AGENDA DOCUMENTS 7A3 CONDITIONAL USE PLAZA WEST JOINT VENTURE PLANNING AND ZONING DEPARTMENT MEMORANDUM NO. 92-119 June 4, 1992 TO: Members of the Planning and Development Board FROM: Christopher Cutro, Planning and Zoning Director RE: Plaza West Joint Venture File No. 675 SUMMARY: Vincent Gallo, the agent for Plaza West Joint Venture, is requesting a conditional use to allow a beauty salon, barber shop, manicurist, tailor, or dressmaker on the site located at 3452 West Boynton Beach Boulevard. The site is a 2.4 acre site which contains 13,164 square feet of space. The site requires 65 parking spaces (at 1 space for each 200 square feet) and the site contains 96 spaces. The site is landscaped and a buffer has been provided between this property and the Stonehaven PUD to the east. The zoning of the site is C-1 Office and Professional District, which allows various types of offices and public uses. The uses requested by the applicant are all allowed as conditional uses. SURROUNDING LAND USES AND ZONING: Across Boynton Beach Boulevard to the north of the site is a commercial structure. West of the site is vacant land which has been approved for the Knuth Road PCD. On that site directly across Knuth Road from the subject property will be a convenience store that sells gasoline. To the south is an office building. To the east is single family residential, which is part of the Stonehaven PUD. STANDARDS FOR EVALUATING CONDITIONAL USES: The Planning and Zoning Board and City Commission shall consider only such conditional uses as are authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses absolutely or conditioned upon the conditions including, but not limited to, the dedication of property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose of this section. In evaluating an application for conditional use, the Board and Commission shall consider the effect of the proposed use on the general health, safety and welfare of the community and make written findings certifying that satisfactory provision has been made concerning the following standards, where applicable: 1. Ingress and egress to the subject property and proposed structures thereon, with particular reference to automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe_ Access is provided to the site by two driveways, one, a one-way exit driveway on the north side of the building, which is 12 feet wide. This driveway is located 72 feet from the corner of Boynton Beach Boulevard and Knuth Road. The second driveway is a two-way driveway located on the south side of the building and is 25 feet wide. Sidewalks have been provided on both Boynton Beach Boulevard and Knuth Road. Plaza West Joint Venture Page Two 2. Off-street parking and loading areas where required, with particular attention to the items in subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and nearby properties, and the city as a whole. 96 parking spaces are provided on site, which meets the parking requirements. It is not anticipated that the requested uses will adversely affect any surrounding uses. In fact, certain uses will eliminate traffic from Boynton Beach Boulevard because no services are available on the south side of the road at this time. 3. Refuse and service areas, with particular reference to the items in subsection 1 and 2 above. A dumpster site for solid waste is located on the east side of the property. However, the dumpster is not on the pad. The dumpster should be relocated and the pad should have a wall and gates installed around it. 4. Utilities, with reference to locations, availability, and compatibility. The site is served with water and sewer lines. 5. Screening, buffering and landscaping with reference to type, dimensions, and character. The bUffering on the site to meet the requirements of the Code of Ordinances must be planted with a hedge. 6. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adjacent and nearby properties. The sign on the site does not meet the Code of Ordinances of Boynton Beach. The sign must be brought into conformance by 1996. 7. Required setbacks and other open spaces. The structures on the site meet the setback requirements of the C-1 district. 8. General compatibility with adjacent properties, and other property in the zoning district. The site was developed in the County and annexed into the City. The office use of the property makes it compatible with the residential to the east and helps to buffer the residential from the Knuth Road PCD. 9. Height of buildings and structures, with reference to compatibility and harmony to adjacent and nearby properties, and the city as a whole. The height of structure is one story and is compatible with surrounding uses. 10. Economic effects on adjacent and nearby properties, and the city as a whole. It is not anticipated that the requested uses will have a detrimental impact on the surrounding use. Economic impact on the City will be minimal. Plaza West Joint Venture Page 3 11. Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19, Article II of the City of Boynton Beach Code of Ordinances. This standard is not applicable because the site was previously developed in the County. 12. Compliance with, and abatement of nuisances and hazards in accordance with the performance standards section 4 of the zoning regulations; also, conformance to the City of Boynton Beach Noise Control Ordinance. None of uses require environmental review and none of uses generate noise which would violate the Noise Control Ordinance. REVIEW OF COMMENTS: The Technical Review Committee reviewed this request and no comments were forthcoming from the Committee. RECOMMENDATION: Staff recommends approval of the request for the conditional uses with the following conditions: 1. that a hedge be installed on the east side of the property to complete the buffer; 2. that a wall and gates be installed around the dumpster pad.
