PARKING LOT VARIANCE
Section 5-l44(c) 4 of the Code of Ordinances requires that when a
variance to Section 5, Article X, Parking Lots is requested, the
Technical Review Board must forward to the Planning and Zoning
Board a recommendation, and that the recommendation forwarded is
to be made a part of the pUblic hearing proceedings. To that
end, this memo is forwarded, consistent with 5-l44(c)(4).
Carlos Diaz, agent for Sybar-Savannah Square Joint Venture, has
requested a variance to section 5-l4l(g)(6) of the Parking Lot
Regulations, which prohibits parking lot interior access aisles
within the 100 foot "throat" portion of major shopping center
driveways. The subject property is located at the northeast
corner of North Congress Avenue and N.W. 22nd Avenue. In this
instance, the applicant is requesting relief from the 100 foot
throat requirement for the two driveways onto Quantum Boulevard,
to permit one right turn-in/right turn-out access aisle at the
egress aisle to each major driveway. Each access aisle is /.,.
proposed to be located 23 feet from the respective right-of-way."

submitted in connection with a request for site plan approval, to
permit the construction of a 173,200 square foot shopping cen~er.
For an explanation of the code requirement, the nature of the:~
variance requested, and the variance justification, please refer
to the attached Notice of Public Hearing and application.
On Tuesday, October 6, 1987, the Technical Review Board (TRB) met
to reevaluate the initial recommendation, due to the redesign and
resubmittal of the s1te plan, in order to determine if a change
in the previous recommendation was necessary as a result of the
new site plan submittal. After review and discussion, the
Technical Review Board recommended that the original
recommendation remain unchanged, and that the variance request be
approved in part and denied in part. With respect to the
recommendation for approval, the Technical Review Board made.
findings that elimination of the access aisle request on the
south side of Quantum Boulevard (adjacent to the theatre) would
severely restrict on-site traffic flow during the peak hours of
operation of the theatre. Therefore, the Technical Review Board
recommended approval of this request, subject to the construction
of raised curbing within the main driveway (as proposed on the
site plan) which would eliminate the left turn movements for
ingress and egress to the sUbject access aisle. However, the
request to allow for the access aisle connecting to the main
driveway for the parcel located on the north side of Quantum
Boulevard was recommended for denial. It was the consensus of
the Technical Review Board that this access aisle was more of a
convenience rather than a necessity, and is not critical with
regard to safe on-site traffic flow. It should be noted that the
revised site plan provides for the elimination of this driveway
connection, consistent with the original. recommendation of
Technical Review Board, which was based on the site plan
submitted for review at the September meeting.

It is our intent to develope the two latter properties in unison and provide
adequate parking facilities with an abundance of landscaping within open areas.
The request for variance consist of providing a interior access aisle going
into only the egress side of a major drive separated from the ingress side by
. five(5') foot landscaped island. The egress drive will have one lane left onto
Quantum Boulevard, where stacking can occur; and another lane to continue across
or make a right turn onto Quantum Boulevard. The impact of entering into a right
lane from the access aisle, 'we believe, 'will have a minimal effect on traffic flow
due to the small number of parking stalls provided within area it serves. By
complying with regulation as it exists, we create a disturbing vehicular circulation
flow, and also reduce parking spaces available on site. ,~
