SUBJECT: TRB Review - Cross Creek Centre
Master Plan Modtfication
We have reviewed the developer supplied water/waste water impact
statement and agree that the impact is less than the 10%
allowable for a master plan modification. Several uses would
exceed the 10% requirement but is is unlikely these would be the
ultimate use.
For your information, two such uses are a seven machine coin
laundromat and a forty seat vending machine restaurant.
We suggest, as a condition of approval, any use exceeding the 10%
requirement be prohibited.

MASTER PLAN MODIFICATION
In accordance with the City of Boynton Beach, Florida, Code of Ordinances,
specifically Appendix "A" - Zoning, the applicant for the above referenced project
shall:
1. The applicant shall present satisfactory legal documents to constitute
evidence of the unified control of the entire area within the proposed PCD.
The applicant shall agree to:
a) proceed with the proposed development according to the provisions of the
Zoning Regulations and conditions attached to the zoning of the land to PCD.
b) the applicant shall provide agreements, contract, deed restrictions and
sureties acceptable to the City for the completion of the development
according to the plans approved at the time of zoning to PCD and for
continuing operation and maintenance of such areas, functions and facilities
as are not to be provided, operated or maintained at public expense.
c) the applicant shall bind his successors in title to any commitments made
under Subsections 3a and 3b above. All agreements and evidence of unified
control shall be examined by the City Attorney and no zoning of land to the
PCD classification shall be adopted without a certification by the City
Attorney that such agreements and evidence of unified control meet the
requirements of these zoning regulations. Appendix "All - Zoning, Section 6F3,
"Unified Control".
2. The applicant shall agree to landscape the two medians within Boynton Beach Blvd.
rights-of-way. Appendix "A" - Zoning, Section 6F4, lIStandards for Planned
Commercial Developments", Subsection 6F4b, lIconcerning streets, consistant with
the intent of these regulations, any required roadway improvements shall be
constructed at the applicants expense".
3. The applicant shall provide a written statement that the outdoor eating area
shall be protected with a non-mountable raised continuous curbing in accordance
with Appendix lIAlI - Zoning, Section 6F4c, "Physical Character of the Site. The
site shall be suitable for development in the manner proposed without hazards
to persons or property, on or off the tract, from probability of flooding,
erosion, or other dangers, annoyances, or inconveniencesll. This comment may
also be found on the Engineering Department Technical Review Board comments
relative to the proposed site plan for the new commercial building.
