Occupancy, for theatres # 1, 3, 5, 7, and 8. Prior to the BUilding
Department issui1:g the temporary Certificate of Occupancy for the
remaining theatres, I would like to ensure that you do not have any
outstanding or pending issues concerning this site that must be
rectified, including the bonds required for improvememts at Congress
Avenue and Quantum Boulevard, and excluding other issues that are
ccvered entirely with city approved surety.
If the issues are related to permits issued by the BUilding
Department, please provide the permit number and nature of unresolved
issue, If the unresolved issues are not permit related, notlfy the
owner or the owners agent to ensure that the issues are rectified,
Please respond to this office within ten days so that we may proceed

SUBJECT: Bonding of Road Improvements for
Village Shoppes of Boynton
Accompanying this memorandum, you will find a letter from Charles
Walker, Jr., of the Palm Beach County Engineering Dept. which
states that the County will construct an additional 2 lanes for
the link of Congress Ave. between N.W. 22nd Ave. and Miner Road,
as well as the improvements to the intersection of N.W. 22nd.
These improvements will be paid for out of the road impact fees
that have been paid to the County by the developer. Since the
County is guaranteeing the construction of these improvements,
the bonding of these improvements by the developer prior to the
issuance of a building permit, and the construction of these
improvements prior to the issuance of a C.O., as required by the
Memorandum from Carmen Annunziato dated May 8, 1989, would not be
necessary.
Please be advised, however, that the remainder of the
improvements listed on pp. 19-20 of the Traffic Impact AnalYSis
prepared by MDDM, Inc. (Items A.2., A.2., A.5., and C.3.) which
lie within rights-of-way will need to be bonded, or some other
acceptable surety provided to the City. In addition, the
Engineering Dept. may require an administration fee for the
inspection of all improvements listed in the MDDM, Inc. which are
located within public rights-of-way.

Dear Mr. Cannon:
Thi's is to confirm that Palm Beach County w111 be assum1ng the subject project's
obligations for roadway construction on Congress Avenue from N.~. 22nd Avenue
to Miner Road, and on N.W. 22nd Avenue, using 1mpact fees already paid by the
project. This arrangement 1s pred1cated upon the developer agreeing to direct
and pay Rossi and Malavas1 Eng1neers to complete the plans for the NoW. 22nd
Avenue and Congress Avenue 1ntersection to the configuration outlined in my
letter to you of May 29, (copy attached).
It 15 understood that the Target Shopping Center will contribute 160.000.00
toward the expans10n of the intersection. as outlined in my letter. Palm Beach
County will absorb the costs of the necessary modifications to the traffic
s1gnal. It is agreed that the cost of non-site related plan preparation will
be e11g1ble for consideration for a partial refund of impact fees.paid by the
Shoppes of Boynton Beach. The plans include those for the 6 laning of Cong~Q$s
Avenue, the plans already prepared for N.W. 22nd Avenue, and those for the
expansion of N.W. 22nd Avenue/Congress Avenue intersection.
We anticipate that the Widening of Congress Aven~B from Boynton Beach Boulevard
to Miner Road will be under construction within the nQ~t thrQQ months. The

At our meeting, it was noted that certain of th.se ,required impro~ements had
overlapping developer commitments.
It was a1so noted that existing right of way const~a1nts precluded tha
construction of northbound* and southbound right turn lanes. Lastly, 1t was
pointed out that, while there 1$ no ,pacific developer require~entt dua1 left
turn'lanes. westbDund, would be rQqu;red on Northwest 22nd Avenue 10 order to
provide an accaptab18 alignment across the intersection.
In an attempt to eliminate confusion resulting from the cverlapptng conditions,
as well as wa~ta? I made the following proposal which should result in some
savings to each of the developments involved.
Basically. it i. ~ suggestion that th. 1nter~ect1on be bU11t to provide the

geometrfes. It is ~ sU9gest1on that the in~olved shopping centers simply fund
the cost of the 1mprovements on N.W. 22nd Avenue on their respectivQ sides of
Congress Avenue.
With thts work be1ng included in thi project to widQn CongrGi$ Avenue, both
projects should realize a savings over what would have been charged if the
1mprovements were contr~cted individuallY.

