ANNUNZIATO, PLANNING DIRECTOR RE: REQUEST FOR TIME EXTENSIONS - EXPIRATION OF DEVELOPMENT ORDERS Accompanying this memorandum you will find two requests for retroactive extensions of previously extended Development Orders which have expired. In each instance, progress towards meeting the steps required to obtain a building permit has been made. In the interim, however, the City has adopted in concept the proposed Urban Design Plan for Boynton Beach Boulevard. Based on the above, it is recommended that these requests be granted subject to the revision of the landscape plans to incorporate the retail frontage plantings which would be required by the proposed Urban Design Plan. The revised landscape plans should be submitted to the Building Department for review and approval by the Community Appearance Board prior to expiration of the time extensions. The original site plan approval date was May 19, 1987 and at the April 19, 1988 City Commission meeting, we were granted a six month extension on the approval. We would conclude, therefore, that our original site plan approval, which is valid for one year, expired May 19, 1988 and a six month extension would then bring the expiration to ~ovember 19, 1988. Due to the following extenuating circumstances, we must request an additional six month extension on the site plan approval: 1. The finalization of the agreement between the Owner and Lake Worth Drainage bisfrict tock longer than anticipated and was just recently resolved. 2 . Due to the widening of Boynton Beach Boulevard and the County's permitting process, the issue of curb cuts for this parcel became another iten that took more time to resolve t'han expected. The que'stien was whether permitting would be done through the D.O.T. or to proceed through HARDRIVES, the County's Contractor, and.. this necessitated meetings with D.O. T., Pa 1m Beach Co~"hty Engineering, HARDRIVES and the Owner. After much review and discussion, the County determined that they could coordinate the curb cuts in their existing construction, and thisw'item was just rec~ntly resolved. The Owner has worked diligently to provide a project which will benefit the citizens of Boynton Beach as well as one which will enhance the neighborhood. He is currently pursuing a lending institution which will finance the construction of this project and he would need more time to finalize those arrangements. An extension approval would greatly increase the Owner's efforts to obtain acceptable financing for this project. Based on these items of concern, we would appreciate your utmost consideration of granting an additional six month extension for this project. The delays that we have experienced in going forward with the con- struction were caused by the delays in our receiving the necessary permits from the Florida Department of Transportation.
