SUBJECT: Boynton Lakes North
The master plan for Boynton Lakes North does not allow screen
enclosures to be constructed on the sides of the single-family
homes. The Planning Department has had many inquiries from the
residents in this development concerning what procedure would be
necessary to allow for the screened enclosures to be constructed
on the sides of the single-family units. The proper procedure is
a master plan modification. As part of this procedure, the
applicant must submit documentation that the homeowners' associ-
ation concurs with the modification requested.
Attached is a copy of a letter submitted by the Board of
Directors of Boynton Lakes North which indicates that the Board
is not in favor of this request.

Dear Tom:
After thorough deliberation, the Board of Directors of Boynton
Lakes North has decided not to get involved with Lennar as the
builder, Joint Venture as the developer, Lennar Sales People,
and individual Lennar homeowners in the matter of side screen
enclosures. We held a meeting and it was decided unanimously
by the Board members attending that this is a matter between
Lennar and their homeowners, and does not pertain to the com-
munity as a whole. The Board will not authorize site plan
modification for the entire community based on problems Lennar
homeowners had with individual sales people.
Whatever Lennar decides to do for their homeowners should not
involve the entire community.

On Tuesday, January 16, 1990, the City Commission
voted unanimously to approve the recommendation
of the Technical Review Board that this request
does not constitute a substantial change after
documentation was submitted by the applicant
verifying that Florida Power and Light Company
cannot abandon the subject easement. The Com-
mission is forwarding this request to the
Planning and Zoning Board for final consideration.

existing easement must be maintained to provide proper access for
maintenance purposes.

Modification
Charles w. DeSanti, agent for the Lennar Corporation, has
requested a modification to the previously approved master plan
for the Boynton Lakes PUD. The modification requested is to
allow a non-zero lot line unit on Block 10, Lot 10, as outlined
in the attached correspondence.
The procedure for approving master plan modifications in planned
unit developments is twofold. First, the City Commission must
make a determination as to whether or not the changes requested
are substantial in nature. A determination of substantial change
on the part of the City Commission, which has sole discretion in
this matter, would require a new application for PUD. On the
other hand, a determination of no substantial change allows the
forwarding of the request to the Planning and Zoning Board. The
Planning and Zoning Board then may approve the request. This
procedure appears in Appendix B, Section 12 of the Code of
Ordinances.
wi th respect to the change requested by Mr. DeSanti, the
Technical Review Board (TRB) met on Tuesday, January 2, 1990 to
review the plans and documents submitted and their recommendation
is that the Commission make a finding of no substantial change
for the modification requested, subject to the following:
"That the developer provide written confirmation
from Florida Power and Light Company that the en-
croachment of that portion of their 38 foot wide
utilitF easement onto Block 10, Lot 10 cannot be
abandoned."
The basis for recommending that the developer provide written
confirmation from Florida Power and Light Company is that,
without this confirmation, the developer has not proven that a
hardship exists.
The request to amend the side yard setbacks from zero to three
and one-half feet on the south side of the lot and from 15 feet
to eight and one-half feet on the north side of the lot
represents a deviation from the zero lot line concept and a
reduction of the fifteen foot wide building separation that is a
standard for zero lot line developments within the City. It is
the consensus of the Technical Review Board that this request
represents a significant change 1n the standards for zero lot
line developments in the City and should not be approved unless
the developer can provide documentation that a hardship truly
exists.