The Village Shoppes of Boynton - Supplemental
Staff Comments Concerning Traffic Improvements
The Planning Department has completed the review and coordination
of the developer's traffic impact analysis with the Palm Beach
County Traffic Engineering Department for consistency with the
City's Comprehensive Plan and the County's Traffic Ordinance.
There is agreement between the City and the County that the
conclusions reached by Daniel N. Murray, P.E., in his report
dated April 24, 1989 are reasonable, subject to the submittal of
some additional information that is needed to complete the
report.
Based on the above, it is recommended that the improvements
listed on page 19 and 20 of Mr. Murray's traffic report be
constructed prior to the issuance of a Certificate of Occupancy.
Concerning the signalization of Quantum Boulevard and Congress
Avenue, it is recommended that the developer post a bond for a
proportionate share of the signalization of Quantum Boulevard and
Congress Avenue based on traffic impact, as determined by the
County Traffic Engineer, prior to the issuance of a building
permit.

A revIew of the 2010 Palm Beach County data and of the
TraffIc Impact AnalysIs Table 8, from the WHK, Inc. 4/89 report,
verified that the traffic wIll be reasonably a~comodated by the
roadway network. Therefore, the full build-out of the C-3 site
with The Village Shoppes of Boynton will not adversely impact the
roadway system.

To determine if any highway improvements are necessary to
maIntaIn a reasonable level of traffic flow and safety, detailed
link capacIty analYSIS and critical lane intersectional analysis
were undertaken. Also, it is important to take into
conSIderatIon the 5-Year Work Program in Palm Beach County, since
maJor capacity improvements will be occurring within the zone of
influence of the proposed proJect. Recognizing all these issues,
the following Improvements are valid:
A. SITE ACCESS IMPROVEMENTS
I. A minimum of 100 feet of internal channelization at all
maJor driveways.
2. A separate right and left turn lane for main the access
onto Quantum Boulevard and onto NW 22nd Avenue.
3. Required signing and pavement markings shall conform with
the Manual of Uniform Traffic Control Devices (MUTCD).
4. Compliance to sight triangle criterIa.
5. Ped~strian SIgnal + cross walk for the east approach at
the main access onto Quantum Boulevard.

Upon review of the above mentioned project, the following

4. Show the location of the handicapped ramps leading to the
theater from the handicapped parking spaces.
5. All plans submitted for public record and prepared by a
design professional shall show original raised seal
(legible) and signature of the Florida registered design
professional responsible for the drawings.
6. Show unobstructed cross visibility area and space through
the required site perimeter landscape strip at both sides of
all ingress and egress driveways. The cross visibility area
and space is shown by placing and dimensioning, on the site
landscape plan drawing, a ten foot (10') isosceles right
angle triangle with the right angle on the property line at
the edge of the driveway and landscape strip and completing
the remainder of the triangle into unobstructed landscaping
and stating that the vertical space within this area is
clear of landscape material between thirty inches (30") and
six feet (6').
7. Show unobstructed cross visibility area and space through
the required site perimeter landscaping at the corner of the
property (where two adjacent public right-of-ways
intersect). The cross visibility area and space is shown by
placing and dimensioning, on the site landscape plan
drawing, a thirty-five foot (35') isosceles triangle at the
corner of the property line where the intersection is
located and completing the remainder of the triangle into

In order to facilitate the permitting process, the following
information should be included within your documents submitted to
the Building Department for required permits:
1. All signage must comply with the Boynton Beach Sign

2. Secure approval from Boynton Beach Utility Department and
other utility companies, including Florida Power & Light
for location and type of trees planted within utility
easement areas bordering on public rights-of-way.

Please be advised of the following Planning Department comments
with respect to the above-referenced request for administrative
site plan approval:
1. A final sign-off will be needed to address any outstanding
department staff comments resulting from this modification
or previous modifications. Permit plar.s in the Building
Department must also be amended whenever a site plan
modification is approved.
2. Since it is anticipated that there will be future changes to
square footage and parking spaces prior to completion of
this shopping center, amend the shared parking study on file
to reflect the decrease in number of parkin~ spaces
provided, increase in square footage and change in buffer
resulting from this site plan modification request.
According to our records this was done with previous
modification requests for this project.
