Please be advised that this department received the above
referenced June 5, 1990 memorandum on June 11, 1990.
The Engineering Department has not conducted a final inspection of
the site in order to determine the condition of the site relative
to applicable performance standards and approved site plans.
The Developer as a condition of site plan approval was to assure
the construction of all off-site roadway improvements with suitable
surety (approval by the City Attorney for the City Commission) and
further submit administration fees (2%), prior to the issuance of
"Certificates of Occupancy" as defined within the latest letter
transmi tted to VDM Group principal, Mr. Ted Powell by Mr. Don
Jaeger, Director of Building and Zoning.
The Engineering Department for the City of Boynton Beach, Florida
has not yet received the aforementioned surety, administration fee
and/or any form of assurance from Palm Beach County Traffic
Engineers, regarding the developer's commitment to construct and
improve specific portions of roadways that represented a condition
of the approval process and a prerequisite for issuance of C.O's.

Please be advised that sufficient parking for the theater must be
satisfactorily completed prior to the issuance of a temporary
certificate of occupancy. parking shall be based on one space
pel- fOUL- seats, but not less than one space per one hundred
square feet of gross floor area, since the opportunity does not
yet exist for a shored parking allocation with the shopping
center and its associated parking, currently under construction.

in the developer's traffic impact analysis, the cross walk should
be in place prior to the issuance of additional temporary

SUBJECT: Bonding of Road Improvements for
Village Shoppes of Boynton
Accompanying this memorandum, you will find a letter from Charles
Walker, Jr., of the Palm Beach County Engineering Dept. which
states that the County will construct an additional 2 lanes for
the link of Congress Ave. between N.W. 22nd Ave. and Miner Road,
as well as the improvements to the intersection of N.W. 22nd.
These improvements will be paid for out of the road impact fees
that have been paid to the County by the developer. Since the
County is guaranteeing the construction of these improvements,
the bonding of these improvements by the developer prior to the
issuance of a building permit, and the construction of these
improvements prior to the issuance of a C.O., as required by the
Memorandum from Carmen Annunziato dated May 8, 1989, would not be
necessary.
Please be advised, however, that the remainder of the
improvements listed on pp. 19-20 of the Traffic Impact Analysis
prepared by MDDM, Inc. (Items A.2., A.2., A.5., and C.3.) which
lie within rights-of-way will need to be bonded, or some other
acceptable surety provided to the City. In addition, the
Engineering Dept. may reqUire an administration fee for the
inspection of all improvements listed in the MDDM, Inc. which are
located within public rights-of-way.

At our meeting, it was noted that certain of th,se required improvements had
overlapping developer comnitments.
It was a1$0 noted that existing right of way const~aints precluded the
construction of northbound* and southbound right turn 'anes. lastly, it was
pointed out that, while there 1$ no 'paeiftc developer requirement. dual left
turn "lanes. westbound, would b, r~quired on Northwest 22nd Avenue 1n order to
provide an accaptab1. alignment across the 1nterse~tion.
In an attempt to eliminate conFusion resulting From the overlapp1ng conditions.
as well as waite, I made the following proposal which should result in some
savings to each of th. davelQP~ents ;nvo1ved.
Basically, it i. my suggestion that the inter$8ct1cn be bUilt to provide the

The Village Shoppes of Boynton - Supplemental
Staff Comments Concerning Traffic Improvements
The Planning Department has completed the review and coordination
of the developer's traffic impact analysis with the Palm Beach
County Traffic Engineering Department for consistency with the
City's Comprehensive Plan and the County's Traffic Ordinance.
There is agreement between the City and the County that the
conclusions reached by Daniel N. Murray, P.E., in his report
dated April 24, 1989 are reasonable, subject to the submittal of
some additional information that is needed to complete the
report.
Based on the above, it is recommended that the improvements
listed on page 19 and 20 of Mr. Murray's traffic report be
constructed prior to the issuance of a Certificate of Occupancy.
Concerning the signalization of Quantum Boulevard and Congress
Avenue, it is recommended that the developer post a bond for a
proportionate share of the signalization of Quantum Boulevard and
Congress Avenue based on traffic impact, as determined by the
County Traffic Engineer, prior to the issuance of a building
permit.

link capacIty analYSIS and critical lane intersectional analysis
were undertaken. Also, it is important to take into
conslderation the 5-Year Work Program in Palm Beach County, since
maJor capacity improvements will be occurring within the zone of
influence of the proposed proJect. Recognizing all these issues,
the following improvements are valid:
A. SITE ACCESS IMPROVEMENTS
1, A minimum of 100 feet of internal channelization at all
maJor driveways.
2. A separate rlght and left turn lane for maln the access
onto Quantum Boulevard and onto NW 22nd Avenue.
3. Required signing and pavement markings shall conform with
the Manual of Uniform Traffic Control Devices (HUTCD).

