Charter Drive North, Parcel "A" & "B" - Abandonment
ABAN 95-012
Please place the above-referenced request under Public Hearing on
the February 20, 1996 City Commission agenda.
DESCRIPTION: Stuart Cunningham, agent for Hunters Run Golf and
Racquet Club - the property owner adjacent to Parcels "A" & "B", is
requesting abandonment of Parcels "A" & "B" which are portions of
the Charter Drive North public right-of-way.
RECOMMENDATION: The Planning and Development Board, with a 7-0
vote, recommended approval of this request, subject to the staff
comments in Exhibit "C" and resolution of the access issue. I have
discussed the access issue with the city engineer and he is
satisfied with the means of access that will remain via Charter
Drive North to serve parcel 103. Therefore, staff recommends
approval subject to comment 1 in Exhibit "C".

Accompanying this memorandum you will find one (1) copy of the
application and related documents for the above-referenced
abandonment application. The $500.00 application fee for staff
processing and review has been forwarded to the Finance Department.
A legal advertisement for same has been prepared for a public
hearing for the February 20, 1996, City Commission meeting and will
be forwarded to your office after review by the City Attorney and
City Manager. In order for our department to meet the deadline for
preparing Planning and Development Board agenda materials for this
request, comments from staff and adjacent property owners must be
received by our office by January 18, 1996.
Please inform staff of this time frame when distributing copies of
this request for comment. If easier, comments can be forwarded to

Attached is material which appears to contain opinion of titles
submitted for the above-referenced abandonment applications
received from title companies for parcels A, B & C. As you
advised, I have now made this an abandonment application submittal
requirement. Also attached is the survey submitted with the
abandonment applications.
The public hearing for these abandonment requests is scheduled for
the February 20, 1995, City Commission meeting. Your written
notice as to whether the opinions of title are acceptable is needed
by January 12, 1995.
