000 of the total 50,000 square feet. As indicated
in the memo from the City Engineer, the conceptual parking space
drawing shown on Sheet A-3 of 10 titled "Parking Lot Layout for
Existing Building Only" is not accurate regarding availability of
parking spaces considering the fact that there is an existing
power pole located in an area identified as parking along the
east property line. However, the site has the capacity to
provide the required one-hundred (100) parking spaces. The
extent that the existing site would have to be upgraded to the
current code requirements would be determined when working
drawings that depict the existing conditions and proposed new
improvements are submitted for permit review. A cursory review
of the conceptual plans and the information provided by the City
Engineer, memo no. 92-145, would indicate that the entire site
would have to be upgraded to current code to create the 100
required parking spaces.

2. Sound reduction apparatus, material and/or mufflers be
added to the mulching machinery and/or equipment to
reduce the sound level to the permissible commercial
land use category sound level of 65 (dB) decibels.
3. James and Genevieve Rollyson provide on their property
the 3.1 acre site one hundred (100) code approved
parking spaces prior to the issuance of the Certificate
of Occupancy for the Waste Management of Palm Beach
Mulching Facility.

CITY OF BOYNTON BEACH
CONDITIONAL USE APPLICATION
PROJECT DESCRIPTION
The conditional use application seeks approval for a
vegetation recycling operation to process tree trimmings, lawn
debris I brush and horticultural matter from Waste Management's
Solid Waste Authority District B customers and the City of Delray
Beach customers.
Waste Management will also receive vegetative collections from
the City of Boynton Beach and process the matter at a much lower
cost than currently paid by the Ci ty for transport of bulk
vegetation to county transfer stations. Under a right of first
refusal, the mulch product will then be "donated" to the City for
its beautification program, and transported at no charge.
Equipment requirements for this operation are one (1) front-loader,
one (1) track back hog with a grapple rake bucket, one (~) rolloff
truck with dinosaur hoists, five (5) 40-cubic yard open top rolloff
boxes and one (1) universal tub grinder.
Loads of vegetative waste will be trucked to the site and
deposited on a concrete pad for sorting to separate any non-
vegetative material that may have been indiscriminately
intermingled at curbside. The minimal non-vegetative matter is
immediately compacted and transferred to a waste pick-up truck for
removal. The vegetative matter is trans ferred by a front-end
loader from the pad into the universal tub grinder. This machine

processes the material by a 4-to-l reduction into a usable product
known as mulch. The mulch is conveyed to 40 cubic yard open top
rolloff boxes and transported to the consumer. The end-market is
the SWA who utilizes the mulch material as clean fill cover at the
landfills.
This machinery is diesel-powered and as such would generate no
more noise than that of other vehicles and equipment operational in
the District and on paralleling 1-95. There is potential on a
blustery day for particulate matter, although the woodland will
provide a natural buffer and mitigate emissions passing to other
properties.
Waste Management currently operates a similar
environmentally-safe facility in Northern Palm Beach county, which,
although not required, is D.E.R. permitted.
This vegetative recycling operation will have only one
customer -- Waste Management itself. The processing facility is
not being established as a commercial enterprise, and no sales will
occur on the premises.
The start-up labor force is anticipated at a minimum of five
semi-skilled employees to include a site foreman, two equipment
.operators, and a mechanic and a laborer. These will be newly-
created positions.
Hours of operation will be influenced by
seasons of the year and the quantity of collectible matter, but
maximally would coincide with trucking schedules at the parent
site, which extend from 6:00 a.m. to 8:00 p.m. As the operation
O. will be conducted adjacent to Waste Management's administrative
facility, employee accommodations are immediately available, and
continued emphasis will be placed on making this an accident and
injury free work place. The division safety and training director
will assist in training and inspecting of the facility for any
safety violations.
This project is consistent with the City's goals, objectives
and policies towards reduction of the solid waste stream, and
employs environmentally-safe technology to accomplish this
reclamation.

