Dear Mr. Annunziato:
I would like to submit to you and the Town Council for consideration a proposal to
modify the PCD m3sterplan for Cross Creek Centre.
Our original application was for an all retail center of approximately 50,000 square feet
which eyentually was changed to allow 20,000 square feet of retail and 15,000 square feet
of office in two separate buildings. This change was a result of recommendations from
Staff and the Planning and Zoning Board. Our company was forced to accept this
arrangement; however, we had serious concern about the marketability of the office
portion. These concerns turned out to be justified as we are 100% leased in the retail
portion with a waiting list of several retail tenants and only 40% leased in the office
portion. With the extensiye glut of vacant office space in the area in more legitimate
office projects, I would think that a fully leased, healthy project would be preferable
from the City's and residents' perspective. With over 1,100 feet of frontage and less
than 200 feet of depth, the site is perfectly suited for retail tenants which is proven by
the happiness and success of the tenants in the retail building.

This proposal is therefore to request a modification to the PCD masterplan to allow
retail uses in approximately 1/4 (3,500 square feet) of the office building as described
on said masterplan. I can add sufficient parking on the site plan to accommodate the
increased parking requirement.

Dear Mr. Annunziato:
In response to your letter of November 7, 1986, concerning
amendment of the Boynton Beach Comprehensive Plan, the following
information is provided.
Chapter 163, Florida Statutes, contains language that
clearly indicates a local government may alter proposed plan
amendments after receiving state comments and prior to adoption.
We are concerned that this statutory language is very broad and
could result in a local government adopting a plan amendment
significantly different from what the state had reviewed. This
will, of course, become more important once we start compliance
reviews.
Based on the broad statutory language dealing with plan
amendments, it has always been our policy that a local government
could change the proposed amendment prior to adoption. If,
however, the proposed amendment change would represent a
significant departure from what was reviewed by the state, it is
always a good idea to resubmit for another state review. Based
on my knowledge of the change you are considering, it does not
appear to be significant and I would not think it would need to
come back to the state for another review.

the easement agreement for the 30 foot strip adjacent to the
L-24 canal in that the trees have been removed from this area.

The proposed development site plan shows numerous trees
and some paving to be placed within the easement for Lateral
Canal No. 24. We must object to such use. In this case only,
we will agree to palm trees being planted on the easement line.
They must be the type of palm trees which grow reasonably straight
and will not lean into the easement.

Dear Carmen:
The enclosed Comprehensive Land Use Plan Amendment Application is heing submitted in
accordance with the requirements of the City of Boynton Reach Planning Department.
The Amendment to the previously approved Planned Commercial Development is to allow
for the addition of thirty (30) feet of land along the entire northern boundary of the
site. This Amendment will not affect the square footage or mixed-use of the previously
approved PCD. The purpose of this Amendment is to allow for the required vegetative
buffer along the northern property line. The following is a summary of the comparison
of impacts as required in in Sections IIh.(l) through (8):

The employee projections for the project will not change.
The granting of the Amendment to the previously approved PCO will permit the developer
to better utilize the restrictive property dimensions for landscaping and internal
traffic channelization.
