RE: THE SHOPPES OF BOYNTON - REQUIRED ROADWAY CONSTRUCTION
Dear Mr. Cannon:
This is to confirm that Palm Beach County will be assuming the subject project's
obligations for roadway construction on Congress Avenue from N.W. 22nd Avenue
to Miner Road, and on N.W. 22nd Avenue, using impact fees already paid by the
project. This arrangement is predicated upon the developer agreeing to direct
and pay Rossi and Malavasi Engineers to complete the plans for the N.W. 22nd
Avenue and Congress Avenue intersect i on to the confi gurat i on out 1 i ned in my
letter to you of May 29, (copy attached).
It is understood that the Target Shopping Center will contribute $60,000.00
toward the expansion of the intersection, as outlined in my letter. Palm Beach
County will absorb the costs of the necessary modifications to the traffic
signal. It is agreed that the cost of non-site related plan preparation will
be eligible for consideration for a partial refund of impact fees paid by the
Shoppes of Boynton Beach. The plans include those for the 6 laning of Congress
Avenue, the plans already prepared for N. W. 22nd Avenue, and those for the
expans i on of N. vI. 22nd Avenue/Congress Avenue i nt et~sect i on.
We anticipate that the widening of Congress Avenue from Boynton Beach Boulevard
to Mi ner Road will be under construction withi n the next three months. The
construction on N.W. 22nd Avenue should commence shortly thereafter.

SUBJECT: NORTHWEST 22ND AVENUE AT CONGRESS AVENUE
Dear Mr. Cannon:
I am writing to follow up on our meeting of May 23t 1990 regarding the various
developer obligations for construction at the subject intersection. A summary
of these developments and their respective obligations is as follows:
Palm Isles. P.U.D. (Unincorporated Palm Beach County)
Design and construct two additional lanes on Congress Avenue to complete the six
lane section from Boynton Beach Boulevard to N.W. 22nd Avenue.
Shoppes of Bovnton (Citv of Bovnton Beach)
-Westbound right turn lane
-Eastbound dual left turn lane
-Northbound right/thru lane
-Southbound right/thru lane
-Modifications to the signal
-One additional northbound and southbound thru lane on Congress Avenue from
N.W. 22nd Avenue to Miner Road (to complete the 6 lane section).

At our meeting, it was noted that certain of these required improvements had
overlapping developer commitments.
It was also noted that existing right of way constraints precluded the
construction of northbound. and southbound right turn lanes. Lastly, it was
pointed out that, while there is no specific developer requirement, dual left
turn .lanes, westbound, would be required on Northwest 22nd Avenue in order to
provide an acceptable alignment acro~s the intersection.
In an attempt to eliminate confusion resulting from the overlapping conditions,
as \o/ell as waste, I made the following proposal which should result in some
savings to each of the developments involved.
Basically, it is my suggestion that the intersection be built to provide the
following geometries, with the construction to be accomplished as a part of the
overall project to six lane Congress Avenue. The intersection geometries are
as foll ows:
Congress Avenue
Southbound - 3 thrus, 2 lefts
Northbound - 1 right., 3 thrus, 2 lefts
*You will approach Motorola for the right of way necessary to accomplish the
construction of this right turn lane, outside of the third northbound lane. If
Motorola is unwilling to dedicate, this lane could be deleted. (See attached
marked plan.)
Northwest 22nd Avenue
Eastbound - 1 right, 2 thrus, 2 lefts
Westbound - 1 right, 2 thrus, 2 lefts
Further, it was suggested that Rossi & Malavasi and Kimley-Horn work together
to establish approximate costs for the construction on Northwest 22nd Avenue.
These estimates are to be based on red 1 ine sketches for the suggested
geometries. It is my suggestion that the involved shopping centers simply fund
the cost of the improvements on N.W. 22nd Avenue on their respective sides of
Congress Avenue.
With this work being included in the project to widen Congress Avenue, both
projects should realize a savings oller what \-Iould have been charged if the
improvements were contr~cted individually.

It was agreed that we would meet again with the same group of people on Tuesday,
June 5 at 10:00 in the Traffic Division to discuss the conceptual sketches and
cost estimates. A copy of the plans for Congress Avenue which has been marked
to show the additional right of way to be requested from Motorola is attached
