Rumpf 11\11 W R ~ Director of Planning and Zoning FROM: DATE: March 13,2000 SUBJECT: Walter Dutch Lot of Record Case (aka special commercial exception) Attached please find two documents, one being the minutes from the June 16, 1992 City Commission meeting when the Commission approved the equivalent of a special exception through the "lot of record" provisions within our code. Various points were made at that meeting including commitments by the applicant to limit the design of the property to minimize impacts on adjacent residential properties (e.g. limit the northern thirty feet to drainage and landscaping and construct future improvements consistent with residential character). The second document is a letter from the attorney that met and discussed this matter with staff who does not reference any limitations other than just the 50 foot dimension (of Lot #11) that describes the area to be used for commercial purposes. I am just requesting your opinion regarding the issues discussed during the meeting such as the limitation to landscaping and drainage use and design restrictions. Furthermore, I have attached a copy of the note and excerpt of the zoning map showing the changes made to document the "lot of record" case. Please state in writing for our file whether you believe that any restrictions have been placed on the property, and whether, in your opinion, we have provided adequate documentation on our map. Mr. Cutro said this is a request by Amer1can Development Corporation to allow the construction of an 11,772 square foot bookstore at 1895 North Congress Avenue, which 1s located in the Target Center. The applicant 1s requesting to combine two existing outparcels from the original site ~lan and expand the floor area to accommodate the proposed structure. Another outparcel exists on the site. It should be noted that the applicant will need to have another traffic stUdy done in order to develop that site. He has run up his sQuare footage to the point that what he is proposing on that site will have to be rereviewed by the County. However, that does not affect this site It the present time. There 1s enough square footage left in the original site plan to allow this to go for- ward. Staff reviewed the proposed site plan and found that the s1te complies with the various codes of the City. including the zoning district it is located 1n, the Community Design Plan, and the Landscaping Code. The Planning and Development Board reviewed the proposed site plan and forwarded it the City Commissfon with a recommendation for approval. Commtssioner Aguila said at least two years ago when the Target site plan was originally brought through the City, it was a project of his office. Since then his office has done no work for Target. Target 1s no longer a client of his office and his off1ce has no personal gain. Mr. Cheraf asked Commissioner Aguila 1f he has any work pending with that particular client or 1f he is owed money from that project that m1ght be paid if this were approved. Comm1ssioner Agu11a answered in the negative. Mr. Cherof advised he has no conflict. Motton Commissioner Hanmening moved to approve this r.~uest for site plan approval to construct a 11,772 square foot retail bookstore as an outparcll at the Target Shopping Center. Lot 12 is zoned C2 S 50' Lot 11 is zoned R1A Lot 12 is approximately 9900 sq. ft. S 50. Lot 11 is approximately 3750 sq. ft. Raymond Dumond platted Deier1 Park into 12 lots. He then started building and selling lots. He sold the East six (6) lots. 1 thru 6. r The West six (6) lots. 6 thru 12, he re-subdivided and sold by legal description - parts of one lot and parts of another thus reducing the lot sizes. Result was 8 smaller lots. It is my belief that the zoning cartographer failed to recognize the re-subdivision - relying on the recorded plat. which is incorrect. Thus the South 50' of Lot 11 was split by zoning from the parent- tract.. Lot 12. I would appreciate if this apparent error would be corrected admini- strativly and the S. 50' of lot 11 be zoned C 2. Lot 12 and S 50' Lot 11 zoned C 2 ~s a much more viable lot for development. Presently S 50' Lot 11 does not meet R1A zoning requirements and is unusable. Heyden ~;c-~ Acting Planning an~~~ning Director TO: DATE: March 18, 1994 SUBJECT: Walter Dutch property on N.W. 7th Court - city Commission action regarding zoning boundary On June 16, 1992, the City Commission (see attached minutes) took action regarding a zoning line boundary dispute regarding two lots owned by Walter Dutch on N.W. 7th Court (see also attached approval letter and staff report). Briefly, this is a situation where the zoning line no longer follows the current lot boundary because the property owner reconfigured the lots. In 1987, an application to rezone the same lot Mr. Dutch was requesting in 1992 to "shift" the zoning line, was denied by the City Commission. Section 3.A.5.g of Appendix A - Zoning was the code section used to allow the 1992 "shift". Before the resurrection of Mr. Dutch's case, I had requested, approximately three months ago, your opinion regarding what procedure staff should follow relative to this section; you indicated a rezoning. Please advise regarding the following: 1. Is the procedure described in the above-referenced section a rezoning? If not, please provide direction for staff to follow in the future, including zoning map changes. 2. In light of the 1992 Commission action taken relative to this matter, should the zoning map be changed or did the action grant approval for an "exception" to the allowable use of the subject lot area, but not for a zoning change? 3. Should staff require recordation of a deed restriction which reflects the condition of the 1992 action? 4. What impact, if any, does misinformation within staff's recommendation to Commission, regarding how much of the the property is zoned residential and correspondingly how much should be used for purposes other than residential, have on the 1992 Commission action?
