LEGAL APPROVAL MINUTES REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA ~./ NOVEMBER 7, 1995 *The motion carried 3-1. (Vice Mayor Bradley and Commissioner Rosen cast the dissenting votes.) IX. NEW BUSINESS: A. Items for discussion by Commissioner Sid Rosen 1. Joint workshop meeting with CO.B.W.R.A. Commissioner Rosen advised that he represents the City to C.O.B.W.R.A. A suggestion has been presented to him that it might be beneficial to have a meeting with the executive staff . ofC.O.W.B.R.A. to discuss areas of mutual interest. He recommended a workshop meeting be scheduled in the future. Eugene Sokoloff, President of C.O.B.W.R.A., feels a workshop meeting will be of benefit to both communities. C.O.B.W.R.A. is very flexible with regard to the date and time. To accommodate the City Commission, a meeting after the first of the year would be fine. Dean of the Police Department to try to get additional help. Sgt. Dean will discuss this program with the Police Chief. Questions arose about the budget, the use of volunteers, the use of the First Baptist Church of Lantana, Inc. tax number, purchase of computer equipment, the evaluation of the program, and salaries for teachers. Mayor Taylor pointed out that funding this project requires use of taxpayers' money. He is concerned because the Commission denied a request from Congress Middle School for $5,000 for a new reading program. This is a private undertaking, and if it is approved, other private organizations will come in with similar requests. Mayor Taylor would feel somewhat better about this program if he could evaluate the results of the program after it has been in operation for a year. Attorney Cherof advised that he had not read the back-up material, and at this point, he is not satisfied from what he has heard that public funds could be expended in this way. He would like an opportunity to review this proposal and provide advice to the Commission. Vice Mayor Bradley explained that Poinciana's Latchkey Program is in place. He wondered whether or not this program could be brought there to get it started. He is not opposed to partial funding. However, the City must be convinced before spending public funds. New Beginnings Church Project Commissioner Jaskiewicz reported that a proposal was received by the Commissioners from Wayne Patrick of the New Beginnings Missionary Baptist Church. Mr. Patrick has been involved in bringing the community together. He has provided meals for people in the area, belongs to community organizations, and would now like to broaden his program to provide a counselling and tutoring program for elementary school children in the area. Funding would be involved. Roy Dawson, 436 NW 5 Avenue, advised that this program will provide educational services and counselling for neighborhood children. The program focusses on changing the children's attitudes. . It will entail drug and alcohol prevention activities. This will be an after-school and Saturday program. Mr. Dawson will work directly will the children and he will collaborate with agencies such as the Boynton Beach Community Center and the United Way. Certified teachers and peer group volunteers will be involved. In response to Commissioner Jaskiewicz' question, Mr. Dawson advised that he has applied for a grant; however, he is seeking start-up funds. He has not contacted the School Board to seek support. He has applied to the Community Foundation, but they do not accept grant applications until February. Commissioner Jaskiewicz questioned whether or not Mr. Dawson has considered using volunteers until the grant funds come through. Mr. Dawson stated that the program will begin on November 1 regardless of whether or not funds are available. He will be volunteering his services. Mayor Taylor pointed out that this is a request for the City to fund this program, but this organization is not a public organizatio.n. He questioned whether or not the City could expend taxpayers' funds in this manner. City Attorney Cherof advised that the City can support any local civic organization or group of individuals if their activities support the general public or if it advances the interests of the City so long as the organization does not preclude any segment of society. Commissioner Jaskiewicz felt this proposal should have been presented prior to the budget process. In response to Mayor Taylor's questions, Mr. Dawson advised that this program will be held in an existing church. They are also attempting to secure property on 12th Avenue where an abandoned building is located. Mr. Dawson advised that the area has been canvassed to make a determination on the number of children who would be involved in the program. He feels the problem they will encounter involves what to do with the children when there is an overflow. The children will submit registration forms and be selected for the program based on a first-come, first served basis. Commissioner Jaskiewicz felt a better way to select the participants would be through referrals through the schools. Mr. Dawson pointed out, however, that his purpose is to serve the community. Referrals will fill all of the slots. TABLED UNTIL OCTOBER 17, 1995 At Mayor Taylor's request, this item was further tabled until the fIrst regular City Commission meeting in November. 20 .", ...", ~ MINUTES CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA OCTOBER 2, 1995 Mayor Taylor took this opportunity to advise that The United Way Building in Quantum Park has enormous conference rooms and the City is allowed to use them any time. He felt this would be convenient when we have workshop meetings where many people attend. Mayor Pro Tern Matson also pointed out that we could use the Community Room in Fire Station 3. D. Sound Wall Commissioner Jaskiewicz said many residents in the Forest Park section of the City contacted her about sound disturbances. She was disturbed that Boca Raton and Delray Beach already have been covered with a sound wall, and it is being done piecemeal in Boynton Beach. .