1. Prior to construction, Contractor shall verify trees to remain. trees to be relocated,
and trees to be removed.
2. Contractor shaH determine access routes to trees that will least disturb existing
vegetation.
3. Contractor shall relocate trees with an appropriate sized tree spade. All materials
shall be planted at their original soil levels.
4. Relocated trees shall be thoroughly watered-in immediately upon installation in
their new locations to eliminate air pockets a.nd enhance proper setting,
Contractor shall provide relocated trees with a temporary irrigation system
(including canopy sprays). Coordinate additional watering requirements with
Ovner.
5. All transplanted trees shan be pruned to remove vines, dead and broken branches,
etc. Limb-up/thin as necessary to enhance tree shape and future growth. Clean
trunks of relocated Sabal Palms.
6. Stake/brace relocated trees as necessary to assure stability.
7. Mulch relocated trees with min. 2" Melaleuca mulch or chipped vegetation.
8. Contractor shall replace any relocated plants that die due to his negligence (lack of
water, physical damage, etc.>. Replacements shall be Live Oak, 10' ht., S' spr.
9. During the land clearing and construction stages of development, Developer
shaH erect and maintain protective barriers (to the City Inspector's specifications
consistent with good management practices) around all trees or groups of trees to
be protected. Developer shall not allow the movement of equipment or the storage
of equipment. materials, debris. or fill to be placed within the protective
barrierCs),
10. During the construction stage of development. Developer shalt not allow the
cleaning of equipment or material nor allow the disposal of waste materials such as
paint. oil. solvents. asphalt. concrete. mortar. etc. within the drip line of any tree
or groups of trees to be protected.
11. No attachments or wires. other than those of a protective or supportive nature
shall be attached to any tree.
12. Tree relocation and replacement activity permitted or required by the City of
Boynton Beach shall be done in accordance with standard forestry practices and
procedures. and aU such planting5 shall be reasonably maintained and attended to
promote successful establishment and growth.
13. It shall be a responsibility of the homeowner's association / condominium
association to provide continuing maintenance of the trees in the future.

1. City water will not be supplied for irrigation. Please indicate on the plan your

2. Plan shall show size and type of utility pipes. Your submittal suggests the water
and sanitary sewer plans were included. Please provide for review and comment,
(Sec. 26.16(a)).
3. No trees, or overhang oflarge trees, are permitted within Utility Easements,
(Sec. 7.5-18.1).

Attached is the amended site plan submittal for the above
referenced project for your final review and recommendation. We
would ask that you review this amended site plan submittal to
determine if the plans have been adjusted to satisfy comments
previously made by your department.
If your comments have been satisfied or if your comments can be met
at time of building permit, please advise the Planning and Zoning
Department in writing. If your comments have not been met, please
advise the Planning and Zoning Department in writing.
Finally, we would ask that you include in your memorandum a
recommendation as to whether the project should be forwarded to the
Planning and Development Board for consideration. Please return
your memorandum and the amended plans (Engineering Division shall
keep their plans) to the Planning and Zoning Department by 5:00
P.M. on February 2, 1996.
Per the Technical Review Committee (TRC) determination at the
December 26, 1995 meeting, the previous submittal of the Site Plan
was not discussed. Therefore, the current Site Plan submittal will
be placed on the February 13, 1996 TRC meeting agenda. If you
should have any questions regarding this plan, please feel free to
call Jerzy Lewicki at Extension 6260, who is coordinating the
review of this project.

initial discussions with the City of Boynton Beach, it was
agreed that we would submit the project for your review based
upon a 40' setback from both N.E. 4th Street and the FEC
Railroad to the units and a 20' setback from both the North
and South Property line to the units, with a minimum
separation of 15' between units ( a sketch showing this was
sent to Mr. Lewicki).

Planning and Zoning Department is as follows:
The survey doesn't show N.E. 20th Avenue east of
N.E. 4th Street because it is not platted.
Topographical elevations have been referenced in the
survey legend.

