Rita, Vice President RE: Village Shoppes of Boynton Concrete Pedestrian Sidewalks Dear Mr. Rito: As you are very well aware, the City Commission of the City of Boynton Beach on April 16, 1991, upheld the requirements set forth in the City's Code of Ordinances, specifically Chapter 5, Article X, "Boynton Beach Parking Lot Regulations", Section 5-142 (g), "Sidewalk Standards", thereby maintaining that concrete pedestrian sidewalks shall be constructed through ingress/egress approach areas. I have personally reviewed the approved City plans for your project (copies enclosed herewith) which indicate the construction of the subject sidewalks as agreed upon by the owner's agent during the site plan review process. You are responsible for constructing the infrastructure and public improve- ments pursuant to the site plan, as well as in accordance to the applicable provisions of the City code (as referenced in the aforementioned paragraph). Let me say that the construction of concrete pedestrian sidewalks through ingress/egress approach areas is not a new requirement in the City of Boynton Beach and it is my understanding that all developments (including the City Hall complex) have adhered to this specific requirement over the years. You certainly had the opportunity to present your case to the City Commission at the time the subject matter was heard by them. Unfortunately, I cannot support any fonm of a variance for this work as I do not perceive a hardship case exists in this instance. I see no real advantage in meeting to discuss whether or not you should or should not construct the concrete pedestrian sidewalk, however, should you feel a meeting is warranted, please feel free to contact Joyce Costello, Administrative Assistant, to schedule an appointment. There is no doubt in my mind that you have in fact provided the City of Boynton Beach with a first class shopping center. At this point in time the City is only requesting from you what has been requested from other shopping center developments in the City and that is to simply provide concrete pedestrian sidewalks. As you are aware, the construction of concrete sidewalks at each driveway entrance precludes us from receiving final sitework approval for this project. First, we would like to thank: yourself, Mr. Finizio and Mr. Staudinger for your support and assistance in attempting to modify the parking lot specifications which would have allowed the use of thermoplastic pedestrian striping per Proposed Resolution No. R91-17, which was heard at the City Commission on April 16, 1991. Unfortunately, this resolution came across solely as an attempt to reduce construction costs at the center. Although maintaining costs are always a factor in real estate development, preventing the spending of unnecessary costs is one Df our major concerns. The alternative requested in the aforementioned resolution is a viable altem3.tiv~ and does not sacrifice the intent of this ordinance as proven by the support of the City of Boynton Engineering Department and Rossi & Malavasi Engineers. If amending these parking lot specifications is not probable with the City Commission, we would like to discuss the possibility of pursuing a variance for this work as a hardship case due to several circumstances surrounding this issue. Discussion of these circumstances were not necessary previously if the alternative specifications were approved. a.) All ingress/egress approaches were in place (without continuous sidewalks) when we purchased this property, therefore these areas were not included in our civil engineering drawings which were approved by the City or Boynton Beach. The owner's associates on the project were fIrst made aware of this code requirement on January 10, 1991 by the City Engineering Department. Cobb Theatre opened for business on June 21, 1990. We realize the City has disclaimers protecting them from these types of oversites, but we feel we could have been informed of this requirement a little earlier in the game, as there were dozens of engineering inspections at this site prior to January 1991. c.) Closing entrances to this shopping center to construct sidewalks at this time when there is a viable alternative is only causing undue inconvenience and potential traffic hazards at the site. We feel we have provided the City of Boynton with a first class shopping center that they can be proud of for years to come. To look at this striping request solely as an attempt to cut construction costs is not exactly fair, since it is obvious we have spent thousands of dollars in upgrades to make the Shoppes of Boynton a step above other centers. Engineering department Memorandum 91056 as well as a letter from the VDM Group requesting the modification and a draft of the modified parking lot specifications indicating how this information would be incorporated into the parking standards (should it be approved) was available for the city Commission. By unanimous 5-0 vote this proposed amendment to the existing parking lot standards was denied. We must therefore continue tO'enforce the existing parking lot specifications for continuous concrete sidewalks for ingress/egress driveway approaches. By copy of this letter I am requesting the city Manager notify the VDM Group or so indicate if he wishes the engineering department to correspond directly with VDM. Traffic/Transportation Engineering Consultants , < , \ ADDENDUM TO THE VILLAGE SHOPPES OF BOYNTON TRAFFIC IMPACT ANALYSIS REPORT TRAFFIC TRIP RATE FOR BANK FACILITY =================================== The traffic impact report, including the bank facility in the total shopping center, utilized Land Use Code 820 in the ITE Trip Generation Publication (Fourth Edition). Specifically, in the description it does indicate that bank facilities are included within a shopping center complex. Furthermore, it is important to recognize the type of access to the bank facility. The bank site will have limited access onto Congress Avenue, strictly a right turn in/right turn out driveway. A secondary access off of Quantum Boulevard will also be utilized. The secondary access will be very convenient for mutli-purpose internal trips. For these reasons, I strongly recommend that the shopping center trip rate be applied to the bank facility. The comments raised by Palm Beach County Traffic are related to Drive-In Bank Land Use Code 912. Specifically, under the trip rates per window during the weekday, an