Dear Mr. Roeding:
This letter Shill confirm our telephone conversations held at various times
within the past several weeks regarding the construction of screened
enclosed porches on the side of single family homes in the Boynton Lakes
North Estates Development.
The Master Plan for Boynton Lakes North, a Planned Unit Development (PUD),
does not penmit screened enclosures to be constructed on the sides of the
single family homes. The building setbacks in a PUD are established at
the time of Master Plan Approval. Appendix B of the Boynton Beach Code of
Ordinances allows latitude in the establishment of building setback lines
within PUD's. Since there are no specific criteria for setbacks, it is
not possible to apply for a variance to address specific lot setbacks.
The proper procedure for requesting Modifications to an Approved Master
Plan is for the Homeowners Association to apply for a Master Plan
Modification submitting appropriate documentation.

It has been determined that the land now being developed as Boynton
Lakes was once several individual parcels owned by people who in
1961 granted easemments to FPL for the existing transmission line.
Although no defined width was described in the aforesaid easements,
FPL has maintained and protected whatever width has been necessary
to operate the line.
In 1971, one of the parcel owne~s sought and received a partial
release of easement which clarified the original easement and
defined the easement width at 38 feet. A recent survey by Shepard
& Assoc i ates ill ustrated the easement across the Boynton Lakes
property showing the 38 foot width. -
As we have discussed, 'FPL wi 11 continue to protect and maintain the
transmission easements granted in 1961 and whose width was
clarified and defined in 1971.
