Dear Mr. Roeding:
At the City Commission meeting of April 2, 1991, it was
determined that your application for an amendment to the Boynton
Lakes North Master Plan was improperly filed and could not be
heard by the City Commission.
At the request of the City Commission, staff accepted your
applicatioh and processed it as required by the Code of
Ordinances of the City of Boynton Beach. After review at the
Technical Review Board, comments were assembled from various
departments regarding your request for reduction of side and rear
setbacks.
We have attached a copy of these comments for your review. It is
important to note that future applications for reduction of
required setbacks by any person or group may be subject to these
comments when reviewed by the Technical Review Board and City
Commission (individuals who have greater than required setbacks
may apply without review by the Technical Review Board or the
City Commission). We are providing these comments to you for
your information and for possible distribution to property owners
who may be contemplating applying for a reduction of the setbacks
on an individual or group basis.

Master Plan Modification (reduction in setbacks)
Richard Roeding, on behalf of 120 homeowners of Boynton Lakes
Plats 4, 5, 6, 6A, also known as Boynton Lakes North, has
requested a modification to the previously approved master plan
for the Boynton Lakes P.U.D., as outlined in the attached
correspondence in Exhibit "A". The changes requested are a
reduction in the rear yard setback from ten (10) feet to five (5)
feet for the purpose of constructing hard roof screen enclosures
and a reduction in the side yard setback from fifteen (15) feet
to five (5) feet, also for the purpose of constructing hard roof
screen enclosures.
The procedure for approving master plan modifications in planned
unit developments is twofold. First, the city Commission must
make a determination as to whether or not the changes requested
are substantial in nature. A determination of substantial change
on the part of the City Commission, which has sole discretion in
this matter, would require a new application for PUD. On the
other hand, a determination of no substantial change allows
forwarding the request to the Planning and Zoning Board. This
procedure appears in Appendix B, Section 12 of the Code of
Ordinances.
With respect to the changes requested by Mr. Roeding, the
Technical Review Board (TRB) met on March 14, 1991, to review the
documents submitted and they are recommending the City Commission
make a finding of substantial change for this request to reduce
the side and rear yard setbacks. The reasons for this
recommendation, which are detailed in the attached staff comments
from the Building Department, Fire Department, Engineering
Department, utilities Department, Planning Department and City
Forester in Exhibit "B", are as follows:
1. Response time and fire access to the rear of bUildings would
be impacted if the reduction in the side yard setback,
resulting in a five foot building separation, was approved.
2. Construction of many of the screen enclosures proposed
within five foot of the rear property line would encroach
into existing drainage and utility easements.
3. Despite the fact that this planned unit development (PUD)
was the first PUD to be established within the City, the
previously approved setbacks, which have been modified
several times throughout the years to accommodate screen
enclosures, are less than the minimum standards that have
been applied to new PUDs within the recent past.
4. Allowing a five foot building separation breaches the zero
lot line concept and will alter the aesthetics of the
streetscape within the PUD.

Upon review of the above mentioned project, the following list of
comments must be addressed in order to conform with Boynton Beach
City codes:
1. Show and identify the proposed setbacks on a drawing of a
typical lot.
2. Specify on the drawing the maximum percentage of lot
coverage allowed consistent with drainage requirements
established for the project.
3. Specify on the drawing that no buildings or any kind of
construction shall be placed on utility or drainage
easements including water and sewer.
4. Show and identify on the drawing 'the perpetual four foot
(4') wall maintenance, roof overhang and drainage easement
that is required adjacent to any property line with an
abutting dwelling unit.
5. Specify on the plans that each dwelling unit will have two
parking spaces.
6. State on the plans all of the properties that are part of
the request.
7. The data shown on the proposed master plan must not be in
conflict with the information shown on the recorded plat
documents.
8. All drawings and/or documents submitted for public record
and prepared by a design professional, shall show original
legible raised seal and signature of a Florida registered
design professional responsible for the drawings/documents.
In order to facilitate the permitting process, the following
information should be included within your documents submitted to
the Building Department for required permits:
All structures must comply with the requirements of Table
600 of the Standard Building Code, 1988 Edition, for fire
ratings of exterior walls and percentage of allowable
openings.

