Hoping that you recall our meeting in 'I'ambri Heyden's
tempora~y conferen~s room on this matter back on January 251 I
wanted to refresh your memory about and request confirmation of
the solution th~t MS. Heytten ot':fered toward the end of that
meeting to my cl;hmt' s "replat p;,oblem." The problem is:
(1) The 1983 plat ~or the CEDAR RIDGE pun decicatea the
,pun's int.rnal roa~ways to the public.
C 2) Al though constructed, these roadweys were never
officially accepte~ by the City for public ownership ~nd
mCllintenar1ce.
(3) The cur:rent develeper, CElOAR RIDGE DEVELOPMENT
CORPORATION, INC., and the City both now desire to
"pt'1vat1ze" these roadways in the most: expeditiouS' ~
co~t-8ttect1ve manner_
As YQU will recall, we ~ere jOined in that January 25 meeting
by CEDAR RIDGE is managing partner, Mr. Joe Basile and his
cQn5ulting engineer, Mr. Peter M. Kerekos, p.m. We began our
discu5sion by rev1ew1ng the two (2) known methods of abanaoningcr
privat1z1ng pub11c roa~ways: (1) By reoorded plat (or replst), or
(2) by a petition for abandon~8nt.
Both of these approaches present substantial problems to my
c11ent. The end tesul t of a successful peti t:ion to ab8ndon a
public roadway is the expansion of the abutting lot. to. the
abanaone~ roadway's centerline. Approval is typically requir.d
from 100% of the abutting lot owners. Ultimat.611yt each lot
owner's legal aescription and survey must be changad to reflect
the enl~rged parcel.
Similar problems are presented if the replat t'edesignatas
these roadways as private streets. All affected lot owners (which

~oadwQYs for all Association mem~ers, their guests and invitees.
And maintenanee of all of the PUC'S common areas ere clearly the
obligation of the A8S0c1at1on. put enother way, the lot owners'
"bundle of rights" to utl11ze the PUb's roadways that were
astabl!shed unde~ the or1g1n~1, 1983 plat would not be l1mited by
thl!l II Heyden solution" in any way. Only the general public I s right:
to use these roa~ways would be impacted, 1.e. elim1nated.
Since this "privatizat1on" concept has already been approved
by the c1ty and 1ncorporated into the Cecar Riege Estates
Homeowne~al Associat1on documents, replatting the Cedar Ridge PUD
to rodesignate these roadways as common areas would merely
.i.mplemlilnt a plan of aevelopmant already approved by the city
Com'll1ssion an~ will have no impact whatsoever on .,tbosa who havQ
purchase~ lots within the fUD. '
I am br1ug1ng all of this to your attention at. this timo
because one of Mr. Karekos' associates, a formar mambQr of ~h.
. C1 ty of west Palm .Beach's engineering staff', has questioned
whether the approach SO' laboriously sketched out above will
preSJent title problems in the future. 1'his sarna individual also
a5ke~ 1t tne City of Boynton Beach might accomplish t:hQ samG
roadw~y privat1zat1on purpose by.aopting an ordinance similar ~o
the one attached: Ordinance No. 2210-88. adopted by the WAst Palm
Beach C1ty Commission on September 6, 1988.
It a~cpt1ng a similar ordinance could either replace or
strengthen the "Heyc3en Solution" described above, we may wish to
cons1der that approach as well. Please aavise.

as a SIte plan, and that Included are several very specIfic comments/
recommendations; however, it is understood that this review was cursory
and tbat your plans \",il1 ultimately be formally processed and in
accordance with the requirements at the site plan modificatlon process.
The more s;lgnificant comments relatIve to emergency serVIce access,
circulatlon, location of utilities, and Impact on the adjacent planned
reSIdential community are ItemIzed below;
1) The most southern ball field is oriented with those areas of
the ballfield wllich tend to generate the most nOise, light and
activi ty immediately adj acent to the planned Single family homes of
the Cedar RIdge Estates pun. However, it should be noted that
although staff would suggest that the ball fIeld be reoriented to
maxlmize distances between the planned homes and the active areas
of the ball field, Mr. Basil has indicated that buyers of the
ad] acent lots intentIonally selected those locations for their
proximity to the recreation areas of the school, and redesign of
the recreation facilities may consequently place less desirable
elements adjacent to the residential development, and redirect ball
field lighting toward the planned single family homes);
2) The swimming pool should be relocated in close proximity to the
existIng or planned road system in order to facilitate efficient
emergency access;
3) Proper design/engineering techniques which are both aesthetic
and safe for adj acent residents may be necessary between the
soutllern most ball fIeld and adjacent homes to address the

I have reviewed the plans and find thctnto be lacking in thought regarding the parking situation. I
believe that the pool and ball field areas should have some type of direct parking access and not
be reliant on the staff parking area. I feel this just encourages people to drive onto the grass and
through play areas in an attempt to get to these recreation areas.

Dear Planning Director:
The Solid Waste Authority of Palm Beach County hereby provides certification that
the Authority has disposal capacity available to accommodate the solid waste generation for
the municipalities and unincorporated county for the coming year. This letter constitutes
notification of sufficient capacity for concurrency management and comprehensive planning
purposes. Capacity is available for both the coming year, and the five and ten year
planning periods specified in 9J-5.005(4).
As of September 30, 1994, the Authority's North County Landfills had an estimated
38,200,000 cubic yards of landfill capacity rem::lining. Based upon the existing Palm Beach
County population, the population growth rates published by the University of Florida
Bureau of Economic and Business and Research (BEBR), and projected rates of solid waste
generation, waste reduction and recycling the Solid Waste Authority forecasts that the
existing landfill capacity will be depleted in approximately 2021.
The Authority continues to pursue options to increase the life of its existing
facilities and to provide for all of the County's current and future disposal and recycling
needs. As part of its responsibility, the Authority will provide an annual statement of
disposal capacity, using the most current BEBR projections available.
