2. All plans submitted for specific permits shall meet the City's code requirements at time
of application. These permits include, but are not limited to the following; site
lighting, paving, drainage, curbing, landscaping, irrigation and traffic control devices.
Permits required from agencies such as the FDOT, PBC, SFWMD and any other

The following is a list of 1st review comments regarding the site
plan review of the plans for the above-referenced proj ect. It
should be noted that the comments are divided into two (2)
categories. The first category is a list of comments that identify
deficiencies from the City's Land Development Regulations (L.D.R.)
that are required to be corrected and shown in compliance on the
plans and/or documents submitted for second (2nd) review in order
for the project to continue through the site plan review process.
The second set of comment(s) lists recommendations that the
Planning and Zoning Department staff believe will enhance the
proposed development. The applicant shall understand that all
documents and plans submitted for site plan are subject to
additional comments. I recommend that the applicant/agent contact
me regarding questions related to the comments. If the applicant
is not intending to correct code deficiencies and they request that
the project remain on the review schedule identified in the

typical at all locations.
16. On Sheet 2 of 3 of the architectural set provide
necessary dimensions in the garage to confirm that the
water heater will not preclude meeting the minimum size _

After reviewing the plans for the above reference project, the Building Division cannot support this plan going
forward because of so many unanswered questions that we cannot address without such information as type of
multiple-family residential structures, i.e., apartments, cooperatives, condominiums or townhouses.
If they are to be single-family dwellings, they should comply with R-l site regulations under LDR Section 5,
Paragraph E-2 and should have platted lots to check setbacks and lot coverage.
In addition to the above comments, the following should be shown on the plans:
1. Evaluation and floor plan unless they are single-family.
2. Distance between building to comply with Table 600 of the Standard Building Code.
3. Setbacks should be shown from Park Ridge Circle (See definition of lot frontage, LDR Page
1-23, Article II), also see Access for an understanding of where front setbacks are from.
4. Setbacks must be shown for pools, screen rooms, etc.
5. Sign details required for Site approval.

We have reviewed our December 13, 1995 Memo (No. 95-473) regarding compliance with
comments contained therein. We respond as follows:
1. Revise documents to reflect all comments.
2. All plans submitted for specific pennits shall meet the City's code requirements at
time of application. These permits include, but are not limited to the following~
site lighting, paving, drainage, curbing, landscaping, irrigation and traffic control
devices. Permits required from agencies such as the FOOT, PBC, SFWMD and
any other permitting agency shall be included with your permit request.
3. This master plan is not required as a condition of zoning, but is required as a pre-
requisite to platting. Since the land is to be subdivided into two or more lots or
parcels either by plat or metes and bounds, it must be platted (Chapter 1, Article
II, page 1-33 and Chapter 5, page 5-1). Since the subdivided lots are not shown
on the master plan, the plan cannot proceed without certification from the
applicant that the master plan and the plat will conform with all codes, ordinances,
rules and regulations including, but not limited to, the Boynton Beach Land
Development Regulations.
4. Insufficient information to complete review. This is not a rezoning request, so
dimensions must comply with R-3 zoning. Single family dwellings in R-3 districts
must comply with R-l district requirements. Chap.2, Sec.5, par.G2b, pg.2-21

Attached is the amended site plan submittal for the above
referenced project for your final review and recommendation. We
would ask that you review this amended site plan submittal to
determine if the plans have been adjusted to satisfy comments
previously made by your department.
If your comments have been satisfied or if your comments can be met
at time of building permit, please advise the Planning and Zoning
Department in writing. If your comments have not been met, please
advise the Planning and Zoning Department in writing.
Finally, we would ask that you include in your memorandum a
recommendation as to whether the project should be forwarded to the
Planning and Development Board for consideration. Please return
your memorandum and the amended plans (Engineering Division shall
keep their plans) to the Planning and Zoning Department by 5:00
P.M. on February 2, 1996.
Per the Technical Review Committee (TRC) determination at the
December 26, 1995 meeting, the previous submittal of the Site Plan
was not discussed. Therefore, the current Site Plan submittal will
be placed on the February 13, 1996 TRC meeting agenda. If you
should have any questions regarding this plan, please feel free to

Per our January 16, 1996, letter, the proposed development
will be a Condominium, and we have modified all ~roject
documents accordingly. Also as you may recall, 1n our
initial discussions with the City of Boynton Beach, it was
agreed that we would submit the project for your review based
upon a 40' setback from both N.E. 4th Street and the FEC
Railroad to the units and a 20' setback from both the North
and South Property line to the units, with a minimum
separation of 15' between units ( a sketch showing this was
sent to Mr. Lewicki).
Included with our resubmittal are the following items:
1. Twelve (12) revised prints of the Plat.
2. Twelve (12) revised prints of the Site Plan.
3. Twelve (12) revised prints of the Master Plan.
4. Twelve (12) revised prints of the Survey.
5. Twelve (12) revised prints of the Grading, Paving,
Drainage, Water and Sewer Plans.