SIDE AND REAR SETBACK REDUCTIONS
The Engineering Department has reviewed the applicant's submission and has
determined that approximately four to five hundred residential lots and structures
could be affected by the applicant's request. The following list of comments
should be thoroughly addressed and considered during the review and evaluation of
the subject action.
1. The dedication sheet of the above referenced plat documents specifies in detail,
front, side and rear setbacks in accordance with approved City plans and
documents. Based upon previous modifications to plat dedication sheet the City
Attorney's office has required that all signatures on the face of the dedication
sheet would have to agree to modify the dedications sheet and then provide a
recorded version of the agreement to the City of Boynton Beach, Florida. This
should be verified with the City Attorney.
2. Extreme build-out of the affected lots could potentially diminish the available
pervious area which may not be consistent with existing South Florida permits
for the plats. In addition, each individual lot site drainage should be reviewed
as the addition may alter already approved drainage patterns and will impact rear
lot drainage easements.
3. The applicant's request could adversely affect fire rescue combat teams and
related fire rescue equipment from accessing the rear of residential properties
during instances of fire emergencies.
The Engineering Department for the City of Boynton Beach recommends denial of this
blanket request to reduce side and rear set backs.

We can approve this project, subject to the following:
Houses at the end of Paxford Lane, Plat 6, may not be
suitahlp for ~creened enclosures because of their
pLuximity to a utility easement.
Houses in Plat 6A must be reviewed on an individual
basis because of utility easements along L-18 canal and
internally.
Because of these easements, we suggest owners be required to
obtain individual approval from the Utility Department prior to
issuance of a building permit.

Please be advised of the following Planning Department comments
with respect to the above-referenced request for a master plan
modification:
1. Boynton Lakes was the first Iltruell PUD developed in the
City, which established a minimum lot size of 5,000 square
feet (50 feet x 100 feet). Since that time, as a result of
numerous requests to modifiy previously approved master
plans to accommodate screen enclosures, pools, Florida rooms
and hard roof screen enclosures, the Technical Review Board
has recommended minimum standards to avoid erosion of the
PUD concept and to avoid potential conflicts associated with
providing for these amenities Ilafter the fact". These
minimum standards are as follows: 6,000 square foot lot
size, 60 foot lot width, 20 foot front yard setback, 15 foot
side yard setback on the nonzero lot line side, 15 foot
building setback in the rear and an 8 foot pool and screen
enclosure setback. Due to the fact that the lots within
Boynton Lakes are much smaller than the minimum lot size
within the more recent PUDs and that the rear setback -
where most amenities are desired, is also smaller, it is not
recommended that the setbacks be reduced further.
2. By increasing the building coverage percentage as a result
of constructing larger and more amenities, the open space/
green area percentage is reduced. Although there is an
existing private recreation facility and a sizable public
park planned in the near future within this PUD, play area
for children, usually located in the rear yards, will be
reduced. This increases the tendency for children to play
within the streets where they are at risk.
3. Allowing the side yard setback to be reduced from 15 feet to
5 feet, results in a building separation of only 5 feet
since a setback is only required on one side of the lot
under the zero lot line concept. In addition, due to the
small lot size, irregular lot layout and short driveways,
reducing the setbacks will alter the aesthetics of the
existing streetscape and impact the scale of the buildings
\IIrhich appear to be somewhat congested.
4. After reviewing the list of petitioners, 5 property owners
still cannot be verified (the 4 lots within plat 6A and the
owner of plat 4, block 7, lot 8 on 8 Dalton Place). If this
request is approved, additional information must be
submitted to include these lots under this application.