Our response to Memorandum # 95-583 from Kevin J. Hallahan,
Forester/Environmentalist is as follows:
1. A letter from the Florida Game and Fresh Water Fish
Commission stating there are no endangered/protected
species on the site will be submitted.
2. On the tree survey, several multiple trunked oaks
were identified with each trunk being an individual
tree. The tree relocation/removal plan identifies
each multi~le trunked oak tree as a single tree. The
quantity dlfference is nine, as noted in the
comment.
3. A Tree management plan to address the proper care of
trees in Item #2 is included with this submission.
Our response to Memorandum # 95-565 from John Wildner, Parks
Superintendent, is as follows:
1. The required recreation fee based on the single
family homes calculating factor will be paid when
due at final platting.
2. The developer does not plan to apply for one-half
credit for private recreation.
Our response to Memorandum # 95-442 from Al Newbold, Deputy
Development Director, Buildings Department, is as follows:

We have reviewed our December 13, 1995 Memo (No. 95-473) regarding compliance with
comments contained therein. We respond as follows:

Revise documents to reflect all comments.
All plans submitted for specific permits shall meet the City's code requirements at
time of application. These permits include, but are not limited to the following;
site lighting, paving, drainage, curbing, landscaping, irrigation and traffic control
devices. Permits required from agencies such as the FOOT, PBC, SFWMD and
any other permitting agency shall be included with your permit request.
This master plan is not required as a condition of zoning, but is required as a pre-
requisite to platting. Since the land is to be subdivided into two or more lots or
parcels either by plat or metes and bounds, it must be platted (Chapter I, Article
II, page 1-33 and Chapter 5, page 5-1). Sincc the subdivided lots are not shown
on the master plan, the plan cannot proceed without certification from the
applicant that the master plan and the plat will conform with all codes, ordinances,
rules and regulations including, but not limited to, the Boynton Beach Land
Development Regulations.

Find attached for your review the plans and exhibits for the
above-referenced project. Site Plan Review approval for this
project will be granted by the City Commission. To ensure that
the project stays on line with the review time frame, I request
that the plans and exhibits be reviewed and for.mal written
comments transmitted to the Director of the Planning and Zoning
Department no later than 5:00 P.M. on December 20, 1995. Do not
return plans and exhibits. Retain same for the review of the
amended plans {second review} .
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
Section 8 of the Code of Ordinances to review and formulate
comments.
2. The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in Section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards or the
documents show code deficiencies, additional data and/or
corrections should be requested by the reviewer through the
Planning and Zoning Department.
3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member(s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific
code section may be included in their review comments with the

6. If a TRC member finds the plans acceptable, he/she shall
forward a memo, within the time frame stated above, to the
Planning and Zoning Director stating that the plans are
approved and they do not have any comments on the plans
submitted for review and recommend the project be forwarded
through the approval process.
All comments shall be typed, addressed and transmitted to the
Director of the Planning and Zoning Department for distribution to
the applicant. Please include the name and phone number of the
reviewer on this memo. Michael E. Haag will be the Planning and
Zoning Department staff member coordinating the 1st review of the
project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and the procedures for
resubmission. When the Planning and Zoning Department receives the
amended plans, they will distribute the plans with a cover memo to

the project stays on line with the review time frame, I request
that the plans and exhibits be reviewed and for.mal written
comments transmitted to the Director of the Planning and Zoning
Department no later than 5:00 P.M. on December 20, 1995. Do not
return plans and exhibits. Retain same for the review of the
amended plans (second review) .
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
Section 8 of the Code of Ordinances to review and formulate
comments.
2. The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in Section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards or the
documents show code deficiencies, additional data and/or
corrections should be requested by the reviewer through the
Planning and Zoning Department.
3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member(s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific
code section may be included in their review comments with the
name of the appropriate TRC Member that is responsible for the
review specified.
6. If a TRC member finds the plans acceptable, he/she shall
forward a memo, within the time frame stated above, to the
Planning and Zoning Director stating that the plans are
approved and they do not have any comments on the plans
submitted for review and recommend the project be forwarded
through the approval process.
All comments shall be typed, addressed and transmitted to the
Director of the Planning and Zoning Department for distribution to
the applicant. Please include the name and phone number of the
reviewer on this memo. Michael E. Haag will be the Planning and
Zoning Department staff member coordinating the 1st review of the
project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and the procedures for
resubmission. When the Planning and Zoning Department receives the
amended plans, they will distribute the plans with a cover memo to
all TRC Members for review and approval.
