Heyden Planning and Zoning Director DATE: February 9, 1996 SUBJECT: Charter Drive North, Parcel "A" & "B" - Abandonment ABAN 95-012 NATURE OF REQUEST Stuart Cunningham, agent for Hunters Run Golf and Racquet Club, the property owner adj acent to Parcels "A" & "B", is requesting abandonment of Parcels "A" & "B" which are portions of the Charter Drive North right-of-way. The attached Exhibit "A" is a location map that shows the parcels to be abandoned and their relationship to the Charter Drive right -of -way, which is public, and Summit Drive right-of-way, which is private. The attached Exhibit "B" contains a legal description and survey of the proposed abandonment. BACKGROUND The agent originally indicated that the requested right-of-way parcels to be abandoned were parts of the Charter Drive North right-of way, previously abandoned by the City. A search of City files and the submitted supporting documentation indicates that the Charter Drive right-of-way, west of Congress Avenue, and north of Summit Drive still belongs to the City. ANALYSIS The application states that the requested abandonment has been submitted in order to abandon surplus right-of-way. The Engineering Department has expressed concern that access to Parcel 103, vacant and located immediately west of the terminus of Charter Drive North would be limited if this abandonment were approved (see Exhibit "C" the Subject Site and Surrounding Area). The applicant's reasons for filing this abandonment and the grounds that support the request are included in the attached Exhibit "D" - Application. The City departments involved in the review of the request for abandonment and the utility companies notified of the request are identified below. Public notice was given to the property owners that abut the right-of-way to be abandoned and has been advertised in the newspaper. North Charter Drive North right-of-way and farther north Chanteclair Villas, Condos, zoned R-3 (Multiple-family Residential) East Hunters Run, zoned PUD South Privately owned Summit Drive right-of-way and farther south is Hunters Run PUD West Charter Drive North undeveloped Parcel 103, family Residential) and farther west is zoned R-3 (Multiple- RECOMMENDATION Staff recommends denial of this abandonment request based on Engineering Department comments. However, if approval is granted, it shall be subject to the following conditions, which shall be addressed prior to adoption of the abandonment resolution: 1. If easements are requested by Florida Power and Light and Southern Bell they shall be legally described and recorded with Palm Beach County. 2. The Hunters Run Golf and Racquet Club shall provide a permanent access easement to Parcel 103 to the satisfaction of the Engineering Division. CD 6. 7. 1. The name of the signator is unreadable, and authority to sign is undocumented (LDR Chapter 22, Article III, Section 2, Paragraph A, Page 22-6). There is no legal description attached (LDR Chapter 22, Article III, Section 2, Paragraph B, Page 22-6). Reason given (that property is surplus) is only true ifit does not deny access to any adjacent property (LDR Chapter 22, Article III, Section 2, Paragraph D, Pg.22-6). No unity oftide or written acceptance of all adjacent property owners was submitted (LDR Chapter 22, Article III, Section 2, Paragraph E, Page 22-6). No certification was attached providing access will not be unreasonably limited (LDR Chapter 22, Article III, Section 2, Paragraph F, Page 22-6). No utility company statements were provided (LDR Chapter 22, Article III, Section 2, Paragraph G, Page 22-6). No evidence of payment of required $500 fee was attached (LDR Chapter 22, Article III, Section 3, Paragraph A,Page 22-6). 2. The only major issue here is one oflimiting access to adjacent property owners. Discussions have been held concerning this access for quite some time, without resolution.