Dear Mike:
The following are in response to the evaluation of Conditional Use questions:
#10 The odor produced from the operation of this facility is the smell of
chipped wood, which happens to be a somewhat pleasant odor. Waste
Management plans to control any dust produced by this operation by
spraying light streams of water on the byproduct as necessary. The fence
around the perimeter of the property wi the p.v.c. slats will serve as a
buffer for some of the dust. The row of proposed trees around the
property will also serve as a buffer to control the dust. Most of the
prevail ing winds blow from the East-Southeast and in essence will be
blowing directly into a large piece of property owned by Waste Management
(West of this facility).
#12- The only potential continuous noise would come from the engine of the
diesel grinder. A diesel engine from a truck traveling at 40 m.p.h. will
produce a decibel rating of approx. 80 dba. at 50 feet away. The grinder
is not expected to produce noises above this level. This level is
considered 'moderately load' but please keep in mind that this noise will
not be any more annoying than all the delivery trucks travelling down
Industrial Way to the neighboring industrial facilities. The pedestrian
sidewalk is 60 ft. away from the grinder and separated by a 6 ft. high
fence with pvc slats. The slats would also serve as a noise buffer.
Trees have been planted along the south end of the property at a closer
distance than required to serve as a noise buffer as well.

The amended plans for the above referenced project have been
submitted and reviewed. The following comments from the original
set of comments have not been satisfactorily corrected on the
amended plans. The deficient comments shall be corrected.
However, it is acceptable to show compliance with the outstanding
comments on the plans that are required to be submitted to the
BU1lding Department for permit review.
1. Add to the landscape plan the continuous visual landscape
barrier that is required along the north, south and west
property lines of the new site. The landscape barrier is
required to screen the on-site vehicle use area from the
abutting right-of-way and from the abutting property.
Identify on the plan: the specie, spacing and height at
planting of the required landscape material. (Maximum
spacing is two (2) feet on center. Minimum height at
planting is eighteen (18) inches. Fifty (50) percent of the
total number of plants are required to be a native specie)
(Section 8.1, Chapter 4, Site Plan Review)
2. Prior to the issuance of a building permit to commence
construction, the applicant shall submit to the Planning and
Zonlng Department a copy of a survey that shows a recorded
ingress/egress easement through the new site that allows
access to the old site. A drainage easement should also be
1ncorporated into the final survey of the new site to allow
the owner of the old site access to work on the drainage
system that serves the old site.
3. Prior to the issuance of a building permit to commence
construction, the applicant shall submlt to the Planning and
Zoning Department a City approved cross access agreement
slgned by both property owners.
4.
The proposed use is des1gnated as a conditional use and will
be evaluated consistent to the requirements identified in
Section 11.2 of Appendlx A-Zoning of the Code of Ordinances.

Revised Review Comments
We have reviewed the amended plan and offer the following observations:
l) A power pole stands in the center of the existing lot. Minimum
drive width in the area of the pole must be 24'. Plan shall
reflect same. Pole area must be delineated by pavement markings.
2) In the area of the pole and tanks there exists a landscaped area.
Since no pavement exists in this area, activation of these stalls
cannot be considered maintenance, but must be considered recon-
struction and are therefore subject to upgrading to current
standards per City code. (estimate 6 or 7 stalls)
3) The remaining stalls designated P can be restriped under a main-
tenance operation.
4) The stalls marked F are in a area where pavement does not now
exist. These stalls are subject to upgrading to current City
standards.
This department does not herein attempt to rectify the number of
existing and future parking stalls required, but refers the determin-
ation to Planning and Zoning.
Regarding previous comments (Memo 92-ll4 Revised) #2 and #4 have been
addressed to our satisfaction. Comment #l and #3 can be addressed
prior to building permit.

property owner to the north.
2) The proper dimension of the parking stall, layout sheet A-3, is
18' to edge of pavement, l6' to wheel stop.
3) South Florida Water Management District exemption must be
obtained prior to permitting.
4) Stop sign post shall be concrete encased per F.D.O.T. standards.
The above comments can be addressed at the time of building permit.

Attached is the amended site plan for the above referenced development for
your final review and recommendation.
We would ask that you review this amended site plan to determine if the
plans have been adjusted to satisfy comments made previously by your
department.
If the comments have been satisfied or if your comments can be met at time
of building permit, please advise the Planning and Zoning Department in
writing.
If your comments have not been met or must be met by correcting the site
plan again, please advise the Planning and Zoning Department in writing.
Finally we would ask that you recommend to us if the the plan should be
forwarded to the Planning and Zoning Board for review or held for further
revisions by the applicant.
Please return your memo and the revised plans to the Planning and Zoning
Department by 5:00 P.M. on May 6, 1992
If you should have any questions regarding this plan, please feel free to
call Mike Haag at 228 who is coordinating the review of this development.