The Planning Department has completed the review and coordination
of the developer's traffic impact analysis with the Palm Beach
County Traffic Engineering Department for consistency with the
City's Comprehensive Plan and the County's Traff,ic Ordinance.
There is agreement between the City and the County that the
conclusions reached by Daniel N. Murray, P.E., in his report
dated April 24, 1989 are reasonable, subject to the submittal of
some additional information that is needed to complete the
report.
Based on the above, it is recommended that the improvements
listed on page 19 and 20 of Mr. Murray's traffic report be
constructed prior to the issuance of a Certificate of Occupancy.
Concerning the signalization of Quantum Boulevard and Congress
Avenue, it is recommended that the developer post a bond for a
proportionate share of the signalization of Quantum Boulevard and
Congress Avenue based on traffic impact, as determined by the
County Traffic Engineer, prior to the issuance of a building
permit.

Upon review of the above mentioned site plan, the following comments must be
addressed in order for the project to conform with Boynton Beach codes and
ordinances:
1. The Boynton Beach Sign Ordinance will permit two (2) free-standing signs
for this project, one along N.W. 22nd Avenue and one along Congress Avenue.
2. One (1) sign is permitted for each individual tenant with a square foot area
not to exceed ten (10) percent of the face area of each occupancy.
3. Handicapped ramps must be provided at intervals not to exceed 100 feet on
center along the front of the retail stores.
4. A 36 inch high (at time of planting) landscape buffer is required between the
parking area and all right-of-ways.
5. A solid stucco masonry wall must be provided along the north property line
of Tract A.
6. All plans submitted for public record by a design professional registered in
the state of Florida must be signed and sealed.
7. South Florida Water Management District approval is required.
8. Lake Worth Drainage District approval is required. In addition, the drainage
district must approve the proposed landscaping within their easement.
9. The striping for handicapped parking stalls must be blue in conformance with
city standards.

1. The water main near the theater must be moved out from under
the dumpster enclosure.
2. Add an additional valve on the fire hydrant near the theater,
plus an additional main-line valve near the hydrant at Building

3. We question the need for a 211 meter on the bank parcel.
4. A 211 x four 111 brass adapter may be used to allow 4 meters on
one 211 service. Add additional service lines as necessary for
those services showing more than 4 meters.
5. Type II KII copper is required on all water servi ces wi th either
end under pavement, which appears to be all services on this
site. Meters may be relocated to grassed areas so as to
shorten the services, if desired.
6. A tapping sleeve and valve will be required for the hydrant
line near buildings "LII and 11M. II Also, indicate the water
service to be tapped into the hydrant line, rather than the 1611
water main. Add a gate valve near the hydrant.
7. Water mains are not permitted in sidewalks in that they pose a
trip hazard to pedestrians.
8. Specify the size and materials used for sanitary services.
9. Add a detail showing raised curb areas around garbage can and
dumpster wash areas, which must be directed to the sanitary
sewer system. Alternatively, provide a detail showing how
these areas will be contoured to preclude storm water from
entering the sanitary system, as prohibited by code.
10. Water services and meters must be included in utility
easements.

2) The developer's traffic report has been forwarded to the

and analysis to determine consistency with the City's
Comprehensive Plan. Final comments with respect to traffic
improvements will not be available until prior to the
Planning and Zoning Board meeting.

1. The plant list should include quantities of each species
used to show 50% native trees and 30% native shrubs/bushes
provided on the site.
2. All interior parking lot trees must have a clear trunk of 5'

3. The adjacent public road R.O.W.'s should receive water from
the site irrigation system.
4. Landscaped areas on site show berming in conflict with these
same areas showing depressions for water retention on the
Engineering plans. This conflict should be resolved and
changes made on the landscape plan.
5. The applicant must submit a landscape and irrigation plan
for the grass median(s) on Congress Avenue adjacent to the
project site. The applicant must receive a permit to
install the materials from the Palm Beach County Engineering
office. The City Parks Division will assume maintenance and
liability for the plantings after work is completed by the
applicant.