~ Vice Mayor Bradley advised that the DOT has tentatively planned to fill in both the missing gaps on the east side of 1-95. The work on the first part is tentatively scheduled for the middle of 1996. He advised that he keeps bringing this matter up at the Metropolitan Planning Organization meetings. The problem with moving ahead on the east side of 1-95 has created a problem on the west side of 1-95. When you build a wall, the sound hits the wall, bounces off, and makes things worse for the people on the west side. In addition, Golfview Harbour is near a canal, and sound carries over water. Mayor Taylor saw the funding and believes that within the next two years, the east side of 1-95 is going to be taken care of. In fact, some projects were readjusted to move that up. Now the westside residents are complaining. However, the money is already allocated for the next two years. He felt a quicker solution would be to landscape the area with trees, shrubs and a berm because the engineers advised that noise will go over a wall. The residents live so far back on the west side that a wall will not have an affect. However, landscaping would probably absorb the noise. Mayor Taylor advised that public input will be taken at the next four MPO meetings. . Commissioner Rosen did not think it would correct the situation if they put up a west wall facing an east wall. He felt that Mayor Taylor's suggestion of the foliage is much more practical. In response to Mayor Pro Tern Matson, Vice Mayor Bradley stated that if you live more than 175 feet from the wall, the wall makes no difference. This is the decision the business owners will have to make. If a decision is made to have a turn lane for every business on the Boulevard, we will have no medians. He is hopeful that the businesses will be willing to sacrifice some of their access in order to get a beautifully-landscaped median. He feels the overall appearance of the Boulevdrd will bring more people to the Boulevard and enhance business in the long range. Mayor Pro Tem Matson reported that she, the City Manager and the Planning Director met with the long-range planning committee of the First Baptist Church approximately six months ago. She now requested that Ms. Heyden contact Woody McDuffy to make certain he is aware of the plans because a change to the median to NW 1 st may disrupt the access to the church. In addition, she is concerned with 3rd because it is a heavily- traveled thoroughfare. She looks forward to these concerns being addressed and solved. Consensus There was a consensus of the Commission for the paver blocks for Boynton Beach Boulevard and the Federal Highway project. Mr. Zen gage has discussed doing a pattern with three colors of paver blocks which will have an impact upon entering the City. Federal Highway, and Sausalito Groves. 12 lJ MINUTES REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORI DA JUNE 20, 1995 I Richard Harris, agent for the project and President of the school board, explained that there were comments relative to the abandonment of a portion of the roadway within the plat which is dedicated by the plat of Cedar Ridge. He will immediately proceed with the application for the abandonment. Two agreements with the Cedar Ridge developer are also required. One is for emprgency or maintenance access through the roads of Cedar Ridge to get to the ball fields. The agreement is already in place and he will submit a copy to staff. The other agreement is relative to drainage facilities. Conceptually, an agreement exists with the developer of Cedar Ridge, but it has not been put in writing yet. As soon as it is completed, it will be submitted to staff. Tambri Heyden, Planning and Zoning Director, said there are several criteria in the zoning code which staff is required to evaluate this project against. Policy 1.17 is the most interesting because it pertains to noise and hazards. Normally, it would be expected that this type of recreation would present noise and light problems to the surrounding residences. However, Cedar Ridge has been using this field as a marketing tool. The future owners of the lots abutting this field have seen the plans of the expansion and have bought into the plan. Eleven comments resulted from a cursory review of a conceptual master plan. The comments pertain to relocation of the recreational facilities (ball field and swimming pool); utilities access if the school is to be fenced in, the County's requirement for abandonment of the public road, unity of title to assemble the property, and agreements with the developer of Cedar Ridge Estates relative to drainage and access. 11 i Staff recommends approval based on consistency with the Comprehensive Plan, subject to any comments from Palm Beach County, and acceptance of the abandonment agreement and the agreements regarding drainage and access. Mayor Taylor referred to the note on Page 7 of the back-up material relative to proper notice being given to the public. Ms. Heyden explained that this note means that if anyone objects to the way this was advertised, the applicant understands that he would have to go back and begin again with renotification. In response to Commissioner Jaskiewicz' question, Mr. Harris advised that the current school houses Grade 6 through Grade 12. The elementary campus is located at the Christian Reform Church in lake Worth. That campus will be moved over, and classroom capacity will be increased to accommodate 200 new students. In February, 1995, a master plan modification was approved for the Cedar Ridge Estates PUD located immediately south of the Lake Worth Christian School. Part of the master plan modification request included deletion of the subject property from the PUD. Approval of the master plan modification was subject to rezoning of the subject property from the PUD to an appropriate zoning district for assembling the property with the school property to the north for expansion of the school's facilities. This request will rezone and reclassify the subject property consistent with the remainder of the school property. 