Nick would you check with Jim to see he has had a chance to review my request of him to confirm our handling of this
issue. A few years ago the commission approved sort of a special exception on a small piece of residentially-zoned
property off Boynton Beach Boulevard owned by Walter Dutch/Judy Hatfield. I asked Jim to confirm my assumptions on
conditions and map notation. Claiming that we have discouraged potential buyers by the misinformation that we've
communicated, they are anxious to get a final word. J asked my clerk to send you a copy of it as well but I don't know if it

In response to your memo PZOO-068:
1. Based on my review it appears that there are restrictions on the property arising from the
property owners request in 1992. The property has use restrictions as set forth in the Commission
action reflected in the 6/16/92 minutes.
2. My notes from our 9/22/98 meeting with Tom Hoadley indicate that we acknowledged that
there is a special exception to allow C-2 use on the residential lot and there should be a notation on
the zoning map.
3. The note on the map appears adequate to me.
4. The applicant's representations set forth in the 6/16/92 minutes should be treated as binding
development obligations/restrictions.

storage or display of merchandise or materials shall
be prohibited, with the exception of growing plants
which are stored or displayed as an accessory use to
a lawful principal use.
6. Sale of used merchandise: The sale of
used merchandise shall be permitted as an accessory
use to the sale of new merchandise, meaning that used
merchandise shall be of the same type as the new

Dear Mr. Dutch:
Please accept this as documentation for your files and city records which describes the city approval granted
on June 16, 1992 for the above-referenced property (Lot #12 and a portion of Lot #11 within the Deierl Park
subdivision). As discussed during our telephone conversation on March 31, 2000, there is no question that
the Commission granted approval of the request to use the residentially-zoned portion of your property for
commercial use consistent with zoning regulations for the adjacent commercial parcel (lot #12). However, as
confirmed by Jim Cherof, City Attorney and documented in his E-mail to me dated March 31, 2000, two
conditions are construed to have been a part of this approval. One condition is the requirement that the rear
setback (setback from the northern property line of your portion of Lot #11) ono feet applies to all elements
of a future project except for landscaping and drainage (a buffer wall is also assumed to be allowed within
the setback area). The second condition is the requirement that any buildings constructed on this property
which are built in accordance with the approval granted on June 16th must be designed with residential
character.
I trust that we now have a similar understanding of the use provisions and restrictions applicable to the
subject property. I realize that it has been a frustrating experience for you, as I believe is a result of this
unique approval granted for this property that is essentially only documented through minutes from the
respective meeting. As previously indicated to you, I commit to you that I and the staff of the Planning &
Zoning Division will maintain an accurate understanding of the subject approval and restrictions, and will
accurately communicate same during subsequent inquiries.

Re: Deierl Park, a subdivision of the City of Boynton Beach
Subject - Split Zoning: Lot 12 and S 50 feet of Lot 11 - a contiguous
parcel in one ownership.
Lot 12 is zoned C2
S 50' Lot 11 is zoned RIA
Lot 12 is approximately 9900 sq. ft.
S 50' Lot 11 is approximately 3750 sq. ft.
Raymond Dumond platted Deierl Park into 12 lots. He then started
building and selling lots. He sold the East six (6) lots, I thru 6.
The West six (6) lots, 6 thru 12, he re-subdivided and sold by legal
description - parts of one lot and parts of another thus reducing the
lot sizes. Result was 8 smaller lots.
It is my belief that the zoning cartographer failed to recognize the
re-subdivision - relying on the recorded plat, which is incorrect.
Thus the South 50' of Lot 11 was split by zoning from the parent
tract, Lot 12.
I would appreciate if this apparent error would be corrected admini-
strativly and the S. 50' of lot 11 be zoned C 2.
Lot 12 and S 50' Lot 11 zoned C 2 is a much more viable lot for
development.
Presently S 50' Lot 11 does not meet RiA zoning requirements and is
unusable.