8. One (1) copy of commitment letter from Southern Bell

Planning and Zoning Department is as follows:
1. The survey doesn't show N.E. 20th Avenue east of
N.E. 4th Street because it is not platted.
2. Topographical elevations have been referenced in the
survey legend.
3. Information on the existing structures has been
added to the survey.
4. A note with regard to the use of proposed structures
has been added to the Site Plan.
5. The location and number of parking spaces provided
has been added. We plan to discuss the need for
sidewalk with the appropriate agencies.
6. The location of proposed signs has been added to the
Site Plan.
7. The location of proposed lighting has been added to
the Site Plan.
8. Architectural Plans have been revised to show height
of structures.
9. A colored elevation drawing is being provided with
this submittal.

1. A letter from the Florida Game and Fresh Water Fish
Commission stating there are no endangered/protected
species on the site will be submitted.
2. On the tree survey, several multiple trunked oaks
were identified with each trunk being an individual
tree. The tree relocation/removal plan identifies
each multi~le trunked oak tree as a single tree. The
quantity dlfference is nine, as noted in the
comment.
3. A Tree management plan to address the proper care of
trees in Item #2 is included with this submission.
Our response to Memorandum # 95-565 from John Wildner, Parks
Superintendent, is as follows:
1. The required recreation fee based on the single
family homes calculating factor will be paid when
due at final platting.
2. The developer does not plan to apply for one-half

11. No attachments or wires, other than those of a protective or supportive nature
shall be attached to any tree.
12. Tree relocation and replacement activity permitted or required by the City of
Boynton Beach shall be done in accordance with standard forestry practices and
procedures. and all such plantings shall be reasonably maintained and attended to
promote successful establishment and growth.
13. It shall be a responsibility of the homeowner's association / condominium
association to provide continuing maintenance of the trees in the future.

Planning and zoning Department is as follows:
1. The survey doesn't show N.E. 20th Avenue east of
N.E. 4th Street because it is not platted.
2. Topographical elevations have been referenced in the
survey legend.
3. Information on the existing structures has been
added to the survey.
4. A note with regard to the use of proposed structures
has been added to the Site Plan.
5. The location and number of parking spaces provided
has been added. We plan to discuss the need for
sidewalk with the appropriate agencies.
6. The location of proposed signs has been added to the
Site Plan.
7. The location of proposed lighting has been added to
the Site Plan.
8. Architectural Plans have been revised to show height

were identified with each trunk being an individual
tree. The tree relocation/removal plan identifies
each multi~le trunked oak tree as a single tree. The
quantity dlfference is nine, as noted in the
comment.
3. A Tree management plan to address the proper care of
trees in Item #2 is included with this submission.
Our response to Memorandum # 95-565 from John Wildner, Parks
Superintendent, is as follows:
1. The required recreation fee based on the single

In response to your request, this will confirm that BellSouth Telecommunications is the
source of supply for telephone service to the above referenced project. Telephone
facilities with adequate capacity can be provided for this project. It should be noted,
however, that the owner will be required to provide BellSouth Telecommunications with
recorded easements or conduit. In addition BellSouth Telecommunications may require
exclusive easements for structures that house electronic switching equipment (SLC-96 or
substantially similar equipment). The recorded easements will be without restrictive
conditions furnished in a reasonable time to meet service requirements at no cost, cleared
of trees, tree stumps, paving and other obstructions. In addition each applicant shall
cooperate with BellSouth Telecommunications to keep the cost of construction and
installation of the underground telephone distribution system as low as possible. Where
there are obstructions in the easement or road crossings, the contractor will provide
conduit suitable to BellSouth Telecommunications.

A second street name should be provided for the portion of development south of Park Ridge Circle
to the cul-de-sac. We strongly recommend valley curbs along roadways to improve drainage.

received by my office.
2. The applicant should expound on item #13 ofthe Tree Management Plan to include specific
landscape tasks to complete. These would involve:
a. exotic vegetation control
b. weed/grasses removal/control
c. trash/debris removal/control
d. trimming restrictions of preserve vegetation
e. signage for area
f. fencing for area
g. other site specific items to protect and properly manage the preserve area while under
ownership of the Homeowner Association (documents too).

1. Prior to construction. Contractor shall verify trees to remain. trees to be relocated.
and trees to be removed.
2. Contractor shall determine access routes to trees that will least disturb existing
vegetation.
3. Contractor shall relocate trees with an appropriate sized tree spade, AU materials
shall be planted at their original soil levels.

their new locations to eliminate air pockets and enhance proper setting.

9. During the land clearing and construction stages of development, Developer
shall erect and maintain protective barriers (to the City Inspector's specifications
consistent with good management practices) around all trees or groups of trees to
be protected. Developer shaU not allow the movement of equipment or the storage
of equipment, materials, debris. or fill to be placed within the protective
barrier(s).
10. During the construction stage of development. Developer shall not allow the
cleaning of equipment or material nor allow the disposal of waste materials such as
paint. oil, solvents, asphalt, concrete. mortar. etc. within the drip line of any tree
or groups of trees to be protected.
11. No attachments or wires. other than those of a protective or supportive nature
shall be attached to any tree.
12. Tree relocation and replacement activity permitted or required by the City of
Boynton Beach shall be done in accordance with standard forestry practices and
procedures. and aU such plantings shall be reasonably maintained and attended to
promote successful establishment and growth.
13. It shall be a responsibility of the homeowner's association / condominium
association to provide continuing maintenance of the trees in the future.