average trip rate of 318.4 per window is recommended by the ITE Trip Generation Publication, recognizing the fact that this is an independent bank site and not an integrated bank within a shopping center site. In summary, it is my conclusion that the bank trip rate utilized in conjunction with the shopping center is reasonable and acceptable. However, if you did apply the drive-thru bank site independently, the amount of trips generated would not significantly change the outcome of the study. , . MOTORIST DESIGN DATA MOVEMENT, INC. Traff/clTransportatlon Engineering Consultants LEVEL OF SERVICE AT NW 22ND AVENUE AND CONGRESS AVENUE WITH RECOMMENDED INTERSECTION IMPROVEMENTS ====================================================== A capacity analysis was undertaken at the intersection of NW 22nd Avenue and Congress Avenue under existing traffic conditions. The result was level of service "C". Then, the development traffic was added to the system and the suggested recommendations, as noted on page 19 of the traffic report, were included. A capacity analysis was then conducted with the results indicating a level of service "C" operation. Lastly, a capacity analysis was made with the inclusion of not only existing traffic and development traffic, but also the background traffic. The resulting level of service was "0", which did include the lane geometrics recommended on page 19. LEVEL OF SERVICE ANALYSIS AT THE INTERSECTION OF CONGRESS AVENUE AND QUANTUM BOULEVARD ================================================ An analysis of the traffic generated by the proposed project and with the existing traffic that would proceed through the intersection, a capacity analysis was conducted. The results indicated a level of service "B" under these conditions. Specifically, in the description it does indicate that bank facilities are included within a shopping center complex. Furthermore, it is important to recognize the type of access to the bank facility. The bank site will have limited access onto Congress Avenue, strictly a right turn in/right turn out driveway. A secondary access off of Quantum Boulevard will also be utilized. The secondary access will be very convenient for mutli-purpose internal trips. For these reasons, I strongly recommend that the shopping center trip rate be applied to the bank facility. The comments raised by Palm Beach County Traffic are related to Drive-In Bank Land Use Code 912. Specifically, under the trip rates per window during the weekday, an average trip rate of 318.4 per window is recommended by the ITE Trip Generation Publication, recognizing the fact that this is an independent bank site and not an integrated bank within a shopping center site. In summary, it is my conclusion that the bank trip rate utilized in conjunction with the shopping center is reasonable and acceptable. TrafflclTransportatlon Engineering Consultants ADDENDUM TO THE VILLAGE SHOPPES OF BOYNTON TRAFFIC IMPACT ANALYSIS REPORT TRAFFIC TRIP RATE FOR BANK FACILITY ----------------------------------- ----------------------------------- The traffic impact report, including the bank facility in the total shopping center, utilized Land Use Code 820 in the ITE Trip Generation Publication (Fourth Edition). Specifically, 1n the description it does indicate that bank facilities are included within a shopping center complex. Furthermore, it 1s important to recognize the type of access to the bank facility. The bank site will have limited access onto Congress Avenue, strictly a right turn in/right turn out driveway. A secondary access off of Quantum Boulevard will also be utilized. The secondary access will be very convenient for mutli-purpose internal trips. For these reasons, 1 strongly recommend that the shopping center trip rate be applied to the bank facility. The comments raised by Palm Beach County Traffic are related to Drive-In Bank Land Use Code 912. Specifically, under the trip rates per window during the weekday, an average trip rate of 318.4 per window is recommended by the ITE Trip Generation Publication, recognizing the fact that this is an independent bank site and not an integrated bank within a shopping center si te. In summary, it is my conclusion that the bank trip rate utilized in conjunction with the shopping center is reasonable and acceptable. However, if you did apply the drive-thru bank site independently, the amount of trips generated would not significantly change the outcome of the study. MOTORIST DESIGN DATA MOVEMENT, INC. Traffic/Transportation Engineering Consultants LEVEL OF SERVICE AT NW 22ND AVENUE AND CONGRESS AVENUE WITH RECOMMENDED INTERSECTION IMPROVEMENTS ------------------------------------------------------ ------------------------------------------------------ A capacity analysis was undertaken at the intersection of NW 22nd Avenue and Congress Avenue under existing traffic conditions. The result was level of service "CU. Then. the development traffic was added to the system and the suggested recommendations. as noted on page 19 of the traffic report. were included. A capacity analysis was then conducted with the results indicating a level of service "C" operation. Lastly, a capacity analysis was made with the inclusion of not only existing traffic and development traffic. but also the background traffic. The resulting level of service was "D". which did include the lane geometrics recommended on page 19. LEVEL OF SERVICE ANALYSIS AT THE INTERSECTION OF CONGRESS AVENUE AND QUANTUM BOULEVARD ------------------------------------------------ ------------------------------------------------ An analysis of the traffic generated by the proposed proJect and with the existing traffic that would proceed through the intersection. a capacity analysis was conducted. The results indicated a level of service "B" under these conditions. A capacity analysis was then made with the inclusion of not only the existing + development traffic. but also the background traffic from Quantum Park. The results indicated a level of service "D". EVALUATION OF THE INTERSECTION AT MOTOROLA'S ACCESS ONTO NW 22ND AVENUE --------------------------------------------------- --------------------------------------------------- In reviewing the site plan, the proposed project access onto NW 22nd Avenue should be aligned directly opposite Motorola's driveway. This will avoid any offset intersection which would introduce unnecessary and undesirable traffic conflicts.