2 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA JUNE 13, 1995 The Society included a copy of this conceptual master plan with the subject application for courtesy review by staff to identify and address any problems early in the school's expansion process and to better analyze with this rezoning any potential impacts upon the adjacent planned residential development. The plan was also used to evaluate traffic impacts associated with the request. Comments 8 and 9 on Page 6 of Memorandum 95-268 dated June 9, 1995, have the most relevance at this point in time. Item #8 documents the necessity to abandon the dedi.cated right-of-way and show unity of title. These documents must be submitted prior to adoption of the rezoning ordinance. Item #9 requires that agreements be established between the developer of Cedar Ridge Estates and the Lake Worth Christian School to ensure proper management of the shared drainage area and maintenance access. These agreements must be submitted prior to adoption of the rezoning ordinance. The Planning and Zoning Department recommends that the applications submitted by J. Richard Harris and the Lake Worth Christian School Society, Inc., be approved based on the following: 1. The proposed amendment and zoning would be consistent with Comprehensive Plan objectives and policies; 2. The proposed amendment would not be contrary to the established land use pattern, nor would it create an isolated district unrelated to adjacent and nearby districts, and nor would it constitute a grant of special privilege to an individual property owner; 3. The requested land use and zoning would be compatible with capacities of utility systems, roadways, and other public facilities; 4. The proposed land use and zoning would be compatible with the current and future use of adjacent and nearby properties and would not affect the property values of adjacent or nearby properties; 5. The proposed land use and zoning are of a scale which is reasonably related to the needs of the neighborhood and the City as a whole; 6. The proposed land use and zoning are consistent with the classification and zoning currently in place on the existing school site; and 7. The proposed land use and zoning satisfy the February, 1995 conditions of the Cedar Ridge Estates master plan modification approval. Staff recommends approval of these requests conditioned upon compliance with any comments received from Palm Beach County regarding the traffic study, acceptance of the abandonment application and receipt of all agreements referenced in the staff comments, prior to formal adoption of the rezoning ordinance and incorporation of the staff comments listed in the school's future site plan submittal. 3 MINUTES PLANNING AND DEVElOPMENT BOARD BOYNTON BEACH, flORIDA JUNE 13, 1995 Rick..Harris, agent for the applicant and President of lake Worth Christian School, said he will make application for the abandonment of the right-of-way as soon as is necessary. He is in possession of the agreement of the developer of Cedar Ridge with respect to ingress and egress. They have conceptually worked out agreements with respect to maintenance of the drainage. He will be participating with their homeowners' association. He does not anticipate any problems complying with every request which has been made. They accept all conditions. Mr. Harris stated that the school has no plans to light thefield at any time in the future. The existing fields have never been lighted. All baseball, softball and soccer games are played in the afternoon. Mr. Harris has discussed this situation with Mr. Basil of the Cedar Ridge development, and he advises that the people who have committed to purchase those parcels are aware of the field and have no problem with it. Mr. Harris believes the developer is using this as a marketing tool. Mr. Rumpf agreed with Mr. Harris' comments regarding the developer using this as a marketing tool since several of the adjacent lots have already been sold. In response to Mr. Rosenstock's question, Mr. Rumpf advised that property owners within 400' of this project have been notified of this request. There were no negative responses. VII. PUBLIC AUDIENCE: Margaret Newton, 701 NW 4 Street, addressed the Commission with her concerns about the trash and debris found in the north end of the City. She feels the City needs to devise a new way to take care of this trash in order to eliminate the trash piles. She stated that there are eight trash piles on her street. She said the trash is picked up only once a week and this is not as it is done in the south end of the City. She requested a new way of taking care of the trash. She offered her assistance in eliminating this problem within the next two years. Mrs. Newton also spoke about the centennial activites which are being planned for the City. She pointed out that the Civil War is not something people of color find pleasant. She warned the Commissioners to be careful about including activities which may offend the people of Boynton Beach. Mayor Taylor stated that he lives in the south end of the City and trash is picked up only once a week. He does not feel the problem is with the City's pickup. He thinks the problem lies with the way people are putting out their trash. He is open to suggestions and solutions from the citizens. Mayor Pro Tern Matson advised that a Trash-a-Thon was organized two years ago through the efforts of the North Boynton Beach Task Force. The targeted area was the north end of the City. City employees were brought in to assist and special provisions were made to clean up the area. Only ten people from the community participated. In addition, the trash that was picked up was replaced the following day. 18 MINUTES "'" REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA .., MAY 16, 1995 Commissioner Jaskiewicz said this issue is not unique to the north end of the City. This matter has been brought to the Commission's attention for at least the last two meetings. Code Enforcement Officers have been extremely helpful. If the violators are cited, a solution to the problem may be found. Bob Eichorst, Director of Public Works, advised that trash piles are being mixed with household garbage. He explained that it took Public Works a long period of time to determine the address of a violator, but when a determination was made, Code Enforcemem was contacted. The violator was made to pick up the pile. Whatever the violator was unable to pick up, Public Works picked up, and the violator was charged. A call was received from Mrs. Newton a few weeks ago and a crew was sent out. The trash was picked up and the hole was filled. That same afternoon, building debris was dumped in the same spot. Public Works followed the same procedure this week. Mr. Eichorst explained the importance of community participation so that the violators can be identified. Mayor Taylor said the City's budget includes $30,000 to clean up Martin Luther King Jr. Boulevard only. The City has been trying to work out this problem, but needs help from the community. Vice Mayor Bradley feels community policing will help in this situation, and he looks forward to the implementation of this program. VIII.
